ABOUT

CONTROL OF GRATIFICATION IN THE MINISTRY OF FORESTRY ENVIRONMENT

WITH THE GRACE OF THE ALMIGHTY GOD

MINISTER FORESTRY REPUBLIC OF INDONESIA,

Counterpart: a. that in order to realize the hosting of a clean, free state of corruption, collusion, and nepostisme needs efforts to foster the integrity of the State Employees and State Organisers in the Ministry of Forestry environment;

DECIDED:

SET: A FORESTRY MINISTER ' S REGULATION ON THE CONTROL OF GRATIFICATION IN MINISTRY OF FORESTRY ENVIRONMENT.

BAB I

provisions of UMUM

Article 1

In Regulation of this Minister referred to:

1. Civil servants as referred to in Article 1 of number 2 of the Law No. 31 Year 1999 on the Eradication of Criminal Corruption as amended by Invite-Invite Number 20 Year 2001 on Changes to the Invite Number 31 In 1999, the eradication of the Corrupt Criminal Code was included:

a. Civil servants as referred to in the Law on the Workforce;

b. Civil servants as referred to in the Code of Criminal Law;

c. persons who receive salaries or wages from state or local finance;

d. people who receive salaries or wages from a corporation who receive assistance from state or local finance; or

e. people who receive salaries or wages from other corporations who use capital or facilities from the state or society.

2. The organizers of the State as referred to in Article 1 of the Number 1 Act of 1999 on the Clean and Free State of Corruption, Kolusi, and Nepotism are the State Officials who exercise executive functions, legislative, or judicial, and other officials whose functions and duties are related to the country's organizer in accordance with the provisions of the applicable laws.

3. The Ministry of Forestry's Code of Ethics, which is subsequently called the Code of Conduct, is the norms to which each PNS Ministry of Forestry has to comply with its duty to maintain the dignity, honor, image, and credibility of the Ministry of the Ministry of Justice. Forestry.

5. 6. 8. Disaster is an occurrence or event caused by nature such as floods, earthquakes, mountains erupting, or big winds.

9. A disaster is an event or a sad event that befalls a person, who has an influence on a person's physical, psychological, and/or financial condition, such as: death, chronic pain or illness due to an accident.

10. Conflict of Interest is a situation in which a State employee or an Organizer of the State has or is suspected of having a personal interest in any use of the authority that it owns so that it may affect the quality and performance of which It should be.

19. Recipients are any PNS of the Ministry of Forestry and Third Parties for the acceptance of the gratification associated with the implementation of gratification controls.

20. Rejection is any civil servant civil servant of the Ministry of Forestry and Third Parties, which is repudiated by the acceptance of the gratification associated with the implementation of the gratification controls.

21. The giver is the PNS of the Ministry of Forestry or Third Parties which has a working relationship with the Ministry of Forestry, and performs the granting of catification related to the implementation of gratification controls.

22. The requiver is any PNS Ministry of Forestry which conducts the gratification request associated with the implementation of gratification controls.

23. The Gratified Control Unit, subsequently called UPG, is a Managing Unit that performs the gratification control functions in the Forestry Ministry environment.

BAB II

CATEGORY OF GRATIFICATION AND REPORTING OBLIGATIONS

Article 2

(1) Gratification consists of:

a. The gratification deemed a bribe;

b. The gratification is not considered a bribe.

(2) Any receipt of the Gratification Deemed Bribe is mandatory at the KPK.

(3) Any receipt of the Gratification Not considered a bribe but related to the obligatory kedines reported to UPG or other designated units.

(4) The Gratification as referred to paragraph (3) includes the Gratification obtained from:

A. other parties are cinderamata in official activities such as meetings, seminars, workshops, conferences, trainings or other similar activities;

b. (5) Any receipt of Gratification not considered a bribe as long as not in contact with the post and not opposite to the obligation or duty is not required to be reported on the KPK, which includes:

a. Because of the family's relationships, namely, brother/grandmother, father/mother-in-law, husband/wife, son/daughter-in-law, besan, uncle/aunt, sister/sister/sister/sister/sister/sister/sister/sister, cousin, and nephew;

e. direct gift/undrawn, sweepstakes, discount/rabat, vouchers, points rewards, souvenirs, or other applicable General Applicable gifts;

f. a General Applicable dish or meal;

g. Academic or non-academic achievements followed by using their own expenses such as a championship, race or competition;

h. benefit or interest from the placement of funds, investments or ownership of common applicable private shares;

i. Compensation or earnings of a profession beyond the care of which is not related to the execution of the duties and functions of the Gratification recipient and has obtained a written authorization from a direct supervisor or other authorized party.

