ABOUT
THE INCLUSION OF THE REPUBLIC OF INDONESIA ' S CAPITAL FOR THE ESTABLISHMENT
THE PERSEROAN COMPANY (PERSERO) IN THE AREA OF THE RAILWAY INDUSTRY
PRESIDENT OF THE REPUBLIC OF INDONESIA,
Weigh: a. That in order to support the development of the National Economy especially in the fields of railways by conducting advanced technology activities in the manufacture of carriages, trains, locomotion, and supporting components, is seen to establish a company. (PERSERO) in the area of the Railway Industry in question
Article 2 verse (3) Law No. 9 of 1969 which seeks in the field of Railways Industry;
B. that the Yasa Hall in Madiun has the potential to be upgraded from a maintenance facility into a manufacturing facility and therefore needs to separate the Yasa Hall of the Railway Company to be a Perseroan Company (PERSERO);
c. that in accordance with the provisions of
Section 2 paragraph (1) Government Regulation Number 12 of 1969, the inclusion of the State capital in the framework of such Perseroan Companies (PERSERO) must be governed by the Regulation. Government;
Remembering: 1. Section 5 of the paragraph (2) Undang-U ndang Basic 1945;
2. The Code of Trade Law (Staatsblad of 1847 Number 23) as has been several times amended and supplementary, last with Law No. 4 of 1971 (State Sheet of 1971 Number 20, Additional Gazette number 2959);

Government Regulation Number 12 Year 1969 about the Company Perseroan (PERSERO) (State Gazette 1969 Number 21, Additional State Sheet Number 2894) juncto Regulation No. 24 Year 1972 concerning Changes to the provisions of Article 7 of the Government Regulation of 1969 Number 12 on the Company Perseroan (PERSERO) (State Sheet of 1972 Number 32, Additional Sheet Country Number 1987);
DECIDED:
Establish: GOVERNMENTAL REGULATION ON THE INCLUSION OF THE CAPITAL OF THE REPUBLIC OF INDONESIA FOR THE ESTABLISHMENT OF THE COMPANY OF PERSEROAN (PERSERO) IN THE AREA OF THE RAILWAY INDUSTRY.
BAB I
THE COUNTRY ' S CAPITAL INCLUSION
Section 1
The State of the Republic of Indonesia conducts its inclusion in the stock capital of the Perseroan Company (PERSERO) in the area of the Railway Industry which is next in the Regulation of the Government called PERSERO.
BAB II
INTENT AND PURPOSE
Section 2
The purpose and purpose of PERSERO as referred to in Article 1 is to manufacture and manufacture carriages, trains, lokomotips, and their supporting components.
BAB III
PERSERO CAPITAL
Section 3
(1) Modal PERSERO as referred to in Article 1 is the inclusion of the Republic of Indonesia namely the Railway Yasa Hall in Madiun which was originally within the Railway Company of the Railway, as a portion of the wealth of the State that was placed and For the time of its founding.
(2) The value of the Country ' s Wealth to be used as the inclusion of the PERSERO stock capital is set jointly by the Minister of Finance and the Minister of Transportation.
(3) Other provisions of PERSERO ' s application are set up in its Basic Budget, including the provisions regarding the base capital of PERSERO which are divided over the shares in accordance with the provisions of Article 1 of the Government Regulation No. 24 of 1971.
(4) The PerSERO Opening Neraca is set by the Minister of Finance. 3
BAB IV
EXECUTION, THE ESTABLISHMENT OF PERSERO
Section 4
The execution of the establishment of PERSERO as referred to in Article 1 is done according to the provisions of the Code of Trade Law (Staatsblad Year 1847 Number 23) as has been several times amended and added, lastly with the Act. Number 4 of 1971, with regard to the provisions set forth in Government Regulation No. 12 of the year 1969 juncto Regulation No. 24 Year 1972
Section 5
(1) The completion of the PERSERO is made available to the Minister of Finance in accordance with the provisions of Article 3 of the Government Regulation No. 12 of 1969;
(2) The Minister of Finance may hand over power as referred to in paragraph (1), with the accompanying substitution rights to the Minister of Transportation.
(3) To the Minister of Transportation is given the power to appoint a person to participate in the establishment of the PERSERO, in accordance with the provisions of Article 6 of the Government Regulation No. 12 of 1969.

CLOSING PROVISIONS
Section 6
Things that have not been adequately regulated in this Government Regulation are set to further its own.
Section 7
This Government Regulation shall come into effect on the date of the promulctest.
