BAB I

provisions of UMUM

Article 1

In this Regional Regulation is intended with:

1. The Central Government, which is later called the Government, is the President of the Republic of Indonesia which holds the power of the government of the Republic of Indonesia as referred to in the Constitution of the Republic of Indonesia in 1945.

2. The Provincial Government is the Governor of West Java and the regional device as an element of the regional government's organizer.

3. The Government of the Regency is the Regent and the area's device as an element of the regional government's organizer.

4. District is Garut County.

5. " Bupati is the regent of Garut.

6. The service is the Water Resources and Mining Service of Garut Regency.

13. Irrigation systems include irrigation infrastructure, irrigation water, irrigation management, the institutional management of irrigation, and human resources.

14. The provision of irrigation water is the determination of the volume of water per unit of time allocated from a source of water for an irrigation area based on time, quantity and quality in accordance with the need to support agriculture and other purposes.

15. Irrigation water settings are activities that include sharing, giving, and use of irrigation water.

16. The division of irrigation water is the activity of dividing the water in buildings for the primary and/or secondary networks.

17. Irrigation water is an activity of channeling water with certain amounts of primary or secondary networks to tertiary tenement.

BAB II

PRINCIPLE, INTENT, PURPOSE, AND FUNCTION

Irrigation is organized by the principle of balance social, economic, technical, participatory, sustainability, environmental insight, general expediency, efficiency, effectiveness, regularity and uniformity, sustainability, justice, independence, transparency, and public accountability.

The Second Part

Mean and Purpose

Article 3

(1) Irrigation arrangements are intended to regulate the implementation of the development and management of irrigation systems in the Regency.

(2) The development and management of the irrigation system as referred to in paragraph (1) is organized partisently, integrated, insightful, transparent, accountable, and justice.

(3) The development and management of irrigation systems aims to achieve water benefit in agriculture to achieve food security.

Third Part

Functions

Article 4

(1) Irrigation Serves to support the productivity of agricultural productivity in order to increase agricultural production in the framework of food security and public welfare, especially farmers, which are realized through the sustainability of the irrigation system.

BAB III

PRINCIPLE OF DEVELOPMENT AND MANAGEMENT OF IRRIGATION SYSTEMS

BAB IV

INSTITUTIONAL IRRIGATION MANAGEMENT

Article 8

Article 9

(1) To realize the stewardship of the irrigation system in county irrigation areas, the Regent can form and establish an irrigation commission.

BAB V

AUTHORITY AND RESPONSIBILITY

First Section

District Government

Article 10

The authority and responsibility of the Government of the District in the establishment of government affairs of development and management of irrigation systems includes: a. establish a county policy in the development and

management of irrigation systems based on the development and management policies of national and provincial irrigation systems with regard to the interests of the surrounding area;

b. carrying out the development of primary and secondary irrigation systems in an irrigation area in one county;

c. carrying out the management of primary and secondary irrigation systems on the area in one county that area is less than 1,000 ha;

d. provide land water usage and company in the county area for irrigation purposes;

e. maintaining the effectiveness, efficiency and order of implementation of the development of primary and secondary irrigation systems on the intact irrigation area in a single county;

f. maintaining the effectiveness, efficiency, and order of execution of primary and secondary irrigation systems in an irrigation area in one county that is less than 1,000 ha;

g. facilitate a settlement of disputes between irrigation areas within a single county related to the development and management of irrigation systems;

h. providing assistance to the community of farmers in the development and management of irrigation systems that are the responsibility of farmers ' society at its request based on the principle of independence;

Second Quarter

Village Government

Article 11

The authority and responsibility of the village government in the holding of government matters of development and management of irrigation systems include: a. carrying out the construction of village irrigation; b. carrying out an increase and management of irrigation systems that

is built by the village government; c. maintaining the effectiveness, efficiency and order implementation of upgrades

irrigation systems on irrigation areas built by the village government; and

d. maintaining the effectiveness, efficiency and order of execution of irrigation systems in irrigation areas built by the village government.

Third Quarter

Farmers Society

Article 12

Rights and The responsibility of the peasant community in the development and management of irrigation systems includes: a. carrying out the development and management of tertiary irrigation systems; b. maintaining the effectiveness, efficiency and order of execution

BAB VI

COOPERATION IN THE DEVELOPMENT AND MANAGEMENT OF IRRIGATION SYSTEMS

First Section

Cooperation between the Government of Regency with Government

Article 13

(1) The Government of the Regency may cooperate with the Government in the development and management of primary and secondary irrigation networks on the basis of the agreement under applicable rules of law-invitation regulations.

(2) Cooperation in development and management as referred to in paragraph (1), including cooperation in the implementation of the construction of new irrigation networks, enhancers and/or rehabilitation of primary and secondary irrigation networks in the county irrigation area.

Second Quarter

Cooperation between the Government of the Regency with Provincial Government

Article 14

(1) The Government of the Regency may cooperate with the Provincial Government in the development and management of primary and secondary irrigation networks under agreement under regulatory terms Applicable laws.

Third Section

Cooperation between the Government of the Regency with P3A Mitra Cai/GP3A Mitra Cai/IP3A Partner Cai

Article 15

In the implementation of the development and management of the system irrigation, the Regency Government can co-operate with P3A Partner Cai or GP3A Partner Cai or IP3A Partner Cai, covering: a. Tertiary network development with P3A Partners Cai in the area

the tertiary services are concerned; b. development of a secondary network with GP3A Partner Cai on

the secondary services area concerned; and c. development of primary networks with IP3A Partner Cai on the area

service/primary or one area of irrigation is concerned.

BAB VII

STAGING OF PEASANT COMMUNITY PARTICIPATION IN DEVELOPMENT AND

IRRIGATION SYSTEM MANAGEMENT

Article 16

The Regency Government in accordance with its authority encourages participation the community of farmers in the development and management of irrigation systems, for improving the sense of independence and sense of responsibility for the sustainability of the irrigation system.

Article 17

(1) The participation of peasant communities in the development and management of irrigation systems begins from the initial stage of thought, decision making, and the implementation of activities in the development, enhancing, operation, maintenance, and rehabilitation.

(2) The participation of the peasant community as referred to in verse (1) can be realized in the form of a donation of thought, ideas, time, power, materials, and funds.

(3) The participation of peasant people as referred to in verse (1) is done individually or through P3A Partner Cai.

(4) The participation of the peasant community as referred to in paragraph (1) is based on of the will and the ability of the peasant society as well as the spirit of partnership and independence.

(5) The participation of the peasant community as referred to in verse (1) can be channeled through P3A's Cai Partners in its work area.

BAB VIII

WATER-USER GROWER EMPOWERMENT

MANAGEMENT OF IRRIGATION ASSETS

Section 53

Section 54

Article 59
