ABOUT
TEMPORARY ALLOCATION OF FUNDS FOR TOBACCO YIELD EXCISE RESULTS
BUDGET YEAR 2013
BY THE GRACE OF THE ALMIGHTY GOD
FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,
Weigh: a. that under the 2012 Law No. 19 Act on Budget and State Shopping of the Year of Budget 2013, it has been allocated the Fund for the Excise Results of the Budget Year 2013 Results;
B. that under the terms of Article 66A paragraph (4) of the Law No. 11 of 1995 on Excise as amended by Law No. 39 of 2007 and the provisions of Article 1 paragraph (3) of the Regulation of the Minister of Finance Number 84 /PMK.07/ 2008 about Use of Funds for Tobacco Results and Misuse Of The Misuse Of Allocation Of Funds For Tobacco Excise Results as amended by the Regulation of the Minister of Finance Number 20 /PMK.07/2009, Fund for the Excise Results of Tobacco Results for the Regions provinces, counties, and cities are established with the Regulation of the Minister of Finance;
c. that under consideration as referred to in letter a and letter b, need to establish the Finance Minister Regulation on Temporary Allocation Of Funds For The 2013 Budget Year Tobacco Excise Results;
Given: 1. Law No. 11 of 1995 on Excise (State of the Republic of Indonesia in 1995 Number 76, Additional Gazette of the Republic of Indonesia Number 3613) as amended by Law No. 39 of 2007 (Republic of the Republic of Indonesia) Indonesia Year 2007 Number 105, Additional Gazette of the Republic of Indonesia No. 4755);
2. Act No. 19 of 2012 on Budget and State Shopping of the Year of the 2013 Budget (State Sheet of the Republic of Indonesia Year 2012 Number 228, Additional Gazette of the Republic of Indonesia Number 5361);
3. Finance Minister Regulation Number 84 /PMK.07/ 2008 on the Use of Funds For the Excise Results of Tobacco Results and Sanctions On The Misuse Of The Allocation Of Funds For Tobacco Yield Excise as amended by the Regulation of the Minister of Finance Number 20 /PMK.07/2009;
4. Finance Minister Regulation Number 06 /PMK.07/ 2012 on the Implementation and Accouncability of the Transfer Budget to the Regions;
5. Finance Minister Regulation Number 165 /PMK.07/ 2012 on the Alignment of the Transfer Budget to the Regions;
DECIDED:
Set: A FINANCIAL MINISTER ' S REGULATION ON THE TEMPORARY ALLOCATION OF FUNDS FOR THE 2013 BUDGET YEAR TOBACCO EXCISE RESULTS.
Article 1
Allocation while Funding For Tobacco Results Excise Results (DBH CHT) 2013 Budget year is set based on estimates of the receipts for the 2013 Budget Year Tobacco Results.
Article 2
(1) Alocation while DBH CHT The Year of Budget 2013 was amounting to Rp1.760.415.895.943.00 (one trillion seventy billion four hundred fifteen million eight hundred and ninety-five thousand nine hundred and forty-three thousand rupiah).
(2) Alocation while DBH CHT as referred to in paragraph (1) is up 2% (two percent) of the receipt of Tobacco Results as referred to in Law No. 19 of 2012 on Budget Revenue and Shopping State of Budget 2013.
(3) The details of the temporary allocation of DBH CHT as referred to in paragraph (1) are listed in the Attachment which is an inseparable part of the Regulation of this Minister.
Article 3
(1) Alocation while DBH CHT as referred to in Section 2 of the paragraph (1) is set per province using a variable with each weighting as follows:
a. The receipt of tobacco excise was 2 (two) the previous year with a weight of 58% (fifty-eight percent);
B. average dry tobacco production for 3 (three) the previous year with a weight of 38% (thirty-eight percent); and
c. Social environmental coaching (measured by human development index figures) 2 (two) the previous year with a weight of 4% (four percent).
(2) Alocation while DBH CHT as referred to in paragraph (1) for the province, district, and city is governed by the Governor in the area concerned.
Section 4
The use of DBH CHT for provinces, counties, and cities is exercised in accordance with the provisions of the laws.
Section 5
The Regulation of the Minister comes into effect on the date of the promulctest.
