WITH THE GRACE OF GOD ALMIGHTY

MINISTER OF ENERGY RESOURCES OF THE MINERAL REPUBLIC OF INDONESIA,

DRAWS: A. That in order to maximize the potential utilization of hydropower from reservoirs and/or irrigation channels, it is multipurpose for the Hydroelectric Power Plant and to maintain the sustainable operation of the Power Power Plant. Water is up to 10 MW which is already in operation, needing to fine-tune the arrangement regarding the purchase of electric power from the Air Power Plant by the State Electric Power Company (Persero) as referred to in the Minister of Energy and Resources Regulation. Mineral Power Number 12 Year 2014;

b. that under consideration as intended in the letter a, it is necessary to establish the Regulation of the Minister of Energy and Mineral Resources on the Changes to the Minister of Energy and Source Regulations

DECIDED:

Establishing: REGULATION OF ENERGY MINISTER AND MINERAL RESOURCES ON CHANGES TO THE REGULATION OF ENERGY MINISTER AND MINERAL RESOURCES NUMBER 12 OF 2014 ABOUT THE PURCHASE OF ELECTRIC POWER FROM THE HYDROELECTRIC POWER PLANT BY THE STATE ELECTRIC COMPANY (PERSERO).

Article I

Some provisions in the Regulation of the Minister of Energy and Mineral Resources Number 12 of 2014 on the Purchase of Electric Power From the Hydroelectric Power Plant By PT Corporate Electric Company (Persero) (State News The Republic of Indonesia in 2014 No. 594) was changed as follows:

1. The provisions of Article 3 of the paragraph (1) are amended so that Article 3 reads as follows:

Article 3

(1) With the Regulation of this Minister, the Minister assigned PT PLN (Persero) to purchase an electric power from:

a. The PLTA with a capacity of up to 10 MW (ten megawatts) is managed by the venture body as referred to in Article 2 which has already had IUPTL;

b. PLTA utilised hydropower from reservoir/dam and/or irrigation channels whose construction is multipurpose with a capacity of up to 10 MW (ten megawatts) managed by the venture body as referred to in Article 2 that have been Have the IUPTL.

(2) The Assignment as referred to in paragraph (1) applies as:

a. immediate appointment agreement for the purchase of electric power by PT PLN (Persero); and

b. the approval of the purchase price of electric power by PT PLN (Persero).

2. The provisions of Article 4 paragraph (1) are amended so that Section 4 reads as follows:

Section 4

(1) The purchase price of electricity from the PLTA with capacity up to 10 MW (ten megawatts) as referred to in Article 3 is specified with regard to the electrical grid voltage of PT PLN (Persero), and the plant location/region (factor F) with

magnitude as set forth in Appendix to the IA and IB Annex which is an inseparable part of this Minister's Regulation.

(2) The purchase price of an electric power as referred to by paragraph (1) is already Including the entire cost of procuring a network of splicing from a plant to the PT PLN (Persero) power grid and is the price used in the PJBL without any price negotiation and without any escalation.

3. The provisions of Article 6 of the paragraph (1) letter b are amended so that Article 6 reads as follows:

Article 6

(1) PT PLN (Persero) may purchase an electric power from:

a. PLTA with a capacity above 10 MW (ten megawatts); or

b. PLTA uses hydropower from a reservoir/dam and/or irrigation channel whose construction is multipurpose with a capacity above 10 MW (ten megawatts).

(2) The purchase price of an electric power from the PLTA as referred to in paragraph (1) is based on a deal between PT PLN (Persero) with the business entity.

(3) The purchase price as referred to in paragraph (2) is mandatory for approval. Minister.

4. The provisions of Article 18 paragraph (1), paragraph (2), and paragraph (4) are amended so that Article 18 reads as follows:

Article 18

(1) At the time the Regulation of the Minister comes into effect, the purchase price of electricity from the PLTA with capacity up to 10 MW (ten megawatts) of the entity that has obtained a designation as a PLTA developer of PT PLN (Persero) and the price is specified under the terms before the Regulation of this Minister applies, stated to remain in effect.

(2) Price the purchase of an electric power as referred to the paragraph (1) may be adjusted, with provision:

a. The business entity, as referred to in verse (1), should first be designated as the hydropower manager for the power plant by the General General EBTKE;

b. to be designated as the water power manager as referred to in the letter a, the business entity is required to deliver a request to Dirjen EBTKE by attaching a copy of the entire development related document

The plant-owned PLTA, and for the entity whose generation has been operating must attach a report to the plant's operations.

(3) The value adjustment of the purchase of electric power as referred to in the verse (2) is based on a deal between PT PLN (Persero) with the business entity, provided the terms:

a. the weighted average price as set forth in Annex III which is an inseparable part of the Regulation of the Minister is used as the highest benchmark price in the negotiation process;

b. The price of the purchase of electric power proceeds of the deal is fixed and directly poured in the PJBL and the expiring term until the end of the PJBL.

(4) The purchase price adjustment process as referred to in paragraph (3) must be completed within the slowest term of 90 (ninety) business days since the establishment of an entity as the water power manager for the power plant in accordance with the terms of the applicable law. with the applicable mechanisms and procedures regarding the adjustment of the purchase price of an electric power.

(5) The purchase price as referred to in paragraph (3) the letter b must get the Minister ' s approval.

(6) In terms of the price adjustment process cannot be completed within 90 (90) days of work. In a verse (4), then PT PLN (Persero) must report a reason for the uncut of the deal to the General General of EBTKE.

(7) Following the signing of the PJBL as referred to in paragraph (3) letter b, the provisions apply:

a. against the uninitiated body of the PLTA physical development is required to achieve the financial close fulfillment of (financial close) and begin the slowest nuclear power plant development activities in the term 6 (six) months since signing PJBL;

b. against the entity that has not been able to complete the physical development of the PLTA is required to begin continuing the physical development of the PLTA within the slowest term 3 (three) months since the signing of the PJBL;
