., b. that the University of Indonesia has had sufficient management skills to be able to gain its independence, autonomy, and greater responsibility;
., c. that to be able to realising that intent above, need to immediately be established the legal status of the University of Indonesia as a State-Owed Law Agency;

.,, Setting: A GOVERNMENT REGULATION ON THE DESIGNATION OF THE UNIVERSITY OF INDONESIA AS A STATE-OWNED LEGAL ENTITY.

BAB I
UMUM PROVISIONS

Section 1
In this Government Regulation referred to by:
1. University is the University of Indonesia as the State-owned Law Agency;
., 2. The Minister is the Minister of National Education in charge of higher education;
., 3. The Minister of Finance is the Minister in charge of representing the Government in the field of finance which has the authority in any separation of the wealth of wealth to be placed as an initial wealth and other financing according to the regulations. Applicable laws;

., 8. The Board of Great Teachers is an element of the University of Indonesia which serves on the coaching of academic life and moral integrity as well as ethics in the civitas environment of the University of Indonesia;
., 9. Rector is the Chairman of the University of Indonesia who is authorized and responsible for the hosting of the University of Indonesia;
., 10. The Dean is the Head of the Faculty of the University of Indonesia who is in charge of the University of Indonesia, and is responsible for organizing education in their respective fac

BAB II
ASSIGNMENT

Section 2
.,, (1) With the Regulation of this Government designated the University of Indonesia as the State-owned Law Agency which organizes higher education.
., (2) By designation as referred to in paragraph (1), then all rights and obligations, equipment and wealth, hosting of higher education, including employees are transferred to the assets and staff of the university.
.,, (3) the implementation of the diversion as referred to in paragraph (2) of this section, is governed by the Minister and the Minister of Finance.

ASAS, NATURE, AND THE PURPOSE OF


The First Part
Asas and Nature

Section 3
The university is organized based on an asas-based principle by:
., a., a. Moral independence to build a college as a moral force in the development of a democratic society and able to compete globally;
., b. Global insight to disseminate the life of the nation by developing and dissemination of science, technology, culture, and art.

Section 4
The University as the State-owned Law Agency as referred to in Article 2 is a non-profit legal entity.

The destination

Section 5
The university ' s goal is:
., a., a. embody the research university as a flagship center of science, technology, culture, and art;
., b. Preparing students to be members of a moral society and having an academic and or professional ability to implement, develop and or enrich the science of science, technology, culture and arts;
., c. developing and disseminating science, technology, culture, and art and seeking its use to improve the level of community life and enrich the national culture;
., d. supporting the development of a democratic society by its role as a self-independent moral force;
., e. achieve competitive advantage through the application of the principle of university resources managed with professional asas.

The Third Part
Jatidiri, Occupation, and Term

Section 6
.,, (1) The university is a university-shaped higher education institution that bears the name of a nation and is composed of the overall basis of a unit that manages science, technology, culture, and or the arts.
.,, (2) The shape and use of the emblem, the hymn, the flag, and the cap as the attributes of his identity are arranged and set in the Law of the University.

Section 7
Universities are located in the State Capital of the Republic of Indonesia.

Section 8
.,, (1) University as a state-owned higher education institution organized by the Government of the Republic of Indonesia since February 2, 1950;
(2) The university was established for an unspecified period of time.

The Fourth Part
Wealth and Funding

Section 9
.,, (1) The initial wealth of the university constitutes the wealth of the country separated from the State Budget and Shopping Budget;
(2) The high wealth of the university as referred to in verse (1) is the entire wealth of the country embedded in the university, except for the land whose value is set by the Minister of Finance based on the calculations performed jointly by the Department of National Education and Department of Finance.

