MALINAU, AND BUPATI KAPUAS HULU IN ORDER TO HOST FOREST PROGRAMS AND CHANGES

CLIMATE (FOREST AND CLIMATE CHANGE)

WITH THE GRACE OF THE ALMIGHTY GOD

THE ENVIRONMENT MINISTER AND FORESTRY

THE REPUBLIC OF INDONESIA,

DRAWS: A. that under the Finacing Agreement and Separate Agreement between the Government of the Republic of Indonesia with the Government of the Federal Republic of Germany in 2010 has agreed on the cooperation of the Forest Programme and Climate Change (Forest and Climate) Change) carried out in three counties (Upper Kapuas, Berau, and Malinau);

b. That in order to improve the effectiveness of the Forest and Climate Change program, there are several government affairs in the field of forestry which are charged with the Regent;

c. that as a follow-up Article 39 paragraph (5) of the Government Regulation No. 7 of 2008, the assignment of part of government affairs from the Government to the Regent is set with the Regulation of Ministers;

DECIDED:

STIPULATING: THE REGULATION OF THE MINISTER OF ENVIRONMENT AND FORESTRY ABOUT THE ASSIGNMENT (MEDEBEWIN) PART OF THE 2015 FORESTRY AFFAIRS GOVERNMENT AFFAIRS TO THE BERAU BUPATI, BUPATI MALINAU, AND BUPATI KAPUAS HULU IN ORDER TO HOST FOREST PROGRAMS AND CLIMATE CHANGE (FOREST AND CLIMATE CHANGE ).

BAB I

UNDERSTANDING

PASAL 1

In Regulation of this Minister referred to:

1. The Government (Central), which is then called the Government, is the President of the Republic of Indonesia which holds the power of government of the Republic of Indonesia as referred to in the Basic Law of the Republic of Indonesia in 1945.

BAB II

INTENT AND PURPOSE

Section 2

(1) The intent of hosting the hosting duties is to increase the efficiency and effectiveness of governance, development management, and the general service of the governance affairs of the forestry field.

(2) The purpose of hosting duties is to streamline the execution of tasks and resolve issues, as well as to help the holding of governance, and development of development affairs of government in the field of forestry for the area.

BAB III

HOSTING DUTIES

First Section

The Governing Duties

Article 3

(1) the Minister assigns a portion of government affairs in the field of forestry to the Regent Berau, the regent of Malinau, and the Regent of the Upper Kapuas.

(2) The details of the governance of the forestry assigned to all three regents as referred to in paragraph (1), are listed in the Order of the Regulation of this Minister.

Second section

Implementation of the Host Task

Article 4

BAB IV

BAB V

COACHING AND SUPERVISION

section 6

(1) Technical coaching For the conduct of the governing field governing the field of forestry assigned as referred to in section 3 is exercised by the Secretary-General of the Ministry of Forestry.

(2) The coaching as referred to in paragraph (1) includes the granting of guidelines, facilitation, training, technical guidance, monitoring, and evaluation.

(3) Functional oversight of the exercise of the assigned forestry business as referred to in section 3 and recap (review) of the financial statements of the master's duties, is carried out by the Inspectorate General of the Ministry of Forestry.

(4) The Minister may withdraw the assigned forestry field government affairs, if:

a. The Minister changed the policy; and/or

b. It is possible to exercise the affairs of the government of forestry assigned as referred to in Article 3 not to the norms, standards, procedures, and criteria established by the Minister.

(5) Rewithdrawal of the governance affairs of the forestry field as referred to in paragraph (4), specified with the Minister Rule.

BAB VI

SANCTION

Article 7

(1) Regional Device Work Unit (SKPD) as referred to in Section 4 of the paragraph (1) of the host of the duties of the host of the host. (2) Sanctions of the termination of the allocation of funds and the duties of the host for the next budget year may be performed if:

a. The regional device working unit does not deliver a three-monthly financial report to the Minister in a row 2 (two) times in the running budget year; and/or

b. There is an aberration of the results of the examination of the Financial Examiner's Agency, the Financial and Financial Supervising Board, the Inspectorate General of the Ministry of Forestry, Inspectorate General of the Ministry of the Interior or Regional Inspectorate.

(3) Sanctions as intended in paragraph (1) specified by the Minister after consulting with the Minister of Finance.

(4) The introduction of the sanctions as referred to in paragraph (1) does not release the SKPD from the obligation of conveyance of the duties of the master's duties. as referred to in this Minister Rule.
