REGULATION of the MINISTER of INDUSTRY of the REPUBLIC of INDONESIA NUMBER 87/M-IND/PER/12/2013 REGARDING the ENFORCEMENT of the NATIONAL STANDARD (SNI) of COOKING OIL PALM are MANDATORY with the GRACE of GOD ALMIGHTY MINISTER of INDUSTRY of the REPUBLIC of INDONESIA, Considering: a. that the oil Palm is a Fried food products consumed, need guaranteed safety, quality and its nutrition value for improving public health;
b. that, in order to ensure the safety, quality and nutrition of Palm cooking oil needs to enforce Indonesia national standard (SNI) of cooking oil Palm are mandatory;
c. that based on considerations as referred to in letter a and letter b needs to set a regulation of the Minister of industry regarding the enforcement of Indonesia national standard (SNI) of cooking oil Palm Are Mandatory;

Decide: define: REGULATION of the MINISTER of INDUSTRY REGARDING the ENACTMENT of the INDONESIAN NATIONAL STANDARD (SNI) of COOKING OIL PALM are mandatory.
Article 1 In this ministerial regulation is: 1. Cooking Oil Palm is the main composition of foodstuffs triglycerides derived from Palm oil, with or without chemical changes, including cooling, and hydrogenation has been through a process of purification by the addition of vitamin A.
2. Palm cooking oil Manufacturer is: a. which company produces cooking oil palm, with the process of purification, oil bath, with or without mixing vitamin A or packaging, hereinafter referred to as the manufacturer; or b.  companies that perform business activities of Palm cooking oil packing with or without mixing vitamin A, hereinafter referred to as Packaging.
3. A certificate of use of the product is the sign of the SNI-SNI SPPT hereinafter referred to is the use of Telltale Products SNI Certificate issued by Certifying Products to manufacturers of cooking oil Palm fits the requirement of SNI.
4. Product certification agencies, hereinafter called LSPro is an institution that has been accredited by the National Accreditation Committee and appointed by the Minister to perform product certification Mark Use SNI.
5. Laboratory Testing is a laboratory that has been accredited by the National Accreditation Committee and appointed by the Minister who conducted the testing activities against examples of products according to specifications/SNI test method.
6. National Accreditation Committee, hereinafter called KAN is non structural, which is at the bottom and is responsible to the President with the task of setting the system of accreditation and certification as well as authorized to accredit institutions and laboratories to perform certification.
7. Surveilan is checked at regular intervals and/or specifically against manufacturers who have obtained the SPPT-SNI over the consistency of application of SPPT-SNI, which is done by LSPro.
8. A supervisory Officer product standards that hereafter PPSP is a civil servant in the Centre or area assigned to conduct surveillance of products in the production location and outside the location of the production activity of SNI have been enforced compulsorily.
9. The Minister is the Minister of menyelengarakan Affairs of the Government of the industrial field.

Article 2 the producers referred to in Article 1 point 2, at least have: a. the unit purification, oil unit, mixer unit vitamin A, packaging machinery or packaging machine, without a storage shed, and test equipment Manufacturers for quality cooking oil Palm; or b.  storage tanks, mixing units of vitamin A, packaging machines, storage places, and quality test equipment for the Packaging of Palm cooking oil.
Article 3 Imposes a standard National Indonesia Palm oil FRY SNI 7709:2012 compulsorily against Palm cooking oil with a number of postal rates and description of the goods as follows: No Postal Rate/HSUraian BarangEx. 1511.90.92.00 RBD Palm Olein in packaging net weight does not exceed 20 kg. Ex RBD Palm Olein 1511.90.99.00. in packaging net weight exceeds 20 kg. Ex. 1516.20.98.00 Hydrogenated RBD Palm Olein in packaging net weight not exceeding 20 kilograms and exceed 20 kg.
Article 4 (1) cooking oil Palm as stipulated in article 3 mandatory packed in.

