The ELECTORAL COMMISSION REGULATION number 04 2013 on the FORMATION and GOVERNANCE of OVERSEAS ELECTION COMMITTEE WORK and GROUP ORGANIZERS of OVERSEAS VOTING in the GENERAL ELECTION OF MEMBERS of the HOUSE of REPRESENTATIVES by 2014 with the GRACE of GOD ALMIGHTY, the ELECTION COMMISSION is Considering: that in order to implement the provisions of article 8 paragraph (1) letter b law number 15 year 2011 about Election Organizers and article 32 paragraph (2) Letter c , paragraph (3), paragraph (7), article 41, article 42, article 43, article 44, article 45, article 46, article 102 paragraph (1), section 149 subsection (2), article 158, article 159, article 160, section 161, article 162, section 163, article 164, article 165, section 167, article 168, article 169, article 170, article 171, article 174, paragraph (9), subsection (9), article 175 Article 176, paragraph (2) , (3), (5), article 177, section 179, section 180, 181, article 182 Article paragraph (1), subsection (2), subsection (3), subsection (4), subsection (5), article 192 of the Act number 08 year 2012 general election of members of the House of representatives, the regional representative Council, and Representatives of the region, the need to establish Regulations on the establishment of Electoral and governance Work Overseas Election Committee and group organizers of Overseas Voting In the general election of members of the House of representatives by 2014;
Remember: 1. Act No. 2 of 2008 about the political parties, as amended by laws No. 2 2015 about changes in the law number 2 of 2008 on political parties (State Gazette of the Republic of Indonesia number 8 in 2011, an additional Sheet of the Republic of Indonesia Number 5189);

5. The Joint Electoral Commission Rules, the Supervisory Board Elections, and the honor of the elections in 2012, the number 13 number 11 in 2012 and the number 01 in 2012 about the Peneyelenggara general election code of conduct;
6. The Electoral Commission Regulation number 05 in 2008 About the layout work of Electoral Commission, Provincial Electoral Commission, Electoral Commission and Kabupaten/Kota as modified by regulation Number 21 Electoral Commission in 2008, Election Commission Regulation Number 37 in 2008, an Election Commission Regulation number 01 in 2010;

The Electoral Commission Regulation number 07 in 2012 on the stages, the Program and the schedule of organizing elections of members of the House of representatives, regional representative Council and Regional Representatives by 2014 as amended by regulation number 11 Electoral Commission in 2012, Election Commission Regulations No. 15 in 2012, and Election Commission Regulations No. 18 in 2012 (news of the Republic of Indonesia year 2012 Number 1205);

Decide: define: ELECTION COMMISSION REGULATIONS on the ESTABLISHMENT and LAYOUT of WORK OVERSEAS ELECTION COMMITTEE and GROUP ORGANIZERS of OVERSEAS VOTING in the GENERAL ELECTION OF MEMBERS of the HOUSE of REPRESENTATIVES by 2014.
CHAPTER I GENERAL PROVISIONS article 1 In this regulation, the definition of: 1. The elections, further abbreviated as elections, is a means of implementing the people's sovereignty is exercised directly, free, General, secret, honest, and fair within the unitary State of the Republic of Indonesia based on Pancasila and the Constitution of the Republic of Indonesia in 1945.
2. The House of representatives, hereinafter abbreviated HOUSE of REPRESENTATIVES, is the House of representatives as stipulated in the Constitution of the Republic of Indonesia in 1945.
3. the Electoral Commission, hereinafter abbreviated Election Commission, Election organizers is an institution which is a national, independent and remain in charge of carrying out the election.
4. Election Committee of Foreign Affairs, hereafter abbreviated PPLN, is a Committee formed by the ELECTION COMMISSION to administer Elections in foreign countries.
5. The Group of organizers of the vote Abroad, hereinafter abbreviated as KPPSLN, is a group formed by PPLN to carry out voting in polling stations abroad.
6. the polling stations Abroad, hereafter abbreviated to TPSLN, is the place of performance of the vote abroad. 7. Residents are Citizens of the Republic of Indonesia who are domiciled in the territory of the Republic of Indonesia abroad.
8. Voter is a citizen of Indonesia that has been fulfilled is 17 (seventeen) years or older or have/never marries.
Article 2 in the implementation of tasks and KPPSLN PPLN, based on principles: a. self-contained;

b. be honest;

c. fair;

d. legal certainty;

e. code of conduct;

f. public interest;

g. openness;

h. proportionality;

i. professionalism;

j. accountability;

k. efficiency; and l.  effectiveness.

