THE INCLUSION OF THE CAPITAL OF WEST JAVA PROVINCIAL GOVERNMENT

ON PT TIRTA GEMAH RIPAH

WITH THE GRACE OF THE ALMIGHTY GOD

THE GOVERNOR OF WEST JAVA,

DRAWS: A. that in order to add capital to the government of the West Java Provincial Government on PT Tirta Gemah Ripah, the gradual inclusion of the Regional capital was in accordance with the Regional financial capability;

b. that the inclusion of capital of the Government of West Java Province in PT Tirta Gemah Ripah as contemplated by the letter a, is set with the Regional Regulation of the Province of West Java;

Given: 1. Law No. 11 of 1950 on the Establishment of West Java Province (State News of the Republic of Indonesia on 4 July 1950) Jo. Law No. 20 of 1950 on the Government of Greater Jakarta (State of the Republic of Indonesia 1950 No. 31, Additional Gazette of the Republic of Indonesia Number 15) as amended several times, last with Invite-Invite No. 29 Year 2007 on the Government of the Provincial Special Region of Jakarta as the State Capital of the Republic of Indonesia (Indonesian Republic of Indonesia Year 2007 Number 93, Additional Gazette Republic of Indonesia Number 4744) and Law No. 23 Year 2000 on the Establishment of the Banten Province (State Sheet) Republic of Indonesia Year 2000 Number 182, Additional Gazette of the Republic of Indonesia No. 4010);

DECIDED:

SET: THE REGIONAL REGULATIONS ON THE INCLUSION OF GOVERNMENT CAPITAL WEST JAVA PROVINCE IN PT TIRTA GEMAH RIPAH.

BAB I

provisions of UMUM

Article 1

In this Region Regulation, it is referred to:

1. The area is the province of West Java.

2. The Regional Government is the Governor and the Regional Devices as an organizer of the Regional Government.

3. The Governor is the Governor of West Java.

4. The Regional People's Representative Council (DPRD) is the Regional People's Representative Council of West Java Province.

5. The next of the Gemah Gemah Ripah (Limited) is a Limited Perseroan-shaped Business Entity established under the Akta Notary Meidward Nainggolan, SH No. 17 of the 2003 Jo's 21 March. The Act of Change No. 30 of October 14, 2005 and has been awarded from the Minister of Justice on 22 May 2003 with its Decision Number C. 11282.HT.01.01.TH 2003 and confirmed by the Regional Regulation No. 12 of 2006 on PT Tirta Gemah Ripah, next has undergone several changes, last with Akta Notary Yuliani Idawati, SH, Sp.N. 7. Area Capital Inclusion is any attempt to include the Regional Capital on a joint venture between the Regions and/or with other private/body entities and/or Regional Capital utilization by other entity/entity with a purpose, purpose and/or entity's capital, and/or other entity's capital. BAB II

INTENT AND PURPOSE

Article 3

The purpose of the Local Government's capital inclusion in PT Tirta Gemah Ripah is:

a. developing Regional investment;

b. improving the application of PT Tirta Gemah Ripah;

c. pushed the Regional economic growth; and

d. Increase the original revenue of the Region.

BAB III

INCLUSION CAPITAL

Article 4

(1) The liability for the inclusion of the Regional Capital on PT Tirta Gemah Ripah is 51% (fifty-one percent) of Rp. 60.000.000.00 (sixty-one percent) billion) which is divided over 600,000 (six hundred thousand) shares with a nominal value of Rp. 100.000.00 (one hundred thousand rupiah) per share sheet or Rp. 30,600,000.000.00 (thirty billion six hundred million rupiah) divided over 306,000 (three hundred and six thousand) a share sheet.

(2) The inclusion of Regional Capital on PT Tirta Gemah Ripah As of December 31, 2007, the company was Rp. 3,300,000.00 (three billion three hundred million rupiah) divided over 33,000 (thirty-three thousand) of shares with a nominal value of Rp. 100,000.00 (one hundred thousand rupiah), so that there is residual liability for the addition of a paid capital of Rp. 27,300,000.00 (twenty-seven billion three hundred million rupiah).

(3) To meet the remaining capital addition of the Government of the Regions as referred to in paragraph (2), it is announced the inclusion of the Regional Capital in the APBD Change of the Year of Budget 2010 on the expenditure section of Rp. 6.120.000.00 (six billion hundred and twenty million rupiah) which are divided into 61,200 (sixty-one thousand two hundred) shares with a nominal value of Rp. 100.000.00 (hundred thousand rupiah).

(4) In terms of the inclusion of the Regional Capital as referred to in paragraph (3) has been met, then the remaining obligation of adding capital to PT Tirta Gemah Ripah was Rp. 21,180,000,000,-(twenty-one billion hundred and eighty) million rupiah).

(5) The remaining obligation of capital addition of the Regional Government as referred to in paragraph (4), will be met through the inclusion of the Regional capital gradually according to the needs of PT Tirta Gemah Ripah and based on financial capabilities The area, whose bulk is being broadcast in the Regional Regulation on APBD.

BAB IV

CONTROL

Article 5

(1) The Board of Directors PT Tirta Gemah Ripah delivers a report on the development of quarterly business activities and reports quarterly and semester as well as the Annual Financial Report to the Governor, accordingly the provisions of the laws.

(2) The Annual Financial Report as referred to in paragraph (1) must be audited by the Public Accountant.

(3) The Governor delivers reports of business activities and financial reports each semester to the DPRD.

BAB V

Article 6

With the provisions of this Regional Regulation, then the Regional Regulation of West Java Province Number 8 Year 2007 on the Raid of Capital of West Java Province in PT Tirta The Ripah Gemah (section Of The Area Of 2007 Number 7 Of The Series E, Extra Sheet Area Number 37) was revoked and stated to be not valid.

CONCERNING

THE CAPITAL INCLUSION OF THE GOVERNMENT OF WEST JAVA PROVINCE

ON PT TIRTA GEMAH RIPAH

I. UMUM.

PT Tirta Gemah Ripah was the Regional Business Agency of the Province of West Java whose foundation was poured in the Akta Notary Meidward Nainggolan, SH number 17 of 21 March 2003, which had received the authorization of the Minister of Justice. The Republic of Indonesia through Decision No. C-11282 HT.01 01.TH.2003, which was then confirmed with the Regional Regulation No. 12 Year 2006 on PT Tirta Gemah Ripah. The efforts of PT Tirta Gemah Ripah are the development, enterprise and utilization of water resources intended for the welfare of the people who are expected to provide a good service to the community, helping to move Regional economy and contributing to Regional revenues.

Modal base PT Tirta Gemah Ripah in Akta Notary Meidward Nainggolan, SH No. 17 of 21 March 2003 was set at Rp. 1.000.000.00 (one billion rupiah), Then in Regional Regulation No. 12 Year 2006 enhanced to the size of Rp. 60.000.000.00 (sixty-billion rupiah). The ownership of shares of the Government of West Java Province is at least 51% or Rp. 30,600,000.00 (thirty billion six hundred million rupiah). As for the realization of the inclusion of the regional capital on PT Tirta Gemah Ripah until December 31, 2009 was Rp. 3,300,000.00 (three billion three hundred million rupiah), so it still has the remaining liabilities of Rp. 27,300,000.00 (two Twenty-seven billion three hundred million rupiah) whose fulfillment is done gradually according to the needs of PT Tirta Gemah Ripah and the Regional financial capabilities.

Article 5 Verse (1)
