THE CHANGE OF PUBLIC COLLEGE BECOMES

THE LEGAL PUBLIC COLLEGE

WITH THE GRACE OF GOD ALMIGHTY

MINISTER OF EDUCATION AND CULTURE OF THE REPUBLIC OF INDONESIA,

DRAWS: A. that to make further arrangements regarding the implementation of the autonomy of the college through the public college of the law, and carry out the provisions of Article 27 paragraph (6) of the Government Regulation No. 4 Year 2014 regarding the Governing Higher Education and College Management, needs to regulate the process of changing the country ' s colleges into law-body public colleges;

b. that based on the consideration as referred to in the letter a, it needs to establish the Minister of Education and Culture on the Change of the College of State into the State College of the Law;

Given: 1. Law Number 12 Year 2012 on Higher Education (State Gazette Indonesia Year 2012 Number 158, Additional Gazette Republic of Indonesia Number 5336);

2. Government Regulation Of The Republic Of Indonesia Number 58 Of 2013 On The Form And Mechanism Of Funding The Public College Funding Law (sheet Of State Of The Republic Of Indonesia In 2013 Number 142, Additional Sheet Of State Republic Indonesia Number 5438);

3. Government Regulation No. 4 of 2014 on the Hosting of Higher Education and Management Of Colleges (sheet Of State Of The Republic Of Indonesia In 2014 Number 16, Additional Gazette Of The Republic Of Indonesia Number 5500);

4. The Presidential Decree No. 47 of 2009 on the Establishment and Organization of the Ministry of State as amended last by the Presidential Regulation No. 13 of 2014 on the Fifth Amendment to the Regulation of President No. 47 of the Year 2009 on the Establishment and Organization of the Ministry of State;

5. Presidential Decree No. 24 of 2010 on Occupation, Duty, and Functions of the Ministry of State as well as Susunan Organization, Duty, and Functions of the Ministry of State as it has been several times amended last with the Presidential Regulation No. 14 2014 on the Fifth Amendment of Presidential Regulation No. 24 of 2010 on Occupation, Duty, and Functions of the Ministry of State as well as the Organizational Functions, Duty, and Functions of the Ministry of State;

6. President's decision No. 84 /P of the year 2009 regarding the United Indonesia Cabinet II as amended last by the Decree of the President of the Republic of Indonesia No. 54 /P of the Year 2014;

DECIDED:

Establish: MINISTER REGULATION EDUCATION AND CULTURE ABOUT THE CHANGE OF THE PUBLIC COLLEGE INTO A PUBLIC COLLEGE OF LEGAL ENTITIES.

BAB I

provisions of UMUM

Article 1

In this Ministerial Regulation referred to by:

1. The State College, which is next abbreviated to PTN, is a College established and/or organized by the Government.

2. The State College of Law which is next abbreviated as PTN is a State College established by the Government, which is a subject of autonomous law.

3. Evaluation of PTN Performance is a systemic effort to assemble, compose, cultivate, and assess data as well as reliable and sahih information about PTN ' s ability to manage the college autonyously.

4. The PTN self-evaluation is the assessment performed by the PTN itself against all elements within the organization and governance as well as the performance of the PTN.

5. The minimum standard of PTN financial viability is the flow of funds and the ability to excavate the variety of funding sources that can be provided for the holding of the legal entity.

6. The Long-Term Development Plan is a plan for the development of a legal entity for the term of 15 (fifteen) to 25 (twenty-five) years.

7. The PTN transition plan is a plan on stage, target, step, and schedule to the management of PTN as a legal entity.

8. The statute is the basic rules of the Management of Colleges which are used as the cornerstone of drafting regulations and operational procedures in the College.

9. An independent team is a team formed by the Minister to evaluate the performance of PTN whose members are not derived from the evaluated PTN.

10.The Ministry is a Government device that undergoes government affairs in the field of education.

11.Minister is the Minister who organizes Government affairs in the field of education.

12.Director General is the Director General of Higher Education.

BAB II

REQUIREMENTS

Section 2

(1) PTN Requirements being PTN the legal entity includes the level and degree of capabilities of PTN for:

a. organizes a quality College Tridharma;

b. manage PTN organizations based on good governance principles;

c. meet the minimum financial eligibility standards;

d. running social responsibility; and

e. play a role in the economic development.

