The MINISTER of infrastructure and transport in consultation with the Minister of ECONOMIC DEVELOPMENT and the MINISTER of economy and finance having regard to law No 662 December 23, 1996 and, in particular, article. 2, paragraph 100) (a), which provides for the establishment at the Mediocredito Centrale SpA of a guarantee fund in order to ensure a partial insurance to loans granted by lenders to small and medium-sized enterprises; Having regard to law No 266 August 7, 1997 and, in particular, article. 15, establishing rules for the operation of that trust fund; Having regard to the order of the Minister of industry, Commerce and handicrafts May 31, 1999, n. 248, establishing criteria and modalities for the granting of the guarantee and to the management of the Guarantee Fund Act December 23, 1996, n. 662; Having regard to the Treaty establishing the European Union; Having regard to the definition of small and medium sized companies listed in annex 1 of Regulation (EC) no 800/2008, of August 6, 2008, the European Commission, declaring certain categories of aid compatible with the common market in application of articles 87 and 88 of the Treaty establishing the European Union; Having regard to Council Regulation (EC) 1998/2006 of December 15, 2006 on the application of articles 87 and 88 of the Treaty to state aid of minor importance (de minimis); Having regard to the communication from the European Commission 2009/C 16/01, concerning the temporary community framework for State aid measures to support access to finance in the current financial and economic crisis, and in particular paragraph 4.2.2 (limited amounts of aid), 4.3.2 (State aid in the form of guarantee), 4.6.2 (State aid to risk capital); Having regard to Directive of the President of the Council of Ministers of June 3, 2009, published in the Gazzetta Ufficiale della Repubblica italiana of June 9, 2009 laying down rules of application in the communication from the Commission-temporary community framework for State aid measures to support access to finance in the current financial and economic crisis, adopted by the Standing Conference for the relations between the State , the regions and the autonomous provinces of Trento and Bolzano, on April 8, 2009; Having regard to the decision of the European Commission of May 28, 2009, C (2009) 4277 approving the temporary aid scheme of limited amount foreseen in the communication n. 2009/C 83/01 from the European Commission in April 7, 2009; Having regard to the decision of the European Commission of May 28, 2009, C (2009) 4289 authorising the aid measure provided for in paragraph 4.3-State aid in the form of a guarantee-envisaged by the European Commission's communication 2009/C 16/01; Having regard to the order of the Minister of infrastructure and transport, in consultation with the Minister of economic development and the Minister of economy and finance, July 27, 2009, published in the Official Gazette October 7, 2009, # 233, establishing a ' institution of a special section reserved for small and medium-sized enterprises of motor transport of goods for third parties, within the framework of the guarantee fund for small and medium-sized enterprises mentioned in art. 2, paragraph 100) (a) of law December 23, 1996, n. 662»; Given that among the sectors most affected by the downturn in the real economy and the impact of the credit squeeze, which began in the second half of 2008, the industrial vehicles sector; Noted that the fall of the truck market is in crisis at the same time crossing the road transport sector; Considered therefore the need to amend and supplement the Decree July 27, 2009, in order to extend the possibility to access the guarantee fund for small and medium-sized enterprises for the purchase of vehicles by companies working in the field of road transport services on behalf of others; Given that the most representative membership organizations of trucking companies and truck industry have requested that extension in order to spur national economic system essential sectors;
Decrees: Art. 1 1. In art. 3 of the Decree of the Minister of infrastructure and transport, in consultation with the Minister of economic development and the Minister of economy and finance, July 27, 2009, published in the official journal October 7, 2009, # 233, establishing a ' institution of a special section reserved for small and medium-sized enterprises of motor transport of goods for third parties, within the framework of the guarantee fund for small and medium-sized enterprises mentioned in art. 2, paragraph 100) (a) of law December 23, 1996, n. 662, after paragraph 1 is added as follows: ' 1-bis. When an undertaking, as defined in art. 1, paragraph 2, of this Decree, requires collateral for the purchase of vehicles of category N1, N2, N3, O4, ensuring it is accessible within the limits and under the conditions laid down in art. 3 of the Decree of the President of the Council of Ministers June 3, 2009, published in the Official Gazette of June 9, 2009, # 131 and authorised by the European Commission decision No C (2009) 4277 of May 28, 2009, with which it was implemented the temporary aid scheme of limited amount foreseen in the communication n. 2009/C 83/01 from the European Commission in April 7, 2009 concerning the temporary community framework for State aid measures to support access to finance in the current financial and economic crisis, published in the official journal of the European Union of April 7, 2009, # C83». This Decree will be submitted to the supervisory authorities and published in the official journal of the Italian Republic.
