ABOUT

FOUNDING GUIDELINES, CHANGES, AND CLOSURES

PRIMARY AND SECONDARY EDUCATION UNIT

WITH THE GRACE OF GOD ALMIGHTY

MINISTER OF EDUCATION AND CULTURE OF THE REPUBLIC OF INDONESIA,

DRAWS: that in order to carry out the provisions of Article 182 paragraph (11), and to provide further arrangements regarding the terms of the formal education unit terms as referred to in Section 184 of the paragraph (1), paragraph (2), and paragraph (3) of the Regulation Government Number 66 of 2010 on the Change of Government Regulation No. 17 Year 2010 on Management and Hosting Education, needs to establish the Minister of Education and Culture Regulation on the Standing Guidelines, Changes, and Closing of Basic and Medium Education Units;

Given: 1. Law No. 20 of 2003 on National Education System (Indonesian Republic of Indonesia Year 2003 Number 78, Additional Gazette Republic of Indonesia No. 4301);

Law No. 32 of the Year 2004 on Local Government (Indonesian Republic Year 2004 Number 125, Additional Gazette Republic of Indonesia Number 4437) as amended last several times with Act No. 12 2008 (sheet Of State Of The Republic Of Indonesia In 2008 Number 59, Additional Gazette Of The Republic Of Indonesia Number 4844);

DECIDED:

SET: THE REGULATION OF THE MINISTER OF EDUCATION AND CULTURE ON THE GUIDING GUIDELINES, CHANGES, AND THE CLOSING OF THE BASIC AND MIDDLE EDUCATION UNIT.

BAB I

provisions of UMUM

Article 1

In Regulation of this Minister referred to:

1. The government is the central government.

2. The local government is the provincial government, the county government, or the city government.

3. The head of the provincial service is the head of service that handles the field of education in the province.

4. The head of the county/city service is the head of service that handles the field of education in the district/city.

5. The governing body is the foundation, sorority, and other forms of law that apply for the application of the establishment and the change in the education unit organized by the community.

6. The Ministry is the ministry that organizes government affairs in the field of Education.

Article 2

(1) The establishment and changes in the primary and secondary education education units can be performed by:

a. Government;

b. local government; or

c. society.

(2) The closure of the primary and secondary education education unit can be performed by:

a. Government; or

b. local government.

Article 3

(1) The establishment of the education unit is the opening of a new education unit.

(2) The change in education unit is:

a. change of name and/or form of the name and/or form of a particular unit of education becomes the name and/or other form of education unit;

b. merger of 2 (two) or more units of education into 1 (one) new education units;

c. The breakdown of 1 (one) education unit becomes 2 (two) education units or more; or

d. change of education unit organized by the public to be hosted by the Government or local government.

(3) The closure of the education unit is the revocation of the establishment of the education unit as it is not eligible in accordance with the laws.

BAB II

THE REQUIREMENTS OF THE EDUCATION UNIT

Section 4

(1) The establishment requirements of the education unit include:

a. the results of the feasibility study;

b. content content;

c. quantity and qualification of educators and education;

d. means and educational infrastructure;

e. education financing;

f. evaluation and certification system; and

g. management and educational processes.

(2) In addition to the requirements as referred to in paragraph (1), the establishment of an educational unit must attach:

a. the results of the feasibility study on the prospect of establishing a formal educational unit of spatial, geographical, and ecological terms;

b. the results of a feasibility study on the prospect of establishing a formal education unit in terms of listing prospects, finance, social, and cultural prospects;

c. data on the balance between the number of formal education units with school-age residents in the region That's;

d. data regarding the proposed educational unit distance between a similar formal education unit cluster;

e. data on the capacity of the display power and the scope of the range of the formal education unit of the same type;

f. data on estimated financing for the survival of the least for one (one) academic year next; and

g. data on the status of land ownership and/or building of an educational unit must be proven by a valid document of ownership in accordance with the provisions of the laws on behalf of the Government, local government, or the organizer ' s body;

(3) The establishment requirements of the education unit as referred to in paragraph (1) should at least meet the Minimal Service Standards.

Article 5

Special Establishment of the Vocational High School (SMK), in addition to the requirements as referred to in Article 4, must meet:

a. the availability of the means and amenity of the practices that conform to its faculty;

b. the presence of region resources that require certain vocational skills;

c. presence of a working field potential;

d. the mapping of the same type of education unit in the region; and

e. There is community support and the industry world as evidenced by the written documents of the public and the business/industry.

Section 6

The establishment of SMK on certain areas of expertise outside of the Ministry of Education and Culture in addition to meeting the requirements as referred to in Article 5 also must meet the requirements of the ministry/agency specified The non-ministry government organizes SMK.

Article 7

(1) The establishment of a primary and secondary education education unit organized by the public as referred to in Article 2 of the paragraph (1) the letter c is performed with first to form the governing body laws.

(2) The governing body as referred to in paragraph (1) is a non-profit in accordance with the provisions of the laws.

Article 8

(1) The requirement of the educational unit's establishment as referred to in Article 4 of the paragraph (1) is poured in the master plan of the development of the education unit (RIPS);

(2) RIPS as referred to in paragraph (1) is the guideline the basic development of the education unit for the shortest term of 5 (five) years.

(3) RIPS as referred to in paragraph (1) as follows:

a. vision and mission;

b. curriculum;

c. educated participant;

d. educators and education;

e. means and infrastructure;

f. funding;

g. organization;

h. education unit management; and

i. role as well as the community.

