LEGISLATION REPUBLIC OF INDONESIA NUMBER 29 YEAR 2014

ON THE SEARCH AND HELP

WITH THE GRACE OF THE GOD ALMIGHTY THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

REPRESENTATIVES OF THE PEOPLE OF THE REPUBLIC OF INDONESIA and

PRESIDENT OF THE REPUBLIC OF INDONESIA

DECIDED:

SET: A LAW OF SEARCH AND ASSISTANCE.

CHAPTER I OF THE GENERAL PROVISION

Article 1

In this Act referred to:

1. Search and rescue are all efforts and activities to search, rescue, rescue, and evacuate humans who face an emergency and/or danger in an accident, disaster, or human endangering condition.

2. The implementation of the Search and Help Operation is a series of Search and Help activities including Search and Search and Search Operations.

3. Search and rescue are a series of activities undertaken to monitor, monitor, anticipate, and coordinate the Search and Help activities.

10. Human endangering conditions are events that befall, harm, and/or threaten the safety of men, in addition to accidents and disasters.

11. Flight is a unit of system consisting of the utilization of airspace, aircraft, airport, air transport, flight navigation, safety and security, living environment, and support facilities and other public facilities.

12. Voyages were a unit of systems consisting of transportation in the waters, divinity, safety and security, as well as the protection of the maritime environment.

13. An airship is any engine or device that can fly in the atmosphere due to the lift force of the air reaction, but not because of the air reaction to the surface of the Earth used for the Flight.

18. Each person is a person and/or body, whether legal or legal entity.

Article 2

BAB II ASAS AND PURPOSE

Section 3

Article 4

The Search and Help Help aims:

CHAPTER III OF SEARCH AND HELP

Section 5

(1) The State is responsible for the Search and Rescue organization.

(2) The search and assistance as referred to in paragraph (1) is performed by the Government.

Section 6

The Search and Help's is included:

a. Search and Help parent plan;

b. Potential for Search and Help;

c. The implementation of the Search and Help Operations;

d. human resources;

e. Institutional;

f. means and infrastructure;

g. information and communication systems;

h. funding;

i. international cooperation;

j. role as well as the community; and

k. Criminal provisions.

Article 7

(1) The Search and Help is performed against:

a. Accident;

b. Disaster; dan/or

c. Human endangering conditions.

(2) The implementation of the search and assistance as referred to in paragraph (1) is performed in accordance with the provisions of the Laws of the Law

CHAPTER IV POTENTIAL SEARCH AND HELP

Section 8

(1) The government is responsible for the coaching of Search Potency and Help.

(2) The coaching potential for the Search and Help as referred to in paragraph (1) is exercised by the Search and Help National Agency.

(1) The coaching potential of the Search and Help as referred to in Section 8 of the paragraph (2) includes:

a. settings;

b. controls; and

c. supervision.

(2) The settings as referred to the paragraph (1) letter a are done with:

a. create the norms, standards, procedures, and the criteria for the Search and Help; and

b. Create a policy in Search and Help.

(3) Controlling as referred to in paragraph (1) letter b is performed with:

a. provide direction and guidance in the execution of established norms, standards, procedures, criteria, and policies; and

b. provide guidance and counseling about the rights and obligations to the community in the Search and Help hosting.

(4) The supervision as referred to in paragraph (1) of the letter c is performed with:

a. monitoring and assessment of the conduct of the policy and the implementation of the Search and Help; and

b. The refinement of the established policy.

(5) Further provisions on the coaching of Search Potency and Help are set up in Government Regulation.

CHAPTER V PLAN MASTER PLAN SEARCH AND HELP

Section 10

(1) The Search and Help is executed based on Search and Help planning in a single system entity Effective, efficient, and reliable.

(2) Search and assistance planning as referred to in paragraph (1) is compiled in the Search and Help building plan.

(3) The Search and Help development plan is referred to on paragraph (2) must pay attention to:

a. a national development plan;

b. section development plan;

c. geographical, geologic, hydrological, and demographic conditions; and

d. the development of science and technology.

Article 11

(1) The Search and Help Development Plan is an integral part of the national development planning.

(2) The Search and Help Development Plan as intended in paragraph (1) compiled by the Government by engaging the community.

(3) The search and rescue development plan is set in a long-term development plan, medium-term development plan, and plan Annual development in accordance with the provisions of the laws.

Section 12

(1) The Search and Assistance Development Plan is compiled in the form of the National Search and Search master plan.

(2) National Search and Search master plan as contemplated in paragraph (1) set with the Presidential Regulation.

