AT THE MINISTRY OF NATIONAL DEVELOPMENT PLANNING/
NATIONAL DEVELOPMENT PLANNING AGENCY

WITH THE GRACE OF THE ALMIGHTY GOD

NATIONAL DEVELOPMENT PLANNING MINISTER/
HEAD OF THE NATIONAL DEVELOPMENT PLANNING AGENCY
REPUBLIC OF INDONESIA,

Weigh: a.  that in order to maintain accountability for the utilization of overseas loans and grants has been established Government Regulation No. 10 Year 2011 on the Tata Cara Procurement of Foreign Loans and the Reception of Hibah, and the Regulation of the Minister of State Planning National Development/Head of the National Development Planning Board Number 4 Year 2011 on Planning, Proposed Submissions, Assessment, Monitoring, and Evaluation of Financed Activities From Overseas Loans and Hibah;
B.   that it has been given the law as referred to in the letter a, need to replace the Regulation of the Minister of State of National Development Planning/National Development Planning Board Number 1 of 2007 on the Mechanism and Procedure in the National Development Planning Ministry/National Development Planning Board in the Investigative Process, Monitoring and Evaluation of Financed Activities from the Loan and/or Overseas Hips;

c. that under consideration as referred to in letter a and letter b, need to establish the National Development Planning Minister/Head of the National Development Planning Agency on the Planning Document Drafting Mechanism as well as Monitoring, and Evaluation of the Performance of Implementing Overseas Lending Activities and Hibah at the National Development Planning Ministry/National Development Planning Agency;
Remembering: 1.   Act No. 1 Year 2004 on the State Treasury (Indonesian Republic Year 2004 Number 5, Additional Gazette of the Republic of Indonesia Number 4355);
2. Act Number 25 Year 2004 on National Development Planning System (State Sheet Indonesia Year 2004 Number 104, Additional Sheet Country Republic Indonesia Number 4421);
3. Government Regulation No. 10 Year 2011 on the Tata Cara Procurement of Foreign Loans and Reception of Grants (sheet of State of the Republic of Indonesian 2011 No. 23, Additional Gazette of the Republic of Indonesia No. 5202);
4. Presidential Regulation No. 82 of 2007 on the National Development Planning Board;
5. Presidential Regulation No. 47 of 2009 on the Establishment and Organization of the Ministry of State as it has been several times amended, last with the Presidential Regulation Number 91 of 2011;
6. Regulation of the Minister of State of National Development Planning/Head of the National Development Planning Board Nomor.PER.005/M. PPN/10/2007 about the Organization and the Working Tata Ministry of National Development Planning/Development Planning Agency National, as it has been amended with Regulation of the National Development Planning Minister/Head of the National Development Planning Board Number 7 of 2012;
7. Regulation of the Minister of State of National Development Planning/Head of the National Development Planning Board Number 4 Year 2011 on Planning How Planning, Proposed Assessment, Assessment, Monitoring, and Evaluation of Activities financed from Outside Loans The Land and the Hibah;

DECIDED:
Establish: REGULATION OF THE NATIONAL DEVELOPMENT PLANNING MINISTER /HEAD OF THE NATIONAL DEVELOPMENT PLANNING AGENCY ON THE MECHANISM OF DRAFTING PLANNING DOCUMENTS AS WELL AS MONITORING AND EVALUATION OF PERFORMANCE OF THE CONDUCT OF OVERSEAS LOAN ACTIVITIES AND GRANTS IN THE MINISTRY OF PLANNING FOR NATIONAL DEVELOPMENT/NATIONAL DEVELOPMENT PLANNING AGENCY.

