REGULATION of the MINISTER of NATIONAL DEVELOPMENT PLANNING/NATIONAL DEVELOPMENT PLANNING AGENCY HEAD of the REPUBLIC of INDONESIA number 2 by 2014 ABOUT the MECHANISM of the PREPARATION of the PLANNING DOCUMENTS AS WELL AS MONITORING and PERFORMANCE EVALUATION of the IMPLEMENTATION of the ACTIVITIES of FOREIGN LOANS and GRANTS at the MINISTRY of NATIONAL DEVELOPMENT PLANNING/NATIONAL DEVELOPMENT PLANNING AGENCY with the GRACE of GOD ALMIGHTY MINISTER of NATIONAL DEVELOPMENT PLANNING/HEAD of the NATIONAL DEVELOPMENT PLANNING AGENCY of the REPUBLIC of INDONESIA, Considering: a. that in order to maintain the accountability of the utilization of foreign loans and grants has been assigned the Government Regulation number 10 in 2011 about the procedures for the procurement of Foreign Loans and grants, and regulatory acceptance of State Minister of national development planning/national development Planning Agency Head number 4 in 2011 about the procedures for planning, Proposal Submission, assessment, monitoring, and evaluation of the activities financed from Foreign Loans and grants;
b. that has been established with the legislation referred to in letter a, need to replace a regulation of the Minister of State for national development planning/national development Planning Agency Head No. 1 of 2007 on the mechanisms and procedures in the Ministry of national development planning/national development Planning Agency in the process of Preparation, monitoring and evaluation of the activities financed from the Loan and/or Grants abroad;
c. that based on considerations as referred to in letter a and letter b, need to establish the regulation of the Minister of national development planning/national development Planning Agency Head about the mechanism of the preparation of the planning documents as well as Monitoring, performance evaluation and implementation of the activities of Foreign Loans and grants at the Ministry of national development planning/national development Planning Agency;
Remember: 1. Act No. 1 of 2004 on the Treasury of the State (State Gazette of the Republic of Indonesia in 2004, an additional Sheet No. 5 of the Republic of Indonesia Number 4355);
2. Act No. 25 of 2004 about National Development Planning System (State Gazette of the Republic of Indonesia Number 104 in 2004, an additional Sheet of the Republic of Indonesia Number 4421);
3. Government Regulation number 10 in 2011 about the procedures for the procurement of Foreign Loans and acceptance of Grants (State Gazette of the Republic of Indonesia Number 23 in 2011, an additional Sheet of the Republic of Indonesia Number 5202);
4. Presidential regulation Number 82 in 2007 about the national development planning Board;
5. Presidential regulation Number 47 in 2009 about the formation and organization of the Ministries, as it has been modified several times, the last presidential regulation Number 91 in 2011;
6. Regulation of the Minister of State for national development planning/national development Planning Agency Head URNomor.PER. 005/URM.PPN/10/2007 about the Organization and the Work of the Ministry of State for national development planning/National Development Planning Agency, as amended by regulation of the Minister of national development planning/national development Planning Agency Head number 7 in 2012;
7. Regulation of the Minister of State for national development planning/national development Planning Agency Head number 4 in 2011 about the procedures for planning, Proposal Submission, assessment, monitoring, and evaluation of the activities financed from Foreign Loans and grants;
Decide: define: REGULATION of the MINISTER of NATIONAL DEVELOPMENT PLANNING/NATIONAL DEVELOPMENT PLANNING AGENCY HEAD ABOUT the MECHANISM of the PREPARATION of the PLANNING DOCUMENTS AS WELL AS MONITORING and PERFORMANCE EVALUATION of the IMPLEMENTATION of the ACTIVITIES of FOREIGN LOANS and GRANTS at the MINISTRY of NATIONAL DEVELOPMENT PLANNING/NATIONAL DEVELOPMENT PLANNING AGENCY.
CHAPTER I GENERAL PROVISIONS article 1 In this ministerial regulation is: 1. The Ministry of national development planning/national development Planning Agency, hereinafter called VAT/Bappenas Ministry, the Ministry is organizing the Affairs of Government in areas of national development planning.
2. Minister of national development planning/national development Planning Agency Head, who then referred to the Minister, the Minister is organizing a Government Affairs in the field of national development planning.
3. The Secretary of the Ministry of national development planning/Principal Secretaries of the national development planning board, hereinafter called the Secretary of the Ministry, are the helpers of the Minister in the administration of the Ministry of construction and the VAT/Bappenas.
4. Deputy field of Funding Development, hereinafter called the Deputy of funding, are the helpers of the Minister in policy formulation and implementation of national development plan preparation in the field of funding development.
5. Deputy Minister helper elements are involved in the planning, assessment, monitoring and evaluation of foreign loans and grants in accordance with national development areas be duties and responsibilities.
6. The Ministry/Institution is the Ministry/ministries/non governmental agencies.
7. State-owned enterprises, STATE-OWNED COMPANIES hereinafter referred to as the business entity is that all or most of the capital is owned by the State through its investment directly derived from the wealth of the country separated.
8. Minister of finance was the Minister who organized a Government Affairs in the field of finances of the State.
9. Foreign Loan is any debt financing through Government obtained from Foreign lenders are bound by the agreement letter loan and not the shape of the country's securities, which must be paid back with specific requirements.
10. The loan activities of the Foreign Loans were used to finance specific activities.
11. The plan of utilization of Foreign Loans, hereinafter abbreviated as RPPLN, is a document that contains an indication of needs and plan the use of Foreign Loans in the medium term.
12. A list of Plans, medium-term Foreign Loans, hereinafter abbreviated DRPLN-JM is a decent list of activity plan financed from Foreign Loans for the period of the medium-term.
13. A list of the priority Plan Loans Abroad, hereinafter abbreviated as DRPPLN, is a list of plan of activities that have had an indication of funding and is ready to Loan financed from the foreign countries to the annual term period.
14. The list is a list of plan of activities that have been listed in DRPPLN and ready to be proposed to and/or negotiated with potential lenders overseas.
15. Government Grants, hereinafter called the grants, is every country's acceptance in the form of foreign exchange, a foreign exchange dirupiahkan, dollars, goods, services and/or securities obtained from grants that don't have to be paid back, originating from within the country or abroad.
16. The plan of utilization of Grants, hereinafter abbreviated RPH, is a document that contains a policy direction, strategy, and utilization of medium-term grants in accordance with national development priorities.
17. A list of Plan grant activities, hereinafter abbreviated as DRKH, is a list of the annual activities plan viable funded with grants and has received the funding from the indication of the prospective giver a grant.
18. Monitoring activities observations made is periodically to provide information about the status of the development of an activity, as well as identify problems that arise and formulate the necessary follow-up.
19. Performance evaluation of the implementation of the Activity is an activity that systematically collect and analyze data and information to assess the achievement of the goals and objectives of the activities.
CHAPTER II the INTENTIONS, goals, principles, and the SCOPE of article 2 of the Ministerial Regulation was enacted with a view to maintaining accountability and improve coordination in the Ministry of VAT/Bappenas in carrying out the preparation of the planning documents as well as monitoring and performance evaluation of the implementation of the activities of Foreign Loans and grants.