The REQUIREMENTS of KPPSLN and PPLN MEMBERS article 3 the requirement to become a member and PPLN KPPSLN is as follows: a. citizen of the Republic of Indonesia;

b. the lowest age of 25 (twenty-five) years;
c. loyal to Pancasila as the Foundation of the State, the Constitution of the Republic of Indonesia in 1945, and the ideals of Proclamation 17 August 1945; d. have integrity, strong personal, honest and fair;
e. not be members of political parties that declared with a valid waiver or at least for a period of 5 (five) years ceases to be a member of a political party that is proved by the certificate of the Superintendent concerned political parties; f. domiciled within the working area and PPLN KPPSLN;

g. capable physically and spiritually;

h. educated most low ADMIN or equivalent;
i. never prison are convicted on the basis of a court decision has acquired legal force anyway because doing criminal acts which were threatened with imprisonment 5 (five) years or older.
Article 4 the completeness requirements as stipulated in article (3) include the following: a. a copy of the resident card (KTP) is still valid;

b. a copy of the last diploma legalised by the competent authority;
c. affidavit of allegiance to Pancasila as the Foundation of the State, the Constitution of the Republic of Indonesia in 1945, and the ideals of Proclamation 17 August 1945;

d. affidavit of not being a member of a political party for at least a period of 5 (five) years; e. Health Certificate from local Hospitals or Clinics;
f. waiver never quite part of the prison are convicted on the basis of a court decision has acquired legal force anyway because doing criminal acts which were threatened with imprisonment 5 (five) years or older;

Article 6 (1) PPLN domiciled in the Republic of Indonesia representative office abroad.

(2) KPPSLN domiciled in the polling stations abroad.

CHAPTER IV duties, AUTHORITY, and OBLIGATION of article 7 duties, authority, and obligation of PPLN is: a. assist the ELECTION COMMISSION in updating the data selector, selector list, a list of electors the results of repair, and the list of electors; b. form KPPSLN;
c. Announces list of voters while doing repairs, voter data on the basis of input from the community Indonesia abroad, announced a list of electors the results of repair, as well as setting the list of voters; d. passing on voters ' list of citizens of the Republic of Indonesia to the ELECTION COMMISSION;

e. implement the stages of organizing Elections set by the ELECTION COMMISSION;
f. do the recap of the results of the vote count of the entire TPSLN in the work and results of the vote by post; g. Announces the results of the vote count of the entire TPSLN in the area of work;

h. submit a news event and a certificate of the results of the vote count to the ELECTION COMMISSION;

i. maintaining and securing the integrity of the ballot box;

j. perform evaluation and reporting for each stage of organizing Elections in the territory it works;
k. implementing socialization of organizing elections and/or related to duties and authorities to the people of Indonesia PPLN abroad;
b.  perform duties, authority, and other obligations provided by the ELECTION COMMISSION in accordance with the regulations; and d. carry out tasks, authority and other obligations provided by law.

Article 8 duties, authority, and responsibilities of KPPSLN are: a. announce the list of voters remains in TPSLN;


b. submit a list of voters remained to witness the Election participants present and supervisor of elections abroad;

c. administer the voting and counting of votes in TPSLN;

d. announced the results of the vote count in TPSLN;
e. follow up immediately and report the findings presented by witnesses, Foreign Election Supervisors, participants of the election and the public on the day of voting; f. secure the ballot box after the counting of the votes;
g. making news event of voting and counting of votes, as well as making the obligatory certificate of vote count and hand it to the witnesses, the present Election participants and supervisors of elections abroad; h. submit the results of the vote count and a certificate of the results of the vote count to PPLN;
i. carry out duties, authority, and other obligations provided by the ELECTION COMMISSION in accordance with the regulations; and j.   carry out tasks, authority and other obligations provided by law.

