ABOUT
IMPORT DUTIES ON SECURITY MEASURES AGAINST THE IMPORT OF PRODUCTS IN THE FORM OF A TARP OF SYNTHETIC FIBERS OTHER THAN AWNING AND THE SUN ' S COOL

FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,

Weigh: a. that under the provisions of Article 70 of the Government Regulation No. 34 of the Year 2011 on Anti Dumping Action, the Act of Imbalan, and the Act of Trade Security, against imported goods, in addition to being subjected to Customs, may be subject to the Measures of Security. In the event of a Security Act, the following are:
B. that based on the results of the Indonesian Trade Security Committee's investigation (KPPI) there is evidence of a spike in the number of imported goods from synthetic fibers in addition to awning and the sun's crust which causes serious losses. against the industry in the country;
c. that based on the results of the KPPI investigation as referred to in the letter a, the Minister of Commerce, through Letter Number: 1069 /M-DAG/ SD/7/2011 dated 15 July 2011, submitted a proposal to the Minister of Finance to wear Bea In Action Safeguards against the import of the tarp products of synthetic fibers in addition to awning and the sun ' s kerai;
D. that under consideration as referred to in the letter a, letter b, and the letter c, and in order to carry out the provisions of Article 23D paragraph (2) of the Law No. 10 Year of 1995 on Kepabeanan as amended by the Act Number 17 Years 2006, required to establish the Minister of Finance Regulation on the introduction of the Safeguard Measures of the Product importation of the Sintetic Serat Other than Awning and the Sun's Kerai;

Given: 1. Act No. 7 of 1994 on the Unrest of the Agreement Establishing the World Trade Organization (State Sheet of the Republic of Indonesia in 1994 No. 57, Additional Sheet of State of the Republic of Indonesia No. 3564);
2. Act No. 10 of 1995 on Kepabeanan (Sheet of State of the Republic of Indonesia of 1995 Number 75, Additional Gazette of the Republic of Indonesia Number 3612) as amended by the 2006 Act Number 17 (Country Gazette) Republic of Indonesia Year 2006 Number 93, Additional Gazette Republic of Indonesia Number 4661);

DECIDED:

Establish: FINANCE MINISTER 'S REGULATION ON THE IMPOSITION OF THE SECURITY MEASURES ON THE IMPORT OF PRODUCTS IN THE FORM OF A TARP OF SYNTHETIC FIBERS IN ADDITION TO AWNING AND THE SUN' S KERAI.

Section 1
Against the import of products in the form of a tarp from a synthetic fiber other than awning and the sun's kerai included in the ex. 6306.12.00.00 tariff post, the Customs is subjected to Security Action.

Section 2
The Duties Of The Security Measures as referred to in Article 1 are imposed for 3 (three) years with the following provisions:

Article 3
Bea entering the Security Act as referred to in Section 1 is subject to the importation of all countries, except against the product of the tarp as referred to in Article 1 produced from the countries as set forth in an Attachment that is an inseparable part of this Financial Minister Regulation.

Section 4
(1) The introduction of the Security Measures as referred to in Article 1 is:
a. additional Customs General (
Most Favored Nation); or
B. additional Bea Login Preferences based on the applicable international goods trade agreement schemes, in terms of import done from countries included in the international goods trade agreement scheme and meet the provisions in international goods trade agreement schemes.
(2) In terms of provisions in the scheme of international goods trade agreements are not met, the imposition of the Customs Enforcement of the importation of the countries included in the trade agreement scheme International goods, as referred to in verse (1) letter b are the most common customs additions (Most Favored Nation).

Section 5
Against the import of the product of a tarp as referred to in Article 1 that is derived from countries excluded from the Custody of the Custody Act as referred to in Article 3 and which is derived from countries that have trade cooperation with Indonesia as referred to in Section 4 of the paragraph (1) letter b, the importer shall submit the Letter of Origin Letter (Certificate of Origin).

Section 6
The provisions regarding the imposition of the Customs Act tariff act as referred to in Article 2 are fully applicable to the import of goods that import customs notice documents mean got the registration number from the Port Customs Office Revenue from the effective date of this Financial Minister Regulation.

Section 7
1. The Regulation of the Minister of Finance is valid for 3 (three) years of date from the effective date of the Regulation of this Financial Minister.
