REGULATION of the GOVERNMENT of the REPUBLIC of INDONESIA NUMBER 48 by 2013 ABOUT GRANTING SALARY/PENSION/ALLOWANCE THIRTEENTH MONTH in FISCAL YEAR 2013 to CIVIL SERVANTS, STATE OFFICIALS, and the RECIPIENT of a PENSION/ALLOWANCE with the GRACE of GOD ALMIGHTY the PRESIDENT of the Republic of INDONESIA, Considering: a. that the Government is obliged to improve the welfare of civil servants, State officials, and the recipient of a pension/allowance as a manifestation of the Government's appreciation for achievement and devotion to their nation and State;
b. that the granting of salary/pension/allowance thirteenth month is one of the Government's efforts in improving the welfare of civil servants, State officials, and the recipients of pensions/allowances;
c. that based on considerations as referred to in letter a and letter b and in order to carry out the Act number 19 in 2012 about the budget of the State Expenditures and revenues of the fiscal year 2013, needs to establish government regulation about awarding of Salary/Pension/Allowance thirteenth month In fiscal year 2013 To civil servants, State officials, and the recipients of pensions/Allowances;

Decide: define: GOVERNMENT REGULATIONS CONCERNING THE GRANTING of SALARY/PENSION/ALLOWANCE THIRTEENTH MONTH in FISCAL YEAR 2013 to CIVIL SERVANTS, STATE OFFICIALS, and the RECIPIENTS of PENSIONS/ALLOWANCES.
Article 1 In Regulation it is: 1. Public servants are civil servant (PNS), a member of the Indonesia national armed forces (TNI), and members of the State police of the Republic of Indonesia (the NATIONAL POLICE).
2. State officials is: a. the President and Vice President;
b. the Chairman, Vice Chairman, and members of the people's Consultative Assembly;
Chairman, Vice Chairman, and members of the House of representatives;
d. the Chairman and Deputy Chairman of the Constitutional Court and justice of the Constitution;
e. the Chairman, Vice Chairman, Chairman, and Chief Justice on the Supreme Court;
f. Judges on the judicial Bodies of the General State Administrative, judicial, religious courts, judiciary and Military judge who employed for judicial duties (yustisial);
g. the Chairman, Vice Chairman, and the tax court judge;
h. the Chairman, Vice Chairman, and members of the body of the Financial Examiner;
i. the Chairman and Deputy Chairman of the corruption eradication Commission;
j. the Chairman, Vice Chairman, and members of the judicial Commission;
k. Ministers and Ministerial Office;
b.  Head of the Representation of the Republic of Indonesia who serves as Ambassador Extraordinary and Plenipotentiary;
m. Governor and Vice Governor; and n.  Regent/Vice Regent/Mayor and Vice Mayor.
3. Recipients are: a. Retired civil servants;
b. Retired State officials;
c. the recipient of a pension, the Widow/Widower/child of a recipient of a pension referred to in letter a and letter b; and d.  The pension recipient parents of CIVIL SERVANTS killed.
4. The recipient of the allowance is: a. the recipient Benefits Veterans;
b. recipients of Honorary Members Allowances Committee Indonesia Center;
c. the recipient of the Alimony Awards National movements of the Pioneers/Independence;
d. the recipient of the Allowance the Widow/Widower of a recipient of Benefits as referred to in letter a, letter b, and the letter c;
e. a recipient of benefits is Former Royal Nederland Indonesisch Leger/Royal Marine (ROYAL/KM);
f. Recipient Benefits Orphans/Orphan members of TNI/POLRI;
g. Allowance Recipients Members of TNI/POLRI for dismissed with respect keprajuritannya service between 5 (five) years up to less than 15 (fifteen) years;
h. Retirement Allowances are recipients of the TNI/POLRI for dismissed with respect keprajuritannya between service 15 (fifteen) years up to less than 20 (twenty) years;
i. the recipient parents ' Allowances for members of the TNI/POLRI which fall; and j.  Recipients Of Disability Allowances.
Article 2 (1) of the civil service, State officials, and the recipients of pensions/Allowances given salary/pension/allowance thirteenth month in fiscal year 2013.
(2) civil servants referred to in subsection (1) includes: a. civil servants stationed or deployed abroad;
b. civil servants employed outside the Government agencies that his salary was paid by the parent agency;
c. civil servants who were laid off temporarily;
d. civil servants waiting money recipients; and e.  Prospective Civil Servants.
(3) civil service referred to in subsection (1) does not include civil servants who are currently undergoing a leave outside the country or dependent seconded outside government agencies.
