No. 42 YEAR 1981
ABOUT
SOCIAL WELFARE SERVICES FOR POOR FACIR

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh: a. That poor facir problem is a matter of national issues that must be masterminating continuously and gradually;
B. that one of the efforts to overcome poor facir is to provide social welfare services for poor facir;
c. that because of these matters above and in the course of execution of Law Number 6 of the Year 1974 on the provisions of the Social Welfare (State Gazette of 1974 number: 53, Additional Gazette number 3039) need to set up Social welfare services for poor facir in Government Regulations;

Remembering: 1. Section 5 of the paragraph (2), Article 27 paragraph (2), and Article 34 of the Basic Law of 1945;
2. Act No. 6 of 1974 on the provisions of the Social Welfare (State Sheet of 1974 No. 53, Additional Gazette number 3039);

DECIDED:

Establish: Government regulations on the service of social welfare for poor facirs.

BAB I
UMUM PROVISIONS

Section 1
In this Government Regulation referred to by:
It is not a person who has a source of livelihood, and has no ability to meet the essential needs of humanity or a person who has a source of livelihood but is unable to fulfill. Essential needs are for humanity.
2. The Social Welfare Service for Poor Poor is any effort, program, and activities aimed at restoring, fostering, and developing social welfare for poor facir.
3. The Social Welfare Fund for Poor Poor is all funds referred to money and or goods derived from the public and other sources under applicable laws and are used for the benefit of the ministry. Social welfare for poor facir.
4. Social assistance is a temporary aid given to poor facir, with the intent that they can improve his life waj ar.
5. Social rehabilitation is a process of refetionalisation and development to enable poor facilings capable of carrying out its social functions reasonably in people's lives.
6. Minister is the Minister of Social Affairs.

BAB II
SOCIAL WELFARE SERVICES FOR POOR FACIR

Section 2
(1) Poor Poor ' s Fakir Miskin deserves social welfare services.
(2) The social welfare services for the poor facir as referred to in paragraph (1) include:
a. social assistance;
B. Social rehabilitation.

Section 3
(1) Social assistance as referred to in Article 2 of the paragraph (2) of the letter a given to the poor with the intent that they may seek to increase the level of social welfare.
(2) The number, taters, and implementation of the granting of social assistance as contemplated by paragraph (1) are further regulated by the Minister.

Section 4
(1) Social Rehabilitation as referred to in Article 2 of the paragraph (2) of the letter b is carried out against the poor with the intent that they be able to carry out and develop its social functions in people's lives.
(2) Rehabilitation as referred to in paragraph (1) includes selection, coaching, development, and advanced coaching efforts.

Section 5
(1) The selection effort is intended to be able to establish the type of coaching against the poor facir in rehabilitation.
(2) The selection effort as referred to in paragraph (1) includes activities of activities among others:
a. identification;
B. Interview.

Section 6
The coaching effort is intended to foster poor facir skills in order to play a role in improving its prosperity.

Section 7
The coaching effort as referred to in Article 6 includes activities among others:
a. swadaya awareness coaching;
B. mental coaching;
c. Physical coaching;
D. Skill coaching;
e. Public life awareness coaching.

Section 8
Poor facir who has finished undergoing coaching developed his ability to strive for himself in order to improve his social welfare tarf.

Section 9
In carrying out the development efforts as referred to in Article 8, the Minister may provide the assistance of the application.

Section 10
(1) Against the poor, which has been completed rehabilitated and has attempted itself in the midst of society followed by continued coaching.
(2) Advanced Coaching as referred to in paragraph (1) includes activities among others:
a. surveillance;
B. Guidance.
(3) The execution of a coaching, advanced as referred to in paragraph (1) and paragraph (2) of this section is further governed by the Minister.

BAB III
SOCIAL WELFARE SERVICES FOR POOR FACIR
BY SOCIETY

Section 11
(1) Social welfare services for poor facir by society are organized by social and individual organizations in accordance with applicable laws.
(2) Service as referred to in paragraph (1) includes social assistance efforts and social rehabilitation.
(3) The execution of the provisions as referred to in paragraph (1) and paragraph (2) of this section are governed by the Minister.

Section 12
(1) The social organization that organizes social welfare services for poor facir may be granted aid or subsidies.
(2) The type, number, event, and the terms of granting or subsidy assistance are governed by the Minister.

Section 13
Ministers or authorized officials at any time do a check on the implementation of social welfare services for the poor facir committed by the social organization.

Section 14
The Minister may take action against the social organization administrator and to the individual who organizes social welfare services for poor facir that deviates from the goal or does not meet the requirements in accordance with the rules. Applicable laws.

BAB IV
THE SOCIAL WELFARE FUND FOR POOR FACIR

Section 15
(1) For the sake of the implementation of social welfare for poor facir, the Minister is able to pursue the collection of social welfare funds for poor facir derived from society and other social welfare funds based on regulations Applicable laws.
(2) The gathering of social welfare funds for poor facirs that are on and out of society as referred to in paragraph (1) are governed by the Minister.
(3) The acceptance of social welfare funds for the poor facir derived from the public as referred to in paragraph (1) is notified in writing to the Minister of Finance.
(4) The event of use of funds as referred to in paragraph (1) and paragraph (2) is governed by the Minister.

BAB V
THE TRANSITION AND CLOSING PROVISIONS

Section 16
The things that have not been set up in this Government Regulation all along regarding the implementation will be further set up by the Minister.

Section 17
By the enactment of this Government Regulation, then all laws governing the social welfare services for the existing poor facir remain in effect, as long as it does not conflict with this Government Regulation.

Section 18
This Government Regulation shall come into effect on the date of the promulctest.