Article 3 of this regulation to the Minister designated for the purpose of: a. improving the quality of the preparation of the planning documents of Foreign Loans and grants;
b. improving the quality of the implementation of the monitoring and evaluation of the performance of the implementation of the activities of Foreign Loans and grants; and c.  improve the effectiveness of the use of Foreign Loans and grants.
Article 4 preparation of the planning documents as well as monitoring and performance evaluation of the implementation of the activities of Foreign Loans and grants implemented mandatory: a. conformed to the rules;
b. synergies with national development planning system;
c. effective;
d. efficient;
e. the transparent; and f.  Code of conduct.
Article 5 scope of which is set out in ministerial regulation this is the preparation of the planning documents as well as monitoring and performance evaluation of the implementation of activities, comprising: a. Loan activity funds sourced from Foreign Loans; and b.  Grant planned a fund sourced from within the country and abroad.
CHAPTER III FOREIGN LOANS the first part of planning document Lending Activities article 6 planning document Lending Activities consist of RPPLN, DRPLN-JM, DRPPLN, and a list of activities.

The second part is the preparation of article 7 (1) RPPLN Compilation done with based on RPJMN and noting the maximum loan limit plan drawn up by the Minister of finance.
(2) the preparation of DRPLN-JM is done based on the results of the assessment of the feasibility of the proposed activities submitted by Ministries/Agencies/local government/STATE-OWNED ENTERPRISES.

(3) preparation of DRPPLN is done based on the results of the assessment of the readiness criteria in part fulfillment of activities that have been listed in DRPLN-JM.
(4) preparation of a list of Activities undertaken on the basis of the results of the assessment of the fulfillment of the entire criteria of readiness activities that have been listed in DRPPLN.
(5) preparation of RPPLN, DRPLN-JM, DRPPLN, and a list of activities coordinated by Deputy Funding involving the Deputy related field and/or other relevant agencies.
(6) The Deputy related fields accountable in the conduct of the assessment referred to in subsection (2), (3) and (4).
(7) an assessment of the readiness criteria in part fulfillment of the activities referred to in paragraph (3) and assessment criteria of the readiness of the entire fulfillment of the activities referred to in paragraph (4), governed more by guidelines set forth by the Secretary of the Ministry.
The third part Designation and submission of article 8 (1) Deputy Funding delivered the draft RPPLN, DRPLN-JM, DRPPLN, and a list of activities to the Minister.
(2) the Minister sets the RPPLN, DRPLN-JM and DRPPLN through a decision of the Minister.
(3) the Minister approves the list of activities through a letter to Minister of finance.
Article 9 (1) the Minister delivered to the Secretary at the Ministry of RPPLN, head of the Agency, the head of the region, and President Director of STATE-OWNED ENTERPRISES.
(2) the Minister conveys DRPLN JM-and DRPPLN to the Minister of finance, Minister of the Ministry, the leadership of the institution, the region, the head of the STATE-OWNED ENTERPRISES as well as Director of the prospective Foreign lenders.
(3) the Minister delivered a list of Activities to the Minister of finance.
The fourth part changes to article 10 (1) RPPLN and DRPLN-JM may be updated and refined in accordance with the needs and/or the development of the national economy.
(2) changes to RPPLN and DRPLN-JM, as referred to in paragraph (1), carried out under the directive of the Minister.
(3) the provisions on the preparation of RPPLN and DRPLN-JM, as referred to in article 7 to article 9, apply mutatis mutandis against drafting changes to RPPLN and change DRPLN-JM.
CHAPTER IV GRANTS the first part of the document Planning Grants planning documents article 11 Grants planned consisting of the RPH and DRKH.