Article 13

(1) The national Search and Search master plan is compiled for a term of 20 (twenty) years.

(2) The National Search and Search master plan as referred to in verse (1) may be reviewed 1 (one) times in 5 (5) years.

CHAPTER VI HOSTING SEARCH AND HELP OPERATIONS

Section Parts General

Section 14

The Search and Assistance Operation is performed against:

a. Boat accident and airship;

b. Accident with special handling;

c. Disaster at the emergency response stage; and/or

d. Human endangering conditions.

section 15

The hosting of the Search and Help Operations as referred to in Article 14 is done through:

a. Search and Help Alert;

b. Search and Help operations; and

c. Quest for Search and Help.

section 16

The implementation of the Search and Assistance operation as referred to in Section 14 is the task and responsibility of the Agency National Search and Help.

section 17

The hosting of the Search and Assistance Operation as referred to in Article 14 of the letter is done in accordance with the provisions of the laws.

Article 18

(1) In the event of an accident as referred to in Article 14 of the letter b that does not require special handling, the implementation of the Search Operations and the Help is performed by the compulsory and/or community apparatus.

(2) The crash that requires special handling as referred to in Section 14 of the letter b is an accident that requires:

c. Certain work procedures.

Article 19

Article 20

The Second Part of Search and Help

Section 21

(1) Search and assistance is referred to in the Section 15 of the letter a is executed for 24 (twenty-four) hours perpetually in accordance with the division of time.

(2) The Search for Search and Help consists of regular standby and special standby.

(3) Search and Search Rescue services are carried out by the search and rescue team. Standby.

(5) The Search and Assistance Supervision as referred to in paragraph (4) must have a competency certificate for the Search and Help mission coordinator.

Section 22

(1) Search and/or Help as referred to in Article 15 of the letter a is done through the early stages of consciousness and oppressor.

Article 23

The Third Part Search and Help Operations

paragraph 1 General

Section 25

(1) Search and rescue operations are in place throughout the Republic of the Republic of Indonesia.

(4) Further provisions of the Expertise and/or competency standards as referred to in paragraph (3) are governed in the Government Regulations.

Article 26

(1) The National Search and Help National Agency helps Operation Search and Help upon request:

a. Commander of the Indonesian National Armed Forces or designated official on the Military Air Aircraft and Military Aircraft Crash;

b. The head of the Indonesian National Police or a designated official in the Air Force and Police Airplane Crash;

c. government agencies that host government affairs in the field of torture at the space city; and/or

d. officials are authorized in other restricted areas.

(2) In the event of an accident in the area of airport authority or port authority, the National Agency for Search and Help can immediately provide assistance with coordinating with the airport authority or port authority.

(3) Further provisions on the manner and aid procedure of Operation Search and Help as referred to in paragraph (1) and paragraph (2) are governed in the Government Regulation.

Section 27

Search and help operations are made up of stages:

a. Search for Search and Help Operations; and

b. Search and rescue operation termination.

(1) The implementation of the Search and Assistance operation as referred to in Section 27 of the letter a In the event of an accident, disaster, and/or Human Danger.

(2) The implementation of the Search and Help operation as referred to in paragraph (1) is performed in the form:

a. implementation of the search with help;

b. Search for non-help.

(3) The implementation of the Search and Rescue operation is based on the preparation of an effective and efficient plan.

(4) The drafting of the plan as referred to in paragraph (3) includes:

a. identification of location situations;

b. Estimated Event, Disaster, and/or Human Harm/or Conditions for Human Risk, Victim's movement after occurrence, position coordinates position, search location, officer and search equipment and help to be deployed, and form Search and Help operations; and

c. Help and Evacuation activities.

(5) Further provisions on the Implementation of the Search and Help Operations as referred to in paragraph (1) are governed in the Government Regulation.

Article 29

(1) National Agency of Search and Relief coordinates and be responsible for the implementation of the Search and Help Operations.

(2) The implementation of the Search and Assistance Operation is performed by a ad hoc (s) organization, consisting of: a. Search and Help coordinator;

b. Search and Help mission coordinator;

c. Field coordinator; and/or

d. Search and rescue units.

(3) At the time of the emergency response stage as referred to in Section 14 of the c, the Search and Rescue Mission Coordinator is operationally responsible to the National Search and Help National Agency and Administratively to the Search and Relief Coordinator and coordinate with the body that organizes government affairs in the field of disaster relief.

(4) In the event of a Disaster, the establishment of an organization in the implementation of Search and Help operations are conducted based on level determination disaster in accordance with the provisions of the laws.

