EDUCATION EDUCATION

WITH THE GRACE OF THE ALMIGHTY GOD

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weighing: that in the course of implementation Article 29 paragraph (4) Invite-Invite Number 20 Year 2003 on the National Education System, is seen needing to establish a Government Regulation on Education of Diners;

Remembering: 1. Section 5 of the paragraph (2) of the Basic Law of the Republic of Indonesia Year of 1945;
2. Act Number 20 of 2003 on National Education System (State Sheet Indonesia Year 2003 Number 78, Additional Gazette Republic of Indonesia Number 4301);

DECIDED:

Establishing: REGULATION OF THE GOVERNMENT OF THE REPUBLIC OF INDONESIA ON THE EDUCATION OF DENSATIONS.

BAB I
UMUM PROVISIONS

Section 1
In this Government Regulation referred to by:
1. Education of the profession is a profession education organized by the Ministry, other ministries, or non-ministry government agencies that serve to enhance the skills and skills in the exercise of the duty of care for employees A country and a potential civil servant.
2. The profession education is higher education after a bachelor program that prepares educated participants to have a job with special skill requirements.
3. The education unit is a unit of education that organizes profession education in the work environment of the Ministry, other ministries, or the institutions of the non-ministry concerned and/or other educational units outside of the Ministry of Education. the work environment of other ministries or non-ministry government agencies concerned, both on the formal educational path and on the nonformal educational path.
4. Participant education education is a civil servant and prospective civil servant who is given the duty or permission by the Ministry, other ministries, or non-ministry government agencies concerned to follow the education of diners.
5. Accreditation is the eligibility assessment event and educational unit based on the criteria set forth.
6. The Ministry is the Ministry of National Education.
7. Other ministries are the ministries that are authorized to organize the education of diners.
8. The next Nonministerial Government Institution called LPNK is a government agency that is authorized to organize education in the education of the government.
9. The Minister is the minister who organizes government affairs in the field of national education.
10. Another minister is the minister who is authorized by the Minister in organizing the education of diners.

BAB II
FUNCTION AND CHARACTERISTIC

Section 2
Educational education serves to improve the skills and skills of civil servants and prospective civil servants in the Ministry, other ministries, or LPNK in the implementation of tasks in its work environment in order to achieve educational objectives. national.

Section 3
(1) Higher Education is an education that aims to improve the skills and skills of learnants in a particular area of expertise in order to improve the performance of performing duties on the Ministry, other ministries, or LPNK places They work.
(2) Education of didineness oriented towards the interests of community service and the needs of certain professions of the Ministry, other ministries, or LPNK.
(3) The ability and skills as referred to in paragraph (1) are the standard competency of education graduates tailored to the national standards of education by considering the development of science, technology, art, and culture.

BAB III
HOSTING EDUCATION EDUCATION

Section 4
(1) The educational education program has only received the educated participants of civil servants and prospective civil servants.
(2) Civil Servants and prospective civil servants as referred to in verse (1) may come from the Ministry, other ministries, or LPNK organizers of the education program of the diners.

Section 5
(1) The educational educational program that is the educational program of the profession after the bachelor program (S-1) or diploma four (D-IV) may be held in and/or outside of the educational unit present in the Ministry, other ministries, or LPNK associated, both on formal education and on nonformal educational pathways.
(2) Education of a formal education on the course of formal education as referred to in paragraph (1) is organized with a learning load of 36 (thirty-six) up to 40 (forty) semester credit units after the bachelor program (S-1) or diploma four (D-IV) in accordance with the provisions of the laws.
(3) Education of the degree on nonformal educational pathways as referred to in paragraph (1) is organized with the study load equivalent of 36 (thirty-six) up to 40 (forty) semester credit units after the bachelor program (S-1) or diploma four (D-IV) that can be done in the form of courses, education and training, or any other form of type.
(4) The learning burden as referred to in paragraph (2) and verse (3) is calculated from the learning load of face-to-face activities, structured activities, and independent activities that are part of the burden of learning it can be obtained from the results of the learning assessment through experience or credit collection of other educational units set up further with the Minister ' s Rules.
(5) The degree of education with the burden of learning beyond the provisions as referred to in verse (2) and verse (3) is further regulated by the Minister's Ordinance.
(6) The majors on kedinasan education are exercised in the form of specialization programs set by the Ministry, other ministries, or related LPNK.
(7) The study program on education education developed with regard to the objectives of the study program to be achieved, the competency of the expected educated participants, the contribution to national development, contribution to the needs of the people, And the excellence of the education of the diners.
(8) The arrangement and development of the study program is carried out by the Ministry, other ministries, or LPNK concerned after receiving input from the association of professions, the world of work/related industries, and the public.
(9) The majors and courses of study as referred to in paragraph (6) and verse (7) are compiled based on the National Standards of Education.

