The MINISTER having regard to the Treaty on the functioning of the European Union; Having regard to Directive 2001/37/EC of the European Parliament and of the Council of June 5, 2001 on the approximation of laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco products; See, in particular, article. 9, paragraph 2, of the directive, which stipulates that the European Commission provides for the adaptation to scientific and technical progress of health warnings referred to in annex I to that directive; Having regard to the Legislative Decree June 24, 2003, n. 184, recante: "implementation of Directive 2001/37/EC on the manufacture, presentation and sale of tobacco products", and in particular art. 6, paragraph 2, point b); Having regard to Directive 2012/9/EU of the European Commission of March 7, 2012 amending Annex I to Directive 2001/37/EC of the European Parliament and of the Council on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco products; Visto l'art. 13, paragraph 1, of law February 4, 2005, n. 11, establishing a "general rules on Italy's participation in the EU regulatory process and procedures for the implementation of Community obligations", which provides that Community rules do not autonomously applicable, amending Executive mode and technical characteristics of directives already transposed into national law, it is implemented, in matters of art. 117, second paragraph, of the Constitution, by Decree of the Minister responsible for the subject, which gives timely notice to the Presidency of the Council of Ministers-Department for Community policies; Given the new scientific knowledge on the effects of tobacco use and on the principles that should guide the effective labelling of tobacco; Considered that the guidelines for packaging and labelling of tobacco products, adopted in November 2008 by the third Conference of the parties to the who Framework Convention on tobacco control, advised to periodically review and update the standards for packaging and labelling of tobacco products based on the new knowledge;
Decrees: Art. 1 1.