Section 10
., (1) The institution of the separation of the country 's wealth to be placed as the university' s initial wealth as referred to section 9 of the paragraph (1) is organized by the Minister of Finance;
.,, (2) The wealth of the country of the land as referred to in section 9 of the paragraph (2) is utilized for the benefit of the university;
.,, (3) The results of the wealth utilization of the land as referred to in verse (2) into university income and used for the execution of university duties and functions;
.,, (4) The university's initial wealth of land as referred to in verse (2) is used as large as the university with the untransferable provision.

Section 11
.,, (1) All wealth in all forms, including intellectual property, facilities, and objects outside the ground are listed as legitimate as the property of the university;
., (2) Intellectual Property consists of patents, copyrights, and other forms of intellectual property that are wholly owned or partially owned by the university;
.,, (3) The acquisition, use, and management of intellectual property are further regulated in the decision of the Guardian Council in accordance with the laws of the Law.

Section 12
.,, (1) The financing for the holding, management, and development of the university comes from:
., a., a. government;
B. communities;
c. foreign party;
D. efforts and university savings.
.,, (2) The funds from the government as referred to in paragraph (1) of the letter a, derived from the State Budget and Shopping Budget, which is composed of:
., a., a. routine budget;
B. Construction budget.
., (3) The university allocates a budget that comes from the public as a co-fund companion acquired from the government in routine financing as it is referred to in paragraph (2).
.,, (4) The Government can allocate development budgets for financing of investment development and university development through applicable mechanisms, in accordance with programs and priorities.
.,, (5) The admission of the university as referred to in paragraph (1) b is not the Successor State Tax (PNBP).

BAB IV
ORGANIZATION

Section 13
.,, (1) The university organization consists of the Assembly of Guardians, the Board of Audit, the Academic Senate of the university, the University Leadership, the Grand Master Council, the Academic Senate, the Faculty of Academic Affairs, the Academic Acting, the management element, the business unit, and the other elements. which is considered necessary;
.,, (2) The academic executor element is the faculty, major/part and other forms that are viewed as necessary;
(3) The management element is the Directorate and other forms that are seen need.;
.,, (4) the supporting element is the library, laboratory, and other forms that are viewed as necessary;

BAB V
THE TRUSTEES ASSEMBLY

Section 14
.,, (1) The Mayor ' s Assembly is a university organ representing the interests of the government, the interests of the public, and the interests of the university, which consists of as many as 21 (twenty-one) people;
(2) The elements in the Guardian Council of Amanat are:
., a., a. Minister;
B. University Academic Senate;
C. Society;
D. University employees;
e. Students;
f. Rector;
.,, (3) Members of the Mayor ' s Assembly of Amanat are appointed and dismissed by the Minister based on the proposal of the Academic Senate;
.,, (4) Members of the Guardian Council of Amanat who represent the Minister of number of one person assigned by the Minister;
.,, (5) Members of the Guardian Assembly who represent the Academic Senate of the university are 11 (eleven) persons and are elected by the Academic Senate of the University who meet the main criteria on commitment, ability, integrity, good academic achievement, and insight as well as interest in the college;
.,, (6) Members of the Guardian Assembly of the general public elements number 6 (six) persons proposed by the Academic Senate and meet the primary criteria of commitment, ability, integrity, vision, and insight and interest in the college;
.,, (7) Members of the Guardian Assembly who represent the element of university employee number 1 (one) people and are selected based on the applicable mechanism among those who have good integrity and work achievement;
.,, (8) Members of the Guardian Assembly who represent the university student element number 1 (one) persons and are selected based on the applicable mechanism among those who have good integrity and academic achievement;
.,, (9) Members of the Guardian Assembly who represent the element Rector cannot be elected as chairman and do not have the voting rights in matters concerning the performance of the rector and the election of the rector.

Section 15
.,, (1) Member of the Guardian Council, except those who represent the student element are selected for a term of 5 (five) years, and may be reelected for 1 (one) times the term;
.,, (2) Members of the Guardian Council, which represent the student element are selected for a term of 1 (one) year, and may be reelected for 1 (one) times the term;
.,, (3) The Assembly of Guardians is led by a chairman and assisted by a secretary who is from and elected from and by the Assembly of Guardians for a term of 2.5 (two and a half) years and may be re-elected for one term term;
.,, (4) Members of the Guardian Assembly have the same voting rights, except in the election of the rector, the member representing the element of the minister has 35 percent of the voting rights of all voting rights.

