MINISTER FOR EDUCATION AND CULTURE OF THE REPUBLIC OF INDONESIA 7 2015

THE FOREIGN MINISTER OF THE REPUBLIC OF INDONESIA

AND

MINISTER OF EDUCATION AND CULTURE OF THE REPUBLIC OF INDONESIA,

DRAWS: A. that the establishment of Indonesian education abroad is one of the guarantees of fulfilment of the rights of Indonesian citizens abroad;

b. that to streamline the education for Indonesian citizens abroad, need to be arrangements regarding the management and hosting of Indonesian education abroad;

c. that based on consideration as intended on letter a and letter b, need

establishes the Joint Rules of Minister of Education and Culture and Minister of Foreign Affairs on Management and the Hosting of Indonesian Education;

Establishing: REGULATION WITH THE MINISTER OF EDUCATION AND CULTURE AND FOREIGN MINISTER ON THE MANAGEMENT AND HOSTING OF INDONESIAN EDUCATION ABROAD.

BAB I

provisions of UMUM Section 1

In this Joint Regulation referred to:

1. Education is a conscious and planned endeavor to realize the learning atmosphere and learning process for learning to actively develop their potential for the spiritual power of religion, self-control, personality, intelligence, and self-control. 10. The SILN teacher is a professional educator with the main task of educating, teaching, guiding, directing, training, assessing, and evaluating the learners employed at SILN.

11. The power of education is a member of the public who is devoted and raised to support education.

12. Learners are members of the public who seek to develop self-potential through the learning processes available on the course, the body, and the type of education.

13. The Chief Representative of the Republic of Indonesia, subsequently called the Chief Representative is the Ambassador Extraordinary and Full-power, the Permanent Representative of the Republic of Indonesia, the Power of the Fixed Effort, the Temporary Entity, Consul General, Consul, and Acting Acting Republic of Indonesia. BAB II PURPOSE

PATH EDUCATION

CHAPTER IV FORMAL EDUCATION

Section of the Governing Law

Article 4 (1) SILN may be hosted by the Government or the public

Article 5 (1) SILN is exercised under the provisions in the education system

c. based on the results of the eligibility study of the Representative, the Minister of Foreign Affairs provides recommendations for the proposal of the establishment of SILN as referred to in the letter a and letter b to the Minister of Education and Culture; and

d. The Minister of Education and Culture published a permit for the establishment of SILN upon the recommendation of the Minister of Foreign Affairs.

(3) The establishment of SILN is performed in accordance with the provisions of the laws of Indonesia, the local state and the law and the International custom.

Part Two of the Didik

Article 7

(1) The SILN educated participant is primarily for the WNI who live abroad. (2) SILN may receive a WNA learer who meets the requirements.

Third Part

Head SILN Article 8

Article 9

The Fourth Section of Teachers and Education

Article 13 (1) The teacher on SILN organized by the Government consists of:

a. a civil servant teacher;

Article 14 of the Composition and the number of teachers on SILN are organized by Government proposed by the Representative to the Ministry of Foreign Affairs and the Ministry of Education and Culture is based on: a. real needs;

b. ratio to the number of educated participants; and c. provisions of the regulations of Indonesia and state

of the country

. Article 15

(1) The teacher of civil servants on SILN organized by the Government is employed after through the process as follows: a. Minister of Education and Culture with the Minister of Foreign Affairs

performs a joint selection against the prospective SILN teacher after the prospective teacher gets a written permission from a staffing officer;

b. pass the joint selection as referred to in letter a; c. placements as civil servants teacher on SILN

set by the Minister of Education and Culture; and d. Civil servants teachers on SILN are not home-staff

or local employees (local-staff) who are placed in the Representative.

(2) The civil servant teacher's civil servant as referred to in verse (1) the d letter is performed with Regard to the provisions of the laws of Indonesia and the local state.

Article 16 The Teacher of the Civil Civil Service is entitled to receive salaries, allowances, protection and facilities during the placement in accordance with regulatory provisions. It's

Article 17

(1) Teacher is not a civil servant on SILN organized by the Government appointed after going through the following process:

a. The selection is hosted by the Ministry of Foreign Affairs and the Ministry of Foreign Affairs;

b. the signing of a working contract with the Ministry of Education and Culture was conducted upon passing the selection before the appointment; and

c. The appointment of teachers instead of civil servants was set by the Ministry of Education and Culture.