Article 3

(1) The Gratification that is considered a bribe is in association with office and is contrary to the obligations of another:

a. admission of money from the PNS Ministry of Forestry or recency and or third parties in the process of licensing, checking, staffing, procurement of goods or other processes related to the post of receivables;

b. acceptance of gifts of goods, accommodation facilities, of the PNS Ministry of Forestry or recanan is known or exemplary to be given due to the authority related to the position of the recipient;

c. unofficial acceptance in the form of money, the goods, facilities, or accommodation received related to the process of execution of activities related to the PNS Ministry of Forestry and Third Parties;

d. Unofficial acceptance in the form of money, goods, facilities or accommodation received by the officers/officials of the procurement of goods/services from the partnership of goods providers/services related to the procurement of goods/services that will, be and be run;

f. acceptance of tourist travel facilities including trips for worship purposes by the PNS Ministry of Forestry and/or Core Family Members of third parties or partners;

k. The acceptance of a special cut (discount) during the PNS Ministry of Forestry and/or Core Family Members purchases goods from Third Parties or partners;

l. parcel receipts by the PNS Ministry of Forestry and/or Core Family Members of the partnership at a time of religious holidays;

m. acceptance of donations, catering, building, decorating, and make-up of the bride from third party or partner at the time of the civil service Office of the Ministry of Forestry is having a party or a hajatan.

(2) The Gratification is considered a bribe to be received with the condition:

a. unknown process, namely in terms of the PNS Ministry of Forestry and/or Core Family Members did not know the time and location of the reception process as well as unknown identity and address;

b. The rejection caused the disruption of the good name of the Ministry of Forestry, as long as it was not in the form of money and precious letters and did not exceed the limits of the natural or standard acceptance of the receipts, which were considered bribes in the rupiah equivalent of each party.

(3) The rejection or acceptance of the gratification or acceptance of a bribe should be reported to UPG no later than 7 (seven) days of work since the acceptance of the gratification.

(4) The acceptance of the gratification deemed bribes that have been reported to UPG or KPK then the provisions of the offence become not applicable to the PNS The Ministry of Forestry is concerned.

Article 4

(1) Acceptance of Gratification is not considered a bribe, among other things:

a. Commercial or special interest rates applicable to the general public or applicable to all employees under the agreement between the recipient and the recipient;

b. benefits/benefits that are common to the public for the placement of funds or shareholdings personally by the PNS Ministry of Forestry and/or Core Family Members;

g. reception of gifts by the PNS Ministry of Forestry in relation to the improvement of the performance of the good instance given by the Ministry of Forestry and by the stakeholders of the Ministry of Forestry, with agreement and written consent from Ministry of Forestry;

h. Award-giving results from academic and non-academic achievements are obtained outside of a series of kedinasan activities;

i. acceptance of promotional items in an activity/event official provider, due to the launch of a new product;

j. admission of parcels on holidays that are not derived from third parties or associates of goods and services providers that have a working relationship with the Ministry of Forestry;

k. acceptance of sponsorship is not in the form of money in activities organized by the Ministry of Forestry that is not from third parties or partners to the Ministry of Forestry or which would lead to conflicts of interest;

l. the acceptance of the results of teaching outside of the working hours to the other, in accordance with its expertise, throughout the received written permission of the superior.

(2) For admission to the admission category of gratification is not considered a bribe as referred to paragraph 1, can be accepted and enjoyed by the recipient without any obligation of reporting to UPG.

BAB III

MECHANISM REJECTION

Article 5

(1) Rejections are done politely and politely by providing an explanation of the policy and the rules of the gratification to the giver.

BAB IV

AWARDING

Article 6

(1) Giving with the purpose of bribery or gratification which is considered a bribe is prohibited to be performed by any PNS Ministry of Forestry.

(2) Giving with the purpose of bribery or gratification is considered a bribe, including but not limited to:

a. the granting of a PNS or state organizer who is due to his position as a controller or manager of government agency accounts;

b. the granting of a PNS or state organizer who is due to his post to do the deed or not to do the deed in the interests of the Ministry of Forestry;

c. awarding to the PNS or the country ' s organizer who is due to The position of the Ministry of Forestry.

Section 7

Giving to the Third Party may be conducted on the condition of fulfilling the provisions as following:

a. The administration is administered from the Ministry of Forestry to government/corporac/individual agencies.

