THE SOCIAL MINISTER REPUBLIC OF INDONESIA,

TIED: a. that to implement the provisions of Article 9 of the Government Regulation No. 38 of 2007 on the Division of Government Affairs Between the Government, Provincial Government, and the Government

District/City areas, need to be drafted norms,

standard, procedure and criteria;

b. that in order to host social rehabilitation can meet the basic needs of the social welfare problem of social tuna and the social rehabilitation organizing institution of the social tuna can

provide optimal service, the need for the rules set about standards for social rehabilitation organizing institutions of social tuna;

c. that based on consideration as in letter a and letter b, need

set the Social Minister ' s Regulation on Standard

SET: A SOCIAL MINISTER ' S REGULATION ON THE STANDARDS OF SOCIAL REHABILITATION ORGANIZING INSTITUTIONS OF SOCIAL TUNA.

BAB I

provisions of UMUM

Article 1

In Regulation of this Minister referred to:

1. A standard is a technical specification or something that is standardized as a reference in performing an activity program.

2. Social rehabilitation is a process of refetionalisation and development

to allow a person to be able to perform its social functions reasonably in people's lives.

3. Social tuna is a person who is due to a particular factor, not or less able to carry out a decent life or in accordance with religious, social or legal norms as well as socially inclined to be isolated from the life of society as Vagrants,

beggars, homeless, victims of trafficking people, former citizens of the penitentiary, and people with HIV/AIDS.

4. Social Social Rehabilitation Organizing Institute is

the social rehabilitation organizing institute of social tuna established by the Central Government, provincial government, county/city local government, or society that organizes social rehabilitation activities for the Social Welfare Problem of Social Welfare.

5. Vagrants are people who live in unsuitable circumstances

with the norm of life that are viable in the local community, as well as having no place to live and work that remains in a particular region and living wandering in a public place.

6. Beggars are the ones who earn income by begging in public in various ways and reasons to expect the mercy of others.

7. Tuna Susila is a person who is sexually related to a person or opposite sex over and over and alternately outside of a legitimate marriage in exchange for a reward for money, material, or services.

8. Victims of human trafficking are individuals who experience psychic, mental, physical, sexual, economic,

and/or social abuse, resulting in a criminal trafficking act.

9. The former Citizen of Penitentiary is someone who has finished serving a criminal period handed down to him based on a court decision that has had a fixed legal force.

10. People with HIV/AIDS are someone who has been infected

HIV/AIDS based on HIV/AIDS counseling and physician referrals.

11. Professional Social Workers are individuals who work, both in government and private institutions that have social job competencies and professions, and concern in social work gained through education, training, and/or experience

social work practices to carry out service tasks

and handling social problems.

12. The Social Welfare is a person who is educated and trained professionally to carry out service tasks and handling social problems and/or someone who works, both in the organizing institute of rehabilitation organizers Social or private social tuna that spaces its activities in

13. Social volunteers are a person and/or community group, whether set in social work and not set

14. A social welfare institution is a social organization or social society that carries out a social welfare organization formed by the public, both legal and non-legal entities.

15. The Minister is the minister who organizes government affairs

on the social field

Article 2

The Standards of Organizing Institute Of Social Medicine Social Tuna Aim:

a. provides guidelines for the organizers of the Social Tuna Social Rehabilitation;

b. provide protection against the Problem

Article 3

(1) Social Tuna Social Rehabilitation may be performed in and/or at

STANDARD INSTITUTE

The Kesatu section

General

Article 4

(1) Standard Social Social Rehabilitation Organizing Institute

includes:

a. organization structure;

b. human resources;

c. means and infrastructure;

d. fund management management and fund liability management; and

e. The Social Rehabilitation program.