Section 16
(1) The Guardian Council is responsible for:

., h. deal with the highest resolution of the problems that are within the university.
.,, (2) the Assembly of Trusts can delegate its authority in writing to the Rector for certain tasks;
.,, (3) the provisions of the assignment and duties as set forth in paragraph (2) are specified in the Household Budget;
.,, (4) The required budget for the implementation of the Guardian Assembly of the Amanat is charged on the university budget.

Section 17
The Chairman and the Secretary of the Assembly of the Guardians are prohibited from calling me a double post as:
a. leaders and other structural offices in other colleges;
B. a structural position on the agency or the central government agencies and regions;
., c. Other posts that may incur conflicts of interest with the interests of the university.

BAB VI
THE AUDIT BOARD

Section 18
.,, (1) the Board of Audit is a university organ that independently carries out the evaluation of the results of internal and external audits of the university for and on behalf of the Guardian Council of Amanat;
.,, (2) The number of members of the Board of Audit as many as 5 (five) persons consisting of the chairman, secretary, and member;
.,, (3) Members of the Audit Board are appointed for a term of 5 (five) years and may be reappointed for one term term;
.,, (4) The Chairman, Secretary, and members of the Board of Audit are appointed and dismissed by the Assembly of Trusts;
(5) The Audit Council is responsible to the Guardian Assembly;
.,, (6) The Board of Audit may appoint auditors to carry out audits at universities, in the fields of education, scholarship, finance, and staffing;
.,, (7) the Auditor reports the results of the audit as referred to in paragraph (6) to the Audit Board;
.,, (8) Requirements, governance of the appointment, and dismissal of members of the Audit Board are set up in the Household Budget.

Section 19
(1) the university ' s Audit Council on duty:
., a., a. establish an internal audit policy;
B. designate and lift professional audit power;
c. study and assess both internal and external audit results;
D. take a conclusion and submit a suggestion to the Assembly of Guardians of Amanat.
.,, (2) The implementation of the Audit Board duties of the Board is charged to the university budget.

BAB VII
THE ACADEMIC SENATE

Section 20
.,, (1) The Academic Senate of the university is the highest normative body in the university in the academic field;
(2) The Academic Senate consists of:
., a., a. Rector and the Vice Rector;
B. Dean of the Faculty and Chair of the Graduate Program;
C. The Deputy Master of Great;
D. Vice Lecturer is not a Great Teacher;
e. The head of the university library.
.,, (3) The deputy master is proposed by the faculty of as many as two (two) persons for each faculty, in terms of the number of Grandmaster the faculty of less than two persons then the drawdown can be filled by the vice-lecturer;

.,, (8) The Chair of the academic senate of the university cannot be arrested as the Chairman of the Assembly of Trusts and Chairman of the Board of Audit;
.,, (9) In carrying out the duties, the academic senate of the university may form the commissions of duty, the authority of the tatakerja and the arrangement of its members is set by the academic senate of the university;
.,, (10) Tata's way of holding university academic meetings, the selection of members of the academic senate of composition and the number of each unit are set by the university's academic senate and poured in the budget of the House of the Union.

Section 21
(1) Academic Senate on duty:

., g. provide input to the leadership in the drafting of the Strategic Plan as well as the Work and Budget Plan;
h. carrying out academic quality supervision in the holding of the university;
., i. provide input, advice, and reprimand to the university ' s Leadership in the management of universities in academic fields;
J. Formulate a campus life order.
.,, (2) The results of the drafting and formulation of the paragraph (1) are delivered to the Guardian Assembly to be specified;
.,, (3) The budget implementation of Academic Senate duties is charged to the university budget.

