ON THE PROCEDURE OF PURCHASING POWER AND THE BENCHMARK PRICE

THE ELECTRIC POWER PURCHASE FROM THE MINE MOUTH PLTU, THE " PLTU COAL, PLTG/PLTMG, AND PLTA BY PT COMPANY

ELECTRICITY OF STATE (PERSERO) THROUGH DIRECT ELECTION AND DIRECT DESIGNATION

THE ENERGY MINISTER AND MINERAL RESOURCES OF THE REPUBLIC OF INDONESIA,

Weigh: that in order to accelerate the development of the power plant by PT of the State Electricity Company (Persero) and to implement the provisions of Article 39 paragraph (2) of Government Regulation No. 14 of 2012 on the Activities of the Power Supply Service as amended with the Government Regulation No. 23 Year 2014, it needs to establish the Regulation of the Minister of Energy and Mineral Resources on the Electrical Power Purchase Procedure and the Purchase Price of Electric Power Purchase From the Mine PLTU, PLTU Coal, PLTG/PLTMG, and PLTA By PT Corporate Electricity Company (Persero) Through Direct and Direct Appointment;

DECIDED:

Establits: REGULATION OF ENERGY MINISTER AND MINERAL RESOURCES ON THE PROCEDURE OF PURCHASING POWER POWER AND THE BENCHMARK PRICE OF ELECTRIC POWER PURCHASE FROM PLTU MINE MOUTH, PLTU COAL, PLTG/PLTMG, AND PLTA BY PT STATE POWER COMPANY (PERSERO) THROUGH DIRECT SELECTION AND DIRECT APPOINTMENT.

Article 1

(1) The State Electric Company (Persero) is obliged to meet the needs of electricity in its area of effort.

(2) In meeting the needs of the electricity power as it is referred to the paragraph (1) PT Corporate Electricity (Persero) can carry out electric power purchases from PLTU Mulut Mine, PLTU Batubara, PLTG/PLTMG, and PLTA.

(3) The purchase of electric power by the State Electric Company (Persero) as referred to in paragraph (2) with the permit holder of other power supply efforts to be carried out on the basis of an electric power supply plan.

(4) Electric power purchase of PLTU Mulut Mine, PLTU Batubara, PLTG/PLTMG, and PLTA as referred to in verse (2) can be done through direct election and direct appointment throughout meeting the criteria.

a. Diversification of energy for power generation to non-fuel oil; and/or

(6) The direct appointment Criteria as referred to in paragraph (4) is:

a. Electric power purchase done from PLTU Mulut Mine, marginal PLTG and PLTA;

b. purchase of excess electric power from PLTU Mulut Mine, PLTU Batubara, PLTG/PLTMG, and PLTA;

c. electric power purchase of PLTU Mulut Mine, PLTU Batubara, PLTG/PLTMG, and PLTA if the local electrical power system is in crisis condition or an emergency provision of electrical power; and/or

d. the electric power purchase of PLTU Mulut Mine, PLTU Batubara, PLTG/PLTMG, and PLTA in order to add generation capacity to the power plant center that has been operating at the same location.

(7) In terms of more of 1 (one) interested developers submitting an electric power purchase offering through direct designation as referred to in paragraph (6), the purchase of power is made by direct election.

Section 2

(1) PT Companies The State Electricity (Persero) is required to announce an electric power purchase plan as referred to in Section 1 in accordance with an electrical power supply plan.

(2) The purchase of an electric power as referred to in Section 1 is implemented through electronic procurement.

Article 3 (1) of the Board of Directors of the State Electricity Company (Persero) set further

(2) Direct election process as referred to in paragraph (1), preceded by a tuntas test of the technical and financial capabilities that a procurement agent may perform designated by the State Electric Company PT (Persero) and up to the signing of an electric power purchase agreement, at most 45 (forty-five) days.

(3) The direct appointment process as referred to in paragraph (1), preceded by a tuntas test of the technical and financial capabilities may be performed by the procurement agent party designated by the Company PT. State Electricity (Persero) and up to the signing of an electric power purchase agreement, at most 30 (thirty) days.

Section 4

Guna speeds up the process of purchasing electricity power as referred to in Section 1, PT Company The State Electricity (Persero) is required to compose:

a. the standard of the power generation procurement document; and b. the standard electric power buy agreement for each type

plant. Article 5

The purchase of electric power must meet the technical requirements that refer to the Indonesian National Standard (SNI) in the field of calm, international standards or other countries ' standards that do not conflict with ISO standards. (International Organization for Standardization) or IEC (International Electrotechnical Commission), and paying attention to regulations regarding the Internal Level of Internal Affairs (TKDN).

Article 6

(1) The highest benchmark price of purchasing power from PLTU Mulut Mine, PLTU Batubara, PLTG/PLTMG, and PLTA by PT Corporate Electricity Negara (Persero) as referred to in Section 1 is as set forth in The attachment that is an inseparable part of this Minister ' s Regulation.

(2) The highest benchmark price of the purchase of electric power as referred to in paragraph (1), is based on the following: a. the highest benchmark price is the levellized base at

busbar plant; and b. The highest benchmark price is the price at the time

the plant was declared a commercial operation (Commercial Operation Date).

(3) Purchase of electric power for PLTU Mulut Mine, coal PLTU, PLTG/PLTMG, and PLTA implemented based on the highest benchmark price as referred to in paragraph (1) is not required for the approval of the sale of the electric power from Minister.

Article 7 By referring to the benchmark price as referred to in Article 6, the purchase price of an electric power can be made adjustments as determined in the electricity purchasing agreement.

Article 8 For the area In particular, the State Electric Company (Persero) can make an electric power purchase From a power plant at the price of the highest price, as referred to in Article 6, it is based on the estimated price of the State Electric Company (Persero), and is required to obtain the approval of the sale price of electricity from the U.S. Minister.

revoked and declared not to apply.