(2) Selection as a letter a may be held by SILN and Representative, if a teacher's candidate is not a civil servant domicile in an accredited country or work area.

(3) The teacher's order is not a civil servant. as set forth in paragraph (1) performed with regard to the provisions of the rules Laws Indonesia and the local country.

Article 18

(1) The WNA teacher can be employed on SILN hosted by the Government after going through the following process:

a. Pass the selected selections hosted by SILN and Representative;

b. signing of a working contract with the Ministry of Education and Culture after graduating the selection when prior to appointment;

c. appointment as a WNA teacher on SILN is set with the Chief Representative Decision; and

d. The appointment of the teacher as referred to in the letter b is specified by the Minister of Education and Culture.

(2) The WNA teacher force as referred to in paragraph (1) the letter c is done with regard to the provisions The laws of the country and the local state.

Article 19 Teachers are not civil servants entitled to receive salaries and allowances in accordance with the provisions of the laws.

Article 20

(1) Teachers on SILN organised by the public are appointed by the organizers.

(2) The SILN teacher force as referred to in verse (1) is reported to the Minister of Education and Culture through the Representative.

Section 21 (1) Civil civil servants at SILN held by

The government is entitled to protection, awards, competency development, career coaching, and promotion in accordance with the provisions of the IBM International Business Organization ("IBM"). By law.

(2) Teachers are not civil servants and the WNA teacher is entitled to the award and development of competence.

Article 22 (1) The Education Power employed on SILN can be lifted

from WNI or WNA.

(2) The educational workforce that is employed on SILN organized by the Government is selected and appointed by the Representative.

Fifth Section

Coaching and Oversight Article 23

(1) Coaching and supervision of SILN performed by the Representative, the Ministry of Foreign Affairs, and the Ministry of Education and Culture;

(2) The coaching and supervision as referred to in paragraph (1) of the Representative includes:

a. receive, research, and reapply SILN ' s founding permission request;

b. deliver the SILN establishment permit document delivered by the party to the Ministry of Education and Culture;

c. carry out the selection of prospective learners with SILN; d. receive and propose a list of nominations while participants

national exams to the Ministry of Education and Culture;

e. oversee the holding of the national exam on SILN; f. signing a national exam results letter and the diploma

in case there is a SILN Head vacancy; g. performing monitoring and evaluation periodically against

SILN; and

h. receive periodic reports each semester from SILN and proceed to the Ministry of Education and Culture and the Ministry of Foreign Affairs.

(3) Coaching and supervision as referred to in paragraph (1) of the Ministry of Foreign Affairs, covering:

a. monitoring and evaluating the SILN performance hosted by the Government of the Republic of Indonesia;

b. monitor the use of SILN budget derived from the Indonesian Republican Representative budget;

c. monitor and provide input related to the formation and procurement of employees on SILN hosted by the Government;

d. provide input related to the award-giving and coaching career of SILN teachers hosted by the Government;

e. monitor, evaluate, evaluate, and provide input related to asset management on SILN hosted by the Government.

(4) Coaching and supervision as referred to paragraph (1) performed by the Ministry of Education and Culture conducted under the provisions of the laws in the national education system include:

a. establish the hosting policy, coaching, supervision, education assessment, and execution of the national exam on SILN;

b. carry out the coordination of the staging, coaching, supervision, education assessment, and execution of the national exam on SILN;

c. grant the SILN establishment permission on the recommendation of the Foreign Secretary;

d. carrying out educational execution of SILN;

e. monitor the use of SILN ' s budget derived from the budget of the Ministry of Education and Culture and the public;

f. set the national exam participants on SILN; g. implement the national exam on SILN;

h. provide blanks of national exam results, diplomas, certificates, and other captions according to the needs; and

i. monitor, evaluate, and foster educational hosting at SILN.

Sixth Section Reporting

Article 24 Head of SILN through the Chief Representative shall provide the report of the hosting of education to the Ministry of Foreign Affairs and the Ministry of Education and Culture at any end semester.

The Seventh Section

The Education Calendar Section 25

The SILN academic calendar is set by the Chief Representative with a guideline to the national education calendar and the provisions of the public holidays that apply in the Representative.

The Eighth Section of the School Committee

Article 26 (1) In order to help improving the quality and the solubility of the process

learning to teach at SILN was formed a school committee or an organ of educational representation of the unit of education.

(2) the school committee or the organ of representation of the stakeholders of the education unit is an independent institution consisting of parents or guardians of students, school communities, and educational people who care about education.