Article 30

(1) The Search and Help Coordinator as referred to in Section 29 of the paragraph (2) the letter of the National Search and Help Center is said.

Section 31

(1) The Coordinator of the Search and Help mission as referred to in Article 29 of the paragraph (2) of the letter b is held by the head of the office Search and Help.

(2) In certain circumstances, the Head of the National Agency Search And Help can appoint a search and rescue mission coordinator other than the head of the Search and Help office based on consideration:

a. security conditions;

d. Capabilities as a Search and Search mission coordinator.

Section 32

The field coordinator as referred to in Article 29 of the paragraph (2) of the letter c is the official or the staff assigned by the Search mission coordinator and Help to coordinate and control the implementation of the Search and Help Operations in a specific search area.

Section 33

The Search and Help Unit as referred to in Section 29 of the paragraph (2) the d letter consists of Up to the end of the month for the following: Perform Search and Help.

b. there is a request from a company or an owner of an Air Aircraft or a Ship; and/or

c. there is a new development based on the evaluation of the Search and Search mission coordinator for the implementation of the Search and Rescue operation.

(4) The reopening charge of the Seeking Operation and the Help as referred to in paragraph (3) the letter a and the letter c is borne by the National Search and Help Agency.

(5) The cost of extension of the term or opening Seek Assistance and Assistance operations as specified in paragraph (3) The letter b is borne by the requesting party.

Article 35

(1) In the implementation of the Search and Relief Operations, the National Search and Rescue Agency can:

a. establish an event in an accident, disaster, and/or Harming Human Condition into a restricted area to enter; and/or

b. Make a reduction or destruction of some or all over an object in accordance with the provisions of the laws.

(2) The deduction or destruction as referred to in paragraph (1) the letter b may only be performed with the purpose of helping, saving, and/or evacuating the Victims.

Section 36

Section 37

Section 38

(1) Any Person who has Search and Help Services is required to meet and assist in the implementation of the Search Operations and Help at the request of the National Search and Help Agency.

(2) The termination of the implementation of the Search Operations and Help as Referred to in paragraph (1) is performed by the Search and Help coordinator at the suggestion of the search and rescue mission coordinator.

BAB VII THE HUMAN RESOURCES

Section 42

(1) The government is responsible for the provision and development of human resources in the field of Search and Help.

Section 43

(2) Education and training as referred to in paragraph (1) is exercised by the National Search and Help Agency includes:

a. the formation and improvement of the quality and quantity of the human resources for the Search and Assistance capability;

b. curriculum and syllabus as well as educational and training methods in accordance with established standards; and

c. Update and improved tool technology and infrastructure learning teaching at educational institutions and training in the Search field and Help.

Article 44

Section 46

BAB VIII INSTITUTIONAL

Article 47

(1) The government forms the Agency National Search and Help to organize government affairs in the field Search and Help.

(2) The National Search and Help Agency as referred to in paragraph (1) is a non-ministerial government institution.

(3) The National Agency for Search and Help as referred to in paragraph (2) are below as well as responsible to the President.

Article 48

(1) The National Agency for Search and Relief as referred to in Article 47 is on duty:

a. assemble and establish the norms, standards, procedures, criteria, and permissions and procedures in the course of the Search and Help;

b. provide guidelines and briefings in the Search and Help holding;

(3) In carrying out the duties as referred to in paragraph (1), the National Search and Rescue Agency has the authority to deploy the necessary personnel and equipment of the Indonesian National Armed Forces and the State Police. Article 49

CHAPTER IX MEANS AND PRASARANA

Article 51

Article 53 (1) The use and provision of the Search and Help infrastructure

may be performed through cooperation with the Government, legal entity, or other institution in accordance with the provisions of the laws.

(2) The use and assistance of the Search and Help infrastructure as referred to in paragraph (1) must be prioritised to support the hosting of Search and Help Operations.

Article 54 (1) The government provides ease of access to the means that

with the provisions of the laws in the field of pabeeness and taxation; and

(4) The Search and Assistance Information System as referred to in paragraph (2) must be most connected with:

a. Airport authority;

b. airport organizer unit;

c. Dealer;

d. The organizers of the train;

e. Traffic information center and road transit;

f. disaster relief organizer;

g. meteorological, climatological, and geophysical organizers;

h. the organizer of volcanology and geological disaster mitigation;

i. Hospital organizers;

j. Geospatial information organizer;

k. the organizer of the kenavigasian; and

l. the organizer of the torture information.

Article 58

Article 61

Section 62

(1) The National Agency for Search and Help provides services through an emergency telephone number easily accessible to the public.

