IRRIGATION COMMISSION

WITH THE GRACE OF GOD ALMIGHTY

MINISTER OF PUBLIC WORKS AND PEOPLE ' S HOUSING

DRAWS: a. that in order to fulfill the need for irrigation water for various parties and in line with Article 37 of the paragraph (1) of the Government Regulation No. 23 of 1982 on Irrigation and to ensure an orderly conduct of the management of irrigation networks built by the Government The central, provincial government, and county/city regional governments, need to be formed of the institutional management of irrigation;

Establish: REGULATION OF THE MINISTER OF PUBLIC WORKS AND PEOPLE ' S HOUSING ON THE IRRIGATION COMMISSION.

BAB I

provisions of UMUM

Article 1

In this Ministerial Regulation, referred to:

1. Irrigation is a means of providing, setting, and disposal of irrigation water to support agriculture that are of its kind including surface irrigation, marsh irrigation, underground water irrigation, irrigation pump, and tambak irrigation.

2. Irrigation systems include irrigation infrastructure, irrigation water, irrigation management, the institutional management of irrigation, and human resources.

3. The provision of irrigation water is the determination of the volume of water per unit of time allocated from a water source for an irrigation area based on time, quantity, and quality in accordance with the need to support agriculture and other purposes.

4. Irrigation water settings are activities that include sharing, giving, and use of irrigation water.

5. Irrigation water sharing is the activity of dividing the water in buildings for the primary and/or secondary networks.

6. Irrigation water is an activity of channeling water with certain amounts of primary or secondary networks to tertiary tenement.

7. The use of irrigation water is the use of water from tertiary tenement to irrigate farmland at a time when necessary.

8. Irrigation water disposal, then called drainage, is an overwater flow that is not used in a particular irrigation area.

9. An irrigation area is a unit of land that receives water from a single irrigation network.

BAB III

POSITION, WORKSPACE, DUTIES, AND FUNCTION

Section Parts

Provincial Irrigation Commission

Article 3

(1) The provincial irrigation commission is located in the provincial capital.

The provincial irrigation commission has a working area that includes:

f. provide input in order to evaluate the management of irrigation assets;

g. provide consideration and input on granting of water allocation permits for the activities of the regional expansion of the irrigation network and the increased irrigation network;

h. Provide input to the governor regarding the designation of the right to use water for irrigation and water business rights for irrigation to the business entity, the social entity, or the individual;

i. discuss and provide consideration to the problem of irrigation areas due to drought, flooding, and other natural disasters;

j. provide input and consideration in the area regulatory designation process on irrigation;

k. provide input and consideration in an effort to maintain the reliability and sustainability of the irrigation system; and

l. report to the governor the results of the program and the progress, input obtained, and report on activities performed during 1 (one) year activities.

(2) On the irrigation area as referred to in Article 4 of the letter b, the provincial irrigation commission help the governor with the task:

j. provide input and consideration in the area regulatory designation process on irrigation;

k. provide input and consideration in an effort to maintain the reliability and sustainability of the irrigation system; and

l. report on the results of activities to the governor regarding the program and progress, input obtained, and report on activities performed for one year.

Section 6

Section 10

Commission Irrigation District/City

Article 11

Article 13

e. Formulate a plan that has been prepared by the service of the agency to consider the water discharge data available on any part of the irrigation, simultaneous or group water, the suitability of the plant type, and the division plan and water-giving;

f. Formulate an irrigation network maintenance and rehabilitation plan that includes priority provision of funds, maintenance, and rehabilitation;

g. provide input in order to evaluate the management of irrigation assets;

h. provide consideration and input on granting water allocation permits for the activities of the expansion of the irrigation network service and irrigation network upgrades;

i. provide input for use of water for irrigation and the right to work for irrigation to a business entity, social entity, or individual;

j. Discuss and address the problems of the irrigation area due to drought, flood, and other natural disasters;

k. provide input and consideration in the area regulatory resettlement process concerning irrigation;

l. provide input and consideration in an effort to maintain the reliability and sustainability of the irrigation system; and

m. report the results of activities to the regent/mayor regarding the program and progress, input obtained, as well as report on activities performed during 1 (one) year.

(2) On the irrigation area as referred to in Article 12 of the letter b, commission County/city irrigation helps the regent/mayor with the task:

a. propose a formulation of a policy plan to the governor to maintain and improve the condition and irrigation function;

b. Formulate an annual plan of provision, division and irrigation of irrigation for agriculture and other purposes;

d. g. provide consideration and input on granting of water allocation permits for the activities of regional expansion of irrigation network services and an increase in irrigation networks to be passed on to the governor;

i. discuss and provide consideration to the problem of irrigation areas due to drought, flooding, and other natural disasters;

j. provide input and consideration in the area regulatory designation process on irrigation;

l. report the results of activities to the bupati/mayor, regarding the program and progress, the input obtained, as well as report the activities performed during 1 (one) year.

BAB IV

ORGANIZATIONAL STRUCTURE, MEMBERSHIP, AND WORK ORDER

PROVINCIAL IRRIGATION COMMISSION

PARAGRAPH 1

ORGANIZATIONAL ARRANGEMENT OF THE PROVINCIAL IRRIGATION COMMISSION

ARTICLE 15

(1) The irrigation commission ' s management consists of:

Membership of the Provincial Irrigation Commission

Article 16

(1) The membership of the provincial irrigation commission consists of:

a. provincial regional vice government;

b. representatives of the water-user farmers ' sororities in cross-county irrigation areas/kota;

c. co-group users of other irrigation networks; and

d. The deputy district irrigation commission/city that has a county/city irrigation area.

(2) The membership of an irrigation commission as referred to in paragraph (1) the letter b and the letter c are selected proportionally and done with the principle of representation of the irrigation area located upstream, middle, downstream, and the area of irrigation and the irrigation area. performed based on the level of technical, semi-technical, and simple, technical irrigation networks.

Provincial Irrigation Commission

Article 17

Article 18

(1) The right of member of the provincial irrigation commission:

Secretariat of the Provincial Irrigation Commission

Article 19

Article 20

Paragraph 1

Article 22

BAB V

ELECTION PROCEDURE AND IRRIGATION COMMISSION DESIGNATION

Article 36

(1) Procedure The election of an irrigation commission member of the government and non-government elements is carried out through the steps:

a. the governor or regent/mayor each forming a preparatory committee for the formation of a provincial or county/municipal irrigation commission consisting of:

1) the chairperson of the member;

BAB VI

Article 38

BAB VII

FINANCING

Article 39
