The DIRECTOR GENERAL for the promotion of agro-food quality having regard to Regulation (EC) No 510/2006 of March 20, 2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs; Having regard to law no 526 December 21, 1999 laying down rules for the fulfilment of the obligations arising from Italy's membership of the European communities-Community law 1999; Visto l'art. 14 of the above Act December 21, 1999, # 526 and in particular paragraph 15 which identifies the functions for the exercise of which the protection consortia of PDOs, PGIs and TSGS can receive, by measure of recognition, the corresponding assignment by the Ministry of agricultural food and forestry policies; Having regard to the ministerial decrees April 12, 2000, published in the Gazzetta Ufficiale-serie generale-# 97 of April 27, 2000, containing general provisions concerning reliability requirements ' the protection consortia designations of origin (PDOs) and protected geographical indications (PGI), and identification of the criteria of representation in the corporate bodies of the consortium of protection of designations of origin (PDOs) and protected geographical indications (PGI) issued by the Ministry of agricultural food and forestry policies in art. 14, paragraph 17 of the abovementioned law no 526/1999; Having regard to the September 12, 2000, Decree No. 410 published in the Gazzetta Ufficiale-serie generale-n. 9 of January 12, 2001 by which, pursuant to art. 14, paragraph 16 of law No. 526/1999, it was adopted the regulation concerning the distribution of costs arising from the activities of consortia of protection of PDOs and PGIs entrusted by the Ministry; November 2004 saw the legislativo19 Decree No. 297, published in Gazzetta Ufficiale-serie generale-# 293 of December 15, 2004, containing "penalty provisions under Regulation (EEC) no 2081/1992 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs "; Seen on October 12 Decree published in the Gazzetta Ufficiale-serie generale-# 272 of November 21, 2000 by which, in accordance with the provisions of art. 14, paragraph 15) (d) of the Act 526/1999, were given directives for the collaboration of the consortium of protection of PDOs and PGIs with the Ispettorato Centrale Repressione Frodi, now the Central Inspectorate for the protection of the quality and fraud repression of food and agricultural products, in the supervisory activities; Seen the Decree May 10, 2001, published in the Gazzetta Ufficiale-serie generale-# 134 of June 12, 2001, incorporating additions to the mentioned decrees of April 12, 2000; Seen the Decree May 4, 2005, published in the Gazzetta Ufficiale-serie generale-n. 112 of May 16, 2005 laying down these decrees of April 12, 2000 integration; Seen the Decree May 4, 2005, published in the Gazzetta Ufficiale-serie generale-n. 112 of May 16, 2005, establishing a mode of derogation from art. 2 of said Decree April 12, 2000; Seen August 5, 2005 Decree, published in the Gazzetta Ufficiale-serie generale-n. 191 of August 18, 2005, amending the Decree of May 4, 2005; Having regard to the departmental Decree # 7422 of May 12, 2010 laying down general provisions concerning verification of institutional activity attributed to the protection consortia pursuant to art. 14, paragraph 15 December 21, 1999, law No. 526 having regard to Regulation (EC) No 148 of February 15, 2007, published in the official journal of the European Communities L 46 of February 16, 2007 which was recorded the protected designation of origin "Sardegna"; Having regard to the Decree of January 16, 2009, published in the Gazzetta Ufficiale-serie generale-# 22 of January 28, 2009 with which it was awarded to the Consortium for the protection of Sardinian extra virgin olive oil with protected designation of origin recognition and assignment to perform the functions referred to in art. 14, paragraph 15, of law December 21, 1999, # 526 for the PDO "Sardegna"; Considered that the condition required by art. 5 April 12, 2000 Decree mentioned above, reliability requirements ' the protection consortia and satisfied, since the Ministry has verified the participation, in the shareholder structure, the subjects belonging to the category «olive growers» in «fats (oils)» identified in art. 4 of the same Decree, which represent at least the 2/3 of production controlled by the inspection body in significant period of reference. This verification was performed on the basis of declarations made by the applicant and the attestations issued by the inspection body Agris Sardinia, carrying out control activities on protected designation of origin "Sardegna"; Considering that the Statute approved by this Administration has been subjected to the verification referred to in art. 3, paragraph 2, of the aforementioned Decree May 12, 2010 departmental; Was therefore considered necessary to confirm the assignment of the Consortium for the protection of Sardinian extra virgin olive oil with protected designation of origin to carry out the functions indicated in art. 14, paragraph 15 of the abovementioned law no 526/1999, Decreed:

Sole article 1. It is confirmed for three years from the date of promulgation of this Decree, granted by Decree of January 16, 2009, the Consortium for the protection of the Sardinian extra virgin olive oil with protected designation of origin, registered office in Sassari-Italy Avenue # 39, to perform the functions referred to in art. 14, paragraph 15, December 21, 1999, law n. 526 for the PDO "Sardegna". 2. The predicted position, which entails the obligation of the specifications given in the decree October 7, 2004, can be suspended with motivated and withdrawn according to art. 7 April 12, 2000 Decree laying down general provisions concerning the requirements of reliability is the protection consortia of protected designations of origin and protected geographical indications. This Decree is published in the official journal of the Italian Republic and becomes effective on the date of enactment of the Decree.
