NUMBER 61/M-DAG/PER/9/2013 ON

CHANGES TO THE TRADE MINISTER ' S REGULATION NUMBER 83/M-DAG/PER/12/2012 ON THE IMPORT PROVISIONS

WITH THE GRACE OF GOD ALMIGHTY THE TRADE MINISTER OF THE REPUBLIC OF INDONESIA,

THE DRAW: A.

that to increase the flow of goods and effectiveness of the implementation and supervision of certain products imports, it needs to make changes to some provisions of the Regulation of Trade Minister Number 83/M-DAG/PER/12/2012 on Conditions Import A Specific Product;

b. that under consideration as intended in the letter a, it needs to establish the Trade Minister ' s Regulation on the Change of Trade Minister Regulation 83/M-DAG/PER/12/2012 on Certain Product Import Conditions;

DECIDED:

Establish: REGULATION OF TRADE MINISTERS ON CHANGES TO THE MINISTER ' S REGULATIONS TRADE NUMBER 83/M-DAG/PER/12/2012 ON THE TERMS OF THE IMPORT OF CERTAIN PRODUCTS.

Article I Some provisions in the Regulation of Trade Minister Number 83/M-DAG/PER/12/2012 on the Terms of Import Import of Products are certainly changed as follows:

1. The provisions of Article 1 of the number 4 are amended so that Article 1 reads as follows:

Article 1 In this Ministerial Regulation is referred to as: 1. Import is the activity of inserting goods into the area

customs. 2. Certain products are products affected by the import

based on this Minister Regulation which includes food and beverage products, traditional medicine and supplements of food, cosmetics, clothing so, footwear, electronics, and toys children,

3. Importer Listed A Specific Product, which is next called IT-The Definite Product is a company that performs the Definite Product import activities.

4. The verification or technical browsing of the import is the technical examination activity of the Tercourse Product conducted by surveyors.

5. Surveyor is a survey company that is authorized to conduct the verification or technical search of imported products.

6. The Trade Service Unit (UPP) is the unit that organizes the service in the trading sector.

7. The Minister is the minister who organizes government affairs in the field of commerce.

8. The Director General is Director General of Foreign Trade, Ministry of Commerce.

9. The coordinator and Managing Director of the UPP is the Acting Officer appointed by the Secretary General of the Ministry of Commerce to coordinate and carry out the hosting of services to the UPP.

10. The Director is the Import Director, Directorate General of Foreign Trade, Ministry of Commerce.

2. The provisions of Section 6 are amended so that it reads as follows: Section 6

(1) Each import of Certain Products by Certain Products can only be done through the destination port: a. sea port: Beopponent in Medan, Tanjung Priok at

Jakarta, Tanjung Gold in Semarang, Tanjung Perak in Surabaya, Sukarno Hatta in Makassar, Dumai in Dumai, Jayapura in Jayapura, Tarakan on Tarakan, and Krueng Geukuh in North Aceh; dan/or

b. Airport: Kualanamu in Deli Serdang, Sukarno Hatta in Tangerang, Ahmad Yani in Semarang, Juanda in Surabaya, and Hasanuddin in Makassar.

(2) Imports of Certain Products by Certain Products performed through the seaport of Dumai in Dumai, The seaport of Jayapura in Jayapura, and the seaport of Tarakan on Tarakan for food and beverage products.

(3) Imports of Certain Products by Certain Products undertaken through the seaport of Krueng Geukuh in North Aceh only for food and beverage products, clothing so, footwear, and electronica.

3. The provisions of Section 9 of the paragraph (1) are amended so that Section 9 reads as follows:

Article 9 (1) Verification or the import technical drill as referred to

in Section 8 is performed against Certain Product imports, including data or captions. The least bit about: a. The state and the port fit; b. Decoding time; c. Destination port; d. Post Tarif/HS and description of goods; e. SNI Tags (SNI)

for Certain Products whose SNS is mandatory; and

f. Certificate of Analysis (CoA) for Certain Products is required.

(2) The verification results or technical browsing of the import as referred to in paragraph (1) are poured in the form of the Surveyor Report (LS) for use as a customs document in the settlement of customs in the field of import.

(3) For the conduct of the verification or technical search of the import as it is referred to in paragraph (1), Surveyor is collecting the rewards of the services of the Most Certain Products. determined by paying attention to the benefits azas.

4. Section 10 is deleted.

5. The provisions of Section 12 are amended to the following: Section 12

(1) The Company that has obtained the designation as the IT-Product shall be required to submit a written report on the execution of the Program's import of the Program. http://inatrade.kemendag.go.id.

(2) The delivery of the report as referred to in paragraph (1) is performed in terms of its importation of or unendealized.

(3) The report as referred to in paragraph (1) is delivered every 3 (three) the slowest month of the 15th (fifteen) next quarter to the Coordinator and Acting UPP, and Director.

6. The provisions of Article 19 are amended to read as follows: Article 19

(1) The provisions of this Ministerial Regulation do not apply to imports: a. Certain Products included in Section 25 of the paragraph (1) and

Section 26 of the paragraph (1) of the Law Number 10 of 1995 on Kepabeanan as amended by Law No. 17 of the Year 2006;

b. A certain product of clothing, such as 10 (ten), pieces per shipment and private property of passengers or crew of the most FOB US$ 1,000.00 (thousand American dollars) per person, with using an airship;

c. Certain products are of the most 2 (two) units per shipment and private goods of the passengers or crew of the most FOB-valued carriers of US$ 1,500.00 (thousand five hundred dollars of Americans) per person, with using an airship;

d. Certain products include the B and c of a shipment item or private property of the passenger or crew of the most FOB US$ 1,500.00 (thousand five hundred American dollars) per person, by using air plane;

e. Certain Products for the purposes of operating activities upstream of petroleum and gas, geothermal and mineral and other energy sectors;

f. Certain Products imported by the manufacturer's importers

is used as a capital goods and/or raw materials associated with its industry; and

g. Certain products are temporarily imported. (2) The Definite Product import as referred to in paragraph (1)

letter b, letter c, and d which exceeds the amount and/or value specified, against the quantity in excess and/or the value of the Product is specified in the Article 18.

7. Between Section 22 and Section 23 of the section 1 (one) of section, Article 22A thus reads as follows:

Article 22A The exception of the provisions set forth in the Regulation of the Minister is set by the Minister.

8. Between Section 23 and Section 24 of the following section 1 (1), Section 23A thus reads as follows:

Article 23A (1) LS as a customs document in the settlement

9. Attachment of the Trade Minister Regulation No. 83 /M-DAG/PER/12/2012 on the Conditions of the Import Product are certainly amended so as to be as set forth in the Attachment that is an inseparable part of the Regulation of this Minister.

Article II This Minister's rule came into effect on the date of the invitation.