(2) The quality referred to in paragraph (1) of the letter a is assessed from:

a. Accredited status and accredited ranking are superior, both colleges and 80% of the program of the study were organized;

b. relevance between vision, mission, and purpose with Higher Education Standards consisting of the National Standards of Higher Education and Higher Education Standards set by the College;

c. results of international publications and/or rights Intellectual property;

d. Academic achievement of students to acquire first place in national and international level competitions;

e. PTN achievements in participating in Government and local government activities; and

f. PTN achievements in participating in the business and industry activities.

(3) Good governance principles as referred to in paragraph (1) letter b are assessed from:

a. accountability of PTN management;

b. transparency, effectiveness, and efficiency in PTN management;

c. non-profit in PTN management;

d. obedience to the laws in the management of PTN;

e. periodization, accuracy, and compliance of time in the drafting and delivery of PTN academic and non-academic reports.

(4) The financial eligibility as referred to in paragraph (1) the letter c is assessed from:

a. Financial and asset management in accordance with the laws of the laws;

b. Financial statements gain reasonable opinion with no exceptions for two consecutive years; and

c. The ability to raise funds aside from student education fees.

(5) The social responsibility as referred to in paragraph (1) the d letter is assessed from:

a. proportion of students who have high academic potential but are less able economically;

b. the proportion of students coming from the leading, outermost, and trailing regions; and

c. College involvement in service to the community.

(6) A role in the economic development as referred to the paragraph (1) letter e rated from:

a. role of institutions in the development of small and medium enterprises;

b. the role of institutions in the resolution of problems in the industriable world; and

c. the institutional role in cultiving the entrepreneurial soul.

Article 3

To find out the feasibility of PTN to be a legal entity, PTN must compose a document:

A. PTN Self evaluation;

b. PTN Long Term Development Plan of the legal entity;

c. Bill of Statute PTN legal entity;

d. Transition plan of the legal entity.

Article 4

The self-evaluation of the PTN as referred to in Article 3 of the very few letters contains at least:

a. PTN background, including description of self-evaluation and stakeholder conversion process;

b. PTN development history, including analysis of the realization of the last Long Term Development Plan and/or Strategic Plan;

c. External environmental analysis, especially the description of the challenges and the opportunities that affect operation and development of PTN legal entities;

d. analysis of the management system and organizational structure at PTN;

e. analysis of the performance and management of the College Tridharma at PTN;

f. analysis of the availability and management of resources at PTN; and

g. analyses of the contribution of the college in the exercise of social responsibility and role in the economic development.

Article 5

The PTN Long Term Development Plan as referred to in Article 3 of the least bit of the letter b contains the least:

a. The rational, rational background and context of PTN changes to the legal entity based on the results of the analysis in the self-evaluation of PTN as referred to in Section 4;

b. Mandate, Vision, Mission, and purpose as PTN legal entity;

c. Internal Mutu Warranty System as a statutory body PTN;

d. Hosting and development of academic fields that include the College Tridharma on PTN legal entities, among others:

1. the field of education, at least including:

a) direction, policy, and educational pecurage;

b) the freedom of the mimbar;

c) the opening, change, and closing of the Study Program;

d) the Study Program curriculum; and

e) the process of learning;

2. the field of research and devotion to the most communities including:

a) direction, policy, and road map of research and devotion to the community;

b) the autonomy of scholarship; and

c) staging and development the fields of research and devotion to the community;

e. Hosting and development of non-academic fields on PTN legal entities, among others:

1. The organization field and the legal entity's organization;

2. The management and development of PTN resource management consisting of:

a) human resources among others:

1) the acceptance of human resources;

2) the assignment, coaching, and development of the human resources; and

3) the working target and career of human resources.

b) resources and infrastructure among others:

1) ownership of means and infrastructure;

2) the use of means and infrastructure;

3) utilization of means and infrastructure; and

4) maintenance of means and infrastructure.

c) financial resources among others:

1) short-term budgets and long term;

2) the rate of any type of education service;

3) acceptance, shopper, and money management;

4) short-term and long-term investments;

5) business unit development;

6) agreement with party third in the scope of the College Tridharma;

7) the debt and short-term debt and long term; and

8) financial logging and reporting systems.

d) information resources among others:

1) the academic and non-academic field information systems;

2) information means and infrastructure; and

3) the management of the information resource information.

f. The implementation and development of the student field of PTN legal entity, among others:

1. Intramricular and extracurricular student activities activities;

2. Student organization; and

3. Talent coaching and student interest.

g. Legal body PTN accountability system;

h. Risk analysis of PTN changes to PTN legal entity;

i. Long Term Development Plan and Program Performance Indicators.