BAB I
UMUM CONDITIONS
Section 1
In Regulation of the Minister this is referred to:
1. The National Development Planning Ministry/National Development Planning Board, which is next called the Ministry of PPN/Bappenas, is the Ministry that organizes government affairs in the field of national development planning.
2. National Development Planning Minister/Head of the National Development Planning Agency, next called the Minister, is the minister who organizes government affairs in the field of national development planning.
3. Secretary of the National Development Planning Ministry/Principal Secretary of the National Development Planning Agency, next called the Secretary of the Ministry, is the supporting element of the Minister in the holding and coaching of the administration Ministry of PPN/Bappenas.
4. Deputy Field Development Fund, subsequently called Deputy Funding, is the supporting element of the Minister in the formulation of policy and the implementation of the creation of a national development plan in the field of development funding.
5. Deputies are the supporting element of the Minister involved in the planning, assessment, monitoring and evaluation of overseas loans and grants on national development in accordance with the fields of duty and responsibility.
6. Ministry/Institute is the ministry/institution of the non-ministerial/institution government.
7. State-owned Enterprises, which is subsequently called the BUMN, is the entire business entity or most of its capital is owned by the state through its direct inclusion of the wealth of the segregated state.
8. Finance Minister is the minister who organizes government affairs in the field of state finance.
9. Foreign Loans are any financing through the debt obtained by the Government from the Foreign lender that is tied by the loan agreement letter and is not in the form of a country ' s precious letter, which must be paid back with Certain requirements.
10,lending Activity is a Foreign Loan used to finance certain activities.
11.Plans Utilization of Foreign Loans, further abbreviated to RPPLN, is a document containing indicative of the need and plans for use of Overseas Loans in the medium term.
12.List of the Mid-Term Foreign Loans Plan, which further abbreviated DRPLN-JM is a list of planned activities financed from Foreign Loans for the medium-term period.
13.A List of Foreign Loan Priority Plans, further abbreviated as DRPPLN, is a list of activities that have indicated funding and ready to be financed from Foreign Loans for the annual period.
14.The Activities List of activities is a list of activities that have been listed in the DRPPLN and ready to be proposed to and/or negotiated with the prospective Foreign Lender.
15.Hibah Government, which is next called Hibah, is any state acceptance in the form of a devisa, a revamped devisa, a rupiah, goods, services and/or a valuable letter obtained from a grant that does not need to be repaid, which come from within the country or abroad.
The 16,Plan of the Grant Utilization, which is further abbreviated to RPH, is a document that contains the direction of the policy, strategy, and utilization of medium-term grants according to the priorities of national development.
The 17.List of the Plan of Grant Activities, which is next abbreviated DRKH, is a list of planned annual activities financed with grants and has obtained indicative of funding from prospective grant-making.
18.monitoring is a regularly conducted observation activity to provide information about the developmental status of an activity, and identify issues that arise and formulate a necessary follow-up.
19.Evaluating Performance Execution Performance is an activity that systematically collects and analyzes data and information to assess the achievement of goals and activities objectives.

BAB II
INTENT, PURPOSE, ASAS, AND SCOPE
Section 2
The rules of this minister are defined by the intent to maintain accountability and enhance coordination in the Ministry of PPN/Bappenas in implementing the drafting of the planning document as well as Monitoring and Evaluation of the Performance of External Lending Activities The Land and the Hibah.

Section 3
The Minister ' s regulation is set with a goal for:
a.   improving the quality of drafting of the Foreign and Hibah Loan planning documents;
B.   improving the quality of the Monitoring and Evaluation of Performance of Foreign Loan Activities and Hibah; and
c. increase the effectiveness of the use of Foreign and Hibah Loans.

Section 4
The drafting of the planning document as well as the Monitoring and Evaluation of the Performance of Foreign Loan Activities and the mandatory Hibah are mandatory:
a.   Obey the rules;
B.   synergy with the national development planning system;
C.   Effective:
D.   Efficient;
e.   transparent; and
f.   Order.

Section 5
The scope set out in this Ministerial Regulation is the drafting of the planning document as well as the Monitoring and Evaluation of the Performance Execution Activities, consisting of:
a.   Activities loans whose funds are sourced from Foreign Loans; and
B.   A planned grant that funds its funds from within the country and abroad.

BAB III
FOREIGN LOAN
The First Part
Activity Loan Planning Document
Section 6
The Activities Loan planning document consists of RPPLN, DRPLN-JM, DRPPLN, and Activities List.

The Second Part
Composition
Section 7
(1) The Drafting Of The RPPLN is conducted in a guideline on RPJMN and pays attention to the maximal limit plan of the loan compiled by the Minister of Finance.
(2) The preparation of DRPLN-JM is carried out based on the results of the feasibility assessment of the activities presented by the Ministry/Regional/Local Government/BUMN.
(3) The preparation of DRPPLN is conducted based on the results of fulfilment of the fulfilment of the activities readiness criteria that have been listed in DRPLN-JM.
(4) The drafting of the Activities List is conducted based on the results of the fulfilment of the activities readiness criteria that have been listed in the DRPPLN.
(5) Drafting Of RPPLN, DRPLN-JM, DRPPLN, and Activities List is coordinated by the Deputy Financing by engaging the Deputy associated fields and/or other related agencies.
(6) The deputies of the related field are responsible in performing the assessment as referred to in paragraph (2), (3), and (4).
(7) The assessment of the fulfillment of a portion of the activity readiness criteria as referred to in paragraph (3) and the judgment of fulfillment of all activities readiness criteria as referred to in paragraph (4), set further with the direction of the implementation which The Secretary of the Ministry.

The Third Part
The assignment and delivery of
Section 8
(1) The Deputy Funding delivers the draft RPPLN, DRPLN-JM, DRPPLN, and the Activities List to the Minister.
(2) The Minister establishes RPPLN, DRPLN-JM and DRPPLN through the Ministerial Decree.
(3) The Minister approved the List of Activities by letter to the Minister of Finance.