Chapter V MEMBERSHIP article 9 (1) Membership PPLN as much as 5 (five) persons originating from Indonesia, the society's Deputy consisted of: a. one (1) Chairman and members; and b. the 4 (four) members. (2) the Chairman of the PPLN selected from and by members of the PPLN.
(3) Members are appointed and dismissed by the PPLN ELECTION COMMISSION upon the proposal of the head of Representation of the Republic of Indonesia in accordance with the territory it works. (4) the secretariat assisted by PPLN PPLN.

Article 10 (1) the Secretariat PPLN as stipulated in article 9 paragraph (4), consisting of 2 (two) persons chosen from civil servants representative offices of the Republic of Indonesia abroad.
(2) 2 (two) Secretariat PPLN as mentioned on paragraph (1) has the task of: a. one (1) person to manage the Affairs of the Organization of the technical; and b. one (1) person to manage the Affairs of the administrative, financial and logistics of the election;
(3) one (1) person in charge of Secretariat staff as a technical organization of Affairs referred to in paragraph (2) letter a doubles as head of the Secretariat.
Article 11 (1) a member of the KPPSLN as many as seven people, comprising: a. one (1) Chairman and members; and b. 6 (six) people members. (2) the Chairman of the KPPSLN elected from and by members of the KPPSLN.

(3) members of the KPPSLN are appointed and dismissed by the PPLN.

Article 12 members of the KPPSLN referred to in article 11 paragraph (1), 2 (two) persons selected from personnel Offices of the Republic of Indonesia overseas to handling security and order at TPSLN.

Article 13 conditions for becoming a member and PPLN KPPSLN is as follows: a. citizen of Indonesia;

b. the lowest age of 25 (twenty-five) years;
c. loyal to Pancasila as the Foundation of the State, the Constitution of the Republic of Indonesia in 1945, and the ideals of Proclamation 17 August 1945; d. have integrity, strong personal, honest, and fair;
e. not be members of political parties that declared with a valid waiver or at least for a period of 5 (five) years ceases to be a member of a political party that is proved by the certificate of the Superintendent concerned political parties; f. domiciled within the working area and PPLN KPPSLN;

g. healthy physical and spiritual;

h. can read and write in the language of Indonesia; and i. never jail are convicted on the basis of a court decision has acquired legal force anyway because doing criminal acts which were threatened with imprisonment 5 (five) years or older.
Article 14 service PPLN begins no later than 6 (six) months before polling day, and ends two months after the day of voting.

Article 15 service KPPSLN begin no later than 1 (one) month before polling day and ending with 1 (one) month after polling day.

CHAPTER VI of the first part of the GRAMMAR of WORK Overseas Election Committee article 16 (1) Chairman PPLN is: a. lead PPLN activities;

b. invite members to hold meetings PPLN;

c. supervise the activities of KPPSLN;

d. hold coordination with parties deemed necessary for smooth execution of tasks;

e. reporting on results of the voter registration and the number of residents to the ELECTION COMMISSION;

f. report on the results of the activities of the provisional vote count periodically to the ELECTION COMMISSION;
g. signed a news event and the certificates of vote count recap together at least 2 (two) members of PPLN;
h. to expedite the vote count, sending the results of a news event, a certificate of the results of the vote count, and a recap of the results of the vote count through fax or electronic mail, or electronic mail to the ELECTION COMMISSION; and i. other activities deemed necessary for the smooth holding of the elections in accordance with the policy defined by the ELECTION COMMISSION, among others, facilitate the Election campaign participants.
(2) if the Chairman of PPLN unable to be implemented by the task, one of the members on the basis of agreement between members.
(3) the duties of a member of the PPLN is: a. assist the Chairperson in carrying out tasks PPLN;

b. perform the duties prescribed by the PPLN Chairman;

c. execute the tasks in accordance with the applicable legislation; and d. provide opinions and advice to the Chairman of the PPLN material considerations. (4) in carrying out the task, the Member is responsible to PPLN PPLN through Chairman PPLN.

Article 17 (1) the duties referred to in Article 13, the meeting was conducted in PPLN.

(2) the meeting referred to in subsection (1) is carried out as needed at the invitation of the Chairman of PPLN.

(3) Materials/material meeting already communicated to members one (1) day prior to the implementation meeting.
(4) in a meeting as referred to in paragraph (2) dimusyawarahkan implementation of the basic tasks PPLN in accordance with the legislation in force.
Article 18 (1) meeting PPLN held upon agreement of members.
(2) each Member is obligated to carry out consistent and legally responsible for all the results of the meeting referred to in paragraph PPLN (1).
Article 7 each Member PPLN has the right and the same opportunity to provide opinions and advice in the meeting.

