PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh: a. That in order to improve the development of the national economy by increasing the production of the agricultural sector specialized in sugar production, and efforts to increase the management of the state plantation companies in the field of sugar production, are viewed as necessary. forming a Perseroan Company (PERSERO) that seeks to be in the field of sugar production
B. that the inclusion of the capital of the Republic of Indonesia for the establishment of the Company of Perseroan (PERSERO) in the letter a above, derived from the wealth of the State embedded in the Corporation of the Plantation XIV founded under the Ordinance of the Republic of Indonesia. The Government No. 14 of 1968, and the Jatitujuh Sugar Project, which were originally separated to become Company Companies under Government Regulation No. 17 of 1979, as well as part of PT's plantation area. XXX plantations located in the Subang area;
c. that in accordance with the provisions of Section 2 paragraph (1) Government Regulation Number 12 of 1969, the inclusion of the capital of the Republic of Indonesia in the framework of a Perseroan Company (PERSERO) is set with Government regulations.

DECIDED:

Establish: GOVERNMENT REGULATIONS ON THE INCLUSION OF THE CAPITAL OF THE REPUBLIC OF INDONESIA FOR THE ESTABLISHMENT OF THE COMPANY OF PERSEROAN (PERSERO) IN THE FIELD OF SUGAR PRODUCTION.

BAB I
THE COUNTRY ' S CAPITAL INCLUSION

Section 1
The State of the Republic of Indonesia conducts an inclusion in the capital of a Perseroan Company (PERSERO) in the field of sugar production.

BAB II
INTENT AND PURPOSE

Section 2
The purpose and purpose of the Perseroan Company (PERSERO) as referred to in Article 1, subsequently called PERSERO, is to advance and develop the sugar industry and increase the yield of sugar production in order to support economic development. national.

BAB III
PERSERO CAPITAL

Section 3
(1) Modal PERSERO is divided into shares in accordance with the provisions of Article 1 of the Government Regulation No. 24 Year 1972 which is the wealth of the countries separated.
(2) The PERSERO (s) which was placed and deployed at the time of its foundation was the inclusion of the State of Indonesia as a wealth of the State that was separated and derived from the value of the entire country's wealth embedded in the State Company. The XIV estates at the time of its dissolution and the value of the entire country's wealth were embedded in the Jatitujuh Sugar Project, as well as a partial value of PT. XXX plantations located in the Subang area;
(3) The value of such wealth value in paragraph (1) as will be used as the inclusion of the State in the capital of PERSERO is set forth by the Minister of Finance based on the results of a joint calculation by the Department of Finance and the Department of Agriculture.
(4) Other provisions of PERSERO ' s application are set up in its Dastic Budget.
(5) The PerSERO Opening Neraca is set by the Minister of Finance.

BAB IV
THE IMPLEMENTATION OF THE PERSERO ESTABLISHMENT

Section 4
The implementation of the establishment of PERSERO was conducted according to the provisions of the Code of Trade Law (Staatsblad Year 1847 Number 23) as amended and last amended by the Law No. 4 of 1971 with the Act of Law of the Law of Commerce. Regard to the provisions of provisions in Government Regulation No. 12 of the year 1969 jo. Government Regulation No. 24 of 1972.

Section 5
(1) The completion of the PERSERO is made available to the Minister of Finance in accordance with the provisions referred to in Article 3 of the Government Regulation No. 12 of 1969.
(2) The Minister of Finance may submit such power to the paragraph (1) with the accompanying substitution rights to the Minister of Agriculture provided that the Basic Budget Plan of PERSERO should be granted prior approval from the Minister of Finance.
(3) To the Minister of Agriculture is given the power to appoint a person to participate in the establishment of PERSERO, in accordance with the provisions of Article 6 of the Government Regulation No. 12 of 1969.

BAB V
Dissolution

Section 6
(1) The Agricultural State Company of XIV which was established with Government Regulation No. 14 of 1968 was declared disbanding at the time of the establishment of PERSERO with the provision that all rights and obligations as well as the wealth of the existing Company of the XIV Planes At the time of its dissolution, it turned to PERSERO.
(2) As a likwidatur in the implementation of the dissolution of the Corporation of the XIV Farm Company as referred to in paragraph (1) at a Committee on a Committee whose membership is made up of the representatives of the Department of Agriculture, the Treasury, The XIV State Company XIV, the Jatitujuh Sugar Project and other agencies deemed necessary.
(3) The implementation of the establishment, the details of the task, the working period, the financing and the other matters concerned with the execution of the work of the Likendation Committee on the paragraph (2) is further regulated by the Minister of Agriculture.
(4) The concern of such lividatur responsibility in verse (2) is carried out by the Minister of Agriculture based on the results of the Direk examination, the Lorat General of State Financial Oversight, the Treasury Department.

BAB VI
OTHER LAIN-CONDITIONS

Section 7
(1) Counted since the time of the establishment of PERSERO and the dissolution of the Planetary State Company XIV as referred to in Article 6 of the paragraph (1), then Government Regulation Number 14 of 1968 and all of its implementation regulations throughout the The XIV Plantation State Company was declared no longer valid.
(2) With the establishment of the inclusion of the State capital for the establishment of PERSERO under this Government Regulation, then Government Regulation Number 45 of 1973 on Diversion Of The State Corporation's Enterprise of the XIV Company into a Company Perseroan (PERSERO) and the Government Regulation No. 17 of 1979 on the Invasion of Modal-State of the Republic of Indonesia for the establishment of the Perseroan Company (PERSERO) in the field of Sugar Production was declared no longer applicable.

CLOSING PROVISIONS

Section 8
Things that have not been set up in this Government Regulation will be set further.

Section 9
The Regulation of this Government begins to apply on the date of the promulctest.