Section 9
(1) The Minister addresses the RPPLN to the minister on the ministry, the leader of the agency, the head of the area, and the principal director of the BUMN.
(2) The Minister delivered DRPLN-JM and DRPPLN to the Minister of Finance, the minister on the ministry, the chief of the agency, the head of the area, the chief director of the BUMN as well as the prospective Foreign Loan lenders.
(3) The Minister addressed the Activities List to the Minister of Finance.

The Fourth Part
Changes
Section 10
(1) RPPLN and DRPLN-JM can be refurbisted and refined according to the needs and/or development of the national economy.
(2) The change of RPPLN and DRPLN-JM, as referred to in paragraph (1), is carried out under the direction of the Minister.
(3) The provisions of the drafting of RPPLN and DRPLN-JM, as referred to in Article 7 to Section 9, apply mutatis mutandis to the drafting of RPPLN changes and DRPLN-JM changes.

The First Part
Grant Planning Documents
Section 11
The planned Hibah planning document is composed of RPH and DRKH.

The Second Part
Composition
Section 12
(1) The Drafting Of The RPH is conducted by guideline on RPJMN.
(2) The preparation of the DRKH is carried out based on the results of the feasibility assessment presented by the Ministry/Institute.
(3) The Drafting Of The RPH and DRKH is coordinated by the Deputy Funding by engaging the Deputy associated fields and/or other related agencies.
(4) The deputies of the related field are responsible in performing the assessment as referred to in paragraph (2).

The Third Part
The assignment and delivery of
Section 13
(1) The Deputy Funding delivered the draft RPH and DRKH to the Minister.
(2) The Minister establishes the RPH and DRKH through the Ministerial Decree.

Section 14
(1) The Minister addresses the RPH to the minister on the ministry and the leadership of the agency.
(2) The Minister delivered DRKH to the Minister of Finance, the minister on the ministry and the leadership of the agencies whose proposals are listed in the DRKH, as well as the candidates for the Hibah.

The Third Part
Changes
Section 15
(1) The RPH can be updated and refined according to the needs and/or development of the national economy.
(2) The change of RPH, as referred to in paragraph (1), is carried out under the direction of the Minister.
(3) The provisions regarding the drafting of the RPH, as referred to in Article 12 to Section 14, apply mutatis mutandis to the drafting of the RPH change.

BAB V
MONITORING AND EVALUATION OF PERFORMANCE PERFORMANCE PERFORMANCE
The First Part
Execution
Section 16
(1) The Deputy Funding Coordinates the Monitoring and Evaluation of the Performance of Activities Financed from Foreign Loans and Hibah.
(2) Monitoring and Evaluation of the Performance of Activities, as referred to in paragraph (1) is conducted through meetings, reporting of activities, and/or field visits by involving related deputian, acting agencies, related agencies Another, and the overseas lender and/or the Hibah.

The Second Part
Reporting and Delivery
Section 17
(1) Based on the results of the Monitoring and Evaluation of the Implementation of the Activities, as referred to in Section 16, the Deputy of the Funding compiled a quarterly, quarterly, Performance Performance Report of the Performance Report.
(2) The Deputy Director of the United States ("Agreement") is the subject of the terms and terms of the Agreement.

Section 18
(1) The Minister approves of the quarterly Performance Performance of Lending Performance on a quarterly basis.
(2) The performance report of the Foreign Loan Implementation and/or the Hibah as referred to in paragraph (1) is delivered to the acting agencies of activities and other related agencies.

The Third Part
The follow up
Section 19
In the event of a slow or unsuitable implementation of Foreign and/or Hibah, the Deputy of the Funding together with the deputies of the related field can conduct analysis and make up the Minister's recommendation. to the Finance Minister about the completion steps of the activities implementation.

BAB VI
DRAFTING OF PLANNING DOCUMENTS AS WELL AS MONITORING AND
EVALUATION PERFORMANCE PERFORMANCE OF SPECIAL ACTIVITIES
Section 20
Preparation of the Planning Document and the Monitoring and Evaluation of the Performance of Staging Activities are the main tools of the main tools of the Indonesian National Armed Forces armament system and the special materials tool of the Indonesian Republic of Indonesia Police set in its own Minister ' s Rule.

BAB VII
OTHER PROVISIONS
Section 21
The provisions of the Planning Document Drafting process as well as Monitoring and Evaluation of Performance Performance Performance of Foreign Loans and Hibah are set up with the implementation guide set by the Secretary of the Ministry.

BAB VIII
CLOSING PROVISIONS
Section 22
At the time of the enactment of the Regulation of this Minister, the Regulation of the Minister of State of National Development Planning/National Development Planning Board Number 1 of 2007 on the Mechanism and Procedure in the National Development Planning Ministry/Agency National Development Planning in the Broadcasting, Monitoring and Evaluation Process is financed from the Loan and/or Overseas Hibah, revoked and declared not applicable.

Section 23
The rules of the Ministry are effective on the date of the promulgations.