(3) The formation of a school committee or an organ of educational representation of the education unit is conducted. in accordance with the provisions of the laws of Indonesia

The Ninth section

Funding Article 27

(1) Funding and SILN assets hosted by the Government are charged on the budget of the Ministry of Education and Culture and the Ministry of Foreign Affairs as well as other funding sources not binding on the terms of the invite-invite rule.

(2) The provisions of the funding and record of assets as referred to in paragraph (1) are governed in separate regulations.

Section 29

Part Tent

Closing SILN

Section 30 (1) The Representative may propose a SILN closure to the Ministry

Education and Culture through the Ministry of Foreign Affairs. (2) The SILN closure as referred to in paragraph (1) can

be proposed if: a. The number of educated participants is less than 16 (sixteen) in the

time 3 (three) of consecutive years;

b. hosting SILN does not correspond to the purpose of the establishment of SILN as referred to in Article 2;

c. there is a state of kahar (force majeure); d. disconnect of diplomatic relations with the recipient country;

and/or

e. hosting SILN violates the provisions of the laws.

(3) Special on SILN hosted by the public, it can be proposed to be closed if the financing for hosting education is inadequate for 3 (three) consecutive years.

(4) The SILN closure is set by the Ministry of Education and Culture based on the proposal as referred to in paragraph (1).

(5) SILN closure must be followed by:

a. The transfer or transfer of educated participants in other educational units is the same and the same type;

b. the submission of SILN ' s archives to the Ministry of Education and Culture through the Representative.

CHAPTER V EDUCATION EARLY CHILD EDUCATION AND NONFORMAL EDUCATION

Part of the Teacher's Education

Article 31 (1) The Representative or the Indonesian public can host

age child education premature and non-formal education abroad. (2) The education of early child education and nonformal education

as referred to in paragraph (1) is required to obtain the permission of the Ministry of Education and Culture in accordance with the proposal of the Ministry of Foreign Affairs.

(3) Child Education Early age and non-formal education abroad, as referred to in verse (1) include educational units or education programs of early childhood education and nonformal education.

(7) The education of early child education and nonformal education can use the SILN facility with the approval of the Ministry of Education and Culture, the Ministry of Foreign Affairs, and local country.

Article 32 (1) Accreditation of non-formal education abroad

is performed by the National Accreditation Board of Early Child Education and Nonformal Education.

(2) Early child education and nonformal education is organized based on the national education system.

The Second Part of the Establishment

Article 33

Establishment of a child education unit or program Early age and non-formal education abroad must obtain the permission of the Minister of Education and Culture.

Article 34

(1) The requirement of establishing an early-age child education unit and a nonformal education is made up of: a. Administrative requirements; and

b. Technical requirements. (2) The administrative requirements consist of:

a. Photo copy of the founder ' s passport; b. the founder's residence permit from a local country;

c. a title of entitlement or a contract of use of a learning place for 1 (one) years;

d. a letter of statement of misrepresentation organizing an early childhood education and a nonformal education;

e. task array and task details; and

f. special for early child education units and nonformal education organized by the public, must have the governing body of the law.

(3) Technical Requirements of the Master Plan Development Unit Education by referring to the National Standards of Education.

Article 35

Tata means the establishment of an early child education and non-formal education abroad: a. The organizers of the establishment of the Dini Age Child Education Unit and

Nonformal Education apply in writing to the Ministry of Education and Culture through the Representative by attaching the completeness of the requirements as referred to in Article 30;

b. Representatives deliver recommendations and application files to the Ministry of Education and Culture at least 30

(thirty) working days after receiving a request from the organizer of an early child education unit and a nonformal education;

c. The Ministry of Education and Culture published the establishment of the establishment of the Dini and Nonformal Education Unit in the longest 30 (thirty) business days after receiving the application of the application and recommendations from the Representative; and

d. The Ministry of Education and Culture through the Directorate General in charge of early childhood education and nonformal education publishes the Mother Number of the Education Institute of the Dini Age and Nonformal Education.

Article 36

(1) The license of an early child education unit or education program is granted for a term of 3 (three) years and may be extended.

Third Part

Didik Participant Article 37

(1) Educations on the education unit of early childhood and nonformal education abroad are the WNI who live abroad.

(2) the education unit of the child early and Nonformal education can receive educated participants/citizens learning WNA requirements.

