ABOUT
EVALUATION AND SUPERVISING GUIDELINES
STATE BORDER MANAGEMENT AND BORDER REGION

WITH THE GRACE OF THE ALMIGHTY GOD

NATIONAL HEAD OF THE BORDER MANAGER,

Weigh: a.  that in order to realize the management of the boundaries of the country and the border region according to the major design and master plan of the border area management and border areas, it needs evaluation and supervising guidelines;
B.   that the provision of Article 14 of the Law No. 43 of 2008 on the Territory of State and Article 3 of the Presidential Regulation No. 12 of 2010 on the National Agency of the Border Management, mandates the National Agency of the Border Management to conduct the evaluation and the oversight of border areas of state and border areas;
c. that under consideration as referred to in the letter a and the letter b, need to establish the Rule of the National Body of the Border Manager on the Evaluation and Supervision Guidelines of the State and Border Regions;
Remembering: 1.   Law No. 43 of 2008 on State Territory (Indonesian Republic of Indonesia 2008 No. 177, Additional Gazette of the Republic of Indonesia Number 4925);
2. Presidential Regulation No. 5 of 2010 on the National Long-term Development Plan of 2010-2014;
3. Presidential Regulation No. 12 of 2010 on the National Agency of the Border Governing Body;
4. Regulation of the National Body of Border Management No. 1 of 2011 on the Great Design of the State and Border Regions of the Year 2011-2025 (State News of the Republic of Indonesia 2010 No. 44);
5. Regulation of the National Body of Border Management No. 2 of 2011 on the Master Plan of Governing The Boundaries Of The Country and Border Regions of 2011-2014 (State News of the Republic of Indonesia 2010 No. 45);

DECIDED:
SET: THE RULE OF THE NATIONAL GOVERNING BODY OF BORDERS ON THE EVALUATION GUIDELINES AND OVERSIGHT OF THE BORDER MANAGEMENT OF STATES AND BORDER AREAS.

BAB I
UMUM CONDITIONS
Section 1
In Regulation of this Agency referred to:
1. The next National Long Term Development Plan abbreviated RPJPN is a national development planning document for a period of 20 (twenty) years.
2. The next National Long-term Development Plan (RPJMN) is a national development planning document for a period of 5 (5) years.
3. Government Work Plan, which further abbreviated RKP is a national development planning document for a period of 1 (one) year.
4. The Strategic Plan of the Ministry/Institute of Non-Ministry Government, subsequently called Renstra K/L is a Ministry of Government planning document/Non-Ministry Government Institute for a period of 5 (five) years.
5. Large design management of the State and Border Regions which are subsequently called the Great Design is a document planning document boundary management of the country and the border region for a period of 20 (twenty) years by following the RPJPN.
6. The country border management master plan and the next border area called the Parent Plan is a state border management planning document and a border area for a period of 5 (five) years by following RPJMN.
7. The state boundary management action plan and the next border area called Action Plan is a document planning document boundary management of the country and the border region for a period of 1 (one) year by following the RKP.
8. The boundary of the State Territory is the boundary line which is the sovereign separator of a country that is based on international law.
9. The territory of the country is one of the country ' s elements which is one unity of the land region, the inland waters, the territorial waters and the territorial waters and the seabed and the ground under it, as well as the air space above, including all sources. The wealth contained in it.
The 10,Areas of the border are part of the territory of the country located on the inner side of the boundary of the region of Indinesia with other countries, in terms of the boundaries of the country on land, the border region is in sub-districts.

14.Monitoring is an activity undertaken to determine definitively the situation and conditions of the work that are being implemented in the management of the boundaries of the country and the border region.
The next 15.2 Border Management Agency (BNPP) is the State Border Management Agency and the Border Area, as amended by Law No. 43 of 2008 on the State Territory.
The next 16.Head of the Border Management Agency, which is then called the BNPP Head, is the head of the BNPP, which is based below and is responsible to the President.

