BAB I
UMUM PROVISIONS

Section 1
In this government regulation referred to:
., 1. Water resources are water, water sources, and the power of the water contained within it.
., 2. Water is all the water that is on, above, or below the surface, including in this sense the surface water, groundwater, rainwater, and sea water that are on the ground.
3. Surface water is all the water that is on the ground surface.
., 4. Groundwater is all water that is present in a layer of soil or rock beneath the surface of the ground.
. .5. A water source is a place or a natural and/or artificial water container that is present on, above, or below the surface of the ground.
., 6. Water resource management is an effort to plan, execute, monitor, and evaluate the conservation of water resources, water resources, and water-damaged power controls.
., 7. Water resource management policy is a strategic direction in the management of water resources.
., 8. The water resource management pattern is the basic framework of planning, implementing, monitoring, and evaluating water resource conservation activities, water resources, and water-damaged power control.
., 9. Water resource conservation is an effort to maintain the existence and sustainability of the state, nature, and function of the water resources to be available in quantity and adequate quality to meet the needs of the living, both at the time. Now and the generations to come.
., 10. Water resource assistance is the optimal effort, provision, use, development, and resource of the water resources to be useful and useful.

., 19. Water quality management is an effort to maintain and restore the quality of incoming water and which is in the water source.

., 30. The central government, subsequently called the Government, is the President of the Republic of Indonesia which holds the power of government of the Republic of Indonesia as referred to in the Basic Law of the Republic of Indonesia in 1945.

., 35. Water resource management is an institution that is authorized to carry out water resource management.
., 36. The coordination container of water resource management is the institution where all stakeholders in the field of water resources conduct coordination in order to integrate the interests of various sectors, regions, and owners of interest in the the field of water resources.
., 37. The National Water Resources Board is a national-level water resource management coordination container.

Section 2
The water resources are fully managed, integrated, and environmentally insightful with the goal of realizing sustainable water resources for the great great prosperity of the people.

Section 3
The scope of the water resource management settings in these government regulations includes:
., a., a. water resource management processes, patterns, and water resource management plans;
., b. the implementation of the infrastructure of water resources, operations and maintenance of water resources; and
., c. conservation of water resources and the mutineers of water resources as well as water-damaged power control.

BAB II
WATER RESOURCE MANAGEMENT FOUNDATION

Section 4
(1) The management of water resources is organized by landscape at:

Water Resource Management Policy

Section 5
The water resource management policy includes aspects of water resource conservation, water resource assistance, water damage control, and water resource information systems that are compiled with regard to their respective region conditions.

Section 6
.,, (1) Water resource management policy at a national level, which is subsequently called the national policy of water resources, is compiled and formulated by the National Water Resources Board and set by the President.
.,, (2) The management policy of water resources on the provincial level is compiled and formulated by the coordination container of provincial water resources management and is set by the governor.
.,, (3) Water resource management policies at the district/city level are composed and formulated by the district/city water resource management coordination container and set by the bupati/mayor.

Section 7

Section 8
., (1) The management policy of water resources at a provincial or district/city level can be established as its own or integrated policy into the provincial or district development policies of the concerned city.
.,, (2) Water resource management policies specified in its own as referred to in paragraph (1) to be one of the references in the drafting, review, and/or refinement of development policies in the province region or -District/City.
.,, (3) In terms of the policy of managing water resources integrated into provincial or county development policies, drafting provincial or county development policy/cities should consider the conditions of the water resources.

The Third Part
The criteria and the Tata Way Redemption of the River Region

Section 9
The river region as referred to in Article 4 of the paragraph (1) letter b is designated as:
a. river region in one district/kota;
B. Cross-district river region/kota;
c. cross-province river region;
D. the cross country river region; and
e. the national strategic river region.

Section 10
The river region as referred to in Article 9 is determined based on:
a. the effectiveness of water resource management with the criteria:
.,
.,, 1) may meet the conservation needs of water resources and the mutineers of the water resources; and/or
., 2) has the availability of a water resource infrastructure that connects the river streams that one with the other river streams.
., b. water resource management efficiency with water resource management control criteria; and
., c. the balance of water resource management in wet river flow and dry river flow areas with sufficient criteria for each person's right to obtain water to meet a healthy, clean, and productive life.