(3) The requirements as referred to in paragraph (2) are set by an early child education unit and a nonformal education.

(4) In establish requirements as referred to in paragraph (3) of the non-formal educational unit must: a. guidelines on the provisions of the laws

Indonesia and the local country; and b. receive consideration from the Ministry of Education and

Culture and Foreign Ministry.

Fourth Quarter Educable and Workforce Education

Article 38 (1) Educations on the education unit of child-age education and education

nonformal abroad consists of WNI and WNA.

(2) Teacher SILN can be assisted in becoming an educator in the education unit of early childhood and non-formal education abroad after obtaining permission from the Ministry of Education and Culture based on the recommendation of the Representative.

(3) WNI who lives outside the country can be assisted as an educator in the education unit of early childhood and non-formal education by meeting the requirements of:

a. have competence as an educator; b. have permission to stay in the local country.

(4) Eductional and workforce employed in child education units of early age and nonformal education are selected and appointed by the organizers.

The Fifth Part of the coaching and the Supervision

section 39 (1) The coaching and supervision of an early child education unit and

nonformal education abroad is carried out by the Ministry of Education and Culture and the Ministry of Foreign Affairs.

(2) Coaching and the oversight as referred to the paragraph (1) conducted by the Ministry of Foreign Affairs through Representatives include:

a. receive, research, and examine the application of the establishment of an early child education program and a nonformal education delivered by an early-age child education and nonformal education;

b. delivered the application of the establishment of the establishment of an early child education and nonformal education program delivered by an early-age child education and nonformal education to the Ministry of Education and Culture;

c. receive and propose a list of nominations while participants of the national exam of education are nonformal;

d. oversee the hosting of the national exam of equality education or final evaluation of learning for all non-formal education programs and competency trials;

e. signed a national exam results letter and an equality diploma;

f. provide periodic monitoring and evaluation of early child education and education units and nonformal education programs; and

g. receive periodic reports from the child education unit early age and nonformal education and deliver to the Ministry of Education and Culture.

(3) Coaching and supervision as referred to paragraph (1) performed by The Ministry of Education and Culture is implemented under the terms of the laws including:

a. establish the implementation, coaching, supervision, education assessment of early child education and nonformal education and execution of a nonformal education national exam;

b. Carry out the coordination, coaching, supervision, education assessment of early child education and nonformal education and execution of a nonformal education national exam;

c. grant the hosting of non-formal education programs over input from the Representative;

d. carrying out the implementation of implementation of early child education programs and nonformal education;

e. carry out the national exam of nonformal education; f. provide a national exam results letter blanko,

diplomas, certificates, and literacy letters; and g. monitoring, evaluating, and fostering host

Early-age child education programs and nonformal education.

Part of Sixth Reporting

Article 40 of the Unit or an early child education program and nonformal education through The Chief of Representatives is required to provide an education report to the Ministry of Education and Culture and the Ministry of Foreign Affairs at the end of the semester.

Seventh Funding Section

Article 41 (1) Funding and SILN assets of early childhood education and education

nonformal hosted by the Government is charged on the budget of the Ministry of Education and the Culture and the Ministry of Foreign Affairs as well as other sources of funding that are not binding on the provisions of the laws.

(2) The terms of funding and record of early child education and nonformal education assets as referred to in paragraph (1) are set in separate rules.

Section Eighth

Closing Article 42

(1) A representative can propose the closure of an early child education unit or program of education and a nonformal education abroad to the Ministry of Education and Culture through the Ministry of Foreign Affairs.

(2) The closure as intended on a paragraph (1) can be proposed if: a. hosting an early child education unit or program

and a nonformal education do not match the purpose of its founding;

b. The state of the kahar (force majeure);

c. The severance of diplomatic relations with the recipient country; d. The host of education violates the rules of the law

BAB VI

TRANSITIONAL provisions

Article 43 of the formal and nonformal educational units abroad that have been in operation and have the founding permission of the Minister of Education and Culture is obliged to adjust to the Joint Rules of the most slow 2 (two) years from the start of this Joint Regulation.

Article 44 At the time the Bersamaini Regulation came into effect, the Joint Decree of the Minister of Foreign Affairs and the Minister of Education and Culture Number 191/81/01 and No. 951 /U/1981 on the Guidelines of Indonesian Schools Outside the country is revoked and declared not in effect.

BAB VII CLOSING

Article 45 of the Joint Rules begins to take effect on the date of the promulcings.
