No. 16 YEAR 2013
ABOUT
THE FAMILY WELFARE CONSULTING INSTITUTE

WITH THE GRACE OF THE ALMIGHTY GOD

THE SOCIAL MINISTER OF THE REPUBLIC OF INDONESIA,

Weigh: a.   that to implement the provisions of Article 9 of the Government Regulation No. 38 of 2007 on the Division of Government Affairs Between the Government, the Provincial Government, and the District/City Local Government, need to be drafted norms, standards, procedures and social field criteria;
B.   That the tide of globalization, characterized by the advancement of science and technology as well as the rapid social change in society, has resulted in the growing number of family bonding values that affect the psychosocial and wholeness problem. family;
C.   That the Regulation of the Social Ministers Number 84 /huk/2010 About the Family Welfare Consulting Institute is already not compatible with the current conditions, so it needs to be replaced;
D.   That based on consideration as referred to in the letter a, the letter b, and the letter c, need to establish the Social Minister ' s Regulation on the Family Welfare Consultation Institute;

DECIDED:
Establish: SOCIAL MINISTER REGULATION ON FAMILY WELFARE CONSULTING INSTITUTE.

BAB I
UMUM CONDITIONS
Section 1
In Regulation of the Minister this is referred to:
1. The next Family Welfare Consultation Institute called LK3 is a unified social services unit that carries out the handling of family psychosocial problems to realize family resilience.
2. The subsequent Social Welfare Institute (LKS) is a social organization or social society that carries out the social welfare organization created by the public, both legal and non-governing. Legal entities.
3. Family is the smallest unit in society consisting of a husband ' s husband, or the husband of his wife and child, or his father and son, or his mother and child, or a family of blood in a straight line up or down to the bottom of the third degree.
4. Family welfare is the condition of which the basic human needs of every member of the family are materially, socially, mentally and spiritually so that it can live a worthwhile human being.

6. Integrated Social Services Unit is a comprehensive, coordinated set of services to meet the needs of the psychosocial troubled family.
7. Psychiatry is a condition related to the surrounding social relations that includes the psychological factors of a person's experience of thought, feeling, and/or behavior that is constantly affecting one. The other.
8. The psychosocial problem is the condition that a person experiences caused by the disruption of social relations, attitudes and behaviors include a disorder of thought, feelings, behavior, and/or social relations that constantly affect one another. The other.
9. Counseling is a process for assisting individuals or groups in overcoming the barriers of his personal development and to achieve the development of personal abilities that it has optimally.
10. Consultation is a professional assistance grant to an organization, group, society, family or individual by a person or a team that has knowledge, skills, and professional qualifications in its field.
11. Information is the issues and efforts to improve the well-being of the family including those in the effort of improving the fulfillment capabilities and solving individual problems.
12. The outreach is professional power efforts LK3 indentifies or finds clients who need social services by working proactively by working in the field.
13. The Advocacy is an act to represent, defend client ' s interests, goodwill through intervention or direct handling, or through enablement with the purpose of ensuring a client acquire its rights.
14. Subprocessors are subject to the terms of this Service and the applicable Service.
15. The Central Government, subsequently called the Government, is the President of the Republic of Indonesia which holds the power of the government of the Republic of Indonesia as referred to in the Basic Law of the Republic of Indonesia in 1945.
16. The Regional Government is the Governor, the Regent, or the Mayor and the area's device as an element of the organizing government of the region.

Section 2
The purpose of the LK3 form, includes:
a.   addressing the family's psychosocial problems;

Section 3

Section 6
The primary objective of LK3 is aimed at families experiencing psychosocial problems.

Section 7
These rules govern the terms and conditions of the establishment, the standard LK3, and the LK3 service.

BAB II
THE TERMS AND CONDITIONS OF THE ESTABLISHMENT
The Kesatu section
General
Section 8
LK3 was founded by:
a.   Ministry of Social Affairs;
B.   the government of the district/kota;
C.   LKS; and
D.   College.

