THE PROVINCIAL AND KABUPATEN/CITY GENERAL ALLOCATION FUNDS
YEAR BUDGET 2014

WITH THE GRACE OF THE ALMIGHTY GOD

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weighing: that to implement the provisions of Article 35 of the Law Number 33 Year 2004 on the Financial Balance between the Central Government and the Regional Government and Article 48 of Government Regulation Number 55 of 2005 on the Balance Fund, it is necessary establish the President ' s Regulation on the General Alocation Fund of the Province and County/City of Budget Year 2014;
Remembering: 1.   Article 4 of the paragraph (1) of the Basic Law of the Republic of Indonesia in 1945;
2. Law No. 33 Year 2004 on the Financial Balance between the Central Government and the Local Government (State Gazette Indonesia Year 2004 Number 126, Additional Gazette Republic of Indonesia Number 4438);
3. Law No. 23 Year 2013 on Budget and State Shopping of the Budget Year 2014 (State Sheet of the Republic of Indonesia Year 2013 Number 182, Additional Gazette of the Republic of Indonesia Number 5462);
4. Government Regulation Number 55 of 2005 on the Balancing Fund (State Sheet of Indonesia Year 2005 Number 137, Additional Gazette of the Republic of Indonesia Number 4575);

DECIDED:
SET: THE PRESIDENT ' S REGULATION ON THE GENERAL ALLOCATION FUNDS OF THE PROVINCIAL AREA AND THE KABUPATEN/CITY OF THE 2014 BUDGET YEAR.

Section 1
(1) The General Alocation Fund in this Presidential Regulation is the General Alocation Fund as defined in the 2013 Law Number 23 Act on Budget and State Shopping of the Year of Budget 2014.
(2) The General Alocation Fund consists of:
a.   General allocation funds for provincial regions; and
B.   The General Alallocation Fund for the county/city area.
(3) The overall amount of the 2014 General Alocation Fund was set at 26% (twenty-six percent) of the Internal Revenue Neto set in the State Budget and Shopping Budget of the Year of the 2014 Budget.
(4) The Proportion Of General Allocation Funds for provincial and county/municipal areas is set as follows:
a.   for provincial regions is set at 10% (ten percent) of the overall number of General Alocations Funds as referred to in paragraph (3);
B.   for the county/city area is set at 90% (ninety percent) of the overall number of General Alocations Funds as referred to in paragraph (3).

Section 2
(1) The calculation of the General Allocation Fund for each provincial and district/city area is performed using the General Alocation Fund formula as set in Law Number 33 of the Year 2004 on Financial Balance between Government Central and Local Government.
(2) The General Alocation Fund of a provincial and county/city area is allocated based on a formula that consists of a fiscal gap and basic allocation.
(3) The fiscal Gap as referred to in paragraph (2) represents the fiscal requirement minus the fiscal capacity.
(4) The basic Alocation as referred to in paragraph (2) is calculated based on the number of Regional Civil Servants ' salaries proportionally.

Section 3
(1) The fiscal needs of the region as referred to in Section 2 of the paragraph (3) are calculated based on multiplicity between the total area shopping average by the summation of each variable weighted multiplier with the index of the population, the broad index region, the construction maturity index, the human development index, and the gross regional domestic product index per capita.
(2) The fiscal capacity of the area as referred to in Article 2 of the paragraph (3) is the summation of the Regional Original Revenue and Funds For Results.

Section 4
(1) The General Alocation Fund on the basis of the fiscal loophole is calculated based on the weight of the fiscal loophole each region of the province and district/city with the number of General Alocation Funds throughout the provincial area or the General Alocation Fund of the entire district/city.
(2) The General Alocation Fund on the basis of the base allocation is calculated based on the number of Regional Civil Servants salaries proportionally including the increase in principal pay, the awarding of the 13th month (thirteenth), and the salary for the Regional Civil Servant Candidate.

Section 5
(1) The area that has a fiscal loophole value is greater than 0 (zero), receiving the General Alocation Fund of the base allocation plus the fiscal loophole.
(2) The area that has a fiscal gap value is equal to 0 (zero), receiving the General Alocation Fund of the size of the base allocation.
(3) The area that has a negative fiscal gap value and that negative value is smaller than the base allocation, receiving the General Alocation Fund the size of the base allocation after being reckoned with the value of the fiscal gap.
(4) The area that has a negative fiscal gap value and such negative value is equal or greater than the base allocation, does not receive the General Alocation Fund.

Section 6
The calculation of the General Allocation Fund for provincial and district/city areas which includes the new autonomous region is done by dividing it proportionally with the parent area, using the data of the population, area area, and shopping of employees accordingly. with data availability.

Section 7
(1) The allocation of the General allocation funds of the 2014 Budget Year is set at Rp341,219.325.651.000.00 (three hundred and forty-one trillion two hundred and ninety-five million and twenty-five million six hundred and fifty-one thousand rupiah).
(2) The details of the allocation for provincial and county/municipal areas are as set forth in the Attachment which is an inseparable part of this Presidential Regulation.
(3) The General Alocations of the Year of Budget 2014 was part of the area revenue that was budgeted in the Budget and Regional Shopping Year of the Budget Year 2014 and/or the Regional Revenue and Shopping Budget Year of the 2014 Budget Year.
(4) The General Alocation Fund of the Year of Budget 2014 is provided for the area through the issuer of the 2014 Budget Year Budget Filings List.

Section 8
The provisions of the implementation of the presentation of the General Alocation Fund to each area are governed by the Regulation of the Minister of Finance.

Section 9
The examination and/or internal oversight of the conduct of the activities and financial management of the General Alocation Fund in provincial and county/municipal areas are conducted as per the laws.

Section 10
The President ' s regulation came into force on January 1, 2014.
