PRESIDENT OF THE REPUBLIC OF INDONESIA,

DECIDED:

.,, establish: REGULATIONS OF THE GOVERNMENT OF THE REPUBLIC OF INDONESIA ON THE SOCIAL INSURANCE OF THE ARMED FORCES OF THE REPUBLIC OF INDONESIA.

BAB I
UMUM PROVISIONS

Section 1
In this Government Regulation referred to by:
1. The Minister is the Minister of Security Security.
., 2. Soldiers of the Armed Forces of the Republic of Indonesia (Indonesian: Soldiers of the ABRI) are Indonesian Army National Army soldiers (TNI-Army soldiers), soldiers of the Indonesian National Armed Forces (TNI), soldiers of the Indonesian National Armed Forces (TNI). The Air Force (Soldiers of the TNI-AU), and the Indonesian National Police Force (POLRI Soldiers).
., 3. Civil servants (civil servants) are civil servants who are employed in the environment of the Department of Defense Security (Dephankam) and the Armed Forces of the Republic of Indonesia (ABRI) later called civil servants of the ABRI Dephankam.
., 4. The Armed Forces of the Armed Forces of the Republic of indoneia (ASABRI), also known as ASABRI, is a social security for the ABRI and PNS Dephankam-ABRI soldiers who provide protection against the risk of loss or loss of income of the soldiers. BAB II
SOCIAL INSURANCE
THE ARMED FORCES OF THE REPUBLIC OF INDONESIA

Section 2
The Armed Insurance of the Armed Forces of the Republic of Indonesia (ASABRI) is composed of insurance santunan, death risk santunan, cash rate insurance and funeral expenses.

BAB III
KEPESERTAAN

Section 3
.,, (1) Each of the soldiers of ABRI and PNS Dephankam-ABRI is required to be an ASBRI participant.
.,, (2) In terms of PNS Dephankam-ABRI employed or assigned to instances outside the Dephankam-ABRI environment, its obligations and its social insurance will follow.

Section 4
.,, (1) While being a participant of ASABRI count starting the date of his appointment as an ABRI soldier or a candidate for PNS Dephankam-ABRI.
.,, (2) For those on the effective date of the Regulation of this Government already have a standing as a soldier of ABRI or the candidate PNS Dephankam-ABRI be as well as the beginning of the date as referred to in paragraph (1).

Section 5
The position of the ASABRI participant ends because:
a. fall, die or die;
B. terminated with respect to the pension rights/benefits are retired;
., c. no longer being a participant for other reasons under applicable law.

BAB IV
THE PARTICIPANT ' S OBLIGATION

Section 6
Participants are required correctly and correctly regarding all of their family members.

Section 7
.,, (1) The obligatory THT/P dues for each participant is set at 3 1/4% (three quarter percent) of the earnings each month.
., (2) The subject of mandatory dues and its fortuitions on the proposal of the Minister can be amended by the Presidential Decree.
.,, (3) The introduction of mandatory dues as referred to in paragraph (1) is carried out in terms of the month the participant receives earnings and ends at the end of the month when the concerned is stopped as a participant.

BAB V
THE PARTICIPANT ' S RIGHT

Section 8
The participant's right consists of:
a. insurance santunan;
B. the risk of death risk;
c. santunan the insurance cash value; and
D. funeral expenses.

Section 9
.,, (1) The insurance coverage is published to participants who stop with respect as ABRI soldiers or PNS Dephankam-ABRI by obtaining pension/benefits are retired.
.,, (2) The risk of death and the santunan of insurance cash is passed to the rightful heir of the fallen participant, dead or dead in duty in the actypic service.
.,, (3) The cash value of insurance is published to participants who are discharged without the pension rights/benefits are retired.
.,, (4) The funeral fees are accepted to the legitimate heirs of the participants who died in retirement/pension status are retired.

Section 10
The provisions of the requirements, the magnitude and the manner of the submission of insurance santunan, the risk of death, the cash rate of insurance, and funeral expenses are further regulated by the Minister.

BAB VI
THE ORGANIZER BODY

Section 11
.,, (1) To host ASABRI established a State-Owled Business Agency as referred to in Law Number 9 of the Year 1969.
.,, (2) The establishment of a State-owned enterprise entity as referred to in paragraph (1) is governed by the Government Regulation.

BAB VII
Warranty of the country


Section 12
., (1) In the case of a State-owned business entity as referred to in Article 11 of the paragraph (1) cannot fulfill its obligations to participants under this Government Regulation, then the State guarantees the fulfillment of the rights of the peras.
.,, (2) The implementation of the provisions as referred to in paragraph (1) is set further by the Minister of Finance.

BAB VIII
THE TRANSITION PROVISION

Section 13
At the time of this Government Regulation, all implementation regulations concerning or relating to the existing administration of ASABRI remain in effect as long as not in conflict with the provisions of this Government Regulation and yet replaced with new provisions issued under this Government Regulation.

BAB IX
CLOSING PROVISIONS

Section 14
The further provisions are necessary for the implementation of this Government Regulation, arranged by the Minister after consulting with the Finance Minister.

Section 15
With the enactment of this Government Regulation, then Government Regulation No. 44 of 1971 on the Social Insurance of the Armed Forces of the Republic of Indonesia, stated does not apply.

Section 16
This Government Regulation shall come into effect on the date of the promulctest.

UMUM

.,, Army of the Armed Forces of the Republic of Indoneisa as a country and the Indonesian nation is a devout and loyal State apparatus to Pancasila and the Basic Law of 1945, as well as the Oath of the Soldier and the Sapta Marga. As the congruency of this position, then against each of the ABRI Soldiers is prosecuted and required to continuously nurture his personality in such a way that it may serve as a soldier with full sense of responsibility. A task force in the field of Homeland Security as well as securing the course of national development.
., because of the role and role of the soldier, and the understanding of reciprocity between well-being with discipline and professional ability, it needs to be scouted and developed the welfare of the ABRI Warrior in a decent way.

.,, Santunan Insurance is a santunan given to ASABRI participants who are honorated with respect from servicemen, ABRI or PNS Dephankam ABRI with pension/pension rights are retired.
The Risk of Death is the santunan given to the participants of ASABRI who were discharged with respect from the soldiers of ABRI or PNS Dephankam ABRI due to the fall, dead or death of the world in active service.
Insurance Cash Value is a santunan given to the participants of ASABRI who are dishonorless/respectfully without the pension rights/allowances are either retired or to the participants of the ASABRI who are discharged with respect for the fall, killed or died in active service.
Funeral expenses are santunan given to the legitimate heirs of soldiers ABRI or PNS Dephankam ABRI who had been a participant of the ASABRI and died after the retirement/allowance was retired.
