ASSIGNMENT OF GENERIC COMPANY FORM (PERUM) DAHANA
BEING A PERSEROAN COMPANY (PERSERO)
PRESIDENT OF THE REPUBLIC OF INDONESIA,
.,, weighed: a. that in order to improve the efficiency and effectiveness of the effort, then the General Corporation (PERUM) Dahana which was established with Government Regulation No. 36 Year 1973 is assessed to meet the requirements to be transferred its form into the Perseroan Company. (SERBOING);
., b. that in respect of such, the diversion of the General Enterprise (PERUM) Dahana becomes a Perseroan Company (PERSEO), needs to be set with the Government Regulation;
.,, Given: 1. Section 5 of the paragraph (2) of the Basic Law of 1945;
., 2. The Code of Trade Law (Staatsblad Tahuni 1847 Number 23) as has been several times amended, last with Law No. 4 of 1971 (State Gazette of 1971 Number 20, Extra State Sheet Number 2959);
., 3. Law Number 9 of the Year 1969 on the Enaconing Of The Statutory Successor Government Number 1 Year 1969 on State Forms Of Effort (state Gazette 1969 Number 16, Additional Gazette number 2890 into Law (State Gazette 1969 Number 40, Additional Gazette Number 2904);
., 4. Government Regulation Number 12 of 1969 on the Company Perseroan (PERSERO) (1969 State Sheet Number 21, Additional Gazette State Number 2894) as amended by Government Regulation No. 24 of 1972 (State Sheet) 1972 Number 32, Auxiliary Leaf Country Number 2987);

Government Regulation No. 3 of 1983 on the Governance of Coaching And Supervision Of The Corporation (PERJAN), Public Company (PERUM) And The Perseroan Company (PERSERO) (State Sheet Of 1983 Number 3, Additional Sheet Country Number 3246) as has been amended with Government Regulation No. 28 of 1983 (State Sheet of 1983 Number 37);
DECIDED:
.,, SET: THE REGULATION OF THE GOVERNMENT OF THE REPUBLIC OF INDONESIA ON THE DIVERSION OF THE FORM OF A COMMON COMPANY (PERUM) DAHANA BEING THE COMPANY OF PERSEROAN (PERSERO).
BAB I
DIVERSION OF FORM AND DISSOLUTION
Section 1
.,, (1) The General Corporation (PERUM) Dahana which was established with Government Regulation No. 36 of 1973 was transferred its form into the Perseroan Company (PERSERO) as referred to in Law Number 9 of 1969.
.,, (2) With the passage of the General Company (PERUM) Dahana becoming a Perseroan Company (PERSERO) as referred to in paragraph (1), the General Company (PERUM) Dahana was declared disbanding at the time of the establishment of the Perseroan Company (PERSERO), with the provision that all rights and obligations, wealth and employees of the General Company (PERUM) Dahana were present at the time of its dissolution, turning to the Perseroan Company (PERSERO) in question.
BAB II
INTENT AND PURPOSE
Section 2
., (1) The intent and purpose of the Perseroan Company (PERSERO) as referred to in Section 1 is to host the efforts as a calicut:
., a., a. producing explosives;
B. marketing its production results;
., c. services in the field of research related to the explosives and which are similar to that;
., d. Other businesses that can support such efforts are referred to in letters a, letter b and letter c.
.,, (2) the endeavour as referred to in paragraph (1) is done by keeping an eye on the provisions of the applicable laws.
BAB III
PERSERO CAPITAL
Section 3
.,, (1) The Modal Company of Perseroan (PERSERO) that was placed and was invaded at the time its founding came from the wealth of the State embedded in the General Company (PERUM) Dahana.
., (2) The value of the Country ' s wealth as referred to in paragraph (1) is set forth by the Minister of Finance based on the results of a calculation with the Department of Finance and the Strategic Industry Governing Body.
., (3) other provisions regarding the Perseroan Company ' s (PERSERO) application are set up in its General Budget, including the provisions of PERSERO base capital divided over shares in accordance with the provisions of the Government Regulation Number 12 Year 1969 as amended by Government Regulation No. 24 of 1972.
.,, (4) The opening Neraca Company of Perseroan (PERSERO) is set by the Minister of Finance.
BAB IV
THE IMPLEMENTATION OF THE PERSERO ESTABLISHMENT
Section 4
The implementation of the establishment of the Company (PERSRO) as referred to in Article 1 is done according to the provisions of the Code of Trade Law (Staatsblad Year 1847 Number 23) as has been several times modified, lastly with Law No. 4 of 1971 with regard to the provisions set forth in Government Regulation No. 12 of 1969 as amended with the Government Regulation No. 24 of 1972.
Section 5
.,, (1) The completion of the establishment of the Perseroan Company (PERSERO) as referred to in Article 4 of which is felt to the Minister of Finance,
.,, (2) the Finance Minister may submit the power as referred to in paragraph (1) with the accompanying substitution right to the Minister of State for Research and Technology/Chairman of the Strategic Industry Manager, provided that the Basic Budget Design The Perseroan Company (PERSERO) must receive approval first from the Minister of Finance.
BAB V
CLOSING PROVISIONS
Section 6
Since the establishment of the Company Perseroan (PERSERO) and the creation of the Dahana General Corporation (PERUM), the Government Regulation No. 36 of 1973 was declared to be not valid.
Section 7
Further provisions are required for the implementation of this Government Regulation governed by the Minister of Finance and the Minister of State for Research and Technology/Chairman of the Strategic Industry Manager Agency, both together and individually in accordance with the the field of their respective duties.
Section 8
This Government Regulation shall come into effect on the date of the promulctest.