Section 6
(1) The basic framework and structure of the curriculum education curriculum are defined by the unit of educational kedinasan by engaging the association of the profession by referring to the standard of contents and applicable nationwide.
(2) The education curriculum is developed by the unit of education in accordance with the necessity of execution of the duties and functions of the Ministry, other ministries, or LPNK.

(4) The National Standard of Education for the education of didines as referred to in verse (3) is used as a reference to the development of curriculum, education, means and infrastructure, management, and financing.

Section 7
(1) The certification education certificate is a certificate of competence.
(2) The certificate of competence as referred to in paragraph (1) is provided to the learer as a recognition of the mastery of the competency of a particular area of expertise by an accredited education unit or a certification institution of the profession.

BAB IV
EDUCATORS AND THE EDUCATION WORKFORCE

Section 8
(1) Educency in the education unit is composed of lecturers and instructors/widyaishvara.

BAB V
EDUCATED PARTICIPANT

Section 10
The conditions for learners of the education of the diners:
a. civil servants and prospective civil servants in the Ministry, other ministries, or LPNK;
B. have a bachelor diploma (S-1) or equivalent; and
c. satisfy the acceptance requirements of the education of the education of diners as set forth by the organizers of the education of diners.

Section 11
(1) Educency education Eductiveness has the right:
a. obtaining the cost of the education of care according to the particular expertise that is followed;
B. utilize educational facilities and facilities to improve the learning process;
c. got guidance from educators and educationist in order to completion of its studies; and
D. obtaining information on the education program that is followed, as well as its study.

(3) Further provisions regarding the rights and obligations of the learnable participants as referred to in paragraph (1) and paragraph (2) are governed by the organizers of the concerned education of the concerned.

BAB VI
MEANS AND PRASARANA

Section 12
(1) The management of the means and infrastructure acquired with the funds derived from the State Revenue and Shopping Budget in the organizers of the education of the diners is held under the provisions of the.
(2) The management of the means and infrastructure acquired with funds that are not derived from the State Budget and Shopping Budget is governed by the organizers of the education of diners.

BAB VII
THE FUNDING

Section 13
(1) The funding of education is derived from the State Revenue and Shopping Budget and/or any other source in accordance with the provisions of the laws.
(2) The use of the education funds is governed in accordance with the provisions of the laws.

Section 14
(1) Autonomy of the financial education unit in finance enforces the authority to accept, store, and use funds.
(2) Management of the education fund adheres to the principle of transparency and public accountability.
(3) The financial management of nursing education derived from the State Budget and Shopping Budget is examined by the Government ' s functional supervising apparatus in accordance with the provisions of the laws.

Section 15
Budget plans and education spending plans are proposed by the leadership of the unit of education of education through the Minister, other ministers, or LPNK leadership to the Minister of Finance to be passed into the education budget of the dineness.

BAB VIII
ESTABLISHMENT

Section 16
(1) The establishment of education kedinasan by the Ministry, other ministries, or LPNK is based on the need for certain expertise to improve the performance of the execution of tasks and functions on the Ministry, other ministries, or related LPNK.
(2) The establishment of the education of kedinasan is based on the written proposal of the Ministry, other ministries, or LPNK to the Minister covering:
a. the study results of the needs of the Ministry, other ministries, or LPNK in certain areas of expertise so requiring education of health care;
B. the results of the study of the needs of the Ministry, other ministries, or LPNK as referred to in the letter a cannot be met by a public college;
c. projection of the number and qualification of education as well as the employment status of a proposed student student proposed to follow the education of the diners;
D. Competency standards, competency trials, and competency certificates that will be used in the education of such care;
e. the education unit and the necessary executor sources, whether in the environment of the Ministry, other ministries, or the related LPNK and those outside the Ministry, other ministries, or LPNK; and
f. Basic budget plans.

Section 17
(1) Terms to obtain the founding permit of the least confounded education unit to have:
a. curriculum;
B. educators and educationist;
c. Education means and infrastructure;
D. the source of financing for the survival of the least for 1 (one) the next academic year;
e. evaluation and certification systems;
f. education systems and educational processes;
G. the specificity of the education of the dinasan; and
h. The legal basis for the education of the diners.
(2) Terms as referred to in paragraph (1) in accordance with the provisions of the laws.
(3) The approval of the establishment of the education of the dineness as referred to in verse (1) is set by the Minister.