Section 9
(1) The LK3 established by the Ministry of Social Affairs as referred to in Article 8 of the letter a is LK3 pilot.
(2) The local government may establish LK3 by referring to the Regulation of this Social Minister.
(3) The establishment of LK3 as referred to verse (2) is delivered to the Minister of Social Affairs through the social institution of the province.

Section 10
The LK3 established by the LKS as referred to in Article 8 of the letter c is passed by the chairman of the LKS caretaker after it gets a recommendation from an instance that is seeding the social affairs according to its level of authority.

Section 11
LK3 founded by the college as referred to in Article 8 of the letter d is a college that has a social work/social welfare department authorized by the rector/dekan/chairperson after receiving a recommendation from the The agency that is drugging the social affairs corresponds to its level of authority.

The Second Part
Terms and Terms of the Way
Section 12
(1) The establishment of LK3 by LKS and colleges must obtain a recommendation from the local government/district c.q. head of the local district/city social agencies, after meeting the requirements.
(2) The LKS and college requirements that can establish LK3 as referred to in paragraph (1) include:
a.   the legal entity;
B.   have a domicile certificate; and
c. listed on the local social agencies for LKS.
(3) The recommendation as referred to in paragraph (1) is valid for 5 (five) years and may be extended.

Section 13
Set the LK3 founding way by the LKS and college as follows:
a.  submitted a recommendation request to the county/city c.q. social institution of the county/city by equipping the requirements as referred to in Article 12 of the paragraph (2) and delivered the founding proposal of LK3.
B.   The request of the recommendation is further processed by the county/city social agencies by convening:
1. Withholding of LK3 erection proposals submitted; and
2. Verify.
c. Social instance of the city/city may receive or reject such requests with notice to the applicant; and
D.  in the event of an accepted application, the head of the county/city social agency publishes the foundation recommendation letter with a gust delivered to:
1. Social Minister c.q. Director General Empowerment of Social Empowerment and Poverty Prevention; and
2. Governor of the province of c.q. social institution of the local province.

BAB III
LK3 STANDARD
Section 14
(1) The LK3 standard applies as the standard of a unified social services unit that address family psychosocial problems, the restoration of family psychosocial conditions, and strengthen the family ' s resilience.
(2) The location of the LK3 office can be in the environment:
a.   the office of the instance that organizes the social field/kabupaten;
B.   regional technical executor;
C.   LKS/society
D.   basic social services units such as public health centers, hospitals, religious affairs offices; and
e.   Educational institution/lodge boarding school.
(3) The location as referred to a paragraph (2) must consider:
a.   easy to reach by service target;
B.   easy in development of service quality; and
c. can realize the effectiveness and efficiency of the service.
(4) The standard LK3 as referred to in paragraph (1) includes aspects:
a.   vision and mission;
B.   organization structure;
c. A means and infrastructure; and
D.   the availability of funds, management management, and accountability.

Section 15
(1) The LK3 in achieving its goal is based on vision and mission.
(2) The formulae of LK3 vision and mission as referred to in verses (1) are made by each LK3.
(3) The Vision and mission of LK3 as referred to in verse (2) remains the guideline to Pancasila and the Basic Law of the Republic of Indonesia in 1945.

Section 16
(1) The organizational structure as referred to in Section 14 of the paragraph (4) of the letter b, consists of:
a.   In-charge;
B.   speaker;
C.   secretary;
D.   treasurer; and
e.   Professional power.
(2) The organizational structure as referred to in verse (1), in the Ministry of Social Affairs is set by the leader of the echelon II unit that is drugging the family empowerment.
(3) The organizational structure as referred to in paragraph (1), in the county/city social agencies is set by the bupati/mayor.
(4) The organizational structure ' s structure as referred to in paragraph (1), in college and LKS is handed over fully to each of the respective colleges and the LKS.