Section 6

(1) Legal body PTN statutes are supplemented by the academic manuscript of the statutes compiled under the body of the body's PTN Long Term Development Plan the law as defined in Article 5 and the provisions of the laws.

(2) The design of PTN statutes of legal entities as referred to in Article 3 of the most small c letters contains:

a. Elements in the regulatory PTN organization of the law consisting of:

3. Superintendent and quality assurance;

4. Academic support or learning sources; and

5. Executor or layout

b. The substance of the statute of PTN statutes derived from PTN is at least composed of:

1. General Terms;

2. Identity;

3. "College Tridharma";

4. System management and accountability framework;

5. Internal quality licensing system;

6. Forms and rules of regulatory pricing;

7. Funding and wealth;

8. Transition provisions; and

9. Closing provisions.

(3) The substance and sequence of the substance design substance as referred to in paragraph (1) the letter b may be adjusted to the requirements of the legal entity.

Article 7

(1) the PTN Seizure Plan of the legal entity as It is referred to in Article 3 of the letter d, containing the program 5 (five) of the legal entity.

a. Implementation of the statutory PTN Long Term Development Plan as referred to in Article 5 of the letter c up to the letter g for a term of 5 (five) years; and

b. The management of the change from PTN to the legal entity, which includes staging, objectives, steps, and schedule of implementation of the statutory PTN transition body.

(3) The PerTransitional Plan PTN of the legal entity must be supplemented by the cost required for the implementation of PTN transition of the legal entity.

Article 8

Evaluation of PTN performance that will be PTN the legal entity is a process of assessment against:

a. the level of allotedness between documents as referred to in Article 3 of the letter a up to the letter d;

b. PTN levels of ability to become PTN legal entities by comparing between PTN capabilities reflected self-evaluation results as referred to in Section 4, with PTN ability to implement PTN Long-Term Development Plan the legal entity, the Draft Statute, and the Plan of Transitional PTN of the legal entity as referred to in Article 3 of the letter b, the letter c, and the letter d.

BAB III

PROCEDURE

Article 9

(1) Prakarsa to convert PTN to PTN legal entity comes from the Minister.

(2) The Prakarsa as referred to in paragraph (1) is delivered to PTN.

(3) In terms of PTN agreeing to change PTN to PTN of legal entity, the PTN leader compiled the proposal for the change of PTN to PTN legal entity.

(4) PTN changes in PTN to PTN the legal entity must be equipped with the document as contemplated in Article 3.

Article 10

(1) The Minister forms and sets an independent team to conduct a performance evaluation of PTN that will become PTN legal entity as referred to in Article 8.

(2) Evaluation of PTN performance as referred to on paragraph (1) prioriting qualitative assessment of experts (qualitative expert judgement).

(3) An independent team member as referred to in paragraph (1) has a competency of the field:

a. higher education;

b. PTN financial management of the legal entity;

c. governance PTN governance entity;

d. The laws in the field of Higher Education; and

e. State-owned goods management.

(4) Independent team members as referred to in paragraph (1) at least 5 (five) people.

(5) The Director General proposes an independent team candidate to be appointed by the Minister.

(6) the independent team is responsible to the Minister through the Director General.

Article 11

(1) After considering reports of the results of an independent PTN performance evaluation of the independent team as referred to in Article 8, the Minister may approve the proposed PTN to be a legal entity.

(2) Based on the Minister ' s approval regarding PTN that becomes PTN the body of the law as referred to in paragraph (1), the Director General prepares the draft Government regulations regarding the formation of a statutory body of PTN.

(3) The Minister delivered the draft Government Regulation as referred to paragraph (1) to the President.

BAB IV

provisions CLOSING

Article 12

The rules of the Minister are in effect on the date of the promulcity.
