REGULATION of the MINISTER of FINANCE of the REPUBLIC of INDONESIA NUMBER 173/FMD. 02/2013 ABOUT ORDINANCE provision, liquefaction, and ACCOUNTABILITY of the FUND HOLDING of the OBLIGATIONS of PUBLIC SERVICE AREAS of OCEAN FREIGHT to ECONOMY CLASS PASSENGERS with the GRACE of GOD ALMIGHTY the MINISTER of FINANCE of the REPUBLIC of INDONESIA, Considering: a. that in order the execution of the obligations of public service areas of ocean freight for economy class passengers, allocation of funds has been assigned the duty of organizing the public service areas of ocean freight for economy class passengers in the budget revenue and Expenditure of the State (STATE BUDGET) and/or BUDGET changes;
b. that, in order to flesh out the provisions on the procedures for provision, liquefaction, and accountability of the Fund holding of the obligations of public service areas of ocean freight for economy class passengers, the need to reorganize the Ordinance provision, liquefaction, and accountability of the Fund holding of the obligations of public service areas of ocean freight to economy class passengers who have previously arranged in a ministerial regulation 157/FMD KeuanganNomor. 02/2010;
c. that based on considerations as referred to in letter a and letter b, need to establish the regulation of the Minister of Finance Ordinance provision, liquefaction, and accountability DanaPenyelenggaraan the obligation of public service areas of ocean freight For economy class Passengers;

Decide: define: REGULATION of the MINISTER of FINANCE ORDINANCE provision, liquefaction, and the LIABILITY of the FUND HOLDING of the OBLIGATIONS of PUBLIC SERVICE AREAS of OCEAN FREIGHT for ECONOMY CLASS PASSENGERS.
Article 1 In regulation of the Minister, that is: 1. The obligation of public service areas of ocean freight For economy class Passengers is the obligation of public service areas of ocean freight to economy class passengers as set forth by the Minister of transport in accordance with the provisions of the legislation, which was assigned to the National Cruise PT Indonesia (Persero) as the implementing Public Service Obligation (PSO).
2. Checklist of implementation of the budget referred to hereafter DIPA is a document the implementation of the budget the budget drawn up by the user/User Power budget.
3. Budget Users hereinafter abbreviated PA is the official holder of the use of budget authority ministries/agencies.

5. Reserve Fund Account is an account belonging to the Minister of finance as Treasurer General of the country used to keep a reserve fund.
Article 2 in order to provide the service of ocean freight economy class to the community with affordable fares, the Government organized a public service obligation.

Article 3 (1) the allocation of funds for the purposes of organizing the obligation of public service areas of ocean freight economy class passengers to set out in the NATIONAL BUDGET and/or BUDGET changes.
(2) Upon the allocation of the funds referred to in subsection (1), DIPA published according to the provisions of legislation.

Article 6 procedures for disbursement of organizing the obligation of public service areas of ocean freight economy class passengers to be carried out in accordance with the provisions of the legislation.

Article 7 (1) the remainder of the Fund holding of the obligations of public service areas of ocean freight to the economy class passengers have yet to be paid up to the end of December of the current year as a result of not doing the verification documents and field as stipulated in article 5 paragraph (4), be placed on the Reserve Fund Account in accordance with the provisions of the legislation.

Article 8 PT Pelayaran Nasional Indonesia (Persero) responsible for formally and materially the implementation and use of the funds of the Organization of the public service obligations of the field of ocean freight for economy class passengers.

Article 9 KPA fully responsible upon remittances of organizing the obligation of public service areas of ocean freight economy class passengers for a cruise to the national kepadaPT Indonesia (Persero).

Article 10 (1) PT Pelayaran Nasional Indonesia (Persero) delivered a report on accountability for the use of funds of the Organization of the public service obligations of the field of ocean freight to economy class passengers to KPA in accordance with the provisions of the legislation.

Article 11 KPA organizes accounting and reporting in accordance with the provisions of the legislation.

Article 12 (1) of the use of funds of the Organization of the public service obligations of the bidangangkutan sea to the economy class passengers as referred to in article 8, performed by authorized inspectors in accordance with the provisions of the legislation.
(2) the report of the results of the examination referred to in subsection (1) is submitted to the Director General, KPA budget-Ministry of finance, and Director General of the Treasury-Ministry of finance.
(3) National Cruise PT Indonesia (Persero) delivered a report on the use of funds of the Organization of the public service obligations of the bidangangkutan sea to the economy class passengers who have done the examination referred to in subsection (1) to the Government through the Minister of transport at the latest 1 (one) months in accordance with the provisions of the legislation.
Article 13 (1) Dalamhal based on the results of the checks referred to in article 12 paragraph (1) States that the amount of funding the Organization of the public service obligations of the field of ocean freight to economy class passengers is greater than the amount paid by the Government of Indonesia National Cruise to PT (Persero), short of the proposed payments to budgeted in the STATE BUDGET and/or BUDGET-Perubahansesuai with the provisions of the legislation.

Article 14 implementation of activities in the framework of the Organization of the public service obligations of the field of ocean freight for economy class passengers, the Ministry of finance and the Ministry of transportation can form teams to undertake monitoring and evaluation in accordance with those powers.

Article 15 of the regulation the Minister applies all the funding for the Organization of the public service obligations of the field of ocean freight to economy class passengers still budgeted/provided in STATE BUDGET and/or BUDGET changes.

Article 16 at the time of this Ministerial Regulation entered into force, the regulation of the Minister of finance Number 157/FMD. 02/2010 about the Ordinance provision, liquefaction, and accountability of the Fund holding of the obligation of public service areas of ocean freight For economy class Passengers, revoked and declared inapplicable.

Article 17 this Ministerial Regulation comes into force on the date of promulgation.