1. Grants to individuals among others:

a) giving to auditi or a non-civil servant in the form of gifts, facilities and accommodation;

b) the granting of audits of the PNS is a general and granted gratification grant. to any auditi;

c) granting PNSconstitutes a grant of gratification in conjunction as a co-worker not in relation to his post;

d) which included a grant in the framework of promotional activities, sponsorship, donations and other provision of official and general terms in relation a working relationship as a Ministry of Forestry co-worker.

2. Grants to government agencies include:

a) the granting directly to such government agencies;

b) awarding should not be in the form of money or equivalent of money;

c) the recipient of a grant is a representative of the government. the legitimate government is based on the designation of government agencies;

d) awarding is not contrary to the rules of acceptance of the gratification that applies at the government of the recipient government;

e) awarding not for the purpose of bribery/gratification considered a bribe.

3. The above grants include the following activities:

a) the granting of a banquet to the authorized representative of the government in the activities of the socialization of the maximum 1 (one) times in a period of 1 (one) month and the value of the maximum number of meals. The given term for a cumulative amount of one year does not exceed the maximum value of the given value in the equivalent of the rupiah equivalent to each recipient;

b) the granting of accommodation, meals, goods, or money to the vice-instance lawful government in order of meeting activities (rapat/gathering/socialisasi/ w orkshop) which is the agenda of the Ministry of Forestry and implemented by the Ministry of Forestry, which is cumulatively in a one-year term not exceeding the standard of the maximal values in the rupiah equivalence to each recipient;

c) awarding in the form of sponsorship or a donation based on the official proposal of the agency submitting.

d) The grant was implemented to improve the interests of the Ministry of Forestry;

e) The grant has been be broadcast by the Ministry of Forestry;

f) Giving in activities sponsorship and the donation must meet the completeness of the document (the submission proposal of the recipient, proof of the use of the granting, receipt and other necessary documents);

g) Giving is not allowed in the form of a breach Decency and hokum;

h) Giving catification to an inappropriate Third Party as set upon letter a up to the letter e, it is mandatory to report to UPG.

BAB V

REQUEST

Article 8

1. PNS Ministry of Forestry if requested to provide the gratification that is not in accordance with the provision provision, is obliged to do a courtesy and courtesy rejection of such a love by providing an explanation of policy and rules The gratification.

BAB VII

CONTROL GRATIFICATION

Article 9

1. The gratification control of the Ministry of Forestry is conducted by UPG which has the task of carrying out the monitoring and control of the gratification in the Ministry of Forestry environment.

2. To perform the task as referred to in paragraph (1), UPG has a function:

a. receive the gratification reporting of the PNS Ministry of Forestry;

b. conduct the received catification reporting processing;

c. do direct confirmation of the report of the gratification to the recipient, the recipient, the caller or other third party associated with the event of acceptance, grant or request gratification;

d. define or provide recommendations for handling and utilization of gratification;

e. conduct coordination, consultation and correspondence to the Corruption Eradication Commission on behalf of the Ministry of Forestry in the implementation of these regulations;

f. monitoring the follow-up to the utilization of the gratification receipt by the Forestry Ministry as well as by the recipient;

g. request data and information to a particular working unit and or the PNS of the Ministry of Forestry related monitoring of the application of the Gratfication Control Program;

h. provide a follow-up recommendation to the Inspector General in the event of a violation regarding the gratification by the PNS Ministry of Forestry;

i. reported the results of the handling of the gratification reporting to the Minister of Forestry and the Corruption Eradication Commission through the General Inspectorate.

Article 10

BAB VIII

IMPLEMENTATION

Section 11

c. Assign to the Auditor to perform the delivery of the Gratified Control Program to all related parties in the supervision/audit process, which is the auditi and the Independent Assessor Institute to inspect/assess for and on behalf of the Ministry Forestry.

d. Commissioning to the General Bureau, the Bureau of Finance and other functions in the Ministry of Forestry environment that has a working relationship with third parties to perform the delivery of the Gratified Control Program to all related parties in the eye of the chain procurement of goods/services in the Ministry of Forestry environment.

e. Provide clear information to any party related to the provisions contained in the Gratification Control Program.

f. The Inspector General monitors the execution/implementation of this Decision and provides periodic reports, i.e. 6 (six) months to the Minister of Forestry regarding its implementation including reports that arise after the provisions of the This.

BAB IX

REPORTING

Section 12

PNS of the Ministry of Forestry or Third Parties is aware of the violation of the provisions contained in this regulation, in order to report the breach in question the provisions apply in the Ministry of Forestry through UPG.

Article 13

The Ministry of Forestry guarantees that the reporting of the gratification carried out by the Ministry of Forestry and Third Parties will be kept secret.

Article 14

SANCTION

Article 15
