Article 7

(2) In terms of the PTS that will be changed to PTN using the Provincial Government lands and/or the District/City Government, then the land must be submitted to the Government.

Article 8

Article 9

(1) The founding procedure of PTN derived from the PTS as referred to in Article 4 of the letter b as follows:

a. The Organizing Agency requested the recommendation of the Higher Education Service Institution in the new PTN region to be established.

b. The Governing Body is compiling a document as defined in Section 6 of the paragraph (2);

c. the document as referred to in the letter b is delivered to the Minister for approval by a gust of the Director General, by attaching:

1. the deed of establishment of the Organizing Board which has been authorized by the ministry in charge of the law along with all changes; and

2. an asset assessment by a registered public accountant;

d. The Director General conducted the assessment and verification of the founding of PTN;

e. The Director General addresses the founding of PTN to the Minister with a busan to the Secretary General;

f. The Secretary General prepared the establishment of the establishment of PTN to be delivered to the Minister;

g. The Minister conveys the proposal of establishing PTN to the minister in charge of the field of the country's apparatus to obtain approval;

h. The Minister established the establishment, organization and work of high school, polytechnics, and academies based on the approval of the minister in charge of the country's apparatus of the apparatus;

i. The minister in charge of the state of the state apparatus proposed the establishment of a university-shaped PTN and an institute to the President;

(2) Following the designation as referred to in paragraph (1) the new letter h and j PTN can host higher education.

The Second Section

The Establishment of the Private College

Article 10

(1) The designation of PTS as referred to in Section 3 of the letter b is the creation of a college hosted by the Organizing Board.

(2) The Establishment of the PTS as referred to in paragraph (1) can be done through cooperation with foreign education institutions in accordance with the provisions of the laws.

Article 11

(1) The establishment of the PTS as referred to in Article 3 of the letter b must meet the National Standards of Higher Education, i.e. qualified to meet the minimum accreditation ranking.

(2) The fulfilment of the National Standard Higher education as referred to in paragraph (1) must be contained in the founding document of the PTS consisting of:

a. feas draft statutes;

c. design of organizational and governance arrangements;

d. Strategic plan design;

e. design of the academic program;

f. the design of the quality assurance system; and

g. The recommendation of the provincial and county/municipal governments.

(3) In terms of the fulfilment of the Prasarana Standard of land in the National Standard of Higher Education as referred to in paragraph (1), the land must be:

a. have the status of the Use Rights as evidenced by the Use Rights Sertiallure on behalf of the Government used for such PTN;

b. in the case of the estate as referred to in the letter a provided by the Provincial Government and/or County/City with the status of the Right To Use, the land must be adorned with and

d. The design of the new PTS quality system.

(3) The change of the PTS as referred to in paragraph (1), under the act of the Establishment of the Organizing Board with the Decree of the authorized official on the status of the governing body's legal entity, the statute, strategic plan, and the old PTS quality licensing system.

(4) In terms of the change of certain PTS names being the name of another PTS as referred to in Article 17 of the letter a, the Organizing Agency conveits the reason and consideration of changes to the PTS name as a substitute for the feasibility study.

(5) The PTS change document format as referred to in paragraph (2) the letter a up to the letter d is further governed by the Director General.

Article 19

Procedure of the PTS changes as referred to in Section 13 of the letter b as follows:

a. The Organizing Agency requested the recommendation of the Higher Education Service Institution in the PTS region will be changed.

b. The Organizing BadanOrganizer:

1. PTS change feasibility study;

2. New PTS Statute design;

3. the new PTS strategic plan design; and

4. New PTS quality control systems design;

c. The PTS change document as referred to in the letter a number 1 to the number 4 is delivered to the Director General to obtain approval;

d. The Director General does the assessment and verification of the PTS change proposal;

e. The Director General gives consent to the design of the PTS change as referred to in the letter a number 1 to the number 4;

f. The Minister specified the PTS change permit;

g. After the permission of the PTS change is set by the Minister as referred to in the letters, the new PTS may be at higher education.

BAB IV

DISSOLUTION OR REVOCATION OF THE COLLEGE PERMIT

Part Part

General

Article 20

(1) The Dissolution Of The PTN is performed by the Ministry.

(2) The revocation of the PTS permit is carried out by the Ministry.