Article 63

(1) In hosting a communication system:

Section 64

Section 65

Personnel navigation service personnel and shipping authorities provide correct and accurate information to the National Agency for Search and Help to assist with Operation Search and Help against Aircraft Crash Air or Ship.

Article 66

Section 67

The airport and port officer in accordance with his authority is required to ensure the completion of the hazard signal transmitter device on any Air Aircraft or Ship to operate as a condition for operation laik.

Section 68

The airport and port officer who does not ensure the completeness of the distress signal transmitter on any Air Aircraft or Ship as referred to in Article 67 are subject to sanction pursuant to the provisions of the laws.

Article 69

The National Agency for Search and Aid operates early detection equipment that can capture the distress signal emitted by the distress signal transmitter tool of the Air Aircraft, Ship, and/or persons Individual.

Article 70

CHAPTER XI FUNDING

Article 73

(1) The government and local governments are responsible for allocating the Search and Help holding fund.

(2) The Funds for the Search and Help can be sourced from:

a. country ' s income and shopping budget;

b. regional income and shopping budget; and/or

c. other legal and non-binding sources of the funds.

(3) Other sources of authorized and non-binding funds as referred to in paragraph (1) c are managed in accordance with regulatory provisions. It's

BAB XII INTERNATIONAL COOPERATION

Article 74

(1) To Host Search and Help, the National Search and Rescue Agency can perform international cooperation with:

a. other state governments;

b. agencies or international organizations in the field of Search and Help; and/or

c. citizens or non-governmental organizations from any other country.

(2) The cooperation as referred to in paragraph (1) may be:

a. exchange information in Search and Help fields;

b. Search and Help communication;

c. help of means and officers in the implementation of the Search and Help Operations;

d. practice together;

e. education and human resources training;

f. provisioning and development of the Search and Search infrastructure and Help; and/or

g. other fields mutually agreed upon.

(3) International cooperation as referred to in paragraph (1) is implemented in accordance with the provisions of the invitational regulations in the field of foreign relations and international agreements.

Article 75

In the event of an accident, a disaster, and/or the Condition of a Human Occurring in a region of another country, the National Body of Search and Help can perform the implementation of the Search and Help Operations for the consent of the country. concerned.

Article 76

The Search and Help Officer is going carrying out Search and Help Operations to other countries must be granted permission from the country in question.

Article 77

(1) The government provides ease of access and service process to Search Officers and Help from other countries in Search and Help Operations.

(2) The ease of access as referred to the paragraph (1) includes:

a. immigration;

d. security agreement;

e. Diplomatic approval;

f. flying approval; and/or

g. (3) Ease of access as referred to in paragraph (1) included in the use of equipment brought by officers from abroad at the crash site, Disaster, and/or Condition of the Human.

(4) The granting of the ease of access as referred to in paragraph (2) is implemented in accordance with the provisions of the invitational regulations.

Article 78

(1) The Search and Help Officers from abroad must be based on assignment and recommendation of the government of the country of origin, international institutions, or non-governmental foreign institutions

(2) Search and assistance officers as referred to in paragraph (1), upon entering the territory of the Republic of Indonesia, must report to the agencies whose scope of duty includes the fields immigration for the process and service of the visa, entry permit, limited residence permit, and exit permit executed in accordance with the provisions of the laws.

(3) Visa, entry clearance, limited residence permit, and exit permit as referred to in paragraph (2) are provided after receiving a recommendation from the National Board of Search and Help.

Section 79

For the Search Officer and Overseas aid holders and diplomatic passports or service passports issued by the United Nations, after entering into the State of the Republic of Indonesia, must report to the United Nations. to the ministry that organizes government affairs in the field of foreign affairs.

BAB XIII ROLE AND SOCIETY

Article 80 (1) In order to improve the Search and

Assistance implementation, the public may play a role in the Search and Help organization.

Disaster, and/or Harm To Man; b. Provide input to the Search National Agency and

Help in the improvement of the rules, guidelines, and technical standards in the Search and Help field;

c. Coaching, hosting, and supervising the Search and Assistance activities;

d. Assistance in Search and Assistance Operations; and/or

e. granting of access to officers in the conduct of Search and Help Operations.

(3) In case of the assistance of the Implementation of the Search and Assistance operation, the public must follow the system and procedure of the Implementation of the Search Operations and Help has been established by the National Search and Help Agency.

Section 81 The role as well as the society as referred to in Article 80 may be conducted individually, groups, professional organizations, enterprise entities, and/or community organizations.

BAB XIV CRIMINAL PROVISIONS

BAB XV provisions TRANSITION