BAB II
THE INTENT AND PURPOSE OF EVALUATION AND SUPERVISION
Section 2
Evaluation and supervision are intended to assess the execution of state and border boundary management activities and ensure the effectiveness, efficiency, progress, and continuity of border management of the country and border regions.

Section 3
The purpose of the evaluation and supervision execution is:
a.   The consistency between policy direction, program, activities, and budget with the process of execution and results achieved in the management of the boundaries of the borders of the country and the border region; and
B.   Acquired by materials as an input for the refinement of systems, policies, programs, and activities in the management of the borders of the country and the border region.

BAB III
THE EVALUATION AND SUPERVISION BASIS
Section 4
(1) Evaluation and supervision of the border management of state and border regions, based on:
a.   RPJPN;
B.   RPJMN;
C.   RKP;
D.   Large Design;
e.   Master Plan; and
f.   Plan of Tata Space in the border area.
(2) Evaluation and supervision of the border management of the country and border regions as referred to in paragraph (1) consider:
a.   the dynamics of the situation and the state border conditions;
B.   a growing strategic issue in the management of the border regions of the country and the border region; and
c. Public complaint.

BAB IV
EVALUATION AND SUPERVISING PRINCIPLES
Section 5
The evaluation and supervising principles of state border management and border areas include:
a.   Objective;
B.   Effective:
C.   Efficient;
D.   Measured;
e.   Continuous;
f.   may be compared; and
G.   It can be accounted for.

BAB V
EVALUATION AND SUPERVISING METHODS
Section 6
Evaluation and supervision of border management of state and border areas is carried out by method:
a.   monitoring;
B.   reporting; and
C.   Verify.

Section 7
Monitoring as referred to in Section 6 of the letter a, is conducted through direct observation and recording of the object, process, and subject of border management of the country and the border region.

Section 8
Reporting as referred to in Section 6 of the letter b, most underloading:
a.   the general overview of activities;
B.   Activities plan:
c. Target assigned;
D.   the results achieved;
e.   physical realization and budget;
f.   problems or constraints encountered; and
G.   Follow-up advice.

Section 9
Verify as referred to in Article 6 of the letter c, done by assessing and/or checking the correctness, completeness, and validity of the report.

Section 10
(1) Implementation of the evaluation and supervision method of the border management and border region as referred to in Section 6, Section 7, Section 8, and Section 9 may be adjusted to the purpose, needs, and object of evaluation and supervision in Section 6. Deputy in the BNPP environment.
(2) The adjustment of the evaluation method and supervision of the management of the boundaries of the country and the border region as referred to in paragraph (1) are defined by the Decree of the BNPP Head.

BAB VI
EVALUATION AND SUPERVISING EXECUTION TIME
Section 11
The time of the evaluation and supervision of the border management of the country and the border region includes:
a.   quarterly;
B.   semesmeter;
C.   yearly;
D.   the part of the time of the execution; and
e.   five annual.

BAB VII
EVALUATION AND SUPERVISING OBJECTS
Section 12
The evaluation and supervising object of state region boundary management and the border region include:
a.   country border management;
B.   the management of the potential border region; and
c. Border-region infrastructure management.

Section 13
Evaluation and supervision of the country ' s territorial limits management as referred to in Article 12 of the letter a, conducted against:
a.   the completion of the assignment and the assertion of the state border;
B.   increased defense, security, and enforcement efforts; and
c. reinforcement of institutional capacity.

Section 14
Evaluation and supervision of the potential management of border areas and the management of the border region infrastructure as referred to in Article 12 of the letter b and the letter c, performed against:
a.   increased economic growth of the region;
B.   improving basic social services; and
c. reinforcement of institutional capacity.

Section 15
(1) The details of the evaluation and supervising object management of the country's boundaries and border areas as referred to in Article 12, Section 13, and Section 14 are adjusted to the annual performance target of each Deputy in the BNPP environment.
(2) The details of the evaluation object and the supervision of the border management of the country and the border region as referred to in paragraph (1) are defined by the Decision of the BNPP Head of the Year.