BAB VIII
THE GREAT TEACHERS BOARD

Section 22
.,, (1) The Great Teachers 'Council is the organ of the university whose members are the whole of the university' s Great Teachers;
.,, (2) The Great Teachers ' Council conducts academic life coaching and fostering moral integrity as well as the ethics of university academics;
.,, (3) The Great Teachers ' Council provides consideration for the proposal of the appointment of the Grand Master, Honorary Doctorate or other honorary grant to the Academic Senate and or the leadership of the university;
.,, (4) The Grand Master ' s Board is led by a chairman and assisted by a secretary who is both elected by a member of the Grand Master Council for 5 (five) years of office and may be re-elected with a provision not to exceed two terms of office;
.,, (5) In carrying out the duties, the Grand Master Council may form commissions that task, the authority of the work of the work and the arrangement of its members are set by the Great Teachers ' Council;
.,, (6) The required budget for the execution of the Great Teachers ' Council duties is charged on the university budget.

BAB IX
UNIVERSITY LEADERSHIP

Section 23
.,, (1) The leadership of the university is made up of the Rector assisted by some Vice Rector persons;
.,, (2) The number and sorting of the Vice Rector duties is set with the Rector 's decision after obtaining the approval of the Guardian' s Assembly of Assembly;
.,, (3) The members of the university leadership must meet the requirements for being able to carry out the legal deeds.
.,, (4) The Vice Rector as referred to in paragraph (1) is the same as the Rector Maid as referred to in the Government Regulation Number 61 of 1999 on the Redemption of the State College as the Legal Body.

Section 24
.,, (1) The university Rector is appointed and dismissed by the Assembly of Guardians by an election with the vote the Minister's element is 35 percent of all valid votes and the remaining 65 percent is divided equally to any other member;
.,, (2) The university 's candidate Rector is submitted by the university' s Academic Senate to the Assembly of Guardians through an election process;
.,, (3) Other university leaders are appointed and dismissed by the Rector, who are then reported to the Assembly of Trusts;
.,, (4) Leadership members are appointed for a term of 5 (five) years and may be reappointed for 1 (one) times the term.

Section 25
Rector candidates must meet the main requirements as follows:
a. Indonesian nationality;
B. healthy physical and spiritual;
c. educated doctor;
D. have high integrity, commitment, and leadership;
e. having an entrepreneurial soul;
f. Extensive insights into higher education.

Section 26
.,, (1) The selection of the university Rector elections can be conducted through the establishment of a committee by the Assembly of Guardians who are tasked with the selection of candidates for Rector through the mechanism of open competition, both from within and outside of the university;
.,, (2) The Mayor 's Assembly may request consideration to the Academic Senate and the Grand Master' s Council against the future Rector candidates before the election is held;
.,, (3) The election of the Rector is conducted in an open meeting of the Guardian Assembly presided over by the Chairman of the Assembly of Trusts;
.,, (4) The candidate of the Rector who obtained the most votes was appointed as the Rector through the decision of the Mayor ' s Assembly of Amanat.

Section 27
The job of the university leadership is:
., a., a. draw up the Strategic Plan based on the general policy of the Guardian Council which contains the university's goals and objectives which are to be achieved within the term of 5 (5) years;
B. Drafting the university ' s Annual Work Plan and Budget;
., c. carrying out the hosting of education, research, devotion to the public by setting rules, rules, and benchmarks of organizing academic activities in general;
., d. manage the entire university wealth and optimally exploit it for university interests;
., e. Fostering education, education, administration, administration, and other workforce defined by the university;
., f. foster relationships with alumni, university environment and society in general;
G. hosting university bookkeeping;
., h. reported periodically to the Assembly of the Guardian on the advancement of the university;
., i. assemble and deliver the annual report to the joint minister of the Guardian of the Guardian;
., j. lift and dismiss the education, administrative power, and other workforce of labor established by the university;

The leadership of the university is prohibited from taking such posts as the following:
., a., a. Leadership and structural offices of university institutions or other educational institutions;
B. The leadership of the enterprise entity within and outside the university environment;
C. Other structural offices in the central government agencies and regions;
., d. Other posts that may cause conflict of interest in the interests of the university.