(2) Standards as referred to in paragraph (1) are intended for the Institute for Social Tuna Social Rehabilitation:

a. bum and beggar;

b. Social Tuna;

c. victims of trafficking persons; and

d. people with HIV/AIDS

Second Part

Organization Structure

Article 5

Structure of the Organizing Institute of Social Rehabilitation Organizers as referred to in Article 4 of the paragraph (1), consists of:

a. Chairman of the Organizing Board of Social Tuna Social Tuna;

b. secretary; and

c. chair of the field of Social Rehabilitation.

Section 6

Chair of the Organizing Institute of Social Tuna Social Tuna as referred to in Section 5 of the letter a is the head

highest Organizing Institution Social rehabilitation of Social Tuna.

Article 7

(1) The Secretary as referred to in Article 5 of the letter b oversees the field of administration and the field of support.

(2) The field of admistration as referred to by paragraph (1) includes:

A. Entrepreneurship;

b. finance; and

c. crowd.

(3) The field of support as referred to in paragraph (1) includes:

a. Dorm hostname;

b. kitchen officer;

c. janitor;

d. security/security officers; and

e. driver.

Article 8

The Chair of the Social Rehabilitation Field as referred to in Article 5 of the letter c is the executor of the Social Rehabilitation in the institution and outside of the institution.

Part Third

Human Resources

Article 9

(1) Human Resources Organizing Institute Of Social Rehabilitation Organizers as referred to in Article 4 of the paragraph includes:

a. Professional Social Worker;

b. health medical personnel;

c. psychologist;

d. Skills instructor;

e. Spiritual mentor;

f. Social Welfare Power;

g. Social Volunteers; dan/or

h. social cleansing.

(2) In addition to the human resources of the Social Tuna Social Rehabilitation Field

as referred to in paragraph (1) for the Organizing Institution of Social Rehabilitation victims of trafficking offences people must be in psychiatric labor.

Fourth Quarter

Sarana and Prasarana

Article 10

Standard means and physical infrastructure for the Organizing Society of Social Rehabilitation as referred to in Article 4 of the letter c, includes:

a. an office space that serves as a leadership space, a staff workroom, boardroom, living room, documentation room, library room;

b. a technical service space that serves as a boarding room, diagnostic space/asesment, psychosocial counseling room, and skill room;

c. The public service room which serves as a dining room, space

worship, health room, hall, security post, warehouse, and bathroom;

d. Organizing Institute equipment Social Tuna Social Tuna consisting of office support equipment, communication equipment, lighting, water and clean water installations, technical service support equipment; and

e. transport tool;

Paragraf 2

Special Standard

Article 11

In addition to the standards as referred to in Article 10, the Rehabilitation Social Rehabilitation Organizer requires space that serves as:

a. a selection room for the temporary place of a client candidate during the acceptance selection period; and

b. Specialized polyclinics provide medical personnel to conduct an examination of sexually transmitted infections and their supporting drugs.

Article 12

In addition to the standards as referred to in Article 10 of the Rehabilitation Organization Social vagrants and beggars require a space that serves as:

a. child activity places; and

b. a selection room for a client place who has a specific illness or condition that must be separated with another client.

Article 13

(1) In addition to the standards as referred to in Article 10 of the Institution

The Rehabilitation Organizer Social people with HIV and AIDS require space and a place to function as:

a. polyclinics that provide medical and special medicines related to the disease that

inflict on it; and

b. special waste dump serves to dispose of special trash deemed harmful to the general public;

(2) The Organizing Institution of Social Rehabilitation of people with HIV and AIDS as referred to in paragraph (1) must have network

with a nearby hospital that serves to provide

ODHA or buddies companion.

Section 14

In addition to the standards as referred to in Article 10 of the Institution Social rehabilitation organizers of the trafficking victims of people require a space that serves as:

a. polyclinics to perform a sexual infectious infection disease check;

b. special room of therapy to provide therapy for clients who have trauma cases.

Fifth Section

The Management Management and Accouncability Fund

Article 15

(1) The mandatory funds are used entirely for the benefit of Hosting Social-Tuna Social Rehabilitation.