Section 17
(1) The charge is referred to in Article 16 of the letter a, in the Ministry of Social Affairs and the social institution of the district/the city is held by the eselon III that has led to the empowerment of the family.
(2) The handler as referred to in Article 16 of the letter a, in college and LKS is handed over fully to each of the respective colleges and the LKS.
(3) The Chairman, Secretary, and Treasurer as referred to in Article 16 of the letter b, the letter c, and the letter d in the Ministry of Social Affairs and the social agencies of the district/city are derived from non-civil civil rights elements.
(4) The Chairman, Secretary, and Treasurer as referred to in Article 16 of the letter b, the letter c, and the letter d in the college and the LKS, fully handed over to each of the respective colleges and the LKS.
(5) Professional power as referred to in Article 16 of the letter e, in the Ministry of Social and Social Affairs of the district/city, college, and the LKS can be derived from elements of civil servants and/or non-civil civil servants.

Section 18
(1) The professional power as referred to in Article 16 of the letter e includes:
a.   professional social worker;
B.   psychologist;
C.   doctor/health care;
D.   police;
e.   legal experts;
f.   religious experts; and
G.   Education expert.
(2) The professional power as referred to in paragraph (1), is at least composed of professional social workers.
(3) The professional power as referred to in verse (2) can be derived from the elements of civil servants.
(4) In terms of professional social workers carrying out tasks and functions can be aided by the human resources of potential elements and other social welfare sources.

Section 19
The tenure of the LK3 management for the post as referred to in Article 16 of the letter b, the letter c, the letter d, and the letter e for 3 (three) years and can be reappointed.

Section 20
The means and the infrastructure as referred to in Section 14 of the paragraph (4) of the letter c, include:
a.   Physical and physical resources;
B.   office equipment;
c. Service documents; and
D.   means of mobility.

Section 21

B.   client parent number register;
c. case logbook;
D.   case summary;
e.   Asset history/inventory; and
f.    list of officers present.
(4) The mobility Sarana as referred to in Article 20 of the letter d, includes:
a.   a two-wheel vehicle;
B.   a four-wheel vehicle; and
c. Other vehicles are tailored to the local LK3 location and needs.

BAB IV
LK3 SERVICE
Section 22
(1) The LK3 service is a service to families experiencing psychosocial problems.
(2) In case the LK3 does not provide the service as referred to in paragraph (1) the administrative sanction is a written warning, the temporary termination of the activities, and the revocation of operational clearance.

Section 23
The LK3 service type consists of:
a.   consultation;
B.   Counseling;
C.   information;
D.   advocacy;
e.   referral; and
f.    The outreach.

Section 24
The type of consultation service as referred to in Article 23 of the letter a aims for:
a.   Make clear and attempt to understand the issues of the family;
B.   find alternate-alternative problem solving;
c. design a follow-up plan for problem solving; and
D.   carry out the breakdown of family psychosocial problems.

Section 25
The type of counseling service as referred to in Article 23 of the letter b aims to:
a.   create relationships based on equality and trust each other with clients/families;
B.   understand the client/family issues in depth;
c. provide emotional support, improve self-awareness and motivation;
D.   provide skills guidance on problem solving strategies, managing stress, improving social relations; and
e.   Do a defense/advocacy and develop a service-giving work network.

Section 26
The type of information service as referred to as Article 23 of the letter c includes:
a.  data management and information about programs, benefits, and procedures to acquire and use the services of various service sources;
B.  provide information to individuals, families, groups and communities in need of available service sources, terms and procedures obtain the required services; and
c. disseminate the LK3 service information and other social services to the community.

Section 27
The type of advocacy service as referred to in Article 23 of the d letter includes:
a.   affect the related party in order to perform the best service;
B.   Urging the relevant parties to improve the rights of the client to obtain services;
c. conduct negotiations with the related parties;
D.   provide testimony and assistance;
e.   Make a legal effort;
f.    guide the client/family about the advocacy skills to address the problem; and
G.   guide the client/family about its rights.

