Law of the Republic of INDONESIA number 11 in 1999 on the ESTABLISHMENT of the MUNICIPALITY of REGENCIES of TERNATE with the GRACE of GOD ALMIGHTY the PRESIDENT of the REPUBLIC of INDONESIA,.,, Considering: a. that is associated with the development and progress of the Provincial level I Areas of Maluku and North Maluku Regencies in General as well as the administrative town of Ternate in particular, and claims the aspirations of society, viewed needs to improve the Organization of the Government development, implementation and construction of community in order to ensure the development and advancement referred to in the future;

.,, b. that the administrative town of Ternate in its development has shown progress, in various fields, in accordance with the role and functions, so that needs to be followed by the development and improvement of infrastructure and facilities management of the area;
.,, c. that the development and the progress not only gave the impact in the form of increased needs for services in the areas of governance, development, and the community, but also gives an idea of the support capabilities and potcnsi territory to organize autonomous region;
.,, d. that to further enhance the effectiveness and results to the Organization of Government, the implementation of development, and service to the community, is seen necessary administrative town of Ternate Municipality Area formed into level II;
.,, e. that corresponds to kctcntuan in Act No. 5 of 1974 about the fine points of governance in the region, hence the creation of the municipality of regencies Ternate should be established by law;
.,, Considering: 1. Article 5 paragraph (1), article 18, and article 20 paragraph (1) of the Constitution of 1945;

., ,2. Act No. 5 of 1974 about the fine points of governance in the area of (State Gazette Number 38 in 1974, an additional State Gazette Number 3037);
., ,3. Act No. 20 of 1958 concerning the determination of the Emergency Law number 22 in 1957 about the Autonomous Region level I Pcmbcntukan Maluku (State Gazette Number 79 in 1957) as the Act (State Gazette Number 61 in 1958, additional State Gazette Number 1617);
., ,4. Act No. 60 in 1958 about the setting of the emergency law Number 11 in 1957 on the establishment of Autonomous areas within the level II regions Autonomous Region Dalain level II level I of the Maluku Province (State Gazette number 80 in 1957) as the Act (State Gazette Number 111 of 1958 an additional Sheet country number 1645);

With the approval of the HOUSE of REPRESENTATIVES of the REPUBLIC of INDONESIA M e m u t u s k a n:.,, set: the law on the ESTABLISHMENT of the MUNICIPALITY of REGENCIES of TERNATE.
CHAPTER I GENERAL PROVISIONS Article l In this law is the:.,, 1. Area is the area of autonomy as stipulated in article l letter c Act No. 5 of 1974 about the fine points of governance in the region.
., ,2. The region is a "region" as referred to in article 1 of the letter g or "areas". as referred to in article 2 of Act No. 5 of 1974 about the fine points of governance in the region.
., ,3. The administrative town of Ternate is as stipulated in government regulation Number 45 Years, 1981 about the formation of the administrative town of Ternate.
., ,4. Regency Regencies North Maluku is referred to in Act No. 60 in 1958 about the setting of the emergency law Number 11 in 1957 on the establishment of Autonomous areas level II within the area of Maluku Province level I (State Gazette Number 60 Years) as the Act.
., ,5. Provincial level I Areas of Maluku is referred to in Act No. 20 of 1958 concerning the determination of the Number of emergency laws in 1957 about the formation of the Autonomous Region level I the Moluccas (State Gazette Number 79 in 1957) as law.
CHAPTER II ESTABLISHMENT and BORDERS article 2 With this legislation formed the municipality of regencies of Ternate in the Maluku Region Province level I.

Article 3 (1) the municipality Region level II covers an area of Ternate:.,, a. Administrative town of Ternate, consisting of:.,, 1) North of Ternate city Subdistrict;

2) Sub Ternate City South;

.,, b. Some districts Regencies North Maluku consisting of:.,, 1) Sub Ternate;., .2) Some cuss Sub-district put in the Sub-District of the island of Ternate, which consists of the villages of the city, the village of Moti Tafamutu, Takofi Village, and Tafaga Village.
.,, (2) the municipality Regencies Ternate referred to in subsection (1), styled and set so that it consists of the districts as follows:.,, a. Subdistrict Ternate City North;

b. Sub Ternate City South;

c. Sub-District of the island of Ternate.

Article 4 With the creation of the municipality of regencies Ternate as stipulated in article 2, Regency North Maluku Regencies were reduced with the municipality of regencies Ternate as stipulated in article 3 paragraph (1).

Article 5 With the creation of the municipality of regencies, Kota Ternate Ternate within the Administrative County of North Maluku Regencies removed.

Section 6.,, (1) the municipality Regencies of Ternate had boundaries as follows:.,, a. Northern Molucca sea borders;

b. the East bordering the Strait Halmahera;

c. the South bordering the Molucca sea;

d. the West bordering the Molucca sea.

.,, (2) the limits referred to in subsection (1), poured in a map that is part an integral part of this Act.
.,, (3) the determination of the boundaries of the municipality of regencies Ternate definitively in the field referred to in subsection (1), established by the Minister of the Interior.
Article 7, (1) with the creation of the municipality of regencies Ternate as stipulated in article 2, and had the area referred to in article 3, the municipal Governments of regencies Ternate is obligated to establish Spatial Locality of the municipality of regencies of Ternate in accordance with the legislation in force.
.,, (2) the determination of the Spatial area of the municipality of regencies Ternate referred to in subsection (1), conducted in an integrated and not separated from National Territory, the Spatial area of Maluku Province level I Areas and Districts/Municipalities regencies in the vicinity.
CHAPTER III of the LOCAL GOVERNMENT and the REGIONS/AREAS of article 8 to lead the operations of the municipal government in Regencies of Ternate, chosen and appointed a Chief area of "Walikotamadya" level II in accordance with the legislation in force.

Article 9 with the formation of the municipality of regencies of Ternate, formed of representatives of the Regional Municipality of regencies of Ternate in accordance with the legislation in force.

CHAPTER IV REGIONAL HOUSEHOLD AFFAIRS article 11.,, (1) at the time of the formation of the municipality of regencies Ternate, handed over some Affairs of the Government as the authority on the base in the field of:.,, a. General Government;

c. education and culture;

d. public works;

e. traffic and Sea Transport;

f. Social;

g. Financial Area;

h. Environment;

j. Agricultural food crops;

k. Plantations;

b. Forestry;

m. Fisheries;

n. animal husbandry;

o. industry and trade;

Mining p.;

q. the tourism;

r. labor.

.,, (2) the implementation of the addition or subtraction of Affairs referred to in subsection (1), arranged by government regulations.
Chapter V TRANSITIONAL PROVISIONS article 12 at the time of the formation of the municipality of regencies of Ternate, the acting head of "Walikotamadya" Regencies Ternate for the first time appointed and designated by the Minister of the Interior upon the proposal of the regional Governor of Maluku level I.

Article 13.,, (1) the members of the House of representatives of the Regional Municipality of regencies Ternate consists of:.,,.,, a. Article 16 All regulations that currently apply to the county level II Area North Maluku remained in effect for the Municipalities of regencies of Ternate, before amended, altered or repealed by law.

CHAPTER VI CLOSING PROVISIONS article 17 at the time of the enactment of this Act, all laws and regulations, which do not comply with this Act stated does not apply.

Article 18 Provisions required further as implementation of this law, are regulated in accordance with Act No. 5 of 1974 about the trees, the Government in the area.

Article 19 this Act comes into force on the date of promulgation.
