ABOUT
THE TOOL GROUP AND THE TELECOM DEVICE

BY THE GRACE OF THE ALMIGHTY GOD
MINISTER OF COMMUNICATIONS AND INFORMATICS OF THE REPUBLIC OF INDONESIA,

Weigh: a.  that in order to guarantee interconnectivity, interoperability and security (network and information) tools and devices created, assembled, entered to be traded and or used in the State of the State of the Republic of Indonesia must meet technical requirements;
B. that the development of tools technologies and telecommunication devices are diverse types, usability, functions and converges, so regulations on the clustering of tools and telecommunications devices need to be adjusted;
c. that under consideration as referred to in the letter a and the letter b, need to be established by the Minister of Communications and Informatics of the Republic of Indonesia on the Tools and Telecommunications Tools Group;

Given: 1.  Law Number 36 Year 1999 on Telecommunications (State Of The Republic Of Indonesia In 1999 Number 154, Additional Gazette Of The Republic Of Indonesia Number 3881);
2. Government Regulation No. 52 Year 2000 on the Hosting Of Telecommunications (Sheet State Of The Republic Of Indonesia In 2000 Number 107, Additional Sheet Of State Republic Of Indonesia Number 3980);
3. Presidential Regulation No. 47 of 2009 on the Establishment of the Organization of the Ministry of State, as amended in the last few times with the Presidential Regulation Number 91 of 2011 on the Third Amendment to the Regulation of the President No. 47 of the Year 2009 on the Establishment and Organization of the Ministry of State;
4. Presidential Regulation No. 24 of 2010 on Occupation, Duty, and Functions of Eselon I Ministry of State, as amended several times, last with the Presidential Regulation Number 92 of 2011 on the Second Amendment to the Presidential Regulation. Number 24 Year 2010 on Occupation, Duty, and Functions of the Ministry of State as well as the Organizational Organisation as well as the Organizational Functions, and the Functions of the Ministry of State;
5. Decree of the Minister of Transportation Number KM 3 Year 2001 on the Technical Requirements of Tools and Telecommunications Devices;
6. Communication and Informatics Minister Regulation No. 29 /PER/M. KOMINFO/09/ 2008 about the Certification of Tools and Telecommunications Devices;
7. Regulation of the Minister of Communications and Informatics Number 17 /PER/M. KOMINFO/10/ 2010 on the Organization and the Working Governance of the Ministry of Communications and Informatics;
8. Rules of Minister of Communications and Informatics Number 15 /PER/M. KOMlNFO/6/ 2011 Adjustment Of The Term Designation On Some Decisions/Regulations of Minister of Communications and Informatics Governing Special Muatan Materials in Post and Telecommunication Fields and Decision/Rule of the Director General of Post and Telecommunications;

DECIDED:

Establishes: MINISTER OF COMMUNICATION AND INFORMATICS REGULATIONS ON DEVICE GROUPS AND TELECOM DEVICES.

BAB I
UMUM PROVISIONS

Section 1

In Regulation of this Minister, referred to by:
1. Cable-based telecommunication tools are any equipment tool used in telecoms that use wires.
2. Cable-based telecommunications devices are a bunch of telecom tools that allow telecoms that use cable.
3. A radio/wireless-based telecommunication device is any equipment used in telecommunications that uses radio frequency spectrum.
4. A radio/wireless-based telecommunications device is a group of telecommunications tools that use radio frequency spectrum.
5. Network group (network) is a group of devices and telecommunications devices that are dislocated in the main network (core network).
6. The access group is a group of devices and telecommunications devices that are located between the main network (core network) and the terminal as well as the main network.
7. Customer's tool group (Customer Premises Equipment/CPE) is a group of telecommunications tools that are located at the end of the user's access/user network.
8. The network support group is a tool used as a supporter on telecommunications tools/devices that are deployed to the main network (core network).
9. Access support groups are tools that are used as proponents on telecommunications devices that are deployed between the main network and the terminal as well as the main network.
10. Customer's tool support group is a tool used as a supporting device/telecommunications device that is its placement at the end of the /user's access network.
11. Harmonized System Code later called the HS Code is the international standard of naming and numbering systems used for the classification of trade products and derivatives managed by World Customs Organization (WCO).

Article 2

(1) Any device and telecommunications device created, assembled, entered for trading and/or used in the Territory of the State of Indonesia is required to meet the technical requirements of the device and the telecommunications device.
(2) More terms on the technical requirements of the device and the telecommunications device as referred to in paragraph (1) are governed by the Minister's Regulation.

BAB II
THE TOOL GROUP AND THE TELECOM DEVICE

Section 3

(1) the telecommunication tools and devices as referred to in Section 2 comprise the group 3 (three) groups, i.e.:
a. network group;
B. Access groups; and
c. Customer Group (Customer Premises Equipment/CPE).
(2) In any tool group and telecom device as referred to in paragraph (1) there is a telecom support tool and device.
(3) The grouping of telecommunications tools and devices as referred to in paragraph (1) and paragraph (2) are listed in the Attachment that are an inseparable part of the Regulation of this Minister.

BAB III
CLOSING PROVISIONS

Section 4

At the time the Ordinance of the Minister is in effect, the Regulation of the Director General of Post and Telecommunications Number 313 /DIRJEN/2011 on the Tool and Telecommunications Group is revoked and stated to be not applicable.

Section 5

The rules of this Minister begin to take effect on the date of promulglement.