Section 28
The type of referral service as referred to in Article 23 of the letter e includes:
a.   discussing the needs and the reasons for referrals with the client/exit;
B.   communicate to a service source who will receive a referral about the client's needs/family needs;
c. Make an appointment with a service source that will receive a referral;
D.  carrying out a referral procedure from a service source that will receive a referral accompanied by a client/family social history record to a service source that will receive a referral; and
e.   Set up the following action:

Section 29
The type of outreach service as referred to in Article 23 of the letter f includes:
a.   embed service to clients, families and communities with proactive descent directly to the target to ensure the client receives the service according to the needed;
B.   provide services to the target location in accordance with the procedures and types of Service available.

Section 30
The LK3 service process is paying attention to aspects:
a.   Enablement
B.   Rehabilitation;
C.   protection; and
D.   Support.

Section 31
(1) The aspect of empowerment as referred to in Article 30 of the letter is an attempt to increase the ability of thought, feeling, and/or behavior of family members in relation to the increased level of life and its liveliments in order enhanced ability for problem solving.
(2) The rehabilitation aspect as referred to in Article 30 of the letter b, is an attempt to restore psychological social conditions and to improve the function and social role of family members.
(3) The protection aspect as referred to in Article 30 of the letter c, is the attempted execution of a family in the solving of psychological social problems.
(4) The supporting aspect of Article 30 of the letter d, is an attempt to support the efforts made by other institutions to improve the quality of life and the livelihood of the family and society.

Section 32
The LK3 service is carried out through the social work process including:
a.   Initial approach;
B.   disclosure and understanding of the problem;
c. Problem solving plan;
D.   problem solving;
e.   monitoring and evaluation;
f.    termination; and
G.   Further guidance.

Section 33
The LK3 service is organized by depanting strategies for building work networks and partnerships.

Section 34
The working network and partnership as referred to in Article 33 consists of:
a.   Potential and Social Welfare Resources;
B.   the hospital;
C.   Police Republic of Indonesia;
D.   Buret/soft/legal help posts;
e.   Trauma Center Trauma Center;
f.    Integrated Services Center for Women and Child Empowerment; and
G.   Other public services that can be used as a working network and partnership of LK3.

Section 35
The work and partnership network as referred to in Article 34 is done through:
a.   equal work;
B.   coordination; and/or
C.   Collaboration.

BAB V
Authorization
The Kesatu section
Government
Section 36
The Minister has the authority:
a.   formulating and setting the LK3 policy;
B.   establish norms, standards, procedures, and criteria about LK3;
c. provide LK3 data nationally;
D.   formulate and oscillate the policy of hosting LK3;
e.   Build a training module;
f.    set the LK3 service standard;
G.   conduct the institutional coordination of LK3 at the national level;
h.   conducting increased human resources and the institutional LK3;
i.    facilitate the means and infrastructure of the LK3 Service;
J.    facilitate the assistance of the LK3 partnership with other institutions;
No,   conduct coordination with the service/social institution of the province and service/social agencies of the district/city against LK3;
I.    conducting LK3 coaching and supervision; and/or
M.   conducting LK3 monitoring and evaluation;

The Second Part
Province
Section 37
The governor has the authority:
a.   Provide a copy of the IBM Cloud Service, and the following terms:
B.   Socializing the policy of LK3;
c. provide LK3 data in its working region province;
D.   coordinate the Regional Device Work Unit (SKPD) in the implementation of LK3 policy, programs, and activities;
e.   carrying out the strengthening of the human resources capacity and the institutional LK3;
f.   facilitate the LK3 partnership with the provincial source system;
G.  facilitate the means and infrastructure of the LK3 Service;
h.  carry out cooperation with other provinces and counties/cities in other provinces as well as the facilitation of intercity/city cooperation in its territory;
i.    carrying out coaching and supervision of LK3 in its working region province; and/or
J.   carrying out monitoring and evaluation of LK3 in its working region province.