(2) The funds as referred to in paragraph (1), the management is conducted in an orderly manner, efficient, effective, transparent, and accountable in accordance with

the provisions of the laws with notice

a sense of fairness and propriety.

(3) Management The financial management as referred to in paragraph (2) includes all activities including planning, management and accountability.

Sixth Part

Social Rehabilitation Program

Article 16

(1) The Form Social rehabilitation as referred to in Article 4

letter e includes:

a. motivation and psychosocial diagnosis;

b. treatment and nurturing;

c. vocational training and entrepreneurial coaching;

d. mental mental counseling;

e. physical guidance;

f. social counseling and psychosocial counseling;

g. accessibility ministry;

h. help and social assistance;

i. Resosialization guidance;

j. continued guidance; and/or

k. referral.

(2) The form of social rehabilitation is exercised using the social work method.

(3) The social work method as referred to in verse (2)

is done by stage as follows:

a. initial approach;

b. the disclosure and understanding of the problem;

c. Drafting the problem solving plan;

d. problem solving;

e. resosialisation/reintegration;

f. termination; and

g. Further guidance.

Article 17

The Organizing Board of Social Rehabilitation Social Tuna carrying out Social Rehabilitation in and outside the institution.

Article 18

Social Rehabilitation of Social Tuna is exercised in accordance with the provisions of the laws.

BAB III

TERMS AND RULES OF REGISTRATION

Section Parts

Requirements

Section 19

(1) Registration Requirements for the Social Rehabilitation Organizing Institution must have:

a. basic budget and household budgets;

b. The establishment of a notary state authorized by the Minister of Law and

Human Rights as the legal entity;

c. the subject matter is taxed;

d. The domicile description of the lurah/local village head/other name

the same type;

e. a work program in the field of Social Tuna Social Rehabilitation services;

f. the source of the funds for the execution of activities;

g. adequate human resources;

h. completeness of the means and the infrastructure; and

i. Financial Report on Accepts, Spending, Allocation Of Organizing Institutions The Social Rehabilitation Organization.

(2) In addition to requirements as referred to paragraph (1), the Organizing Board of Social Rehabilitation Social Tuna of the former citizens Correctional binings require special cooperation with the Correctional Institution and the Correctional Institution that serves to

provide a letter recommendation.

Second Section

Registration

Article 20

(1) Institutions The organizers of the mandatory Social Tuna Social Rehabilitation

register to the ministry or agency that organizes

the affairs of government in the social field in accordance with the territory of its authority.

(2) The Registration as referred to in paragraph (1) is submitted to:

a. Minister, for the Organizing Institute of Social Tuna Social Tuna whose scope of work is more than 1 (one) province;

b. The instance that organizes the province, for the Organizing Board of Social Rehabilitation of Social Tuna whose work area is more than 1 (one) county/kota; and

c. instance. Organize social-field affairs in the district/city, for the Organizing Institute of Social-Tuna Social Tuna whose area of work

at 1 (one) county/city.

(3) Registration as referred to in paragraph (2) is performed by the administrator of the Rehabilitation Organization of Social Tuna Social Tuna by applying to the Minister, the governor, or the regent/mayor in accordance with his authority.

(4) Registration as referred to in paragraph (1) is executed

quickly, easily, and without charge.

Article 21

(1) Tata method of registration for the Organizing Institute of Social Tuna Social Tuna as follows:

a. The applicant applied for a registration application to the Minister, governor, or regent/mayor in accordance with the scope of its jurisdiction by attaching proof of the completeness of the requirements as referred to in Article 19 of the paragraph (1) and

paragraph (2);

b. Such registration applications are processed further by

the instance that organizes the local social field governance and/or the Ministry of Social Affairs;

c. The minister, governor, or regent/mayor may accept or refuse a request with notice to the applicant,

after the review, research, and/or verification of the application is intended;

d. In terms of requests are accepted, the head of the agency that organizes the affairs of the social field governance in accordance with the territory of its jurisdiction publishes the registration mark;

e. The rejection of the Rehabilitation Organizing Institute

Social Tuna Social Tuna as referred to in the letter c is done in writing.

