The MINISTER of labour and social policy having regard to Legislative Decree No 286, July 25, 1998 "consolidated text of provisions governing immigration and discipline rules on the status of foreigners" and subsequent amendments, and in particular art. 27, paragraph 1, that the special cases of input from abroad, to the letter f) provides for the entry of "persons who are authorised to stay for reasons of professional formation, place temporary periods of training at uk employers, including performance within the scope of employment"; Having regard to the Decree of the President of the Republic No 394 August 31, 1999, ' regulation laying down rules for implementing the consolidated text of provisions governing immigration and discipline rules on the status of foreigners "as amended by the Decree of the President of the Republic October 18, 2004, # 334; See in particular art. 40, paragraph 9) (a) of the Decree of the President of the Republic No. 394/1999, which provides, in art. 27, paragraph 1, point f) of Legislative Decree n. 286/1998, that foreigners can enter in Italy for holding training courses and guidance promoted by subject of article. 2, paragraph 1, of the Decree of the Minister of labour and social security March 25, 1998, # 142, depending on the completion of a course of vocational training; Having regard to the order of the Minister of labour and social policy of March 22, 2006, establishing a "national and regional legislation on job training and guidance for citizens outside the European Union '; See also art. 44-bis, paragraph 5, of the Decree of the President of the Republic No. 394/1999, which provides that the inputs into national territory of aliens in possession of the qualifications required for the visa of study intending to attend professional training courses organized by training providers accredited under art. 142, paragraph 1, point d) of legislative decree March 31, 1998, n. 112-aimed at recognition of a qualification or certification of skills acquired, or who wish to carry out internships in art. 40, paragraph 9)) (a) of the Decree of the President of the Republic # 394/1999, must take place within the annual quota; Having regard to the Decree of the Minister of labour, health and Social Affairs of the July 29, 2009, which authorised on a transitional basis, in accordance with art. 44-bis, paragraph 6, of the Decree of the President of the Republic No 394/1999 as amended by the Decree of the President of the Republic No 334/2004, and in the limit of the quotas established for the year 2008, to determine the quota for the year 2009, the number of foreign inputs 5,000 eligible to attend courses in art. 44-bis, paragraph 5, and number of 5,000 foreign inputs employed to carry out internships in art. 40, paragraph 9)) (a), of the Decree of the President of the Republic No. 394/1999 as amended by the Decree of the President of the Republic # 334/2004; Considered that art. 44-bis, paragraph 6, of the Decree of the President of the Republic No. 394/1999 provides that in the event of failure to publish, by 30 June of each year annual quota programming Decree, the Minister of labour and Social Affairs, in the second semestredell year can provide, as a transitional measure, by Decree, within the limits of the quotas established for the year; Given that the date of June 30, 2010 has not been yet published the Decree of annual programming of the quota referred to in art. 44-bis, paragraph 6, of the Decree of the President of the Republic # 394/1999;
Decrees: Art. 1 1. For the year 2010 shall be authorised on a transitional basis, in accordance with article 44-bis, paragraph 6, of the Decree of the President of the Republic August 31, 1999, # 394, as amended by the Decree of the President of the Republic October 18, 2004, # 334, within the limit of the quota fixed for the year 2009, the inputs in Italy of foreign nationals in possession of the qualifications required for issuing visas for study , in: a) 5,000 units for attendance at training courses aimed at recognition of a qualification or certification of skills acquired for periods not exceeding 24 months, in accordance with article 44-bis, paragraph 5, of the P.r.decree # 394/1999, organized by accredited training institutions in accordance with the rules of article 142, paragraph 1, lett. d) of legislative decree March 31, 1998, n. 112; b) 5,000 units for the conduct of training and orientation promoted by entities referred to in article 2, paragraph 1, of the Decree of the Minister of labour and social security March 25, 1998, # 142, depending on the completion of a course of vocational training.
