PRESIDENT OF THE REPUBLIC OF INDONESIA,

.,, Menting: that to accommodate the evolving aspirations in the House of Representatives is seen as necessary to change the provisions of Article 7, 8 and Article 9 Government Regulation No. 5 Year 1999;

.,, Given: 1. Section 5 of the paragraph (2) of the Basic Law of 1945;
., 2. Act No. 11, 1969 on Retirement Employees and Retired Widows/Duda Employees (1969 State Gazette Number 42, Extra State Sheet Number 2906);
., 3. Law No. 8 of 1974 on the Poes of Staff (State Gazette 1974 Number 55, Additional Gazette number 3041);
., 4. Government Regulation Number 32 of 1979 on the Dismissal Of Civil Servants (State Sheet Of 1979 Number 47, Extra State Sheet Number 3149) as amended by Government Regulation No. 1 Year 1994 (State Sheet of 1994 Number 1);
. .5. Government Ordinance Number 5 Tahun 1999 on Civil Servers Who Are Members Of The Political Party (State Sheet Of 1999 Number 11, Additional Sheet Country Number 3801);

DECIDED:

.,, SET: GOVERNMENT REGULATION ON THE CHANGES TO THE GOVERNMENT REGULATION NUMBER 5 OF 1999 ABOUT CIVIL SERVANTS WHO ARE MEMBERS OF THE POLITICAL PARTY.

Section 1
Change the provisions of Article 7, 8 and Article 9 of the Government Regulation No. 5 of 1999 on Civil Service Employees who are members of the Political Parties, thus the whole reads as follows:

" Section 7
.,, (1) Civil civil servants who have become members and or administrators of the political party at the time of this Government Regulation are set, then the membership and or pertinency of the concerned remove it automatically.
.,, (2) the civil servant as referred to in paragraph (1), if it remains a member and or administrator of the political party, no later than 3 (three) months after the enactment of this Government Regulation shall apply for a request. through the direct superior and if allowed then the concerned release of the state office.
.,, (3) for civil servants as referred to in paragraph (2) which waive the country title applies the provisions of Article 8.
.,, (4) for civil servants as referred to in paragraph (1) that remains a member and or caretaker of the political party, if in the middle of time as such in paragraph (2) does not apply via a direct superior dismissed is not with respect.

Section 8
Civil servants who are members and or political party administrators are dismissed from the state office and given a waiting money of the last principal salary for a year.

Section 9
.,, (1) A civil servant who has been discharged from a public office due to membership and or his own political party, can be reactivated in a public office if he waive his membership and or his own business.
.,, (2) Reactivation as referred to in paragraph (1) may only be performed prior to the term 1 (one) year as defined in Section 8 terminate. "

This Government Regulation shall come into effect on the date of the promulctest.

., to further ensure a neutral and impartial stance in political life, then the status of the membership and or the civil servants of the Civil Servants in the existing political party, with the enactment of this Government Regulation need to be declared. It's more assertive, it's automatically abolished.
., in addition, the granting of the money to the civil servant who is a member and or administrator of the political party for a term of 1 (one) year and may be extended each time 1 (one) year and may not be more than 5 (5) years It is considered to interfere with the concentration of civil servants in exerting all power and power to carry out the task of government and of a defenseless and successful development. In accordance with the terms of this license, the terms and terms of the IBM International Terms of Service are subject to the terms of this license. The term of 1 (1) this year is considered sufficient for civil servants to undergo a period of adjustment.

.,, civil servants who are members and or administrators of the political party and dismissed from the state office do not lose their status as a civil servant.
If civil servants are concerned at the time of being discharged from a public office or at the time of time, the waiting period has been 56 years old or more and has a retirement workforce for at least 10 years, dishonorless. as a civil servant with a pension right.
The waiting money is given for at least 1 (one) year. If after spending the time of the civil servant, the civil servant is not 56 years old but has a retirement age of 20 years or more, then the civil servant is discharged with the right of retirement. when it reaches the age of 50 or so. While having a retirement period of less than 20 years despite being 50 years old or more but not 56 years old then the civil servant is discharged with no pension rights.
In addition to receiving a waiting bribe, to the concerned given the increase in regular pay, family allowances, food allowances, and other allowances under applicable laws.
Civil servants who died, after having spent time receiving money waiting and having a retirement age 20 years or more, were deemed dishonorable as a civil servant, and to the widow/dudanya given retired janda/duda.
