THE SECOND CHANGE TO THE INDUSTRY MINISTER ' S REGULATION NUMBER 43/M-IND/7/2008 ABOUT THE ESTABLISHMENT OF AN INDUSTRY GROUP THAT CAN UTILIZE THE USER SPECIFIC DUTY FREE SCHEME (USDFS) SCHEME IN ORDER OF APPROVAL BETWEEN THE REPUBLIC OF INDONESIA AND JAPAN REGARDING AN ECONOMIC PARTNERSHIP
BY THE GRACE OF THE ALMIGHTY GOD
MINISTER OF INDUSTRIES OF THE REPUBLIC OF INDONESIA,

Weigh: a.   that in order to encourage the growth of the national industry through the monitoring of import tariffs with the User Specific Duty Free Scheme (USDFS) in accordance with the Indonesian National Field Business Classification (KBLI) scheme, it needs to change the group industry as specified in the Regulation of the Minister of Transportation Number 43/M-IND/PER/7/2008 and has been amended by the Regulation of the Minister of Industry No. 62/M-IND/PER/8/2008;
B.   that the organizational structure of the Ministry of Industry has been amended as defined by the Regulation Minister of Industry Number 105/M-IND/PER/10/2010 so that it needs to perform a nomenclature of work units associated with the USDFS schema accordingly. with the Ministerial Ordinance referred
c. that under consideration as intended in letter a and letter b, need to establish the Regulation of the Minister of Industry on the Second Amendment of the Regulation of the Minister of Industry Number 43/M-IND/PER/7/2008 on the Redemption of Industrial Groups That Can Utilize The Customs Tariffs With A User Specific Duty Scheme (USDFS) Scheme In Order To Approval Between The Republic Of Indonesia And Japan Regarding A Economic Partnership;

Given: 1 Financial Minister Regulation Number 96 /PMK.011/ 2008 on Assignment Tariff Assignment User Specific Duty Free Scheme (USDFS) In Order Of Approval Between The Republic Of Indonesia And Japan Concern A The Economic Partnership as amended with the Regulation of the Minister of Finance Number 31 /PMK.011/2010;
2. Industry Minister Regulation No. 43/M-IND/PER/7/2008 on Establishing An Industry Group That Can Utilize The Customs Tariff With The User Specific Duty Free Scheme (USDFS) Scheme In Order Of Approval Between The Republic Of Indonesia and Japan Regarding a Economic Partnership as amended by the Regulation of the Minister of Industry No. 62/M-IND/PER/8/2008;
3. Regulation Minister of Industry Number 105/M-IND/PER/10/2010 on the Organization and the Working Governance of the Ministry of Industry;

Paying Attention: The Regulation of the Central Bureau of Statistics No. 57 of 2009 on the Classification of the Indonesian Field of Business;

DECIDED:

SET: MINISTRY MINISTER REGULATION ON THE SECOND CHANGE IN THE REGULATION OF INDUSTRY MINISTER NUMBER 43/M-IND/7/2008 ON THE DESIGNATION OF INDUSTRY GROUPS THAT CAN LEVERAGE THE CUSTOMS TARIFFS WITH THE USER SCHEME THE SPECIFIC DUTY FREE SCHEME (USDFS) IN THE FRAMEWORK OF APPROVAL BETWEEN THE REPUBLIC OF INDONESIA AND JAPAN REGARDING AN ECONOMIC PARTNERSHIP.

Article I
Some provisions in Minister of Industry Regulation No. 43/M-IND/PER/7/2008 on the Designation Of Industry Groups That Can Utilize The Custom Tariff With The User Specific Duty Free Scheme (USDFS) Scheme In Order Of Approval Between the Republic of Indonesia and Japan Regarding a Economic Partnership as amended by the Regulation of Minister of Industry No. 62/M-IND/PER/8/2008 is amended as follows:
1. The provisions of Article 1 of the number 2, number 3, number 4, and the number 7 are changed so that the entirety of Article 1 becomes the following:

Section 1
In Regulation of the Minister this is referred to:
1. User Industry (User) is an industry conducting the import of raw materials in the framework of production purposes within the scope of cooperation between Indonesia and Japan through the Customs Liberation Facility (USDFS) which has received Mail USDFS Industry Verification Description published by Surveyor appointed Minister.
2. Industry Group is a group of industry as referred to in the Baku Classification of Indonesia Field (KBLI).
3. USDFS Facility is the designation of admission tariffs for products that have not been made in the country in accordance with the Regulation of the Financial Ministers Regulation Number 96 /PMK.011/ 2008 as amended by the Regulation of the Minister of Finance Number 31 /PMK.011/2010, for production purposes for the user industry.
4. Industrial Services for Various Special Works on Metal and Metal items (Steel Service Center) is a company that is included in the KBLI 25920 (originally 28920 based on KBLI 2005).
7. Director General Pembina Industry is the Director General in the Ministry of Industry environment in accordance with the division of industrial type coaching as referred to in the Regulation of Industry Minister Number 64/M-IND/PER/7/2011 about Types of Industry in the Coaching of the Directorate General and Agency in the Environment of the Ministry of Industry.

2. The provisions of Article 3 as detailed and listed in the Order of the Rules of Ministers are amended to be as set forth in the Order of this Minister's Ordinance.
3. The provisions of Article 7 are changed to the following:

Section 7
(1) The authority of the authoring of the legal signature as referred to in Article 6 is devolve to the Director of the Metal Materials Industry Basic Materials.
(2) If the official referred to in paragraph (1) is hindrated by more than 5 (5) business days, the Director General of Industry Pembina appoints the Managing Editor of the Director of the Board concerned to validate it.

4. Insert the new provisions between Article 9 and Section 10 to Section 9a as follows:

Section 9a
The User Industry (User) that has utilized the USDFS Scheme before it applies to this Minister Regulation, applies to the KBLI Act 2005.

Article II
The Regulation of the Minister comes into effect on the date of the promulctest.