BAB X
UNIVERSITY OPEN SESSION

Section 30
.,, (1) The open session of the university may be conducted in order to carry out the graduation, the dies natalis, the examiner of the Great Master, and the appointment of an Honorary Doctorate;
.,, (2) The open session of the university followed the Academic Senate and the University 's Great Teachers' Council;
(3) The open session of the university is led by the Rector;
.,, (4) The order and order of implementation of the university ' s open hearings are set further in the Household Budget.

BAB XI
THE BUSINESS UNIT

Section 31
.,, (1) The Business Unit consists of three forms, i.e. the academic enterprise unit, the support unit unit, and the commercial enterprise unit;

.,, (1) Commercial Business Units may be a limited liability unit or other type of commercial venture wholly or part of a university owned as long as it does not conflict with applicable laws, (2) The management of the Commercial Effort Unit as referred to in paragraph (1) is carried out separately from the academic activities of the university;
.,, (3) In terms of the establishment of limited liability, the inclusion of the university capital as a whole does not exceed 20% (twenty percent) of the university's assets.

Section 33
.,, (1) The leadership of the Commercial Business Unit is lifted and dismissed by the Guardian Council for a particular term set further in the decision of the Guardian Council.
.,, (2) The leadership of the Commercial Business Unit is responsible to the Guardian Assembly in conducting commercial business management;
.,, (3) At the approval of the Guardian Council, the leadership of the Commercial Business Unit may establish another form of legal entity, whose shares may be wholly owned or partially by the university;
(4) Each year the Leadership of the Commercial Business Unit is conscripted:
.,
., a., a. Work Plan and Annual Budget to obtain the approval of the Guardian Assembly;
., b. The Annual Report, consisting of financial statements and reports of activities to be accounted for and passed by the Mayor of Amanat Assembly.

BAB XII
SUPPORTING ELEMENT

Section 34
.,, (1) The University may establish support units in the field of education, research, and devotion to the community according to the need;
.,, (2) the organization, establishment, and staging of support units as well as its dissolution are organized in the Household Budget.

BAB XIII
PLANNING, MANAGING, AND ACCOUNTABILITY

The First Part
Planning

Section 35
.,, (1) To achieve the objectives as referred to in Article 5, the ALIGNMENT of the university compiled a Strategic Plan;
.,, (2) The Strategic Plan is a strategy chosen to achieve the goal and program of the annual 5 (five) time to execute such a strategy, at least of which it contains:
., a., a. evaluation of the implementation of the previous Strategic Plan;
., b. the evaluation of the strength, the weaknesses, the opportunities, and the threat that existed at the time;
c. The assumptions used in drafting the Strategic Plan;
., d. target assignment, strategy, policy, and work programs as well as university performance indicators for the next planning period.
.,, (3) The Strategic Plan was drafted by the Leadership after obtaining input from the university's Academic Senate, and submitted to the Guardian's Assembly to be discussed and passed.

Section 36
.,, (1) The Work Plan and the University Budget are the definitions of the Strategic Plan in the Annual Work Plan and the Annual Revenue and Revenue Budget;
.,, (2) The Work Plan and the University Budget are submitted to the Guardian Council no later than 60 (sixty) days before the budget year begins;
.,, (3) The Work and Budget Plan is passed by the Guardian Assembly no later than 30 (thirty) days after the budget year running;
., (4) In the case of a Work Plan and the Budget that is submitted has not been authorized by the Assembly of Trusts as referred to in paragraph (3), the previous university's Work and Budget Plan may be implemented until the confirmation of the Work Plan and the The university budget has been proposed.

