THE PROGRAM RESTRUCTURING PROGRAMS AND/OR EQUIPMENT

SMALL INDUSTRY AND MEDIUM INDUSTRY

WITH THE GRACE OF GOD ALMIGHTY

MINISTER OF INDUSTRIES OF THE REPUBLIC OF INDONESIA,

TO THE DRAW: A. that in order to develop small and medium-sized industries as one of the national priority industries, it needs to increase the power of the Industry in question through engine restructuring programs and/or small Industrial and Industrial equipment medium through the giving of price cuts in the purchase of the machine and/or equipment;

b. that Regulation Minister Perindustrian Number 13 /M-IND/2/2013 on the Machine restructuring and/or industrial equipment of small and medium-sized industries is not in compliance with the development so that it must be replaced with new regulations;

c. that under consideration as intended in letter a and letter b, need to establish the Minister of Industry Regulation on the Machine restructuring program and/or the Appliance

14. Ministry of Industry Regulation Number 15 /M-IND/ PER/2/2011 on the Use of the Home Product Usage Guidelines, in the Acquisition of Government Goods/Services;

15. Regulations Minister Perindustrian Number 64 /M-IND/ PER/7/2011 on Industrial Types in the Coaching of the Directorate General and the Agency in the Ministry of Industry environment;

DECIDED:

Establishing: MINISTRY OF MINISTRY REGULATIONS ABOUT THE ENGINE RESTRUCTURING PROGRAM AND/OR SMALL INDUSTRIAL EQUIPMENT AND MEDIUM INDUSTRY.

Article 1

In Regulation of this Minister referred to:

1. Engine restructuring and/or small Industrial Equipment and Middle Industry called Restructuring is the replacement and/or addition of machine and/or small industrial production equipment and the more efficient medium and/or industrial production equipment and/or other industries. productive to generate quality and competitious products.

2. Director General is Director General of Small and Medium Industry.

Article 2

The Minister of Industry is responsible for the policy and implementation of the restructuring program in order to increase the power of the small Industry saing and Middle Industry.

Article 3

Small and medium Industry Criteria as referred to in Article 2:

a. The small industry is the industry with the most investment value of Rp. 500,000,000,-(five hundred million rupiah), excluding land and building venues; and

b. The medium industry is an industry with greater investment than Rp. 500,000,000,-(five hundred million rupiah) or at most 10,000,000,000,-(ten billion rupiah), excluding land and building venues.

Article 4

The restructuring program is reserved for small and medium-sized industrial enterprises with industry groups as set forth in this Minister of Regulation Attachment.

Article 5

(1) The restructuring program is carried out in form provisioning of the machine and/or industrial equipment purchase price.

(2) The price of the discount, as referred to in the paragraph (1) is provided only for small and medium-sized industrial companies that are:

a. using machines and/or equipment with more advanced technology and new (not used) conditions; and

b. the type of machine used in conjunction with the production process and the supporting equipment.

(3) More terms on the more advanced technology as referred to in paragraph (2) letter a and interrelation to the machine type as intended on the paragraph (2) the letter b is governed by the General Director's Rules.

(4) The Financing of the Restructure Program as referred to in paragraph (1) is charged on DIPA Directorate General of Small and Medium Industries, Ministry of Industry throughout His budget has received approval from the Minister of Finance.

Article 6

(1) The price-cut mechanism referred to in Section 5 is done by the means of replacement (reimburse).

(2) The discount is referred to in paragraph (1) as big as:

a. 35% (thirty-five percent) of the engine purchase value and/or industrial equipment for small industrial companies; and

b. 25% (twenty-five percent) of the engine purchase value and/or industrial equipment for the medium-industrial enterprises.

(3) In terms of small Industrial companies using machinery and/or domestic production equipment as evidenced by mail a statement from the manufacturer of the machine/equipment known to the local Industry Service, the terms of the price cut as referred to in paragraph (2) of the letter a be 45% (forty-five percent).

(4) In terms of medium industrial enterprises using machinery and/or domestic production equipment as evidenced by a statement letter from the manufacturer of the machine/equipment known to the local Industrial Service, the provisions of the pieces the price of the (2) letter b to be 35% (thirty-five percent).

(5) The value of the price as referred to in paragraph (2), paragraph (3), or paragraph (4) of the most Rp. 500,000,000,-(five hundred million rupiah) per company per year of the budget as evidenced by providing evidence of purchase.

(6) The proof of purchase as referred to in paragraph (5) is most slowly dated 1 August at 1 (one) years prior to the year of APBN being the source of program financing.

Section 7

The price cuts are referred to in Article 6 is provided against the purchase of the machine and/or the equipment performed in the manner:

a. cash purchase;

b. banking credit (cash loan and non cash);

c. Finance Institution credit Not Bank (LKBB); and/or

d. supplier of the machine.

Section 8

The machine and/or equipment as referred to in Article 7 should be installed most slowly on September 30 of the year of APBN being the source of financing.

Article 9

The Company has acquired Reduced financing through the Restructuring Program, must submit a report on the progress of machine utilization and/or equipment every 1 (one) year once for 3 (three) years to the Director General.

Section 10

(1) The Director General as the User of the Budget User is required to make a liability report on the execution of the Restructuring Program in the form of a financial report.

(2) The reporting tool as referred to in paragraph (1) refers to the Regulation of Finance Minister Number 171 /PMK.05/ 2007 on the Central Government Financial Accounting and Reporting System.

Article 11

The Director General is required to report on the use of the budget, The goals and objectives of the Program are appropriate and precisely targeted to the Minister. Industry every 6 (six) months.

Article 12

Further provisions concerning the manner of reporting as referred to in Article 9, Section 10, and Section 11 are governed with the General Director's Regulation.

Article 13

(1) The Director General forms a Team Manager, Power Expert, and Technical Team to escort that the Restructuring program is running optimally and appropriately targeted.

(2) The Team Manager, Power Expert, and Technical Team as are referred to the paragraph (1) consists of officials in the Ministry of Industry environment, related technical agencies, and practitioners.

Section 14

The recipient of a restructuring program is prohibited:

a. provide false, fake documents or fraudulent charges; and

b. Assign ownership/transfer of machine and/or industrial equipment to other parties without the consent of the Ministry of Industry for a period of 3 (three) years.

Article 15

(1) The Company is violating the terms of the as referred to in Section 9 of the sanctions cannot follow the Restructuring Program on the Ministry of Industry for the following years.

(2) The company that violates the provisions as referred to in Article 14 is imposed sanctions were:

a. Must return a copy of the accepted price to the State Kas; and/or

b. cannot follow the Restructuring Program of the Ministry of Industry for the following years.

Article 16

Further provisions on the implementation of the Restructuring Program are set up with the General Director's Rules.

Section 17

At the time the Minister's Ordinance is in effect, all the invitational regulations which are the implementation of the Regulation of the Industry Minister Number 13 /M-IND/ PER/2/2013 on the Program of Restructuring Machines/Small Industry Equipment and the medium is declared to remain in effect as long as it doesn't Rule of this Minister.

Article 18

At the time the Ministerial Regulation is in effect, the Regulation of the Minister of Industry Number 13/M-IND/PER/2/2013 on the Program's Restructuring Machine/Small and Medium Industrial Equipment, revoked and declared does not apply.

Article 19

The rules of the Minister are effective at the date of the promulcity.
