REGULATION OF THE REPUBLIC OF INDONESIA FINANCE MINISTER

NUMBER 128 /PMK.011/ 2010 ABOUT

THE DESIGNATION OF THE CUSTOMS TARIFFS ON IMPORTED GOODS IN ORDER ASEAN TRADE IN GOODS AGREEMENT (ATIGA)

WITH THE GRACE OF GOD ALMIGHTY THE FINANCIAL MINISTER OF THE REPUBLIC OF INDONESIA,

THE DRAW: A. that on February 26, 2009, the Government of Indonesia has signed the ASEAN Trade in Goods Agreement (ATIGA) which is the codification and refinement of ASEAN agreements in the comprehensive and integrative trade of goods accordingly. with the ASEAN Economic Community (AEC) blueprint deal related to the movement of goods flows (Free Flow of Goods) as one of the single market-forming elements and a regional production base;

b. that ATIGA as referred to in the letter a, has been ratified with the Presidential Regulation No. 2 of 2010 on the Unrest ASEAN Trade in Goods Agreement (ASEAN Goods Trade Concern);

c. that under Article 21 Paragraph 1 (a) ATIGA has been established that any member country is obligated

to publish the legal enactment to assign a custom tariff on the entire product in the category Inclusion List (IL) in accordance with the commitments that have been set up in Common Effective Preferential Tariff for ASEAN Free Trade Area (CEPT-AFTA);

d. that based on the terms of the letter a, the letter b, and the letter c, and in order to carry out the provisions of Article 13 of the paragraph (2) of the Law Number 10 of 1995 on Kepabeanan as amended with the Invite Number 17 In 2006, it was necessary to establish the Minister of Finance Regulation on the Designation Of The Import Tariff On Imported Goods In The Framework Of The ASEAN Trade In Goods Agreement (ATIGA);

Given: 1. Law No. 7 of 1994 on the Unrest of the Agreement Establishing the World Trade Organization (State Gazette of the Republic of Indonesia in 1994 No. 57, Additional Gazette of the Republic of Indonesia Number 3564);

2. Law No. 10 of 1995 on Kepabeanan (Gazette of the Republic of Indonesia in 1995 No. 75, Additional Gazette of the Republic of Indonesia Number 3612) as amended by Law No. 17 of 2006 (State Sheet) Indonesia's Republic of 2006 Number 93, Additional Gazette Republic of Indonesia Number 4661); Presidential Regulation No. 2 of 2010 on the Unrest ASEAN Trade in Goods Agreement (ASEAN Goods Trade Unrest);

3. The Presidential Decree No. 2 of 2010 on the Unrest ASEAN Trade in Goods Agreement (ASEAN Goods Trade Concern);

4. President's Decision No. 56/P of 2010;

DECIDED:

STIPULATING: THE REGULATION OF THE MINISTER OF FINANCE ON THE DESIGNATION OF THE IMPORT TARIFFS ON IMPORTED GOODS IN ORDER ASEAN TRADE IN GOODS AGREEMENT (ATIGA).

Article 1 Establits import tariffs on imported goods from ASEAN countries, including Brunei Darussalam, Cambodia, Laos, Malaysia, Myanmar, Phillipina, Singapore, Thailand, and Vietnam, in order ASEAN Trade in Goods Agreement (ATIGA), as specified in this Financial Minister Regulation Attachment that is an inseparable part of the Regulation of this Financial Minister.

Article 2 of the provisions of this Financial Minister Regulation applies to goods import whose goods import notification documents have gotten the registration number from Customs office port of income.

Article 3 The introduction of the customs tariff as referred to in Article 1 is implemented as follows: 1. Tarif customs entry in the lower ATIGA frame of the customs rate

entry in general is only applied against imported goods which are equipped with (Form D) which has been signed by the authorized officials in the ASEAN country;

2. Importers are required to list the ATIGA facility code and the reference number of the Origin Letter of Origin (Form D) at the import notice of goods; and

3. (Form D) The original sheet is required to be delivered by the importer at the time of submission of the import notice of goods on the Customs Office in the port of admission.

Article 4 By the enactment of this Financial Minister Regulation, against the import The items that are submitting the import notifications of goods have obtained the registration number of the Customs Office in the port of income, apply the following terms:

a. Import of goods that obtain an item's import notice registration number until June 30, 2010, using the Letter of Origin (Form D) in order of the Common Effective Preferential Tariff (CEPT) scheme;

b. Import of goods which obtain the goods import notification registration number from 1 July 2010 to 6 November 2010, may use the Letter of Origin (Form D) in order of the CEPT scheme or the Origin Letter of Origin (Form D) in the frame of ATIGA.

Section 5 At the time of this Financial Ministerial Regulation is in effect, the provisions regarding the designation of the customs tariffs as set in: 1. Finance Minister Regulation Number 125 /PMK.010/ 2006 on Redemption

Tarif Bea Entry For Goods Import Of Certain Products In The Framework Of The Common Effective Preferential Tariff (CEPT) Scheme;

2. Regulation of Finance Minister Number 129 /PMK.011/ 2007 on the Assignment Of Import Tariffs On Imported Goods In Order Of The Common Effective Preferential Tariff (CEPT) as amended with the Regulation of Finance Minister Number 127 /PMK.011/2008;

3. Finance Minister Rule Number 247 /PMK.011/ 2009 on Classification Changes And The Designation Of Import Duties On Imported Goods-specific Products In Order Of The Common effective Effective Preferential Tariff (CEPT),

revoked and Declared does not apply. Article 6

The Director General of Customs and Excise is instructed to carry out the provisions in the Regulation of the Minister of Finance.

Article 7 of the Regulation of the Minister of Finance is in effect on the date of promulgations and has the power to recede. As of January 1, 2010.