BAB VIII
EVALUATION AND SUPERVISION EXECUTORS
Section 16
(1) The deputies in the BNPP environment carry out the evaluation and supervision of the border management of the states and the border regions according to their respective duties and functions.
(2) The results of the evaluation and supervision of the border management of the country and the border region as referred to in paragraph (1) are reported to the Head of the BNPP through the Secretary of the BNPP.
(3) The implementation of the evaluation and supervision of the management of the state boundary and the national border area as referred to in paragraph (1) involves the ministry/institution of the non-related government.

Section 17
(1) In certain terms, the evaluation and supervision of the border management of the country and the border region can be implemented in a unified and cross-border work unit in the BNPP environment.
(2) The results of the evaluation and supervision of the border management of the country and the border region as referred to in paragraph (1) are reported to the Head of the BNPP through the Secretary of the BNPP.
(3) The implementation of the evaluation and supervision of the border management of the country and the border region as referred to in paragraph (1) involves the ministry/institution of the non-related government

Section 18
(1) Evaluation and supervision of the border management of state and border areas in the province is exercised by border management bodies or regional device working units that handle state border management affairs in the province.
(2) The results of the evaluation and supervision of the management of the boundaries of the country and the border region in the province as referred to in paragraph (1) are delivered to the governor.

Section 19
(1) Evaluation and supervision of the border management of state and border areas in districts/cities are carried out by border management bodies or regional device work units that handle state border management affairs in districts/cities.
(2) The results of the evaluation and supervision of the management of the boundaries of the country and the border region in the district/city as referred to in paragraph (1) are delivered to the regent/mayor.

Section 20
(1)   The BNPP, the provincial government, and the district/city government in carrying out the evaluation and supervision of the border management of the state and border areas as referred to in Article 16 and Section 17 may involve the public.
(2) The repentance of the people as referred to in verse (1) is set in its own right.

BAB IX
EVALUATION AND MONITORING RESULTS REPORTING
Section 21
(1) The Regent/mayor reports the results of the evaluation and supervision of the border management of the country and the border region as referred to in Article 19 to the Governor by busan to the Head of the BNPP.
(2) The report as referred to in paragraph (1) is delivered 1 (one) times in 6 (six) months or at any time if required.

Section 22
(1) The governor reports the results of the evaluation and supervision of the border management of state and border areas and the bupati/mayor report as referred to in Article 18 and Section 21 to the Head of the BNPP.
(2) The report as referred to in paragraph (1) is delivered 1 (one) times in 6 (six) months or at any time if required.

Section 23
(1) The Head of the BNPP reports the results of the evaluation and supervision of the border management of the country and the border area and the governor ' s report as referred to in Article 16, Article 17, and Article 22 to the President.
(2) The report as referred to in paragraph (1) is delivered 1 (one) times in 6 (six) months or at any time if required.

BAB X
EVALUATION AND SUPERVISION FUNDING
Section 24
(1) The funding of the evaluation and supervision of the border management of the country and the border area conducted by the BNPP as referred to in Article 16 and Section 17 is sourced from the State Budget and Shopping Budget and other sources lawful and non-binding.
2. (2) The implementation of the evaluation and supervision of the border management of state and border areas carried out by the border management body or the area of the regional device that handles state border management affairs in the province. as referred to in Article 18 sourced from the Provincial Regional Revenue and Shopping Budget and other authorized and non-binding sources.
(3) Financing the evaluation and supervision of the border management of state and border areas carried out by border management bodies or regional device working units that handle state border management affairs in the country. The district/city as referred to in Article 19 is sourced from the Revenue and Shopping District Area/City Budget and other legal and non-binding sources.

BAB XI
CLOSING PROVISIONS
Section 25
The border management of the National Board of Governing Bodies started to take effect on the date of the promulctest.
In order for everyone to know, the Governing Law of the Head of the Border Governing the Border with its placement in the State News of the Republic of Indonesia.
