PACIFIC OCEAN (CONVENTION ON CONSERVATION AND
THE MANAGEMENT OF THE DISTANT BEARS OF FISH IS
IN THE WESTERN AND CENTRAL PACIFIC OCEANS)
BY THE GRACE OF THE ALMIGHTY GOD
PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh: a.   that in Honolulu, the United States, on September 5, 2000, the Multilateral Summit on Conservation and Management of Far-Changed Fish in the Western and Central Pacific Region in the Seventh Session has set the Convention. on the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific Ocean (Convention on Conservation and Management Of Distant-bears Bears In The Western and Central Pacific Ocean);
B.   that Indonesia's participation in the Convention can increase and advance the national fishing industry by keeping and protecting the sovereignty of the territorial sea region of the Republic of Indonesia;
c. that on the basis of consideration as referred to in letter a and letter b, need to pass the Convention to the President's Regulation;

Remembering: 1.   Article 4 of the paragraph (1) and Section 11 of the Basic Law of the Republic of Indonesia in 1945;
2. Act No. 17 of 1985 on Unrest United Nations Convention on the Law of the Sea (United Nations Convention on the Law of the Sea) (Sheet of State of the Republic of Indonesia 1985 number 76, Additional Sheet of State Republic of Indonesia No. 3319);
3. Act No. 24 Year 2000 on International Covenant (State of the Republic of Indonesia 2000 Number 185, Additional Gazette of the Republic of Indonesia No. 4012);
4. Act No. 21 Year 2009 on the Unrest Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks (United Nations Convention on Provisions on the Law of the Sea on December 10, 1982) related to the Conservation and Management of Restricted Fish Supplies and Supplies. DECIDED:

SET: PRESIDENTIAL REGULATION ON ATTESTATION CONVENTION ON THE CONSERVATION AND MANAGEMENT OF HIGHLY MIGRATORY FISH STOCKS IN THE WESTERN AND CENTRAL PACIFIC OCEAN (CONVENTION ON CONSERVATION AND MANAGEMENT OF FISH-LIKE FISH SUPPLIES FAR IN WESTERN AND CENTRAL PACIFIC OCEANS).

Section 1
Authorize the Convention on the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific Ocean was set on September 5, 2000 in Honolulu, United States, with the Declaration (Statement) against Article 3 of the paragraph (1) Convention, whose original text in English and translation in Indonesian as attached. and is an inseparable part of this Presidential Regulation.

Section 2
In the event of a distinction between the translation of the translation of the Convention in Indonesian with the original English text as referred to in Article 1, the original text is in English.

Section 3
This President ' s regulation starts to apply to the date of the promulctest.

STATEMENT AGAINST ARTICLE 3 OF THE PARAGRAPH (1) OF THE CONVENTION ON CONSERVATION AND THE MANAGEMENT OF LONG-BEAR FISH IN THE WESTERN AND CENTRAL PACIFIC OCEANS

Upon ratification of the Convention,

The Government of the Republic of Indonesia, recalls that the Convention on Conservation and Management Of Long-held Fish Provisions In The Western Pacific and Central Oceans is mandatory exclusively on the application area in accordance with Article 3 of the Convention. In this regard, Indonesia expressed its understanding that the implementation of the Convention only covers Indonesia ' s Exclusive Economic Zone which is facing and resides within the Pacific Ocean as defined in Article 3 of the Convention, and is not passed on to the waters of the islands, sea territorial waters, and inland waters.

DECLARATION ON ARTICLE 3 PARAGRAPH (1) CONVENTION ON THE CONSERVATION AND MANAGEMENT OF HIGHLY MIGRATORY FISH STOCKS IN THE WESTERN AND CENTRAL PACIFIC OCEAN


Upon ratification to the Convention,

The Government of the Republic of Indonesia, wishes to recall that the Convention on the Conservation and Management of Highly Migratory Fish Stoks in the Western and Central Pacific Ocean shall exclusively apply to the area of application as defined in the United States. Article 3 of the Convention. In this regard, Indonesia declares its understanding that the application on the Convention shall only cover the Indonesia’s Exclusive Economic Zone adjacent to and within the Pacific Ocean as defined in the Article 3 of the Convention, and shall not be extended to the archipelagic, territorial and internal waters.