The Second Section

The dissolution of the College of the Country

section 21

(1) The dissolution of the PTS as referred to in Section 20 of the paragraph (1) performed due to Government policy, change Laws, and/or have a violation of the laws of the laws.

(2) The ministry is obliged to provide an explanation to the public on the grounds of the dissolution of the PTN as referred to in paragraph (1).

(3) The Ministry must resolve the academic and non-academic issues arising as a result of the dissolution of the slowest PTN 1 (one) year since the dissolution decision is set.

Article 22

(1) The procedure of the dissolution of PTN as referred to in Article 20 paragraph (1) as follows:

a. The Directorate General requested the recommendation of the Higher Education Service Institution in the PTN region to be dissolved.

b. The Directorate General of Higher Education conducted the evaluation of PTN performance and reported to the Minister;

c. The Director General provides a written warning to the PTN leader at most 3 (three) times each in a 6 (six) month lapse;

d. The Director General conveyed the dissolution of PTN to the Minister with a gust to the Secretary General;

e. The Minister conveyed the dissolution of the university-shaped PTN and the institute to the minister in charge of the field of the country's apparatus to obtain approval;

f. The president established the dissolution of the university-shaped PTN and the institute;

g. The minister conveys the dissolution of PTN of high school, polytechnic, and academy to the minister in charge of the country's apparatus of the apparatus to obtain approval;

h. The Minister established the dissolution of the high school-shaped PTN, the polytechnic, and the academy.

(2) Mutatively mutandis the dissolution procedure of PTKL must meet the provisions as referred to in verse (1).

Third section

The revocation of private college permissions

section 23

(1) The revocation of the PTSas referred to in Article 20 of the paragraph (2) is performed for the reason:

a. PTS no longer meets the establishment requirements of the PTS as referred to in Article 11;

b. The PTS management violates the rules of the invite-invitation rules;

c. The PTS is closed by the Organizing Board; or

d. Unsolvable dispute occurred:

1. The internal stakeholder of the Organizer Agency;

2. College internal stakeholders; and/or

3. between the internal stakeholders of the Organizing Agency and the internal stakeholders of the college.

(2) The Organizer of the PTS revoked his permit for reasons as intended on the paragraph (1) must resolve the issue academic and non-academic arising as a result of the revocable revocation of such permits 1 (one) year after the revocation of the PTS permit is specified.

Section 24

(1) The Procedure of the PTS permit revocation as referred to in Article 20 verse (2) as follows:

a. The Higher Education Service Institution conducts an evaluation of the PTS which will be revoked by its permit and report to the Director General;

b. The Director General provides a written warning to the PTS leader at most 3 (three) times each in a 6 (six) month lapse;

c. The Director General addresses the revocation of the PTS permit to the Minister with a gust to the Secretary General;

d. The Minister established the revocation of the PTS permit;

e. The revocation of the PTS license is delivered to the Organizing Board.

(2) After receiving the assignment of the revocation of the PTS license as referred to in paragraph (1) letter e, the Organizing Board must close the PTS and announce to society through national and regional mass media.

(3) The Organizing Board is mandatory for the completion of academic and non-academic issues arising from the closure of such PTS in the most recent time of 1 (one) year since the revocation of PTS permissions are set.

BAB IV

OPENING, CHANGE, AND CLOSURE PROGRAM OF STUDY

Article 25

(1) The Opening of the Study Program is the addition of a new Study Program on PTN and PTS that have already had PTN and PTS founding permits.

(2) The Study Program change is the replacement of the name inside

Certain field/discipline groups/disciplines, and/or the replacement of the curriculum of study programs on PTN and PTS that have had PTN and PTS founding permits.

(3) The Closing Study Program is a reduction in the Study Program that has been present on PTN and PTS that have already had a college establishment permit.

(4) n the form of a particular Host Body into another Organizing Body form.

Article 18

(1) Changes of the PTS as referred to in Article 13 of the letter b must meet the National Standards of Higher Education, i.e. qualify for satisfy the minimum accreditation rating.