The Second Part
Management

Section 37
.,, (1) The year of the university budget is valid on 1 January to 31 December of the same year;
.,, (2) The university ' s financial management events are tailored to university needs with regard to efficiency, effectiveness, autonomy, and accountability;
.,, (3) the government-derived management and budget accountability event as referred to in Section 12 of the paragraph (2) is conducted under applicable law for the management of the income budget and the shopping country;
.,, (4) The university ' s financial management event as referred to paragraph (2) is set by the Assembly of Guardians of Amanat.

The Third Part
Accountability

Section 38
.,, (1) Within 5 (five) months after the book cap year, the Leadership together with the Assembly of Guardians of Amanat delivers an annual report to the Minister regarding:
.,
., a., a. financial statements including balance sheets, cash flow reports, and net activa change reports;
., b. Academic report, research, and devotion to the public that includes the circumstances, performance, and results of the university;
.,, c. university employment reports that include the circumstances, performance, and progress that has been achieved.
.,, (2) Functional supervising financial statements are compiled according to the applicable accounting standards;
.,, (3) the annual financial report and the annual academic report referred to in paragraph (1) after it gets the authorization of the Minister into public information.

Section 39
.,, (1) the annual financial report and the annual academic report are signed by all members of the university leadership and delivered to the Assembly of Trusts;
.,, (2) In that case there is a member of the university leadership not signing the annual financial report and the annual academic report as referred to in paragraph (1) should be mentioned the reason in writing in the news of the signing event.

Section 40
., (1) the University has an internal auditor consisting of the Academic Audit Board and the non-Academic Audit Board which is appointed and dismissed by the leadership;
.,, (2) Internal Auditors in charge of routinely auditing the entire work unit in the university environment include academic and non academic fields.

BAB XIV
SUPERVISION

Section 41
.,, (1) The supervision of the holding of the university is conducted by the Minister who can delegate this authority to the Assembly of Guardians;
.,, (2) The external supervision of the university ' s financial management is carried out by a functional audit force;
.,, (3) Internal supervision of the university ' s financial management as referred to in Article 19 of the paragraph (1) c conducted by the Board of Audit;
.,, (4) Rector can lift internal audit power to assist in preparation and execution of the audit process;
(5) Internal Auditor is responsible to the leadership of the university.

BAB XV
EMPLOYMENT

Section 42
.,, (1) the university lecturer is a university employee whose appointment and dismissal, position, rights and obligations are established under a work agreement as set forth in the laws regarding the teaching workforce in the college;
.,, (2) The administrative, librarians, technicians, and labor groups outside the lecturers set by the university are university employees, whose appointment and dismissal, position, rights and obligations are set according to work agreement in accordance with the laws regarding employment;
., (3) Lecturer, administrative power, librarian, engineer and other labor group, which at the time of the university designation as the State-owned Law Board of the State of Civil Servlet, gradually transferred its status to university employees;
(4) Replacement of the Status of Civil Servlet into a University Employee as it is called a paragraph (3) for an eternity within 10 (ten) years by resorting that the dual employment system is in effect in time. The short-frame;
.,, (5) Civil Servant university employees and the right of retirement remain the burden of the State Revenue and Shopping Budget in accordance with the provisions of the applicable laws, except before the retirement of the country. as a university employee;
.,, (6) The system and employment management of the university are fully the authority and responsibility of the university;
.,, (7) Other things regarding employment are set further in the Household Budget.

BAB XVI
THE TRANSITION PROVISION

Section 43
.,, (1) The leadership of the university no later than 1 year (one) year after which the Regulation of the Government forms the Assembly of the Guardians (of the Guardian);
.,, (2) The transition period of the administration of the university from the status of the College of State to the State of the Law of the State, except the one mentioned in Article 42 of the paragraph (4), is 5 (five) years;
.,, (3) With the enactment of this Government Regulation all university regulations that are not appropriate and/or in conflict with the Rules of this Government are declared to be not applicable.

BAB XVII
CLOSING PROVISIONS

Section 44
This Government Regulation shall come into effect on the date of the promulctest.