The second part of the drafting of article 12 (1) the preparation of RPH is done with based on RPJMN.
(2) the preparation of the DRKH is done based on the results of the assessment of the feasibility of the proposal submitted by ministries/agencies.
(3) preparation of RPH and DRKH coordinated by Deputy Funding involving the Deputy related field and/or other relevant agencies.
(4) The Deputy related fields accountable in the conduct of the assessment referred to in paragraph (2).
The third part Designation and submission of Article 13 (1) Deputy Funding delivered a draft of the RPH and DRKH to the Minister.
(2) the Minister establishes RPH and DRKH through a decision of the Minister.
Article 14 (1) the Minister conveys RPH to Minister on Ministry and the head of the institution.
(2) the Minister delivered the DRKH to the Minister of finance, Minister of the Ministry and the head of the agency that the proposed activities listed in DRKH, as well as the prospective giver a grant.
The third section changes to Article 15 (1) the RPH can be updated and refined in accordance with the needs and/or the development of the national economy.
(2) change RPH, as referred to in paragraph (1), carried out under the directive of the Minister.
(3) the provisions concerning the preparation of RPH, as stipulated in article 12 and to article 14, apply mutatis mutandis against drafting changes to RPH.
Chapter V MONITORING and PERFORMANCE EVALUATION of the IMPLEMENTATION of the ACTIVITIES of the first part of the implementation of article 16 (1) the Deputy Coordinating Funding monitoring and performance evaluation of the implementation of the activities financed from Foreign Loans and grants.
(2) monitoring and evaluation of the performance of the implementation activities, as referred to in subsection (1) is done through meetings, reporting of implementation activities, and/or field trips involving implementing agencies, related kedeputian, other related agencies, and Foreign lenders and/or grants.
The second part reporting and submission of article 17 (1) based on the results of the monitoring and evaluation of the performance of the implementation activities, as referred to in article 16, the Deputy of funding performance report drafting exercise of Loan/Grant of Foreign Affairs quarterly.
(2) Deputy Funding delivered a draft performance report referred to in subsection (1) to the Minister.
Article 18 (1) the Minister approves the loan Implementation performance report/Grants of Foreign Affairs quarterly.
(2) performance report implementation of Foreign Loans and/or Grant referred to in subsection (1) is submitted to the implementing agencies and other related institutions.
The third part of follow-up in case there are article 19 implementation of the activities of Foreign Loans and/or Grants are slow or do not fit the funding allocation, Deputy together with the Deputy related fields can do the analysis and drawing up a proposal for a recommendation of the Minister of Finance to the Minister about the steps the completion of implementation activities.

CHAPTER VI the PREPARATION of the PLANNING DOCUMENTS AS WELL AS MONITORING and PERFORMANCE EVALUATION of the IMPLEMENTATION of SPECIFIC ACTIVITIES article 20 preparation of the planning documents as well as monitoring and performance evaluation of the implementation of the activities that the special nature of the procurement activities, namely the main tool Indonesia national army weaponry systems and special material the police of the Republic of Indonesia regulated in the Ministerial Regulation.

CHAPTER VII miscellaneous PROVISIONS Article 21 Provisions regarding the process of the preparation of the planning documents as well as monitoring and performance evaluation of the implementation of the activities of Foreign Loans and grants are governed by guidelines established by the Secretary of the Ministry.

CHAPTER VIII PROVISIONS COVER section 22 at the time of the enactment of this Ministerial Regulation, regulation of the Minister of State for national development planning/national development Planning Agency Head No. 1 of 2007 on the mechanisms and procedures in the Ministry of national development planning/national development Planning Agency in the process of Preparation, monitoring and evaluation of the activities financed from the Loan and/or Grants abroad, revoked and declared inapplicable.

Article 23 this Ministerial Regulation comes into force on the date of promulgation. In order to make everyone aware of it, ordered the enactment of this Ministerial Regulation with its placement in the news of the Republic of Indonesia.