The Third Part
District/City
Section 38
The Bupati or the Mayor has the authority:
a.   carrying out the policy of hosting LK3;
B.   carrying out norms, standards, procedures, and criteria about LK3;
c. carry out LK3 service standards;
D.   perform and process LK3 data;
e.   carrying out the strengthening of the human resources capacity and the institutional LK3;
f.    Provide the IBM Cloud Service and Client's use of the Cloud Service for the Cloud Service
G.   carry out cooperation with other districts/cities in and outside the province;
h.   carry out coordination with related services/agencies (SKPD), business and community world; and/or
i.    carrying out monitoring and evaluation in the district.

BAB VI
FUNDING
Section 39
(1) The funding of LK3 policies, programs, and activities organized by the provincial government is sourced from:
a.   provincial regional shopping income budget; and/or
b .a valid source of funding under the provisions of the laws.
(2) The funding of LK3 policies, programs, and activities organized by the county/city government is sourced from:
a.   district/kota; and/or
shopping revenue budget b .a valid source of funding under the provisions of the laws.
(3) The Government may provide funding assistance for the implementation of the policies, programs, and activities of LK3 organized by the provincial government and/or the county/city government.

BAB VII
MONITORING AND EVALUATION
The Kesatu section
Monitoring
Section 40
(1) To guarantee the synergy, continuity, and effectiveness of the measures integrated in the implementation of the policy, program, and activities of LK3, Government, provincial government, district/city government conducting monitoring.
(2) Monitoring as specified in paragraph (1) is intended to know the development and obstacles in the implementation of the policies, programs, and activities of LK3.
(3) Monitoring as referred to in verse (1), performed by coordination with the agency/service that organizes affairs in the social field.
(4) Monitoring as referred to in paragraph (1), carried out from planning, budgeting up to the execution of policies, programs, as well as LK3 activities for the year running.

The Second Part
Evaluation
Section 41
(1) Evaluation of the implementation of LK3 carried out at the end of the budget year by the Government, provincial government, county/city government through agency/service which organizes affairs in the social field.
(2) The LK3 implementation evaluation results are used as input materials for the drafting of policies, programs, and activities for the next year.
(3) The evaluation as referred to in paragraph (1) is exercised in accordance with the provisions of the laws.

BAB VIII
REPORTING
Section 42
(1) The Regent/mayor is obligated to submit a report of LK3 implementation on its territory to the governor.
(2) The Governor is obliged to present the report of the LK3 implementation to the Minister who is drugging the social affairs and the Minister ' s drugging of government affairs.
(3) The execution report as referred to in paragraph (1) and paragraph (2) is delivered at any end of the budget year.
(4) The form and layout of the reporting as referred to in paragraph (1) and paragraph (2) are executed in accordance with the provisions of the laws.

BAB IX
COACHING AND SUPERVISION
Section 43
(1) The Minister of Social Affairs undertook the coaching and supervision over the implementation of the LK3 to the provincial government.
(2) The governor conducts coaching and supervision over the implementation of LK3 to the county/city government.
(3) The Regent/the mayor conducts coaching and supervision in the implementation of LK3 in his region.

Section 44
The public can conduct surveillance on the implementation of the LK3 according to the mechanism and the provisions of the laws.

BAB X
CLOSING PROVISIONS
Section 45
With this Regulation, the Regulation of the Social Ministers Number 84 /HUK/2010 on the Family Welfare Consultation Institute is revoked and stated to be not applicable.

Section 46
These rules are made as the norm, standard, procedure, and criteria governing the LK3 which is a reference to the provincial government and the county/city local governments.

Section 47
The rules of the Ministry are effective on the date of the promulgations.
