The GENERAL MANAGER of quality control and quality assurance systems Saw the Legislative Decree March 30, 2001, # 165, laying down general rules on the sort of labour employed in public administration, and in particular art. 16. d); Having regard to Council Regulation (EC) No 510/2006 of March 20, 2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs, and in particular art. 19 repealing Regulation (EEC) No 2081/1992; Visto l'art. 17, paragraph 1 of the Regulation (EC) No 510/06 laying down that names that at the date of entry into force of the regulation listed in the annex to Regulation (EC) no 1107/96 and those listed in the annex to Regulation (EC) No 2400/96, shall be automatically entered in the ' register of protected designations of origin and protected geographical indications»; Having regard to Council Regulation (EC) no 1263/96 of 1 July 1996 by which the European Union has provided for the recording, inter alia the protected designation of origin ' Collina di Brindisi '; Having regard to articles 10 and 11 of the Regulation (EC) No 510/2006 concerning the controls; Having regard to law no 526 December 21, 1999 laying down rules for the fulfilment of obligations arising from Italy's membership of the European communities-Community Law 1999-and in particular art. 14 which contains specific provisions on controls and supervision of protected names of food and agricultural products by establishing a list of private bodies authorised by Decree of the Ministry of agricultural food and forestry policies, after consultation with the Regions and identifies in the Ministry of agricultural food and forestry policies, the national authority responsible for the coordination of the activity control and responsible for the supervision of the same; Seen the Decree November 15, 2005, published in the Gazzetta Ufficiale della Repubblica italiana no 280 of 1 December 2005, by which the body «BioAgriCoop s.c.r.l.» established in Casalecchio di Reno, Via dei Macabraccia # 8, it was authorised to carry out checks on the protected designation of origin ' Collina di Brindisi '; Seen on November 13, 2008 decree by which the validity of the authorisation granted in accordance with this Decree November 15, 2005, it was extended to renew authorization for the above mentioned inspection body; Having regard to the Decree of January 20, 2009 with which the inspection body «BioAgriCoop s.c.r.l.» established in Casalecchio di Reno, Via Dei Macabraccia # 8, it was deleted from the list of private control bodies for protected designations of origin (PDOs), protected geographical indications (PGI) and certificates of specificity (TSG) according to art. 14, paragraph 7, of law no 526 December 21, 1999; Having regard to the Decree on the same date by which the organism "BioAgriCert s.r.l.» Headquartered in Casalecchio di Reno, Via Dei Macabraccia # 8/3-4-5, it's been included in the list of private control bodies for protected designations of origin (PDOs), protected geographical indications (PGI) and specificity (TSG) claims provided for by art. 14, paragraph 7, of law no 526 December 21, 1999; View the indication expressed by the consortium of extra virgin olive oil DOP Collina di Brindisi, noted the deletion from the aforementioned list of organisations of the inspection body «BioAgriCoop s.c.r.l.» decided to report to the control of the protected designation of origin ' Collina di Brindisi» body «BioAgriCert s.r.l.» established in Casalecchio di Reno, Via dei Macabraccia # 8/3-4-5 as listed previously invoked; Considered that "BioAgriCert s.r.l.» has prepared the plan for the protected designation of origin ' Collina di Brindisi» in accordance with the key control type; Given the need to ensure the continuity of the control on the protected designation of origin ' Collina di Brindisi '; Given that the Ministry of agricultural food and forestry policies, pursuant to art. 14 of law no 526/1999, he availed himself of the technical assessment Group; Given the favourable opinion expressed by the aforementioned technical evaluation Group at its meeting of December 16, 2008; View the documentation on the acts of the Ministry; Considered proceeding with the enactment of the authorization under paragraph 1 of art. 14 of law no 526/99;
Decrees: Art. 1. the body called BioAgriCert s.r.l., established in Casalecchio di Reno, Via Dei Macabraccia, 8/3-4-5, is authorized to carry out the functions of control, provided for in articles 10 and 11 of Regulation (EC) No 510/2006 for the protected designation of origin ' Collina di Brindisi», registered in the European Union by Council Regulation (EC) no 1263/96 of July 10, 1996.