Article 20 (1) of decision making is basically done in a deliberation for consensus.
(2) if in the meeting PPLN can not be taken a decision, the Chairman of conciliating conversationally PPLN took the decision of most votes.
Article 21 (1) the duties of the Secretariat PPLN is: a. assist implementation of PPLN;

b. lead and supervise the activities of the Secretariat of the PPLN;

c. perform the duties prescribed by the PPLN; and d. provide opinions and advice to the head of PPLN. (2) in carrying out the duties of the head of the secretariat responsible to the PPLN PPLN through Chairman PPLN.

Section 22 (1) the staff of the Secretariat of the Organization of the technical affairs PPLN has the task of preparing the technical organization of the elections of the members of Parliament overseas.
(2) the staff of the Secretariat of Administrative Affairs PPLN, finance, and logistics have set up all administrative affairs, financing, administration, finance and accountability PPLN and the logistics of the election. (3) in carrying out its duties the Secretariat staff is responsible to the head of the Secretariat of PPLN PPLN.

The second group of organizers of the vote Abroad Article 23 (1) the duties of Chairman of the KPPSLN in the preparation of organizing the voting and counting of votes is: a. gives a description of the tasks that must be carried out to the members of KPPSLN and TPSLN security officer;

b. announce the place and time of execution of the voting;

c. signed notification letter/call to give voice to the voters; and d. the preparation activity lead TPSLN;
(2) the duties of Chairman of the KPPSLN in the vote in TPSLN are: a. lead KPPSLN activity;

b. implementation of activities leading to the vote;

c. set the voters entering the TPSLN;

d. open the meeting voting right at 08.00 local time;

e. take the oath/promise of KPPSLN members and witnesses who were present;
f. make a news event and additional ballots signed by as much as 2% (two per cent), together at least 2 (two) members of KPPSLN; g. signed ballot; and h.  end the activity of voting on at 14.00 local time.
(3) the duties of the Chairman in the meeting vote count KPPSLN in TPSLN are: a. menyilahkan voters to sit with the code of conduct for those who will follow the vote count;
b. lead the implementation of the vote count and finished in TPSLN and can be attended by participants of the election, the election supervisor, Election monitors and citizens; and c.  signed a news event voting and vote count in TPSLN together with at least 2 (two) members of KPPSLN and can be signed by witnesses who have credentials signed by the Chairman and the Secretary General or the leadership of the other political parties as the Central Election participants in attendance.
(4) no later than one day after the voting was conducted and vote count in TPSLN, Chairman of KPPSLN submit a news event, a certificate of the results of the vote count, ballots, and polling administration fittings and vote count in TPSLN to PPLN with escort from security officer TPSLN. (5) in the exercise of duties, the Chairman of KPPSLN responsible to the Chairman through PPLN PPLN.

Article 24 (1) the duties of a member of the KPPSLN is to: a. assist the Chairperson in carrying out the task of KPPSLN;
b. checks together security officer TPSLN and witnesses present were against everything that relates to the preparation of the implementation of the voting and counting of votes in TPSLN; c. execute the tasks in accordance with the applicable legislation; and d.  perform the duties prescribed by the Chairman of the KPPSLN. (2) in carrying out the task, the Member KPPSLN responsible to the Chairman of the KPPSLN.

Article 25

(1) security officer in charge of TPSLN help KPPSLN to deal with public order and security at the top TPSLN KPPSLN Chairman of the instructions. (2) in carrying out the task, the security officer is responsible to the head of KPPSLN.

CHAPTER VII BUDGET Article 26 (1) the fee for the execution of the duties and KPPSLN PPLN charged to the budget of the STATE BUDGET and the help/facilities of the Republic of Indonesia representative office abroad.
(2) help/facilities as referred to in subsection (1) is referred to in Section 126 subsection (1) of Act No. 15 of 2011 about Election Organizers.
CHAPTER VIII COVER article 27 of this Regulation comes into force on the date of promulgation.

In order to make everyone aware of it, ordered the enactment of regulations this Election Commission with its placement in the news of the Republic of Indonesia.