(2) The process referred to in paragraph (1) the letter b is done in a way:

a. A review of the proposed establishment of the Organizing Board of Social Tuna Rehabilitation Organizers submitted; and

b. review, research, and verification to the location of the Organizing Institute of Social Tuna Social Tuna.

(3) The rejection as referred to in paragraph (1) of the letter e due to:

a. The applicant has not met the completeness of the requirements; and/or

b. Social Rehabilitation Organizing Institute does not perform activities in the Rehabilitation Area

Social Tuna Social.

AUTHORITY

Central Government

Article 22

The minister has the authority:

a. published the registration sign of the Organizing Institution of Social Tuna Social Tuna whose service range is more than 1 (one) province;

b. Formulate a standard implementation policy on the National Rehabilitation Organizing Institute nationally;

c. Organizing Social Tuna Social Rehabilitation via a technical executor unit as a pilot;

d. establish norms, standards, procedures, and the criteria for the implementation of Social Tuna Social Tuna organized by the Social Rehabilitation Organizing Institute of Social Tuna;

e. assemble, recruit, and present the Institution base data

Organizers of Social Tuna Social Tuna nationally;

f. conduct verification and data validation of the nationally nationwide Rehabilitation Organization of Social Tuna Organizing and Social Tuna;

g. Strengthening institutional capacity including improving human resources of the organizers of the Social Tuna Social Rehabilitation;

h. Partnership assistance with the Organizing Institution

A foreign Social Tuna Social Rehabilitation which includes foreign power and assistance/hybah;

i. establish the Organizing Institution of Social Tuna Social Tuna scope of the national service;

j. publishes operational clearance for the Foreign Rehabilitation Organizing Institute of foreign Social Tuna after being consulted and coordinated

with the minister hosting government affairs in the field of foreign affairs;

k. perform accreditation for the Social Rehabilitation Organizing Institute

Social Tuna through accreditation agency;

l. conduct certification for Professional Social Workers and Social Welfare through certification agencies;

m. conduct coaching and supervision of the Social Rehabilitation Organizing Institution of Social Tuna whose scope is more than 1 (one) province; and

n. conducting monitoring and evaluation.

Second Quarter

The governor has the authority:

a. coordinate implementation of policy, programs, and activities of the national Social-Tuna Social Rehabilitation implementation, inter-county and inter-county device work units in its territory;

b. publish the registration sign of the Organizing Institution Social Tuna Social Tuna whose range of services is more than 1 (one)

county in 1 (one) province;

c. establishes the Social Rehabilitation Program based on regional conditions

along does not conflict with the rules of the invite-invitation;

d. The strengthening of the institutional capacity of the organizers of the Social Rehabilitation Social Tuna includes an increase in human resources for

the implementation of the Social Tuna Social Rehabilitation;

e. coaching and supervision of the county/township Social Tuna Rehabilitation Organizing Institution;

f. facilitate the implementation of policy, program, and implementation activities of Social Tuna Social Rehabilitation;

i. provide recommendations for the Organizing Institute of Social Tuna Social Tuna the scope of provincial services to the Minister for the fulfilment of accreditation;

j. provisioning of the services of the Social Tuna Social Rehabilitation Organizer;

k. Cooperation with other provinces and facilitation of cooperation between

county/city in its territory in the implementation of Social Tuna Social Rehabilitation; and

l. perform monitoring and evaluation.