Section 11
The criteria for the national strategic river region designation as referred to in Article 9 of the letter e, in addition to having to meet the criteria as referred to in Article 10, must meet the parameters as follows:
., a., a. the potential for water resources on the region of the river concerned greater or equal to 20% (twenty percent) of the potential water resources in the province;
., b. the number of sectors and the number of residents within the river region concerned:

.,, 1) the number of sectors associated with the water resources on the river region at least 16 (sixteen) sectors; and
.,, 2) the number of residents in the river region is at least 30% (thirty percent) of the total population of the province.
c. magnitude of impact on national development:
., 1) social:
.,
., a) the amount of labor on the employment field affected by the water resources at least 30% (thirty percent) of the entire workforce at the provincial level; or
.,, b) on the river region there is a small island or cluster of small islands bordering on the territory of another country;
2) environment:
.,
., a) designed to be a specific and rare biodiversity on a water source that needs to be protected or that is set out in an international convention;
.,, b) the comparison between the maximum river water discharge and the average annual minimum river water discharge on the main river exceeds 75 (seventy-five); or
., c) the comparison between water needs and the availability of mainstay water each year on the river region is concerned over the 1.5 (one-comma five) figure; or
3) economics:
.,
.,, a) there are at least 1 (one) of an irrigation area that is larger or equal to 10,000 (ten thousand) ha;
.,, b) a productive value of the industry that depends on the water resources on the river region at least 20% (twenty percent) of the industry ' s productive value at the provincial level; or
.,, c) there is an electrical production of hydroelectric power plants connected to the cross-province power grid and/or connected to the national transmission network; and
., d. Negative effects of water damage to economic growth resulted in the economic loss of at least 1% (one percent) of the provincial-level Gross Regional Domestic Product (PDRB).

Section 12

Section 13
The designation of the river region may be reviewed if any physical and/or non-physical changes in the river region concerned that under the criteria referred to in Article 10 and Section 11 result in changes to the river region's boundaries. and/or a river region group change.

Water Resource Management Pattern

Section 14
.,, (1) The pattern of water resource management is compiled and set based on the design of the water resource management pattern.

The design of the water resource management pattern as referred to in Article 14 contains:
a. the purpose of water resource management on the river region is concerned;
., b. basic considerations used in performing the management of water resources;
c. some of the river region condition scenarios;
., d. alternative choice of water resource management strategies for each scenario as referred to in the letter c; and
., e. Operational policy to execute a water resource management strategy.

Section 17
.,, (1) The design of water resource management patterns on a river region in one district/city is formulated by the coordination container of water resource management on a river region in one district/city.

The design of the water resource management plan on each river region is composed for a term of 20 (twenty) years.

.,, (1) The draft of the water resource management plan on a river region in one district/city is composed by the Service at the county/city level through a public consultation with the technical agencies and the related community elements.
.,, (2) The design of the water resource management plan as referred to in paragraph (1) is discussed in the coordination container of water resource management on the river region in one district/city to obtain consideration.
.,, (3) Water resource management plan which has gained consideration of the coordination container of water resources management on a river region in one district/city as referred to paragraph (2) is delivered by the Service on District/city level to the regent/mayor to be set to be a river region water resource management plan in a single district/city.
.,, (4) In terms of the coordination container management of water resources on river areas in one district/city not or has not yet formed, the design of the water resource management plan is discussed by the water resource management coordination container -District/City.

The designation of water for water sources as referred to in Article 65 of the letter a is intended to classify water use in water sources into some groups of water use including water quality.

Section 68
.,, (1) The preparation of water for water sources on each river region is carried out with regard to:

B. the number and deployment of the population as well as its growth projection;
c. The calculation and projection of the water resource needs; and
D. The use of water already exists.
.,, (2) The preparation of water for water resources is part of the preparation of the water resource management plan.

The Fourth Part
The provision of Water Resources

Section 69
The provision of water resources as referred to in Article 65 of the letter b is done by principle:

(1) In the use of water resources, the water resource maintainer is mandatory:

(1) Licensee's use of the water resource is required to:

INFORMATION SYSTEM

Section 106

THE FINANCING

.,, (4) The planning fee as referred to in paragraph (2) of the letter b is the cost for the activities of the drafting of the policy, pattern, and management plan of the water resource.
.,, (5) The charge of the construction implementation as referred to in paragraph (2) of the letter c includes the cost for physical and non-physical environmental conservation activities of water resources, water resource assistance, and water-damaged power control.
., (6) The cost of operating and maintenance as referred to in paragraph (2) the letter d is the cost for the operation of the water resource infrastructure and the maintenance of water resources and water resource infrastructure.
., (7) The monitoring, evaluation and empowerment costs of the people as referred to in paragraph (2) letter e constitute the necessary costs for monitoring and evaluation of the implementation of water resource management as well as the costs for the empowerment of the people in the management of water resources.

.,, (4) The determination of the user economic group as referred to in paragraph (3) is based on the type of use and purpose of use of water resources.

BAB XI
SUPERVISION

Section 120

ADMINISTRATIVE SANCTION

Section 121