(2) the packaging referred to in subsection (1) that direct contact with the Palm cooking oil should food packaging, except for tara in the shape of the tank and tanker trucks.
(3) Packaging as referred to in paragraph (2) is packaged with a capacity of up to 1000 (one thousand) kg.
(4) cooking oil Palm with packaging as referred to in paragraph (3) contains mandatory circulating levels of vitamin A at least 40 IU.
Article 5 producers or importers of Palm cooking oil as referred to in article 3 and article 4 compulsory to apply the provisions of the SNI with: a. have the SPPT-SNI Palm cooking oil in accordance with the provisions of the SNI; and b.  affix the sign of SNI Palm cooking oil on the packaging in a place that is easy to read with tagging that is not easily lost.
Article 6 (1) the solicitation of SPPT-SNI Palm cooking oil as referred to in article 5 a letter addressed to LSPro accredited scope of SNI'S appropriate cooking oil palm and is appointed by the Minister.
(2) publication of SPPT-SNI Palm cooking oil as referred to in article 5 letters a through the implementation of guidelines for the standardization of the National PSN 302-2006: Fundamental – the conformity assessment system of product certification 5, consisting of: a. testing the suitability of quality cooking oil Palm fits STANDARD referred to in article 3; and b.  audit of the implementation of the quality management system STANDARD ISO 9001:2008 quality management system or other equivalent.
(3) the test referred to in paragraph (2) letter a is implemented by: a. Lab Examiners who have been accredited by RIGHT with the scope of the SNI cooking oil palm and is appointed by the Minister; or b.  laboratory outside the country who are appointed by the Minister, with the provisions of the respective countries of Accreditation Bodies have mutual recognition agreements (Mutual Recognition Arrangement (MRA) of) with KAN and have multilateral or bilateral agreement in the field of technical regulations between the Government of the Republic of Indonesia with the country where the Laboratory Examiners in question is located.
(4) the Audit of the application of the quality management system as the ubiquitous question on paragraph (2) letter b carried out by Certifying quality management Systems that have been accredited by an Accrediting Agency'S or the exporting country has signed an agreement of mutual Recognition (Mutual Recognition Arrangement (MRA) of) with the RIGHT.
(5) when the LSPro is not yet available and/or laboratory Examiners accredited by the appropriate scope of SNI'S cooking oil palm, the Minister may designate LSPro and/or laboratory Testers that competencies have been evaluated by BPKIMI.
(6) LSPro and/or laboratory Examiners designated as referred to in subsection (5) the longest 2 (two) years since the appointment must have been accredited by RIGHT with the scope of the SNI Palm cooking oil.
Article 7 LSPro as referred to in article 6 in publishing the SPPT-SNI Palm cooking oil is obliged at least includes information regarding: a. name and address of the company (manufacturer and packaging);
b. address of the factory or packaging;
c. brand;
d. name of the person in charge of the company;
e. the name and address of the importer;
f. food tara g logo.  code h. recycling  number and logo SNI; and i.  This type of product.
Article 8 (1) LSPro referred to in article 6 paragraph (1) is obligated to inform and convey the information to the head of BPKIMI, the Director General of the Builder of the industry, the head of the Fda and the company applicant SPPT-SNI regarding decisions: a. publication of SPPT-SNI;
b. delay the granting or extension of SPPT-SNI for the petition that has not met the requirements for certification;
c. denial of the granting or extension of SPPT-SNI for application which does not meet the requirements of certification; and/or d.  pelimpahan SPPT-SNI to designated LSPro, for LSPro who published the SPPT-SNI is not appointed again; not later than 7 (seven) working days since the publication of the determination of the decisions in question.
(2) LSPro which published the SPPT-SNI Palm cooking oil is responsible for the implementation of the surveilan the use of the sign of the SNI-SNI SPPT published.
Article 9 Palm cooking oil as referred to in article 3 which is traded in the country, which is derived from the results of the domestic production or import is obligated to comply with the STANDARD as referred to in article 4, article 5 and article 7.

Article 10 (1) of Palm cooking oil as referred to in article 3 which is derived from the results of domestic production which do not satisfy the conditions referred to in article 4, article 5 and article 7 was banned.
(2) cooking oil Palm as stipulated in article 3 that has been circulating in the market that comes from domestic production which do not satisfy the conditions referred to in article 4, article 5 and/or article 7 should be withdrawn from circulation by the manufacturers concerned.
(3) the procedures for the withdrawal of the product from circulation as referred to in paragraph (2) is conducted in accordance with the provisions of the legislation.
Article 11 (1) cooking oil Palm as stipulated in article 3 that comes from imports and do not meet the conditions of the STANDARD referred to in article 4 and article 5 prohibited from entering into the customs area of Indonesia.
(2) Palm cooking oil as referred to in paragraph (1) that does not meet the conditions referred to in article 4, article 5 and/or article 7 and has been in the Customs area of Indonesia is resolved according to the provisions of mandatory legislation.
Article 12 (1) coaching and supervision against the execution of the application of the SNI Palm cooking oil compulsorily referred to in article 3 are performed by Directorate General Builder Industry implemented by PPSP.
(2) Supervision as referred to in paragraph (1) are made against the product on site production production locations and conducted at least one (1) times in a year.
(3) in performing the supervision referred to in paragraph (1) Directorate General of Industrial Patrons can coordinate with the Office of the province and the Department or district/city or related institutions.
(4) the implementation of the supervision referred to in paragraph (2) and paragraph (3) may be made on pre market and on the market and carried out in accordance with the provisions of the legislation.
(5) BPKIMI implement coaching against conformity assessment Institutions in the framework of the implementation of the SNI Palm cooking oil.
(6) in carrying out the construction referred to in subsection (5), BPKIMI can provide a written rebuke and sanction compliance with laws-undangann to LSPro and/or Lab Examiners who violates the provisions of this regulation of the Minister.
Article 13 the Director General Industry Builder sets application of technical implementation Instructions and supervision of SNI Palm cooking oil are mandatory.

Article 14 businessmen, LSPro and or laboratory testers who do breach of provisions in the regulations the Minister is penalized in accordance with the provisions of the legislation.

Article 15 this ministerial regulation came into force 15 (fifteen) months from the date of promulgation.

In order to make everyone aware of it, ordered the enactment of this Ministerial Regulation with its placement in the news of the Republic of Indonesia.
