THE SECOND CHANGE OVER THE COUNTY REGIONAL REGULATION OF MUSI RAWAS NUMBER 2 YEARS 2007 ABOUT MEANS OF CANDIDACY, ELECTION, APPOINTMENT, INAUGURATION AND

DISMISSAL OF THE VILLAGE HEAD

WITH THE GRACE OF GOD ALMIGHTY

BUPATI MUSI RAWAS,

Draw: a. that the means of candidacy, election, appointment, appointment and termination of the village head have been set up in the Regional Regulation of Musi Rawas Number 2 of 2007 and have been amended with the Regional Regulation of Musi Rawas Regency Number 9 of 2010;

b. that the rapid development and advancement of information technology has led to changes to human activity in various fields that have directly influenced the birth of new forms of law;

c. that in The purpose of the use of information technology as an attempt to increase the effectiveness and efficacy in the selection of village heads will need to change some of the provisions in the Regional Regulation of Musi Rawas Number 2 of 2007 on the Tata Cara Nomination, Election, Appointment, Appointment and Stop Village Head as has been amended with the Regional Regulation of Musi Rawas Number 9 of 2010;

d. that based on consideration as the letter a, the letter b and the letter c above, then need to establish the Regional Regulation on the Second Amendment of Musi Rawas County Regulation No. 2 Year 2007 on the Tata Way of the Nomination, Election, Appointment, Inauguration and Stop Village Head Stop.

With THE MUTUAL CONSENT OF THE PEOPLE ' S REPRESENTATIVE COUNCIL OF MUSI RAWAS COUNTY

AND BUPATI MUSI RAWAS

DECIDED:

SET : THE REGIONAL REGULATIONS ON THE SECOND CHANGE OVER REGIONAL REGULATIONS MUSI RAWAS COUNTY NUMBER 2 IN 2007 ON THE TERMS OF THE NOMINATION, ELECTION, APPOINTMENT, APPOINTMENT AND DISMISSAL OF THE VILLAGE HEAD.

Article I

Some provisions in the Regional Regulations of Musi Rawas Number 2 of 2007 on the Tata Way of Candidacy, Election, Appointment, Appointment and Stop Head of the Village (The regency of the Regency of Musi Rawas in 2007 No. 2), was changed as follows:

1. The provisions of Article 1 are amended, so that Article 1 reads as follows:

Article 1

In this Regional Regulation referred to as:

1. District is Musi Rawas County.

2. The Government of the Regency is the Government of Musi Rawas Regency.

3. " Bupati is the regent of Musi Rawas.

4. The district is a working area of the Camat as a County District device.

5. " The Head of the Subdistrict.

6. The village is a unity of the legal society that has the boundaries of the region which is authorized to organize and take care of the interests of the local community, based on the origins and customs of the local recognized and respected government systems Republic of the Republic of Indonesia.

7. Village Government is the establishment of government affairs by the Village Government and the Village Consultative Body (BPD) in regulating and taking care of the interests of the local community, based on the origins and customs of the local recognized and respected in the Government of the Republic of Indonesia Government.

8. The Village Government is the Head of Village and Village Devices as an element of the village government organizer.

9. The DPD is an institution that is the embodiment of democracy in the Government of the Village as an element of the Government of the Village.

10. Prospective candidates are the local villagers who meet the requirements to be chosen as the Village Head.

11. The candidate for the right to be chosen is the Future Head of the Village Consultative Assembly

12. The candidate is the candidate for the village head who has the most votes in the Future Head of the Village election.

13. The Chief of the Village is a person appointed by Pajabat who is authorized to exercise the rights, authority and obligations of the Head of the Village within a period of time.

14. The official authorized officer is the authorized officer to lift and dismiss the Chief Village.

15. Voters are residents of the Village concerned and have met the requirements to use the right to vote.

16. Voting rights are the rights that the electorate has to determine the attitude of his choice.;

17. A network is an attempt by the Election Committee of the Head of the Village to obtain the Candidate's Candidate from the local community.

18. Screening is a selection carried out both in terms of administration and the ability and leadership of the Bakal Candidate Head of the Village.

19. A campaign is a media that is used to attract the sympathy of voters who are entitled to the delivery of the program to be implemented when the person is elected Head of the Village.