Article 3 (1) the magnitude of the salary/pension/allowance thirteenth month as referred to in article 2 is in the amount of income a month received by June 2013.
(2) in terms of revenue a month received by June 2013 referred to subsection (1) has not paid of rights which should be accepted, the corresponding to remain given the difference in lack of salary/pension/allowance thirteenth month.
(3) Earnings referred to in subsection (1) for: a. civil servants and State officials include base salary, allowances, family allowances Office/common stipends, allowances and Special Allowances performance/Financial Coaching State (TKPKN);
b. recipients include family allowances, pensions, and allowances for additional income; and c.  The recipient of the alimony received only benefits appropriate legislation.
(4) the magnitude of the earnings referred to in subsection (1) does not include other types of hazards, risk allowance benefits, benefits, benefits security profession/specialty teachers and professors benefits/allowances extra earnings for honor, civil servants, Teachers of special incentives, and other perks that are akin to the compensation benefits/hazards defined by laws and regulations as well as the allowances/incentives were sourced from the receipt of the State is not a tax.
(5) Income referred to in paragraph (3) prior to the discounted dues imposed on the basis of legislation.
Article 4 (1) grant of salary/pension/allowance thirteenth month referred to in article 3 is payable in June 2013.
(2) in the case of granting salary/pension/allowance thirteenth month has yet to be paid out in June 2013, the payments referred to in subsection (1) is made after June 2013.
Article 5 (1) in terms of civil service, State officials, and the recipients of pensions/Alimony received more than one income referred to in article 3, salary/pension/allowance thirteenth month only provided one of the more profitable.
(2) if the future turns out there are civil servants, State officials, and the recipients of pensions/allowances that accept more than one type of income, the excess payment is a debt and must return to the State in accordance with the legislation.
Article 6 (1) the recipient's salary sign-on of civil servants/Officials who died or was killed given the salary of the thirteenth month of salary income of the Canal received in June 2013.
(2) the recipient of the salaries of civil servants/Officials which was declared lost given the salary of the thirteenth month of revenue received in June 2013.
(3) the payment of the thirteenth month's salary as referred to in paragraph (1) and paragraph (2) charged to agencies or institutions of the place of civil servants/Officials work.
Article 7 (1) recipients of the Canal from retired civil servants/Officials who died pensions given thirteenth month of the retirement income of the Canal received in June 2013.
(2) the recipient of the pension of retired civil servants/Officials revealed missing given retirement thirteenth month of retirement income received in June 2013.
Article 8 the provisions of this Regulation apply also for the Chairman, Vice Chairman, and members of the regional representative Council, other officials of the financial rights/equality/administrative-level Ministers, and Deputy Ministers.

Article 9 the necessary Budget for the implementation of this Regulation be imposed on: a. Budget revenues and State Spending for: 1. The Central CIVIL SERVANTS;
2. the members of the INDONESIAN ARMED FORCES;
3. Members of the NATIONAL POLICE;
4. the recipient of a pension;
5. the recipient of the alimony;
6. State officials other than the Governor and Vice Governor, Bupati/Walikota, and Deputy Regent/Deputy Mayor;
7. The Chairman, Vice-chairman, Member of the regional representative Council;
8. other officials of the financial rights/equality/administrative Ministerial; and 9.  The Deputy Minister.
b. income and Budget Shopping Area for: 1. PNS region;
2. the Governor and Vice Governor; and 3.  Regent/Vice Regent and Mayor/Deputy Mayor.
Article 10 further Provisions regarding technical implementation of government regulations is governed by the Minister of the organizing Affairs of the Government in the field of finance.

Article 11 this Regulation comes into force on the date of promulgation.

In order to make everyone aware of it, ordered the enactment of this Regulation with its placement in the State Gazette of the Republic of Indonesia.