(2) The fulfilment of the National Standard of Higher Education as referred to in paragraph (1) must be contained in the PTS change document consisting of:

a. PTS change feasibility study;

b. new PTS statutes design;

c. design of the new PTS strategic plan; n PTN and PTS results in changes in the form of PTN and PTS, then:

1. for PTN applies provisions regarding PTN changes as referred to in Section 16; and

2. for PTS applies provisions regarding the PTS changes as referred to in Article 19.

h. After the Minister's decision on the closure of the Study Program and/or changes in the form of PTN and PTS was delivered to the leaders of PTN and PTS, then the leaders of PTN and PTS were obliged to stop the implementation of the Study Program.

i. After the leaders of the PTN and PTS stopped the implementation of the Study Program, the PTN and PTS leaders were required to perform

completion of the teaching problem, education workforce, and students included:

1. transfer of a lecturer who is the status of an unrequired civil servant to another Study Program relevant or a return to the Minister;

2. The fulfilment of the teaching and education rights of the non-civil civil servants based on the employment agreement; and

3. transfer of students to PTN and other PTS.

Article 32

The authority opens, changes, and closes the Study Program as referred to in Article 25 to Section 31 of the State College of Law is set by the College State height of the law.

BAB V

TRANSITIONAL provisions

Article 33

In terms of the Institution of Higher Education Service has not been formed, a recommendation by the Higher Education Service Institution as referred to in the Ministerial Regulation this, exercised by the Coordination of Private Colleges.

BAB VI

Article 34

Article 28

Section 29

The opening procedure of the Study Program as referred to in Article 25 of the paragraph (1):

a. The leaders of PTN and PTS asked for a recommendation from the Higher Education Service Institution in the PTN and PTS areas that would open the new Study Program.

b. The leader of the PTN and PTS submitted the opening proposal of the Study Program to the Director General;

c. The General Directorate conducted an evaluation of the opening proposals of the Study Program with the help of a profession association and/or peer group of fields with the Study Program to be opened;

d. If the results of the evaluation as referred to in the letter c state that the proposed Study Program is feasible to open, then the Director General establishes the opening of the Study Program;

e. If the opening of the Study Program on PTN and PTS results in changes in the form of the PTN and the PTS, then:

1. for PTN applies provisions regarding the changes to the PTN as referred to in Section 18; and

2. for PTS applies terms regarding the PTS changes as referred to in Section 19.

Section 30

The Procedure of the Study Program as referred to in Section 25 of the paragraph (2):

a. The leaders of PTN and PTS asked for a recommendation from the Higher Education Service Institution in the PTN and PTS regions that would change the Study Program.

b. The leader of the PTN and PTS submitted a proposal for the Study of the Study Program to the Director General;

c. The Directorate General conducts an evaluation of the Study Program change proposal with the help of a professional association and/or peer group of fields with the Study Program to be changed;

d. If the evaluation results are referred to in the letter b stating that the proposed Study Program is feasible to be changed, then the Director General sets the Study Program changes;

e. If the changes in the Study Program on PTN and PTS results in changes in the form of PTN and PTS, then:

1. for PTN applies provisions regarding the college changes as referred to in Article 12; and

2. for PTS applies terms regarding the changes to the high school as referred to in Section 14.

Section 31

Procedure of the Study Program as referred to in Section 25 of the paragraph (3):

a. The closing proposal of the Study Program may be derived from:

1. The leader of the PTN after receiving consideration of the PTN senate;

2. PTS leaders after receiving consideration of the PTS Senate and PTS Organizing Legal Agency approval;

3. Director General based on the results of the implementation evaluation

The Study Program is.

b. In the event of closing the Study Program comes from the leaders of PTN and PTS, the leaders of the PTN and PTS request recommendations from the Higher Education Service Institution in the PTN and PTS regions that will close the Study Program.

c. The Director General performs the evaluation of the closure of the Study Program with the help of a professional association and/or peer group of fields with the Study Program to be closed.

d. Based on the results of the evaluation as referred to in the letter c, the Director General refuses or approves the closing proposal of the Study Program.

e. If the evaluation results in the letter c are proven that PTN and PTS are in violation as referred to in Article 28 of the letter a and letter b, then:

1. For PTN, the Director General provides a written warning to the PTN leader at most 3 (three) times respectively with the longest interval of 6 (six) months, in order for the PTN to immediately cease the breach;

2. for PTS, the Director General and/or Higher Education Service Institution in the region of the Organizing Law Board provides a written warning to the PTS leaders of most 3 (three) times in order to each other with a lapse. At least six (six) months, that the PTS would immediately stop the breach.

f. If within 30 days of the third written warning received by the leaders of the PTN and PTS, a proven violation is still in place, then the Director General on behalf of the Minister sets out the closure of the Study Program.