20. E-vooting is an electronic selection that uses information technology.

2. The provisions of Article 7 are amended, so that Article 7 reads as follows:

Article 7

(1) Which can be chosen to be the Chief of the Village is a citizen of the citizen of the Republic of Indonesia with the terms:

a. Put your trust in the Lord Almighty;

b. faithful and obedient to Pancasila as the Basic State, Invite-Invite the State of the Republic of Indonesia in 1945 and to the State of the Republic of Indonesia as well as the Government of the Republic of Indonesia;

c. the lowest-educated of the schools advanced first and/or equal levels;

d. the lowest of 25 (twenty-five) years at least 60 (sixty) years at the time of registration;

e. healthy physical and healthy spirituation (psychiatric);

f. Good behavior;

g. Handing over a full list of life history contains a history of education and employment as well as family, husband and wife;

h. never been convicted of a prison that has had the provisions of a fixed law with the shortest threat of 5 (five) years or more;

i. was not revoked by the vote by a court decision that has a fixed legal force;

j. knows the area and is known to the community in the local village;

k. never served as a village chief for 2 (two) times of term;

l. not in status as village chief, village chief acting, BPD member and village device;

m. is willing to be nominated to the head of the village;

n. willing to stay and settle in the village if elected to the head of the village;

o. Never got involved in drugs;

p. be legally registered as a resident of the local village legally and residence remain in the village concerned, except the son of the village who is outside the village in question;

(2) The completion of the requirements as referred to in paragraph (1), includes: a. a statement letter created and signed on the Rp.

6,000,-by the candidate himself, as proof of the candidate's eligibility as referred to in paragraph (1) letter a, letter b, letter l, letter m, letter n, letter o and letter q;

b. A copy of a copy that is authorized by the authorized party, as a fulfillment of the candidate's condition as referred to in paragraph (1) of the letter c;

c. candidates as referred to in paragraph (1) letter e;

d. a government physician's letter, as a fulfilment of the candidate's condition as referred to in the paragraph (1) of the letter f;

e. A misbehaving letter as evidenced from the force, as a fulfilment of the candidate's condition as referred to in paragraph (1) of the letter f;

f. a candidate's life history list, created and signed by the candidate, as a fulfillment of the candidate's condition as referred to in paragraph (1) letter h;

g. A warrant has never been convicted of a criminal conviction based on a court ruling that has the power of the law to remain with the shortest threat of five years or more than a court of state, as a condition of the candidate as referred to in the paragraph (1) letter h;

h. A capt is not being stripped of his vote by a court decision which has a fixed legal force from a court of state, as a fulfillment of the candidate's terms as referred to in paragraph (1) letter j;

i. copy of KTP, KK and the domicile letter from the village head, as the terms of the candidate as referred to in paragraph (1) letter p; and

j. Drug-free papers from government doctors and caption letters do not engage drugs from the authorities.

(3) For Village Chief, BPD Members, Village Devices who will run for the Village Head should resign from his post by proven resignation statement letter signed with materai Rp. 6,000,-

(4) The civil servant who is running for the future head of the village in addition to meeting the requirements as referred to in the paragraph (1) and the paragraph (2), also must have a written permission letter from the Regent.

(5) Civil servants of the Indonesian National Armed Forces (TNI) and Polri who are running for the future of the village in addition to meeting the requirements, as referred to in verse (1) and verse (2), must also have a written license and consent from the agency. Its parent.

(6) Honorer running as head of the village, if elected should resign as an honorary power.

(7) For the candidate head of the village elected and appointed to the head of the village count starting the appointment date as the head of the village must reside in the village in question.

3. The provisions of Article 28 are amended, so Article 28 reads as follows:

Article 28 (1) The vote is done by giving voice through

the ballot or using e-voting containing the number, photo and the candidate name.

(2) The voting for the election is done by attempting to blob. candidate image sign candidate in the ballot or select one of the candidates found in e-voting equipment

(3) The giving of the e-voting will be set further by the Regent's rules.

(4) If in the election there is only one candidate, then in the execution of a vote must be provided 2 (two) different image tags each for supporting and not supporting.

(5) The polling place at the Village Hall or any other place is set by the Election Committee.

(6) The timing of the voting vote begins since the hour 08.00 Wib until the finished being touched by Election Committee.

(7) At the time the Village Chief Candidate vote was required to be present and should not be represented.

4. The provisions of Article 29 are amended, so that Article 29 reads as follows:

Article 29 (1) For the purposes of voting in the election, the Election Committee

provides:

a. voicemail bearing the number, photo and name of the prospective village head is selected and at the bottom was signed by the Speaker of the Election Committee as a sign of the valid ballot.

b. The ballot box as the place of the ballot used by voters whose size is set by the Election Committee.

c. A voting booth or a special place for the execution of voting.

d. The encoblosan tool and coblos bearing in the voting booth.

e. A whiteboard containing the names of the candidates for the right of the village is chosen for the counting of the vote.

(2) The material, shape, format, size and number of ballots referred to in paragraph (1) the letter a, is set by the Panitia Election.

(3) The absence of ballot papers and electoral implementation equipment is exercised by the Election Committee.

(4) For the purposes of voting by using e-voting will be facilitated by the Regency government.

5. The provisions of Article 45 are amended, so that Article 45 reads as follows:

Article 45

The Chief of the Village is temporarily dismissed by the Regent without passing through the BPD proposal, due to the status of a suspect committing a criminal corruption, a felony terrorism, a drug criminal, and a macar or a criminal offense. against the security of the country.

Article II

The Regulation of this Region came into effect on the date promulbed.
