REGULATIONS OF THE REPUBLIC OF INDONESIA FINANCIAL MINISTER
NUMBER 170 /PMK.02/2013/ 2013
ABOUT
SETS THE WAY FOR THE BUDGET, COUNTING, PAYMENT,
AND THE ELECTRICAL SUBSIDY LIABILITY

WITH THE GRACE OF THE ALMIGHTY GOD

FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,

Weigh: a.  that in order to ease the burden of the public, it has been allocated electricity subsidy funds in the State Budget and Shopping Budget (APBN) and/or APBN-Perubahan;
B.  That in order to complete the provisions of the manner of the provision of the budget of the conduct of electricity subsidy funds, need to be reset on the terms of the budget provisioning, counting, payment, and the accountability of electricity subsidies. which was previously set up in the Regulation of the Minister of Finance Number 111 /PMK.02/2007;
c. that under consideration as referred to in letter a and letter b, need to establish the Finance Minister's Regulation on the Order of the Budget, Counting, Payment and Accouncability of Electrical Subsidies;

DECIDED:

Establish: FINANCE MINISTERS ' REGULATIONS ON THE TERMS OF THE APPROPRIATION OF THE BUDGET, CALCULATION, PAYMENT, AND THE ACCOUNTABILITY OF ELECTRICITY SUBSIDIES.

Section 1
In Regulation of this Minister, referred to by:
1. The tariff group is a tariff group as referred to in the regulations governing the Tarif Electric Power provided by the Perseroan Company (Persero) of the State Electricity Company.
2. The next (RP/kWh) underlying charge (RPP) is the cost of providing electricity by PT PLN (Persero) to carry out operations activities ranging from generation, transmission, to power distribution. Electricity to customers is shared with total kWh selling.
3. The Sales Volume is the result of the sales of electricity (kWh) of each of the tariff groups.
4. Network Susut is an energy difference (kWh) between the energy received on the side of the mixing with energy sold to the customer after being reduced by the energy used for its own use in the channing and distribution of electrical energy.
5. The Energy Bauran is a certain volume composition of the Oil Fuel (BBM) and the Non BBM required to generate electricity.
6. The next Budget User power (KPA) is an official who has the authority and responsibility of the PA in order to use the budget to which it is used.
7. The next list of Budgeted Execution Lists (DIPA) are the budgeted implementation documents compiled by the Anggaran/KPA User and authorized by the Minister of Finance or the official authorized by the Minister of Finance.
8. Public Service Obligations (PSO) account is an account belonging to the Minister of Finance as the General Treasurer of the State used to store the Reserve Fund.
9. Electrical Subsidies are less than the average difference between the average electric power rate (Rp/kWh) of each of the BPP's reduced BPP (Rp/kWh) Rate at the voltage in each of the tariff group plus the margin (% of the BPP) multiplied by volume sales (kWh) for each tariff group.

Section 2
(1) Electricity Subsidy Funds are allocated in the APBN and/or APBN-Changes.
(2) In order to conduct the budget of the Electricity Subsidy, the Minister of Finance as the Budget User appoints the Director General of the Budget as KPA. s a margin of more payment of electricity subsidies between the monthly paid to PT PLN (Persero) with the results of research and verification as referred to in paragraph (7), the excess of such payment may be compensated with an electric subsidy bill PT PLN (Persero) the next period.
(10) In the case of no electricity subsidy bill PT PLN (Persero) the next period, the excess payment as referred to the paragraph (9) must be immediately tuned to the State Kas by PT PLN (Persero).
(11) The Payment Of Electricity Subsidy based on the corrected Electrical Subsidy calculations as referred to in paragraph (8), paragraph (9), and paragraph (10), constitutes a payment of 100% (one hundred percent).

Section 16
(1) The remainder of the Electrical Subsidy budget that has not been payable up to the end of December year running as a result of not being able to do verification of the document as referred to in Section 12 of the paragraph (1), may be placed on Account Subsidi/PSO reserve funds are subject to the provisions of the laws.
(2) The placement of the funds on a Subsidiary Reserve Account as referred to in paragraph (1), is most high as the remainder of the DIPA pagu for the shopping of Electrical Subsidies.
(3) The refund of a Subsidiary Reserves (PSO) as referred to in paragraph (2) shall be performed under the terms of the laws.

Section 17
(1) In the case of the amount of Electricity Subsidy results of the research and verification is less than the funds available on the Subsidiaries Reserve/PSO Account as referred to in Section 16, then the remaining funds on the Subsidiary Reserve Account/PSO are immediately deployed. to Kas State by using the Account Code 423913 (the readmission of other shopping Years of the Past Budget Year).

Section 18
The Electric Subsidy Payment as referred to in Article 13, Section 15, and Section 16 is temporary.

Section 19
(1) Payment of Electrical Subsidy Funds, examined by authorized examiners under the provisions of the laws.
(2) The results of the examination results as referred to in paragraph (1) are delivered to the Minister of Finance.
(3) The magnitude of the electricity subsidy in a single year of the budget is final based on the examination results report as referred to in paragraph (2).

Section 20
(1) In the case of any less payment of the Electricity Subsidy between which has been paid to PT PLN (Persero) with the results of the examination as referred to in Article 19, the shortage of such payments will be paid to PT PLN (Persero) After it is announced in the APBN and/or APBN-Changes.
(2) In the case of payment shortfall as referred to in the paragraph (1) unannounced on the year running, the fund may be proposed to be broadcast in the APBN and/or APBN-Changes of the next budget year.
(3) In the case of any more Electric Subsidy payment difference between paid to PT PLN (Persero) with the results of the examination as referred to in Article 19, the excess of such payments must be immediately tuned to the State Kas by PT PLN (Persero) used the Account Code 423913 (Other Shopping Back Reception Of The Past Budget Year).

Section 21
PT PLN (Persero) is formally responsible and material for the implementation and use of the Electrical Subsidy Funds.

Section 22
The KPA is responsible for the distribution of the Electrical Subsidy Funds to PT. PLN (Persero).

Section 23
(1) PT PLN (Persero) delivered the account of the accountability of the use of the Electricity Subsidy to KPA.
(2) The liability report as referred to in paragraph (1) at least includes the target and realization of the sales of electrical power, BPP, Network Susut and Energy Bauran.

Section 24
KPA organizes accounting and reporting under the provisions of the laws.

Section 25
In the case of PT PLN (Persero) for a given period is a special assignment from the Government in order to maintain the availability of certain commodity supplies being supervised for a specific area resulting in additional charges for PT PLN (Persero), the additional cost is intended to be included in the calculation of the Electrical Subsidy of the period concerned through the BPP adjustment after it gets the Finance Minister's approval.

Section 26
This Minister ' s regulation applies to the Electricity Subsidies still allocated in APBN and/or APBN-Changes.

Section 27
At the time the Minister ' s Ordinance came into force:
1. Finance Minister Regulation Number 111 /PMK.02/ 2007 on Tata Cara Budgeting, Counting, Payment and Accouncability of Electrical Subsidies as amended by the Regulation of Finance Minister Number 162 /PMK.02/2007, revoked and It's not valid.
2. The temporary payment of the Electricity Subsidy which has been implemented in the 2013 Budget Year which has not been in accordance with the provisions set out in the Regulation of this Minister, are conducted correction/adjustments under this Minister's Regulation.

Section 28
The Minister ' s rules are beginning to apply at the date of the invitation.