The Third Section

District/City

Article 24

The Regent/mayor has the authority:

a. coordinate the implementation of policies, programs, and the activities of the Social Tuna Social Rehabilitation Program with the province and

the county workspace/kota;

b. publish the registration sign of the Rehabilitation Organization

Social Tuna Social Tuna whose services range in county/kota;

c. cooperation with district/city in 1 (one) province in the conduct of policy The program of the activities of the Organizing Institution Rehabilitation of Social Tuna in accordance with the provisions of the laws of the laws;

d. The strengthening of the institutional capacity of the organizers of the Social Rehabilitation organization Social Tuna includes an increase in human resources for the implementation of the Social Tuna Social Rehabilitation;

BAB V

FUNDING

Article 25

The funding source for the Organizing Institute of Social Tuna

Social includes:

a. State Shopping Revenue Budget;

b. province area shopping income budget;

c. county area shopping income budget/kota;

d. community donations; and/or

e. a valid source of funding in accordance with the provisions of the regulations

legislation.

BAB VI

REPORTING

(1) Any Organizing Institution Social Tuna compulsory Social Tuna

makes a written report of the implementation of activities at the end of the year regarding the hosting of activities, funding sources, financial report, human resources, assets, as well as the means and infrastructure of the Organizing Institute of Social Rehabilitation to local social agencies.

(2) The Regent/mayor is obligated to deliver the implementation report

policy, program, and the activities of hosting the Social Tuna Social Rehabilitation that organized by the Organizing Institute of Social Tuna Social Tuna in its area to the governor.

(3) The Governor is obligated to deliver reports of implementation of the policy, program, and activities of the Organizing Institute of Social Tuna Social in his area to the Minister and the Interior Minister

The country.

(4) The execution reporting as referred to in paragraph (2) and paragraph (3) is performed each year.

(5) The form and layout of the reporting as referred to in paragraph (4) are executed in accordance with the provisions of the invite-invitation rules.

BAB VII

COACHING AND SUPERVISION

Article 27

(1) The Minister conducts coaching and supervision in carrying out the activities of activities of the Social Rehabilitation Organizing Institute in the entire region of the Republic of Indonesia.

(2) The governor conducts coaching and oversight in carrying out the program Organization of Social Rehabilitation Organizing Activities in the province.

(3) The Regent/Mayor conducts coaching and supervision in

implementation of the Social Rehabilitation Service Of Social Tuna By The Rehabilitation Organizing Institute Social Tuna Social in district/city.

Article 29

The public can conduct surveillance on the performance of the Organizing Institute of Social Tuna Social Tuna in accordance with the mechanism and provisions of the laws.

BAB VIII

MONITORING AND EVALUATION

Section 30

(1) To ensure a synergy, continuity, and effectiveness of step-step in the course of the implementation of the policy, program, and activities of the Organizing Society Social rehabilitation of Social Tuna, Central Government and local government conducting monitoring.

(2) Monitoring as referred to in paragraph (1), to know

developments and obstacles in the implementation of policies, programs, and Organizing Board activities Social Tuna Social Tuna.

(3) Monitoring conducted periodically through direct coordination and monitoring of the area device working units carrying out policies, programs, and activities of the Social Tuna Social Rehabilitation Organization.

Article 31

(1) Evaluation Organizing the policy, program, and activities of the Social Rehabilitation Organizing Institute is conducted at the end of the year.

(2) The results of evaluation of the implementation of policy, programs, and activities of the Organizing Institute of Social Rehabilitation Social-Tuna used

as a policy of drafting policies, programs, and activities for the following year.

(3) Evaluation as referred to in paragraph (1) is exercised in accordance

with the provisions of the laws.

Article 32

Monitoring and evaluation is conducted as a form of accountability and

quality control of the Social Rehabilitation Organizing Institution Social Tuna.

BAB IX

provisions CLOSING

Article 33

The Regulation of the Minister is made as the norm, standards, procedures, and criteria governing the standards of the Governing Institutions Rehabilitation of Social Rehabilitation Social tuna for the Central Government, local government, and the public in carrying out the treatment of Social Rehabilitation of Social Tuna.

Article 34

The rules of the Minister are in effect on the date of the promulcity.