BAB III

TATEVENT

GRANTING OF ESTABLISHMENT EDUCATION UNIT

Article 9

(1) The founding permit for elementary, junior high school, high school, and SMK is given by the bupati/mayor.

(2) SD, junior high school, high school, and SMK development permits to be a unit and/or local excellence-based education program, provided by the bupati/mayor.

(3) the establishment of SDLB, SMPLB, SMALB, and SMKLB is granted by the governor.

(4) The Indonesian school's establishment permit abroad is granted by the Minister.

(5) The Sponsorship Permit and Education Management by the Institute Foreign Education with the Education Institute in Indonesia is granted by the Minister.

(6) Special Service Education permit granted by bupati/mayor.

Article 10

(1) Tata method of granting SD, junior high school, high school, and SMK clearance is organized by the county/city government as follows.

a. County/city education services apply for the permission to establish a unit of education to the regent/mayor by attaching the results of the feasibility study and data as referred to in Section 4 of the paragraph (2);

b. The regent/mayor or official appointed by the regent/mayor publishes the decision of the unit of education if the requirements as referred to in Article 4 are fulfilled; and

c. the establishment permit as referred to in letter b applies to 1 (one) educational units at 1 (one) location.

(2) The terms of the SDLB, SMPLB, SMALB, and SMKLB permissions are organized by the provincial government as follows.

a. The provincial education service applied for the application of the establishment of an education unit to the governor by attaching the results of the feasibility study and data as referred to in Article 4 of the paragraph (2);

b. A designated governor or official, publishes the decision of establishing a unit of education if the requirements as referred to in Article 4 are fulfilled; and

c. the establishment permit as referred to in the letter b applies to 1 (one) unit. education at 1 (one) location.

(3) The order of SD, junior, high school, high school, and SMK permissions is organized by the community as follows.

a. The host agency applied for the application of the establishment of an education unit to the regent/mayor through the county/city education service by attaching the results of the feasibility study and data as referred to in Article 4 of the paragraph (2);

b. The head of the district education/city service assigned to Team Assessor to examine the establishment of an educational unit;

c. The assessor team as referred to in the letter b is a team formed by the head of the county service/kota;

d. the head of the county/city service is the slowest 3 (three) months after receiving the proposal for the establishment of the unit

education as referred to in item a, publishes a decision letter about the establishment of an educational unit or notification of the establishment of an education unit; and

e. Establishment permissions as specified in the letter d apply to 1 (one) education unit at 1 (one) location.

(4) Tata method permissions SDLB, SMPLB, SMALB, and SMKLB are organized by the community as follows.

a. The organizers applied for the application of the establishment of the education unit to the governor through the provincial education service by attaching the results of the feasibility study and data as referred to in Article 4 of the paragraph (2);

b. The head of the provincial education service assigned to the Assessor Team to examine the establishment of an educational unit;

c. The Assessor team as referred to in paragraph (2) the letter b is a team formed by the provincial service chief;

d. the head of the propinsion service no later than three months after receiving the proposal for the establishment of an education unit as referred to in a grain, issuing a decree on the permission of the establishment of an education unit or notification of the establishment of an educational unit; and

e. the establishment permission as referred to in the letter d applies to 1 (one) education unit at 1 (one) location.

Section 11

BAB IV

NAMING THE EDUCATION UNIT

Article 12

BAB V

CHANGES IN EDUCATION UNIT

Article 13

Section 14

(3) Any additional additions/changes to the skills program as referred to in paragraph (1) and paragraph (2) accompanied by a proposal.

BAB VI

CLOSING EDUCATION UNIT

Article 15

(1) The closure of the education unit is done if:

a. the education unit has not met the establishment requirements of the education unit; and/or

b. education unit has not organized learning activities.

(2) The closure of the educational unit organized by the local government is carried out by the governor or regent/mayor based on the proposal of head of the province or head. The county/city service corresponds to the type and the type of education that is its authority.

(3) The closure of the education unit organized by the public is set by the head of the provincial service or the head of the county/city service in accordance with the The kind and the kind of education that's going to be his authority over the body. the organizer of the unit of education and/or for the evaluation results by the team formed by the head of service.

(4) The closure of the education unit as referred to in paragraph (1) and paragraph (2) followed with:

a. Conversion/transfer of students to other educational units that are the same and the same type;

b. the submission of state-owned assets and other documents managed by the educational unit organized by the local government to the head of the provincial service or the head of the county/city service in accordance with the type and the type of education that it is Its authority;

c. The submission of assets belonging to the education unit organized by the public is governed by the governing body of the unit of education; and

d. the submission of the archive belongs to the educational unit to the local archive manager.

BAB VII

REPORT

Article 16

BAB VIII

TRANSITIONAL provisions

Article 17

At the time of the enactment of this Minister's Regulation, for the education unit who has stood but the status of his land holdings has not belonged to the Government the local government, or the host body is given a timeout in order to qualify the ownership of the land on behalf of the organizer in the slowest term of 10 (ten) years.

Article 18 of the establishment which has been accepted by the service The provincial/city education and provincial education services are under its jurisdiction before the Minister's Ordinance is in effect, processed by the Decree of the Minister of National Education No. 060 /U/2002 on the School of Establishment Guidelines.

BAB IX

CONDITIONS CLOSING

Article 19

With the enactment of this Minister Regulation, National Education Minister's decision No. 060 /U/2002 on the School's Founding Guidelines, revoked and stated did not apply.

Article 20

The rules of the Minister are beginning to apply to the date of the promulgations.
