ABOUT

USE OF USE HYDROCHLOROFLUOROCARBON (HCFC)

IN THE INDUSTRIAL FIELD

WITH THE GRACE OF GOD ALMIGHTY

MINISTER OF INDUSTRIES OF THE REPUBLIC OF INDONESIA,

TO THE DRAW: A. that under the terms of the Vienna Convention and the Montreal Protocol, developing countries are obliged to implement the removal of the use of the Ozone Layer Malware (BPO) gradually to a certain time limit;

b. that hydrochlorofluorocarbon (HCFC) is one of the types of BPO that is used as a raw material and helper in the field of Industry, whose overall imprisonment comes from the import;

c. that based on consideration as referred to in letters a and letter b, need to control and prohibit gradually the use of hydrochlorofluorocarbon (HCFC) in Industrial activities in Indonesia;

d. that based on consideration as referred to in the letter c, it is necessary to establish the Ministerial Regulation on the Prohibition of the Use of Hydrochlorofluorocarbon (HCFC) in the Industrial Field;

The decision of the President of the Republic of Indonesia No. 23 of 1992 on the Concern of the Vienna Convention for the Protection of the Ozone Layer and the Montreal Protocol on Substances that Deplete the Ozone Layer as Adjusted and Amended by the Second Meeting of the Parties London, 27-29 June 1990 (State Gazette of the Republic of Indonesia in 1992 Number 50);

5. Decision of the President of the Republic of Indonesia No. 92 of 1998 on the Concern of the Montreal Protocol on Substances that Deplete the Ozone Layer, Copenhagen 1992 (Montreal Protocol on Damaging Substances Ozone Layer, Copenhagen 1992) (State of the Republic of Indonesia in 1998 No. 105);

12. Regulations Minister Perindustrian Number 105 /M-IND/PER/10/2010 on the Organization and the Ministry of Industry Works;

DECIDED:

SET: THE INDUSTRIAL MINISTER ' S REGULATION ON THE PROHIBITION OF USE HYDROCHLOROFLUOROCARBON (HCFC) IN THE INDUSTRIAL FIELD.

Article 1

In Regulation of this Minister referred to:

1. Hydrochlorofluorocarbon , later called HCFC, is a chemical compound that can potentially damage ozone molecules in the stratosphere.

2. Goods are products that are in the production process and/or operas using and/or contain HCFCs.

3. Industry Company is Everyone who performs activities in the field of Industrial Business based in Indonesia.

4. Technical Considerations is a letter published by an authorized working unit, which contains a technical explanation of a product and is not an import permit/consent.

5. The Director General of Industry Pembina is the Director General in the Ministry of Industry environment which carries out Industrial coaching in accordance with the duties and functions.

Article 2

(1) HCFC as referred to in Article 1 of the number 1 It's one of the types of ozone-layer wrecking materials.

(2) HCFCs as referred to in paragraph (1) may be used as the raw materials/help of the production process and/or operation of the product as follows:

a. cooling room (AC);

b. the air temperature regulatory engine;

c. natural/refrigeration machine;

d. foam or foam;

e. Firefighting; and/or

f. solvent.

(3) The HCFC description as referred to in paragraph (1) as set forth in Appendix I of this Minister Rule.

Article 3

Starting January 1, 2015 HCFC-22 and HCFC-141b types are prohibited for use at:

a. charging in the production process of room cooling engine (AC), air temperature regulatory engine, and refrigeration tools;

b. the production process rigid foam for the items freezers, domestic refrigerator, boardstock/laminated, refrigerated trucks; and

c. the production process integral skin for use in the automotive sector and furniture sectors.

Section 4

Starting 31 December 2030 HCFCs as referred to in Section 2 of the paragraph (3) are prohibited for maintenance of goods.

Section 5

HCFC as referred to in Section 3 is prohibited from use for new investments and/or in order to expand.

Section 6

(1) HCFCs as referred to in Section 2 of the paragraph (3) may be recycled.

(2) Recycle results as referred to in paragraph (1) may only be used for the maintenance of the goods that system It works with HCFC.

Article 7

Goods that do not use HCFCs are required to be assigned the logo as set forth in Annex II of this Minister Rule.

Section 8

(1) The import HCFCs may be used as the default materials/helper of the production process and/or the operation of the product as referred to in Section 2.

(2) HCFC Imports as referred to in paragraph (1) must be based on the Technical Perconsideration Letter of the Director General Pembina Industry.

(3) Submissions Submissions Technical considerations as referred to in paragraph (2) are delivered to the Director General Industrial tamper through the Public Service Unit (UP2) Center, by attaching at least a document:

a. Industrial or Industrial Business Permission Photocopy (Industry);

b. photocopy of the General importer Identifiers (API-U) or the Manufacturer Importer Identifier (API-P);

c. Photocopy of the Enterprise List of Companies (TDP);

d. (NPWP) COPIES OF THE IBM PRODUCTS AND SERVICES HCFC import consent letter period 6 (six) previous month issued by the Director General who carries out the affairs of government affairs of foreign trade;

f. the recommendation of the Deputy who carries out the governance affairs of the ozone layer protection field on the ministry that carries out the governance affairs of the field of living environment; and

g. realization and production plan as well as the realization and plan of use of HCFCs for 1 (one) year, for manufacturers to use themselves; or

h. realization and import plan and the realization and distribution plan of HCFC for 1 (one) year, for the importer at the manufacturer's request.

Section 9

Manufacturers and importers as referred to in Section 8 of the paragraph (3) g and the letter h are mandatory report the realization of importing HCFC every 6 (six) months to the Director General of Industry Pembina.

Article 10

(1) The supervision of the implementation of the Regulation of the Minister is conducted by Director General Pembina Industries is coordinating with Related instances.

(2) The order of supervision as referred to in paragraph (1) is set more further with the Code of Industry Director General Pembina Industries.

Article 11

The Industrial Company that violates the provisions in the Regulation of the Minister are subject to administrative sanctions for the revocation of the Industrial Business Permit (IUI) or the List Mark Industry (TDI).

Article 12

The Minister ' s Regulation is beginning to take effect on the date of the promulcity.
