The MINISTER FOR ECONOMIC DEVELOPMENT in consultation with the Minister of environment, land and sea protection having regard to Directive 2004/8/EC on the promotion of cogeneration based on a useful heat demand in the internal energy market; Having regard to the Legislative Decree of February 8, 2007, n. 20 on the "implementation of Directive 2004/8/EC on the promotion of cogeneration based on a useful heat demand in the internal energy market, as well as amendments to Directive 92/42/EEC", and in particular art. 12, which States that the annexes to Decree the same may be amended and supplemented by Decree of the Minister of economic development in consultation with the Minister of the environment and protection of land and sea, in accordance with the guidelines and decisions of the European Commission; Having regard to Commission decision 2007/74/EC laying down efficiency reference values for separate production of electricity and heat in application of Directive 2004/8/EC of the European Parliament and of the Council; See in particular art. 2 of the above decision, which provides that in case of nationwide temperature scraps over 5° C, the Member State has the power, subject to notification to the Commission, to use more climate zones for the purpose of calculating efficiency reference values; Considering that the climate of the country, such as entailed by ISTAT data processing 2007 meet the conditions laid down in decision cited above; Having regard to Commission decision 2008/952/EC laying down detailed guidelines for the application and use of Directive 2004/8/EC of the European Parliament and of the Council; Given that, in accordance with Decree February 8, 2007, # 20, from 1 January 2011 the energy produced from high-efficiency cogeneration shall be determined according to the method defined by discipline; Withholding the opportunity to amend and supplement the annexes to Decree February 8, 2007, # 20, according to the aforementioned decisions of the European Commission.
Decrees: Art. 1 modifications and repeals 1. Annexes I, II and III to the Decree of February 8, 2007, # 20, are replaced by the following annexes to this Decree. Annex I cogeneration technologies covered by this Decree. Annex II calculation of production from cogeneration. Annex III method of determining the efficiency of the cogeneration process. 2. Are approved annexes IV, V, VI and VII, with additions to the method of calculating the energy from high-efficiency cogeneration, with respect to: a) annex IV-efficiency reference values for separate production of electricity; Annex V-b) efficiency reference values for separate production of heat; c) annex VI-correction factors related to Weather averages for the application of the efficiency reference values for separate production of electricity; d) annex VII-correction factors related to avoid losses on the network.
