Weighing: that in connection with the change of provisions regarding the retirement of the former State Official, then there is a need to be re-established/principal pension adjustment for the former State Official who was retired before the 1st January 1981
Remembering: 1. Section 5 of the paragraph (2) of the Basic Law of 1945,
2. 1969 Law Number 11 of the Workforce Pension and Retirement Widows/Duda Employees (1969 State Gazette Number 42, Additional Gazette Number 2906);
3. Law Number 12 Year 1980 on Financial Rights/Administrative Rights and Members of the Supreme/High Institution of State as well as the Former Chairman of the Supreme/High Institution of State and Former Member of the State High Institution (State Sheet of 1980 Number) 71, Additional State Sheet Number 3182);
4. Government Regulation No. 10 Year 1977 on Changes to Government Regulation No. 17 Year 1967 on the Financial Position of State Minister of the Republic of Indonesia (State Gazette 1977 Number 14);
5. Government Regulation Number 9 of 1980 on Financial Rights/Administrative Region Head of Regional and Former Regional Chief/Former Deputy Regional Head as well as Widows/Dudanya (State Gazette 1980 number 16, Additional Gazette Number of State 3160),
6. Government Regulation No. 44 Year 1980 on Changes to Government Regulation No. 15 Year 1974 on Gaji/Gaji Honorary Chairman, Vice Chairman, and Member of the Supreme/High Institution of State (state Gazette 1980 Number 72);
7. Government Regulation No. 48 of 1980 on Changes to Government Regulation Number 9 of 1980 on Financial Rights/Administrative Region Head of Regions/Deputy Regional Chief and Former Head of Regional/Deputy Regional Chief as well as Widows/Dudanya (Sheets Country of 1980 Number 76);
8. Government Regulation No. 50 Year 1980 on Financial/Administrative Rights Minister of State and the Former Minister of State as well as Widows/Dudanya (State Sheet of 1980 Number 78, Additional Gazette Number 3184);
DECIDED:
Establish: Government regulations on the reenacation of the principal pension of former state officials.
Section 1
(1) Counted starting April 1, 1981
a. The principal pension of the former leadership of the Supreme Court of State and former Member of the State High Institution who was retired before January 1, 1981 is re-established under Law No. 12 of 1980 on the Right of the Union. Administrative Officer and Member of the Supreme/High Institution of State and Former Chairman of the Supreme/High Institution of State and Former Member of the State High Institution (State Sheet of 1980 Number 71, Additional Gazette number 3182) jo. Government Regulation No. 44 of 1980 on Changes to Government Regulation 1974 Number 15 on Gaji/Gaji Honours/Honorary Money Chairman, Vice Chairman and Member of the Supreme/High Institution of State (state Gazette 1980 Number 72);
B. The principal pension of the former Minister of State, which was retired before 1 January 198, was re-established under Government Regulation No. 10 of 1977 (State Sheet of 1977 No. 14) jo. Government Regulation 1980 Number 50 on Financial Rights/Administrative Rights Minister of State and the Former Minister of State as well as Widows/Dudanya (State Gazette 1980 Number 78, Additional Gazette Number 3184);
C. The principal pension of the Former Regional Head and Former Vice-Head of the Regions retired before 1 January 1981, re-established under Government Regulation Number 9 of 1980 on Financial Rights/Administrative Region Head of State/Vice Chief Area and Former Head of Regional/Former Deputy Regional Head as well as Widows/Dudanya (State Sheet of 1980 Number 16, Additional Gazette State Number 3160) jo. Government Regulation No. 48 Year 1980 on Changes to Government Regulation 1980 Number 9 on Financial Rights/Administrative Region Head of Regions/Vice Chief of Regions and Former Head of Regions/Former Deputy Head of Regions as well as Widows/Dudanya (Sheets 1980 State Number 76).
(2) The provisions as referred to in paragraph (1) of the letter a, apply to the former Chairman and former Member of the Working Body of the Central Indonesian National Committee.
(3) Retirement of the principal janda/duda/son of the former State Official as referred to in paragraph (1) as well as the principal pension of janda/duda/child former Chairman and former Member of the Working Body of the Central Indonesian National Committee as referred to in paragraph (2) is set Back/adjusted based on the terms as referred to in paragraph (1).
Section 2
The reassignment of their principal retirement/adjustment as referred to in Article 1, specified by the decision of the Head of the Administration Board
State employees.
Section 3
Above the principal pension, to former State Officials as well as his/her/her children are given food allowances and other allowances applicable to retired civil servants.
Section 4
Things that are n' t quite set up in this Government Regulation are set further by the Presidential Decree.
Section 5
The technical provisions of the implementation of this Government Regulation are established by the Minister of Finance and the Head of the State Administration Board both jointly and individually according to the field of their respective duties.
Section 6
This Government Regulation came into force on April 1, 1981.
