REGULATION of the MINISTER of FINANCE of the REPUBLIC of INDONESIA NUMBER 98/FMD. 06/2013 ABOUT CHANGES to the REGULATION of the MINISTER of FINANCE NUMBER 125/FMD. 06/2011 ABOUT the MANAGEMENT of the STATE-OWNED GOODS that COME FROM DEKONSENTRASI FUNDS and FUNDS the TASK PEMBANTUAN BEFORE the FISCAL YEAR 2011 with the GRACE of GOD ALMIGHTY the MINISTER of FINANCE of the REPUBLIC of INDONESIA, Considering: a. that the orderly administration in order against the management of the State-owned Goods retrieved from Dekonsentrasi Funds and funds the task Pembantuan before the fiscal year 2011 top refinement to be done, the regulation of the Minister of finance Number 125/FMD. 06/2011 about the management of the State-owned Goods that come from Dekonsentrasi Funds and funds the task Pembantuan Before the fiscal year 2011;

Remember: 1. 2. Government Regulation number 7 in 2008 on Dekonsentrasi And Pembantuan (State Gazette of the Republic of Indonesia Number 20 in 2008, an additional Sheet of the Republic of Indonesia Number 4817);
3. Presidential regulation Number 24 of 2010 about the position, duties, and functions of the Ministries as well as the Organization, duties, and functions of the Echelon I Ministries as it has several times changed the last presidential regulation Number 92 in 2011 (State Gazette of the Republic of Indonesia in 2011 Number 142);
4. Regulation of the Minister of finance Number 125/FMD. 06/2011 about the management of the State-owned Goods that come from Dekonsentrasi Funds and funds the task Pembantuan Before the fiscal year 2011;
Decide: define: REGULATION of the MINISTER of FINANCE ABOUT the CHANGES to the REGULATION of the MINISTER of FINANCE NUMBER 125/FMD. 06/2011 ABOUT the MANAGEMENT of the STATE-OWNED GOODS that COME FROM DEKONSENTRASI FUNDS and FUNDS the TASK PEMBANTUAN BEFORE the FISCAL YEAR 2011.
Article I a few Provisions in the regulation of the Minister of finance Number 125/FMD. 06/2011 about the management of the State-owned Goods that come from Dekonsentrasi Funds and funds the task Pembantuan Before the fiscal year 2011, amended as follows: 1. The provision of article 1 point 9 and the number 10 is amended so that article 1 reads as follows: article 1 In this ministerial regulation is: 1. State-owned Goods , hereinafter abbreviated BMN, is all goods bought or obtained over the STATE BUDGET burden or derived from other legitimate earnings.
2. State-owned Goods that come from Dekonsentrasi Funds and funds the task Pembantuan before the fiscal year 2011, hereinafter abbreviated BMN DK/TP, are all goods bought or obtained from Funds and funds Dekonsentrasi Pembantuan Duty before the year 2011 budget.
3. Dana Dekonsentrasi is the funding comes from the STATE BUDGET that is exercised by the Governor as the representative of a Government that includes all of the receipts and expenditure in the framework of the implementation of the dekonsentrasi, does not include the funds allocated to the vertical center of the agencies in the area.
4. The Fund's Task Pembantuan is derived from the STATE BUDGET funds that are implemented by the regional and village that includes all of the receipts and expenditure in the framework of the implementation of the task pembantuan. 5. Dekonsentrasi is pelimpahan the authority of the Government to the Governor as the representative of the Government.
6. Task Pembantuan assignment is from Government to the region and/or other designations or village with the obligation to report and account for their implementation to the commissioning.
7. Power User Stuff is the head Unit Device Work areas or officials designated by the user of the goods for the use of goods that are in control with his best.
8. The regional unit of Work Device, hereinafter abbreviated as SEGWAY, is the Organization/institution on local governments which are responsible for the implementation of dekonsentrasi/task of Government in certain areas in the County, district, Province or city.
9. The use is an activity performed by the user of the goods in managing and menatausahakan State-owned Goods that comply with basic tasks and functions of the concerned agencies. 10. Pemindahtanganan is the transfer of ownership BMN.

2. The provisions of article 7 is modified so that article 7 reads as follows: article 7 (1) the user of goods and/or power user Stuff should do an inventory to determine the details of the data over the BMN DK/TP, including the condition and whereabouts of BMN DK/TP.
(2) the results of the inventory referred to in subsection (1) is used as the basis for the user of the goods in determining the management over BMN DK/TP 3.  The provisions of article 9 paragraph (2) are amended so that article 9 reads as follows: article 9 (1) the determination of the status of the use of BMN DK/TP as stipulated in article 8 made on BMN DK/TP that is being used or planned for use in the performance of duties and functions of the Ministries/agencies.
(2) the determination of the status of the use of BMN DK/TP as referred to in article 8 need not be done at the BMN DK/TP which is planned to be done Pemindahtanganan until December 31, 2014 or have been handed over to third parties.
4. The provisions of article 13 paragraph (2) letter e removed so that Article 13 reads as follows: article 13 (1) grants BMN DK/TP is done to local governments.

b. has been ditatausahakan by Ministries/Agencies;

5. The provisions of article 15 is amended by adding a paragraph to wit paragraph (3) so that the Article 15 reads as follows: article 15 (1) the proposal Grants BMN DK/TP is land and/or buildings from the user of the goods to the person who manages the goods, must be accompanied with supporting data such as: a. the details of the items to be donated, including proof of ownership, year of acquisition, spacious, book value, condition and location;
b. waiver of liability absolute unconditional full of User Goods over the truth of material about BMN DK/TP; c. data of prospective grantees;

d. statement of readiness grant BMN DK/TP from the user of the goods; and e. an affidavit the willingness accepting Grants BMN DK/TP from local authorities and/or news event of the handover, in terms of BMN DK/TP is already diserahoperasikan to local governments.
(2) in case the proof of ownership as intended in paragraph (1) letter a does not exist, then it can be replaced with other evidence such as documents of title deeds/contract, purchase agreement, and other equivalent document which can be used interchangeably with it.
(3) the affidavit of the willingness of accept Grants BMN DK/TP from local authorities as referred to in paragraph (1) letter e was signed by the Governor or Regent/Mayor or authorized officials.
6. The provisions of article 16 is amended by adding a paragraph to wit paragraph (2) to article 16 reads as follows: article 16 (1) the proposal Grants BMN DK/TP form in addition to the land and/or the building of the user of the goods to the person who manages the goods, must be accompanied with supporting data such as: a. the details of the items to be donated include the year of acquisition, identity/specifications, book value, location, designation of the goods;
b. waiver of liability absolute unconditional full of User Goods over the truth of material about BMN DK/TP; c. data of prospective grantees;

d. statement of readiness grant BMN DK/TP from the user of the goods; and e. an affidavit the willingness accepting Grants BMN DK/TP from local authorities and/or news event of the handover, in terms of BMN DK/TP is already diserahoperasikan to local governments.
(2) an affidavit of the willingness of accept Grants BMN DK/TP from local authorities as referred to in paragraph (1) letter e was signed by the Governor or Regent/Mayor or authorized officials.
7. The provisions of article 29 is amended so that Article 29 reads as follows: article 29 filing of proposed management of BMN DK/TP from the user of the goods to the provider of the Goods as provided for in the regulations the Minister is made no later than 31 December 2014.

Article II of this Ministerial Regulation comes into force on the date of promulgation.