Section 18
The establishment of a unit of education is valid for a specific period of time according to the projection of experts in certain areas of expertise required by the Ministry, other ministries, or LPNK.

BAB IX
EVALUATION AND ACCREDITATION

Section 19
(1) Evaluation of tertiary education is carried out in order of quality control as a form of accountability.
(2) Evaluation of kedinasan education is carried out against educated participants, educational units, and educational programs.
(3) The evaluation of the learners is carried out by the unit of education of densations.
(4) Evaluation of the education unit and the education program of kedinasan is carried out by the independent agency authorized by the Minister.
(5) Further provisions on the manner of the implementation of the evaluation and determination of independent institutions as referred to in paragraph (4) are governed by the Regulation of the Minister.

Section 20
(1) Accreditation is done to determine the feasibility of a study program and/or an education unit.
(2) Accreditation as referred to in paragraph (1) is performed by the National Accreditation Board of Higher Education (BAN-PT) for the education of formal diners and the National Accreditation Board of Nonformal Education (BANPNF) for the education of nonformal diners.
(3) The Accreditation as referred to in paragraph (1) may also be carried out by other independent agencies given the authority by the Minister.

BAB X
SUPERVISION

Section 21
(1) Government, local government, and the public conduct oversight of the education of didineness with the principle of transparency and public accountability.
(2) The supervision as referred to in paragraph (1) is performed to ensure the quality of the education of the health in accordance with the provisions of the laws.

BAB XI
COOPERATION

Section 22
(1) The education unit may be in cooperation with other institutions, both at home and abroad.
(2) The cooperation as referred to in paragraph (1) may be in the form of cooperation in academic and/or non-academic fields.
(3) The cooperation in the academic field as referred to in paragraph (2) can be shaped:
a. the return program;
B. credit collection program and credit transfer program;
C. tukar-exchange of educators and/or education;
D. utilization of various resources;
e. scientific periodical publishing;
f. research and development;
G. host of seminars;
h. order education program; and/or
i. Other forms are considered necessary.
(4) The cooperation in non-academic fields as referred to in paragraph (2) may be shaped:
a. management contract;
B. an asset yaginization;
c. fundraising efforts;
D. the share of the services money and the intellectual property rights royalties/paten; and/or
e. Other forms are considered necessary.

BAB XII
THE SANCTION

Section 23
The organizer of the education education that does not meet the requirements as referred to in Article 17 is granted administrative sanction of an oral reprimand, a written reprimand, or revocation of the permit for the education of the dineness.

BAB XIII
THE TRANSITION PROVISION

Section 24
(1) The statutory education unit organized under the Law No. 2 Act 1989 on the National Education System is mandatory to be amended by selecting one of the alternatives as follows:
a. For the education of the diners whose protégates of civil servants and prospective civil servants, both central and regional, are available 4 (four) alternative adjustments:
1) pertinated education is made the education and training of employees organized by the Ministry, other ministries, or the LPNK concerned in accordance with the provisions of the laws, to meet the needs of the will employee skills;
2) The education of pertinous care is maintained to remain a level of education that meets all the requirements set out in the Regulation of this Government, to meet the needs of professional education, specialists, and special skills. other;
3) The education of pertinous care is transliterated into an educational legal body, which the other ministry or LPNK is concerned as the founder has a representation in the organs of stakeholder representation, to meet the needs of going to secondary education, vocational higher education, and academic higher education;
4) The education of pertinous care is transliterated into an educational legal body, which the other ministry or LPNK is concerned as the founder has a representation in the organs of stakeholder representation, to meet at once all needs as are in the letters a number 1), the number 2), and the number 3).
B. For the education of diners whose protégants are not civil servants and not civil servants, available 3 (three) alternative adjustments:
1) The education of pertinous care is transliterated into an educational legal body, which the other ministry or LPNK is concerned as the founder has a representation in the organs of stakeholder representation, to meet the needs of sustainable sectoral and requires the strict supervision and quality of quality from other ministries or the LPNK concerned;

(2) The adjustments as referred to in paragraph (1) must be completed at least 5 (five) years since the Government's Ordinance is promultable.

Section 25
All existing laws that have been present at the time of this Government Regulation are promulgled still in effect as long as not contradictory and have not been replaced under this Government Regulation.

BAB XIV
CLOSING PROVISIONS

Section 26
This Government Regulation shall come into effect on the date of the promulctest.
